          <p>		This Act is the <i>Anti</i><i>-</i><i>D</i><i>iscrimination and Human Rights Legislation Amendment (Respect at Work)</i><i> Act 20</i><i>2</i><i>2</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

        <num>3</num>
        <heading>Schedules</heading>
        <content>
          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>
        </content>
      </section>
      <section eId="sec-4">
        <num>4</num>
        <heading>Review of operation of amendments</heading>
        <subsection eId="sec-4__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> must cause an independent review to be conducted of the operation of the amendments made by this Act.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-2">
          <num>2</num>
          <content>
            <p>Without limiting subsection (1), the review must consider whether:</p>
          </content>
          <paragraph eId="sec-4__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>the amendments made by this Act are operating effectively; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>	(b)	the Australian Human Rights Commission has capacity to carry out the functions relating to compliance with the positive duty in relation to sex discrimination in <i>Australian Human Rights Commission Act 1986</i>,<i> </i>as inserted by Part 2 of Schedule 2 to this Act.<ref href="#dvs-4A">Division 4A</ref> of <ref href="#part-I">Part I</ref>I of the </p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-4__subsec-3">
          <num>3</num>
          <content>
            <p>The review must commence as soon as practicable after the end of the period of 2 years after the day <ref href="#dvs-2">Division 2</ref> of <ref href="#part-2">Part 2</ref> of Schedule 2 to this Act commences and, in any event, not later than 3 years after that day.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-4">
          <num>4</num>
          <content>
            <p>The persons who conduct the review must give <role refersTo="#minister">the Minister</role> a written report of the review as soon as practicable and, in any event, not later than 9 months after commencement of the review.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-5">
          <num>5</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> must cause a copy of the report to be tabled in each House of the Parliament within 15 sitting days of that House after the report is given to <role refersTo="#minister">the Minister</role>.</p>

            <heading>Workplace environment that is hostile for 2 or more reasons</heading>
            <content>
              <p>For the purposes of this Act, a workplace environment may be offensive, intimidating or humiliating to a person by reason of:</p>
              <p>if it is offensive, intimidating or humiliating by reason of 2 or more matters that include the sex or the characteristic, whether or not the sex or the characteristic is the dominant or substantial reason.</p>

                <p>the sex of the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-8A__para-b">
              <num>b</num>

                <p>a characteristic that appertains generally to persons of the sex of the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-8A__para-c">
              <num>c</num>
              <content>
                <p>a characteristic that is generally imputed to persons of the sex of the person;</p>
              </content>
            </paragraph>

                <p>It is unlawful for a person to subject another person to a workplace environment that is hostile on the ground of sex.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-28M__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	A person (the <b><i>first person</i></b>) subjects another person (the <b><i>second person</i></b>) to a workplace environment that is hostile on the ground of sex if:</p>
              </content>

              <num>a</num>
              <content>
                <p>the first person engages in conduct in a workplace where the first person or the second person, or both, work; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-28M__para-b">
              <num>b</num>
              <content>
                <p>the second person is in the workplace at the same time as or after the conduct occurs; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-28M__para-c">
              <num>c</num>
              <content>
                <p>a reasonable person, having regard to all the circumstances, would have anticipated the possibility of the conduct resulting in the workplace environment being offensive, intimidating or humiliating to a person of the sex of the second person by reason of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-28M__para-i">
              <num>i</num>
              <content>
                <p>the sex of the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-28M__para-ii">
              <num>ii</num>
              <content>
                <p>a characteristic that appertains generally to persons of the sex of the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-28M__para-iii">
              <num>iii</num>
              <content>
                <p>a characteristic that is generally imputed to persons of the sex of the person.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	See also <ref href="#sec-8A">section 8A</ref> in relation to workplace environments that are offensive, intimidating or humiliating for 2 or more reasons.</p>
              <p><b><i>conduct</i></b> includes making a statement, whether the statement is made orally or in writing.</p>

                <p>For the purposes of subsection (2), the circumstances to be taken into account include, but are not limited to, the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-28M__para-a">
              <num>a</num>
              <content>
                <p>the seriousness of the conduct;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-28M__para-b">
              <num>b</num>
              <content>
                <p>whether the conduct was continuous or repetitive;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-28M__para-c">
              <num>c</num>
              <content>
                <p>the role, influence or authority of the person engaging in the conduct;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-28M__para-d">
              <num>d</num>
              <content>
                <p>any other relevant circumstance.</p>
              </content>
            </paragraph>

                <p>conduct that is unlawful under <ref href="#sec-28M">section 28M</ref> (hostile workplace environments);</p>

                <p>acts of victimisation (<ref href="#sec-47A">within the meaning of section 47A</ref>) that relate to complaints, proceedings, assertions or allegations in relation to conduct mentioned in any of paragraphs (a) to (c) of this subsection.</p>

                <p>For the purposes of paragraph (1)(a), this subsection covers the following persons:</p>
              </content>

              <num>a</num>
              <content>
                <p>the duty holder;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-47C__para-b">
              <num>b</num>
              <content>
                <p>if the duty holder is an employer—the duty holder’s employees;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-47C__para-c">
              <num>c</num>
              <content>
                <p>if the duty holder is a person conducting a business or undertaking—workers in the business or undertaking;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-47C__para-d">
              <num>d</num>

                <p>the duty holder’s agents.</p>
              </content>
            </paragraph>

                <p>For the purposes of subsection (1), this subsection covers the following conduct:</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>sexual harassment, or harassment on the ground of sex, of persons covered by subsection (5) that is unlawful under subsection 28B(6) or (8);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-47C__para-b">
              <num>b</num>
              <content>
                <p>conduct in workplaces where persons covered by subsection (5) work that is unlawful under <ref href="#sec-28M">section 28M</ref> (hostile workplace environments);</p>

            </paragraph>

              <num>c</num>
              <content>

            </paragraph>
            <paragraph eId="schedule-2__clause-47C__para-c">

                <p>the practicability and the cost of measures to eliminate conduct covered by subsection (2) or (4);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-47C__para-d">

                <p>As soon as practicable after commencing an inquiry into a person’s compliance with the positive duty in relation to sex discrimination, the Commission must give the person a written notice stating the grounds on which the Commission commenced the inquiry.</p>

                <p>The Commission must not find that a person is not complying with the positive duty in relation to sex discrimination unless it has given a reasonable opportunity to the person, to do, at the option of the person, either or both of the following:</p>

                <p>to appear before the Commission, whether in person or by a representative, and make oral submissions in relation to the person’s compliance;</p>

                <p>to make written submissions to the Commission in relation to the person’s compliance.</p>

            </paragraph>

              <p>Sections 21, 22, 23 and 24 and subsection 26(1) apply in relation to the functions of the Commission set out in <ref href="#sec-35A">section 35A</ref>, and in relation to the performance of those functions, as if:</p>

            <heading>Notification of findings and recommendations</heading>
            <content>
              <p>If, as a result of an inquiry into a person’s compliance with the positive duty in relation to sex discrimination, the Commission finds that the person is not complying, the Commission:</p>
            </content>
            <paragraph eId="schedule-2__clause-35E__para-a">
              <num>a</num>
              <content>
                <p>must notify the person in writing of its finding and the reasons for the finding; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-35E__para-b">
              <num>b</num>
              <content>
                <p>may notify the person of any recommendations by the Commission for preventing a repetition or continuation of the failure to comply.</p>
              </content>
            </paragraph>
          </hcontainer>

            <num>35F</num>
            <heading>Giving of compliance notice</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-35F__subclause-1">
              <num>1</num>

                <p>If, as a result of an inquiry into a person’s compliance with the positive duty in relation to sex discrimination, the Commission finds that the person is not complying, the President may give the person a written notice.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-35F__subclause-2">
              <num>2</num>
              <content>
                <p>The notice must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-35F__para-a">
              <num>a</num>

                <p>set out the name of the person to whom the notice is given; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-35F__para-b">
              <num>b</num>
              <content>
                <p>set out brief details of the failure to comply; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-35F__para-c">
              <num>c</num>
              <content>
                <p>specify action that the person must take, or refrain from taking, in order to address the failure; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-35F__para-d">
              <num>d</num>
              <content>
                <p>specify a reasonable period (starting at least 21 days after the day the notice is given) within which the person must take, or refrain from taking, the specified action; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-35F__para-e">
              <num>e</num>
              <content>
                <p>if the President considers it appropriate—specify a reasonable period within which the person must provide the Commission with evidence that the person has taken, or refrained from taking, the specified action; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-35F__para-f">
              <num>f</num>
              <content>
                <p>set out any other matters prescribed by the regulations for the purposes of this paragraph.</p>
              </content>
            </paragraph>

                <p>However, if the President has accepted an undertaking from a person under Part 6 of the Regulatory Powers Act in relation to the positive duty in relation to sex discrimination, a notice must not be given to the person under subsection (1) unless the undertaking is withdrawn, cancelled or expired.</p>

            <heading>Reconsideration of compliance notice</heading>

                <p>be given to the President <quantity refersTo="#deadline">within 21 days</quantity> after the day the compliance notice is given to the person.</p>

            </paragraph>

                <p>If requested, the President must reconsider the compliance notice.</p>
              </content>

                <p>The President may reconsider a compliance notice given to a person without receiving a request if satisfied there is sufficient reason to do so.</p>
              </content>

                <p>The President must act expeditiously in reconsidering a compliance notice.</p>
              </content>
            </hcontainer>

                <p>After reconsidering a compliance notice, the President must:</p>
              </content>
            </hcontainer>

                <p>The President must give written notice of a decision under subsection (6) to the person to whom the compliance notice was given, setting out the reasons for the decision.</p>

                <p>If the President’s functions under this section are performed by a delegate of the President, the delegate who reconsiders a compliance notice:</p>

                <p>must not have been involved in giving the compliance notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-35G__para-b">

                <p>must hold a position, or perform duties, of at least the same level as the person who gave the compliance notice.</p>
              </content>
            </paragraph>
          </hcontainer>

            <heading>Review of compliance notice</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-35H__subclause-1">
              <num>1</num>
              <content>
                <p>A person who has been given a compliance notice may apply to the Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) for a review of the notice on either or both of the following grounds:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-35H__para-a">
              <num>a</num>
              <content>
                <p>the person has not failed to comply as set out in the notice;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-35H__para-b">
              <num>b</num>
              <content>
                <p>the notice does not comply with subsection 35F(2) or (3).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-35H__subclause-1A">

                <p>The application must be made within:</p>
              </content>
            </hcontainer>

                <p>The court concerned may confirm, vary or cancel the notice after reviewing it.</p>
              </content>

            <heading>Enforcement of compliance notice</heading>

                <p>The President may apply to the Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) for an order under subsection (2) if:</p>
