          <p>		This Act is the <i>National Anti</i><i>-</i><i>Corruption Commission (Consequential and Transitional Provisions)</i><i> Act 20</i><i>2</i><i>2</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

            <heading>Transitional—directions in relation to confidentiality</heading>

                <p>This item applies if, immediately before the transition time, any of the following investigations had been commenced but not yet completed:</p>

              <num>a</num>
              <content>
                <p>an investigation of an ACLEI corruption issue by the Integrity Commissioner under <ref href="#dvs-3">Division 3</ref> of <ref href="#part-1">Part 1</ref>2 of the old Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-36__para-b">
              <num>b</num>
              <content>
                <p>a special investigation of an ACLEI corruption issue by a special investigator under <ref href="#dvs-4">Division 4</ref> of <ref href="#part-1">Part 1</ref>2 of the old Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-36__subclause-2">
              <num>2</num>
              <content>
                <p>The National Anti-Corruption Commissioner may continue to conduct the investigation as if the old Act had not been repealed.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-36__subclause-3">
              <num>3</num>
              <content>
                <p>The special investigator may continue to conduct the special investigation as if the old Act had not been repealed.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-36__subclause-4">
              <num>4</num>
              <content>
                <p>(4)	However, the Inspector may, by notice in writing (the <b><i>NACC corruption issue transition notice</i></b>), determine that the new Act applies to the investigation or special investigation if the Inspector considers that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-36__para-a">
              <num>a</num>
              <content>
                <p>it is more appropriate to deal with the investigation or special investigation under the new Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-36__para-b">
              <num>b</num>
              <content>
                <p>the investigation or special investigation could involve corrupt conduct that is serious or systemic.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-36__subclause-5">
              <num>5</num>
              <content>
                <p>If the Inspector issues the NACC corruption issue transition notice:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-36__para-a">
              <num>a</num>
              <content>
                <p>the investigation or special investigation is taken to be a NACC corruption investigation under the new Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-36__para-b">
              <num>b</num>
              <content>
                <p>the Inspector must continue the conduct of the investigation or special investigation under <ref href="#dvs-3">Division 3</ref> of <ref href="#part-1">Part 1</ref>0 of the new Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-36__subclause-6">
              <num>6</num>
              <content>
                <p>The Inspector must, as soon as reasonably practicable, give a copy of the NACC corruption issue transition notice to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-36__para-a">
              <num>a</num>
              <content>
                <p>the National Anti-Corruption Commissioner; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-36__para-b">

                <p>the special investigator.</p>

            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-36__subclause-7">

                <p>The new Act applies to the investigation from the later of the following times:</p>

              <content>
                <p>the time the NACC corruption issue transition notice is given to the National-Anti-Corruption Commissioner;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-36__para-b">
              <num>b</num>
              <content>
                <p>the time specified in the notice.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-36__subclause-8">

                <p>A NACC corruption issue transition notice is not a legislative instrument.</p>
              </content>
            </hcontainer>
          </hcontainer>

            <heading>Transitional—Attorney-General’s certificates about release of information</heading>

                <p>the certificate had not been revoked before the transition time.</p>

            <heading>Application—appointment of first CEO</heading>

              <p>Note:	The effect of this item is that the National Anti-Corruption Commissioner is not required to approve the appointment of the first CEO.</p>

            <heading>Transitional rules</heading>

                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
              </content>
            </hcontainer>

                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-57__para-b">

                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>

                <p>Without limiting subitem (1), the rules may prescribe matters of a transitional nature (including prescribing any saving or application provisions) relating to:</p>

                <p>the amendments or repeals made by this Act; or</p>
              </content>
            </paragraph>
