          <p>		This Act is the <i>Infrastructure Australia Amendment (Independent Review)</i><i> Act </i><i>2023</i>.</p>

        <subsection eId="sec-2__subsec-1">
          <num>1</num>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

                <p>For the purposes of paragraph 5(a), Infrastructure Australia has the function of conducting audits to determine the adequacy, capacity and condition of nationally significant infrastructure, taking into account:</p>

                <p>forecast economic and population growth; and</p>
              </content>

              <num>c</num>

                <p>Australia’s greenhouse gas emissions reduction targets.</p>

            </paragraph>

                <p>An audit must be prepared under this section at such intervals as the Board determines.</p>
              </content>
            </hcontainer>

              <num>3</num>
              <content>
                <p>In performing this function, Infrastructure Australia may consider State, Territory or local government reports on the adequacy, capacity and condition of nationally significant infrastructure.</p>

                <p>Infrastructure Australia must cause a copy of an audit prepared under this section to be tabled in each House of the Parliament within 10 sitting days of that House after the audit is finalised.</p>

              <p>Note:	The United Nations Framework Convention on Climate Change is in Australian Treaty Series 1994 No. 2 ([1994] ATS 2) and the Paris Agreement is in Australian Treaty Series 2016 No. 24 ([2016] ATS 24). They could in 2023 be viewed in the Australian Treaty Series Library on the AustLII website (www.austlii.edu.au).</p>
              <p>Tabling requirement</p>

                <p>Infrastructure Australia must develop a national planning and assessment framework to promote national consistency and coordination in infrastructure evaluations.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-5B__subclause-2">
              <num>2</num>
              <content>
                <p>The framework is not a legislative instrument.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-5B__subclause-3">
              <num>3</num>
              <content>
                <p>Infrastructure Australia must give the framework to <role refersTo="#minister">the Minister</role> and publish the framework on Infrastructure Australia’s website.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-5B__subclause-4">
              <num>4</num>
              <content>
                <p>Infrastructure Australia must review the framework at least every 5 years.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-5B__subclause-5">
              <num>5</num>
              <content>
                <p>In developing and reviewing the framework, Infrastructure Australia must consult with States and Territories.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-5B__subclause-6">
              <num>6</num>
              <content>
                <p>For the purposes of paragraph 5(aa), Infrastructure Australia has the function of evaluating, or endorsing evaluations conducted by or for States or Territories of, proposals covered by subsection (7) that are submitted by any of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5B__para-a">
              <num>a</num>
              <content>
                <p>the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-b">
              <num>b</num>
              <content>
                <p>	(b)	a Commonwealth entity (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-c">
              <num>c</num>
              <content>
                <p>a Commonwealth company (within the meaning of that Act);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-d">
              <num>d</num>
              <content>
                <p>a State;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-e">
              <num>e</num>
              <content>
                <p>a Territory.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-5B__subclause-7">
              <num>7</num>
              <content>
                <p>For the purposes of subsection (6), this subsection covers proposals for investment in, or enhancements to, the following infrastructure:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5B__para-a">
              <num>a</num>
              <content>
                <p>nationally significant infrastructure;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-b">
              <num>b</num>
              <content>
                <p>other infrastructure determined by <role refersTo="#minister">the Minister</role>.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-5B__subclause-8">
              <num>8</num>
              <content>
                <p>A determination made by <role refersTo="#minister">the Minister</role> under paragraph (7)(b) is a legislative instrument.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-5B__subclause-8A">
              <num>8A</num>
              <content>
                <p>In performing the function mentioned in subsection (6) in relation to a proposal, Infrastructure Australia must consider what impacts the proposal, if carried out, would have on:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5B__para-a">
              <num>a</num>
              <content>
                <p>Australia’s net greenhouse gas emissions, as reported in national inventory reports in accordance with:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-i">
              <num>i</num>
              <content>
                <p>the United Nations Framework Convention on Climate Change, done at New York on <date date="1992-05-09">9 May 1992</date>, as amended and in force for Australia from time to time; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-ii">
              <num>ii</num>
              <content>
                <p>the Paris Agreement, done at Paris on <date date="2015-12-12">12 December 2015</date>, as amended and in force for Australia from time to time; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-b">
              <num>b</num>
              <content>
                <p>the achievement of Australia’s greenhouse gas emissions reduction targets; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-c">
              <num>c</num>
              <content>
                <p>any policy issues arising from climate change that Infrastructure Australia considers relevant to the proposal.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-5B__subclause-9">
              <num>9</num>
              <content>
                <p>As soon as practicable after the end of each quarter, Infrastructure Australia must make available on its website:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5B__para-a">
              <num>a</num>
              <content>
                <p>a summary of each proposal evaluated by Infrastructure Australia during the quarter; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-b">
              <num>b</num>
              <content>
                <p>a summary of each proposal for which Infrastructure Australia endorsed an evaluation during the quarter.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-5B__subclause-10">
              <num>10</num>
              <content>
                <p>Infrastructure Australia must cause a copy of the following documents to be tabled in each House of the Parliament within 10 sitting days of that House after the document is finalised:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5B__para-a">
              <num>a</num>
              <content>
                <p>the national planning and assessment framework mentioned in subsection (1);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-b">
              <num>b</num>
              <content>
                <p>the summaries mentioned in subsection (9).</p>
              </content>
            </paragraph>

                <p>For the purposes of paragraph 5(b), Infrastructure Australia has the function of developing targeted Infrastructure Priority Lists that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5C__para-a">
              <num>a</num>
              <content>
                <p>specify priorities for Commonwealth investment in nationally significant infrastructure across Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-b">
              <num>b</num>
              <content>
                <p>take into account:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-i">
              <num>i</num>
              <content>
                <p>audits mentioned in <ref href="#sec-5A">section 5A</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-ii">
              <num>ii</num>
              <content>
                <p>evaluations conducted or endorsed by Infrastructure Australia in accordance with <ref href="#sec-5B">section 5B</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-iii">
              <num>iii</num>
              <content>
                <p>consultations with Commonwealth, State and Territory governments; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-iv">
              <num>iv</num>
              <content>
                <p>any other matters Infrastructure Australia considers relevant.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-5C__subclause-2">
              <num>2</num>
              <content>
                <p>Infrastructure Australia must develop Infrastructure Priority Lists at such intervals as the Board determines. Infrastructure Australia must also develop an Infrastructure Priority List if <role refersTo="#minister">the Minister</role> requests.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-5C__subclause-3">
              <num>3</num>
              <content>
                <p>For the purposes of paragraph 5(b), Infrastructure Australia has the function of developing Infrastructure Plans specifying priorities for nationally significant infrastructure across Australia.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-5C__subclause-4">
              <num>4</num>
              <content>
                <p>An Infrastructure Plan:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5C__para-a">
              <num>a</num>
              <content>
                <p>must be developed at the request of <role refersTo="#minister">the Minister</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-b">
              <num>b</num>
              <content>
                <p>may be developed on Infrastructure Australia’s own initiative after consultation with <role refersTo="#minister">the Minister</role>.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-5C__subclause-5">
              <num>5</num>
              <content>
                <p>An Infrastructure Plan must cover the period determined by the Board after consultation with <role refersTo="#minister">the Minister</role>.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-5C__subclause-6">
              <num>6</num>
              <content>
                <p>Infrastructure Australia must make an Infrastructure Plan available on Infrastructure Australia’s website <quantity refersTo="#deadline">within 14 days</quantity> after it is developed.</p>
              </content>

            <hcontainer name="subclause" eId="schedule-1__clause-5C__subclause-7">
              <num>7</num>
              <content>
                <p>Infrastructure Australia must cause a copy of an Infrastructure Priority List and an Infrastructure Plan to be tabled in each House of the Parliament within 10 sitting days of that House after the document is finalised.</p>

            <num>5D</num>
            <heading>Functions—providing advice on infrastructure matters</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-5D__subclause-1">
              <num>1</num>
              <content>
                <p>For the purposes of paragraph 5(c), Infrastructure Australia has the following functions:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5D__para-a">
              <num>a</num>
              <content>
                <p>to identify any impediments to investment in nationally significant infrastructure and identify strategies to remove any impediments identified;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5D__para-b">
              <num>b</num>
              <content>
                <p>to promote the timely and efficient delivery of nationally significant infrastructure projects, consistent with considerations of social and environmental sustainability;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5D__para-c">
              <num>c</num>
              <content>
                <p>to identify and promote best practice in the planning and procurement of nationally significant infrastructure projects;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5D__para-d">
              <num>d</num>
              <content>
                <p>to review and provide advice on proposals to facilitate the harmonisation of policies, and laws, relating to development of, and investment in, infrastructure;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5D__para-e">
              <num>e</num>
              <content>
                <p>to review Commonwealth infrastructure funding programs and their alignment with Infrastructure Plans:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5D__para-i">
              <num>i</num>
              <content>
                <p>at the request of <role refersTo="#minister">the Minister</role>; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5D__para-ii">
              <num>ii</num>
              <content>
                <p>after consultation with <role refersTo="#minister">the Minister</role>;</p>
              </content>

                <p>Australia’s current and future needs and priorities relating to nationally significant infrastructure;</p>

            </paragraph>

                <p>policy, pricing and regulatory issues that may impact on the utilisation of infrastructure;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5D__para-c">
              <num>c</num>
              <content>
                <p>policy issues arising from climate change, including the achievement of Australia’s greenhouse gas emissions reduction targets;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5D__para-d">
              <num>d</num>
              <content>
                <p>impediments to the efficient utilisation of national infrastructure networks;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5D__para-e">
              <num>e</num>
              <content>
                <p>options and reforms, including regulatory reforms, to make the utilisation of national infrastructure networks more efficient;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5D__para-f">
              <num>f</num>
              <content>
                <p>the needs of users of infrastructure;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5D__para-g">
              <num>g</num>
              <content>
                <p>mechanisms for financing investment in infrastructure;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5D__para-h">
              <num>h</num>

                <p>the delivery of infrastructure projects.</p>

                <p>For the purposes of paragraph (2)(h), Infrastructure Australia may evaluate the delivery of an infrastructure project, including evaluating:</p>

              <num>a</num>
              <content>
                <p>the delivery against any targets set before or during delivery; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5D__para-b">

                <p>any relevant assumptions made before or during delivery.</p>
              </content>
            </paragraph>

                <p>Infrastructure Australia also has the function of promoting public awareness of the matters mentioned in subsections (2) and (3), including by publishing information on its website.</p>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-5DA">
            <num>5DA</num>
            <heading>Functions—assessments of certain nationally significant infrastructure projects without prior evaluation</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-5DA__subclause-1">
              <num>1</num>
              <content>
                <p>For the purposes of paragraph 5(d), Infrastructure Australia has the function of assessing, and reporting on, projects covered by subsection (2).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-5DA__subclause-2">
              <num>2</num>
              <content>
                <p>A project is covered by this subsection if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5DA__para-a">
              <num>a</num>
              <content>
                <p>it is a project for investment in, or enhancements to, nationally significant infrastructure; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5DA__para-b">
              <num>b</num>
              <content>
                <p>the project involves expenditure by or on behalf of the Commonwealth; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5DA__para-c">
              <num>c</num>
              <content>
                <p>the Commonwealth Government’s total expenditure involved in the project is more than $250 million; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5DA__para-d">
              <num>d</num>
              <content>
                <p>the Commonwealth Government has committed to the project without prior evaluation (or endorsement of evaluation) of a proposal for the project by Infrastructure Australia.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-5DA__subclause-3">
              <num>3</num>
              <content>
                <p>Infrastructure Australia must ensure that assessments under this section are conducted at least once in each financial year beginning on or after the commencement of this section and prepare a report on the assessment.</p>

                <p>Infrastructure Australia must cause a copy of the report on the assessment under subsection (3) to be tabled in each House of the Parliament within 10 sitting days after it has been finalised.</p>

            <heading>Functions—annual statements</heading>

                <p>Infrastructure Australia must, during each financial year, prepare and give to <role refersTo="#minister">the Minister</role> the following:</p>

                <p>an annual budget statement to inform the annual Commonwealth budget process on infrastructure investment; and</p>

                <p>an annual performance statement on the performance outcomes being achieved by States, Territories and local government authorities in relation to the infrastructure investment program and existing project initiatives funded by the Commonwealth.</p>

                <p>Infrastructure Australia must cause each annual statement to be:</p>

                <p>tabled in both Houses of the Parliament no later than 14 days prior to the scheduled public release of the annual Commonwealth budget each year; and</p>

            <heading>Resignation of Commissioners</heading>

                <p>A Commissioner may resign <role refersTo="#commissioner">the Commissioner</role>’s appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>

                <p>becomes bankrupt; or</p>
              </content>

            </paragraph>

                <p>compounds with one or more of <role refersTo="#commissioner">the Commissioner</role>’s creditors; or</p>

            </paragraph>

                <p>makes an assignment of <role refersTo="#commissioner">the Commissioner</role>’s remuneration for the benefit of one or more of <role refersTo="#commissioner">the Commissioner</role>’s creditors.</p>

                <p>The Commissioners must hold the meetings that are necessary for the efficient performance of their functions.</p>

                <p>The Chief Commissioner must preside at all meetings at which the Chief Commissioner is present.</p>

                <p>If the Chief Commissioner is not present at a meeting, the other Commissioners present must appoint one of themselves to preside.</p>

            <heading>Quorum</heading>

                <p>At a meeting of the Commissioners, 2 Commissioners constitute a quorum.</p>

                <p>However, if:</p>

                <p>	(a)	a Commissioner is required by rules made for the purposes of <i>Public Governance, Performance and Accountability Act 2013</i> not to be present during the deliberations, or to take part in any decision, of the Commissioners with respect to a particular matter; and<ref href="#sec-29">section 29</ref> of the </p>

                <p>when <role refersTo="#commissioner">the Commissioner</role> leaves the meeting concerned there is no longer a quorum present;</p>

              <p>the remaining Commissioners at the meeting constitute a quorum for the purpose of any deliberation or decision at that meeting with respect to that matter.</p>

            <heading>Voting at meetings</heading>

                <p>A question arising at a meeting is to be determined by a majority of the votes of the Commissioners present and voting.</p>

                <p>The person presiding at a meeting has a deliberative vote and, in the event of an equality of votes, a casting vote.</p>

                <p>The Commissioners are taken to have made a decision at a meeting if:</p>

            <paragraph eId="schedule-1__clause-25__para-a">
              <num>a</num>
              <content>
                <p>without meeting, a majority of the Commissioners entitled to vote on the proposed decision indicate agreement with the decision; and</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>that agreement is indicated in accordance with the method determined by the Commissioners under subsection (2); and</p>
              </content>
            </paragraph>

                <p>all the Commissioners were informed of the proposed decision, or reasonable efforts were made to inform all the Commissioners of the proposed decision.</p>
