        <heading>Short title</heading>

          <p>		This Act is the <i>National Health Amendment (</i><i>Effect of Prosecution—Approved Pharmacist Corporations</i><i>)</i><i> Act </i><i>2023</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p>Definitions</p>

              <content>
                <p>If a person that is a director of an approved pharmacist corporation is charged before a court with having committed an offence referred to in subsection (1), then this section applies in relation to the approved pharmacist corporation:</p>
              </content>

              <num>a</num>
              <content>
                <p>as if the approved pharmacist corporation were charged before the court with having committed the offence; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-b">
              <num>b</num>
              <content>
                <p>if:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-i">
              <num>i</num>
              <content>
                <p>the person is convicted of the offence; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-ii">
              <num>ii</num>
              <content>
                <p>the court concerned thinks that the charge in relation to the offence is proved but, without proceeding to conviction, discharges the person conditionally on the person’s entering into a recognizance;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-c">
              <num>c</num>
              <content>
                <p>if:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-i">
              <num>i</num>
              <content>
                <p>the person ceases to be an ineligible director at a particular time; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-ii">
              <num>ii</num>
              <content>
                <p>at that time, there is no other director of the approved pharmacist corporation that is an ineligible director;</p>
              </content>
            </paragraph>

            <num>6</num>
            <heading>Subsection 133(7)</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>approved pharmacist corporation</i></b> means an approved pharmacist that is a body corporate.</p>
              <p><b><i>ineligible director</i></b>: a director of an approved pharmacist corporation is an <b><i>ineligible director</i></b> if:</p>

              <num>a</num>
              <content>
                <p>the director has been charged before a court with having committed an offence referred to in subsection (1); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-b">
              <num>b</num>
              <content>
                <p>the director has not been acquitted of the offence; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-c">
              <num>c</num>
              <content>
                <p>the charge has not been withdrawn or otherwise disposed of.</p>
              </content>
            </paragraph>

            <num>7</num>
            <heading>Application of amendments</heading>
            <content>
              <p>Subsection 133(6A) of the <i>National Health Act 1953</i>, as inserted by this Schedule, applies on and after the commencement of this item in relation to a person who is or was a director of an approved pharmacist corporation, regardless of whether the person is:</p>
              <p>before, on or after that commencement.</p>

                <p>charged before a court with having committed the offence referred to in subsection 133(1) of that Act; or</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>convicted of the offence; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-7__para-c">
              <num>c</num>
              <content>
                <p>discharged conditionally;</p>

            </paragraph>
