        <heading>Short title</heading>
        <content>
          <p>		This Act is the <i>Home Affairs</i><i> Act </i><i>2023</i>.</p>

      </section>
      <section eId="sec-2">
        <num>2</num>
        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <num>2</num>
          <content>
            <p>Any information in column 3 of the table is not part of this Act. Information may be inserted in this column, or information in it may be edited, in any published version of this Act.</p>

        </subsection>
      </section>
      <section eId="sec-3">
        <num>3</num>
        <heading>Binding the Crown</heading>
        <content>
          <p>This Act binds the Crown in each of its capacities.</p>
        </content>
      </section>
      <section eId="sec-4">
        <num>4</num>
        <heading>Definitions</heading>
        <content>
          <p>In this Act:</p>
          <p><term refersTo="#term-acquisition-of-property">acquisition of property</term> has the same meaning as <def>in paragraph 51(xxxi) of the Constitution.</def></p>
          <p><term refersTo="#term-just-terms">just terms</term> has the same meaning as <def>in paragraph 51(xxxi) of the Constitution.</def></p>
          <p><term refersTo="#term-land">land</term> means <def>Block 26, Section 44 in the Division of Yarralumla, as delineated on Deposited Plan Number 10486 in the Office of the Registrar of Titles at Canberra in the Australian Capital Territory.</def></p>
          <p><term refersTo="#term-relevant-lease">relevant lease</term> means <def>any lease owned or held in respect of the land at the commencement of this Act.</def></p>

      <section eId="sec-5">
        <num>5</num>
        <heading>Termination of lease</heading>
        <content>
          <p>A relevant lease, and any legal or equitable right, title, interest, trust, restriction, obligation, mortgage, encumbrance, contract, licence or charge, granted or arising under or pursuant to a relevant lease, or in dependence on a relevant lease, is terminated by force of this section on the commencement of this section.</p>

      </section>
      <section eId="sec-6">
        <num>6</num>
        <heading>Compensation for acquisition of property</heading>
        <subsection eId="sec-6__subsec-1">
          <num>1</num>
          <content>
            <p>If the operation of this Act would result in an acquisition of property to which paragraph 51(xxxi) of the Constitution applies from a person otherwise than on just terms, the Commonwealth is liable to pay a reasonable amount of compensation to the person.</p>
          </content>
        </subsection>
        <subsection eId="sec-6__subsec-2">
          <num>2</num>
          <content>
            <p>If the Commonwealth and the person do not agree on the amount of the compensation, the person may institute proceedings in the High Court of Australia or the Federal Court of Australia for the recovery from the Commonwealth of such reasonable amount of compensation as the court determines.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>This Act overrides any other law</heading>
        <subsection eId="sec-7__subsec-1">
          <num>1</num>
          <content>
            <p>Subject to subsection (3), this Act:</p>
          </content>
          <paragraph eId="sec-7__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>has effect despite any other law of the Commonwealth or of a State or Territory (whether written or unwritten); and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>applies despite any rights, duties, obligations, powers, limitations, offences, privileges or immunities (however described, and whether actual, contingent or prospective) which would otherwise apply under any other law of the Commonwealth or of a State or Territory (whether written or unwritten).</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7__subsec-2">
          <num>2</num>
          <content>
            <p>Without limiting subsection (1), this Act has effect despite anything contained in, or any rights, duties, obligations, powers, limitations, offences, privileges or immunities (however described, and whether actual, contingent or prospective) that would otherwise apply under, any of the following (including any regulations or other legislative instruments made under them):</p>
          </content>
          <paragraph eId="sec-7__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>	(a)	the <i>Australian Capital Territory (Planning and Land Management) Act 1988</i>, subject to subsection (3);</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>	(b)	the <i>Autonomous Sanctions Act 2011</i>;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>	(c)	the <i>Consular Privileges and Immunities Act 1972</i>;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-d">
            <num>d</num>
            <content>
              <p>	(d)	the <i>Diplomatic Privileges and Immunities Act 1967</i>;</p>
            </content>
          </paragraph>

            <num>e</num>

              <p>	(e)	the <i>Foreign State</i><i>s</i><i> Immunities Act 1985</i>;</p>

              <p>	(f)	the <i>International Organisations (Privileges and Immunities) Act 1963</i>;</p>

              <p>	(g)	the <i>Overseas Missions (Privileges and Immunities) Act 1995</i>;</p>

          </paragraph>

              <p>	(h)	the <i>Seat of Government (Administration) Act 1910</i>;</p>
            </content>
          </paragraph>

            <num>i</num>
            <content>
              <p>	(i)	the <i>Australian Capital Territory National Land (Leased) Ordinance 2022</i>.</p>

          <content>
            <p>	(3)	Nothing in this Act affects the status of the land as National Land under <i>Australian Capital Territory (Planning and Land Management) Act 1988</i>.<ref href="#sec-27">section 27</ref> of the </p>
