          <p>		This Act is the <i>Higher Education Support Amendment (Australia’s Economic Accelerator) Act 2023</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

            <heading>Research commercialisation strategy</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-42-1__subclause-1">
              <num>1</num>
              <content>
                <p>The *AEA Advisory Board must make a written strategy, to be known as the research commercialisation strategy, to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-42-1__para-a">
              <num>a</num>
              <content>
                <p>outline the vision, aims and objectives for translation and commercialisation of university research in areas of national priority; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-1__para-b">
              <num>b</num>
              <content>
                <p>identify new and emerging technologies in areas of national priority; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-1__para-c">
              <num>c</num>
              <content>
                <p>identify and propose ways of addressing regulatory, financial and cultural barriers to translating and commercialising university research in areas of national priority.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	For variation and revocation of a strategy, see subsection 33(3) of the <i>Acts Interpretation Act 1901</i>.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-42-1__subclause-1A">
              <num>1A</num>
              <content>
                <p>The strategy must not be inconsistent with *Australia’s greenhouse gas emissions reduction targets.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-42-1__subclause-2">
              <num>2</num>
              <content>
                <p>The first strategy must be made as soon as practicable after this section commences. A subsequent strategy must be made and in force as soon as the current strategy ceases to be in force.</p>
              </content>

              <num>3</num>
              <content>
                <p>A strategy is in force for 5 years.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-42-1__subclause-4">
              <num>4</num>
              <content>
                <p>The *AEA Advisory Board must give a copy of a strategy to <role refersTo="#minister">the Minister</role> as soon as practicable after making it.</p>
              </content>
            </hcontainer>

              <num>5</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must cause a copy of a strategy to be laid before each House of the Parliament.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-42-1__subclause-6">
              <num>6</num>
              <content>
                <p>A strategy made under subsection (1) is not a legislative instrument.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-42-5">
            <num>42-5</num>
            <heading>Investment plan</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-42-5__subclause-1">
              <num>1</num>
              <content>
                <p>The *AEA Advisory Board must, in relation to each year, formulate written policies for the *Australia’s Economic Accelerator program, dealing with the following matters in relation to the year:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-42-5__para-a">
              <num>a</num>
              <content>
                <p>areas of national priority;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-5__para-b">
              <num>b</num>
              <content>
                <p>the total amount of funding available;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-5__para-c">
              <num>c</num>
              <content>
                <p>any other matters the AEA Advisory Board considers appropriate to deal with to ensure the program meets the program’s objectives.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-42-5__subclause-2">
              <num>2</num>
              <content>
                <p>The *AEA Advisory Board must ensure that the policies are consistent with the research commercialisation strategy in force under <ref href="#sec-42">section 42</ref>-1.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-42-5__subclause-3">
              <num>3</num>
              <content>
                <p>A member of the *AEA Advisory Board, or a person performing functions or exercising powers under the *Australia’s Economic Accelerator program, must not act inconsistently with policies formulated under subsection (1).</p>
              </content>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-42-10">
            <num>42-10</num>
            <heading>Australia’s Economic Accelerator Advisory Board</heading>
            <content>
              <p>		The Australia’s Economic Accelerator Advisory Board (<b><i>AEA</i></b><b><i> Advisory Board</i></b>) is established.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-42-15">
            <num>42-15</num>
            <heading>Functions of the AEA Advisory Board</heading>
            <content>
              <p>The *AEA Advisory Board has the following functions:</p>
            </content>
            <paragraph eId="schedule-1__clause-42-15__para-a">
              <num>a</num>
              <content>
                <p>to advise <role refersTo="#minister">the Minister</role> in relation to translation and commercialisation of university research;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-15__para-b">
              <num>b</num>
              <content>
                <p>to advise <role refersTo="#minister">the Minister</role> in relation to the *Australia’s Economic Accelerator program, including in relation to objectives, conditions of eligibility and conditions of grants;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-15__para-c">
              <num>c</num>
              <content>
                <p>to oversee the performance of functions by priority managers engaged under <ref href="#sec-42">section 42</ref>-75;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-15__para-d">
              <num>d</num>
              <content>
                <p>any other functions conferred on the *AEA Advisory Board by this Act or the Other Grants Guidelines;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-15__para-e">
              <num>e</num>
              <content>
                <p>to do anything incidental or conducive to the performance of the above functions.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-42-20">
            <num>42-20</num>
            <heading>Annual report</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-42-20__subclause-1">
              <num>1</num>
              <content>
                <p>The *AEA Advisory Board must, as soon as practicable after the end of each financial year, prepare and give to <role refersTo="#minister">the Minister</role>, for presentation to the Parliament, a report on the AEA Advisory Board’s operations during the year.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	See also <i>Acts Interpretation Act 1901</i>, which contains provisions about annual reports.<ref href="#sec-34C">section 34C</ref> of the </p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-42-20__subclause-2">
              <num>2</num>
              <content>
                <p>The report must include details of:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-42-20__para-a">
              <num>a</num>
              <content>
                <p>achievements and outcomes in translating and commercialising university research in areas of national priority; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-20__para-b">
              <num>b</num>
              <content>
                <p>regulatory, financial and cultural barriers to translating and commercialising university research in areas of national priority and proposed ways of addressing them.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-42-25">
            <num>42-25</num>
            <heading>Membership of the AEA Advisory Board</heading>
            <content>
              <p>The *AEA Advisory Board consists of the following members:</p>
            </content>
            <paragraph eId="schedule-1__clause-42-25__para-a">
              <num>a</num>
              <content>
                <p>the Chair;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-25__para-b">
              <num>b</num>
              <content>
                <p>the Deputy Chair;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-25__para-c">
              <num>c</num>
              <content>
                <p>not fewer than 4, and not more than 6, other members.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-42-30">
            <num>42-30</num>
            <heading>Appointment of members of the AEA Advisory Board</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-42-30__subclause-1">
              <num>1</num>
              <content>
                <p>Members of the *AEA Advisory Board are to be appointed, on a part-time basis, by <role refersTo="#minister">the Minister</role> by written instrument.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-42-30__subclause-2">
              <num>2</num>
              <content>
                <p>A member holds office for the period specified in the instrument of appointment. The period must not exceed 5 years.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	Subject to subsection (3), a member may be reappointed—see <i>Acts Interpretation Act 1901</i>.<ref href="#sec-33A">section 33A</ref>A of the </p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-42-30__subclause-3">
              <num>3</num>
              <content>
                <p>A member cannot be appointed for more than 3 consecutive periods.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-42-30__subclause-4">
              <num>4</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must appoint one member to be the Chair and another to be the Deputy Chair.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-42-30__subclause-5">
              <num>5</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must ensure that the members collectively:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-42-30__para-a">
              <num>a</num>
              <content>
                <p>possess experience and knowledge in research and its translation and commercialisation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-30__para-b">
              <num>b</num>
              <content>
                <p>represent the sectors of government, industry, business and research.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-42-35">
            <num>42-35</num>
            <heading>Acting AEA Advisory Board members</heading>
            <content>
              <p>Acting by operation of law</p>

              <content>
                <p>The Deputy Chair of the *AEA Advisory Board is to act as the Chair of the AEA Advisory Board:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-42-35__para-a">
              <num>a</num>
              <content>
                <p>during a vacancy in the office of Chair (whether or not an appointment has previously been made to the office); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-35__para-b">
              <num>b</num>
              <content>
                <p>during any period, or during all periods, when the Chair:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-35__para-i">
              <num>i</num>
              <content>
                <p>is absent from duty; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-35__para-ii">
              <num>ii</num>
              <content>
                <p>is, for any reason, unable to perform the duties of the office.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-42-35__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by written instrument, appoint a member to act as the Deputy Chair of the *AEA Advisory Board:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-42-35__para-a">
              <num>a</num>
              <content>
                <p>during a vacancy in the office of Deputy Chair of the AEA Advisory Board (whether or not an appointment has previously been made to the office); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-35__para-b">
              <num>b</num>
              <content>
                <p>during any period, or during all periods, when the Deputy Chair of the AEA Advisory Board:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-35__para-i">
              <num>i</num>
              <content>
                <p>is acting as the Chair of the AEA Advisory Board; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-35__para-ii">
              <num>ii</num>
              <content>
                <p>is absent from duty; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-35__para-iii">
              <num>iii</num>
              <content>
                <p>is, for any reason, unable to perform the duties of the office.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-42-35__subclause-3">
              <num>3</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by written instrument, appoint a person to act as a member (other than the Chair or Deputy Chair) of the *AEA Advisory Board:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-42-35__para-a">
              <num>a</num>
              <content>
                <p>during a vacancy in the office of a member (whether or not an appointment has previously been made to the office); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-35__para-b">
              <num>b</num>
              <content>
                <p>during any period, or during all periods, when a member:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-35__para-i">
              <num>i</num>
              <content>
                <p>is acting as the Deputy Chair; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-35__para-ii">
              <num>ii</num>
              <content>
                <p>is absent from duty; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-35__para-iii">
              <num>iii</num>
              <content>
                <p>is, for any reason, unable to perform the duties of the office.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-42-35__subclause-4">
              <num>4</num>
              <content>
                <p>Subsection 42-30(5) applies to an appointment under this section in the same way as it applies to an appointment under <ref href="#sec-42">section 42</ref>-30.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-42-40">
            <num>42-40</num>
            <heading>Remuneration and allowances</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-42-40__subclause-1">
              <num>1</num>
              <content>
                <p>A member of the *AEA Advisory Board is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, the member is to be paid the remuneration that is prescribed by rules made under subsection (4).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-42-40__subclause-2">
              <num>2</num>
              <content>
                <p>A member of the *AEA Advisory Board is to be paid the allowances that are prescribed by rules made under subsection (4).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-42-40__subclause-3">
              <num>3</num>
              <content>
                <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-42-40__subclause-4">
              <num>4</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters for the purposes of this section.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-42-45">
            <num>42-45</num>
            <heading>Leave of absence</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> may grant leave of absence to a member of the *AEA Advisory Board on the terms and conditions that <role refersTo="#minister">the Minister</role> determines.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-42-50">
            <num>42-50</num>
            <heading>Disclosure of interests to the Minister</heading>
            <content>
              <p><i>	</i><i>	</i>A member of the *AEA Advisory Board must give written notice to the Minister of any direct or indirect pecuniary interest that the member has or acquires and that conflicts or could conflict with the proper performance of the member’s functions.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-42-55">
            <num>42-55</num>
            <heading>Disclosure of interests to the AEA Advisory Board</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-42-55__subclause-1">
              <num>1</num>
              <content>
                <p>A member of the *AEA Advisory Board who has an interest, pecuniary or otherwise, in relation to either of the following must disclose the nature of the interest to a meeting of the AEA Advisory Board:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-42-55__para-a">
              <num>a</num>
              <content>
                <p>a decision by the AEA Advisory Board to recommend, or not recommend, approval of a grant under the *Australia’s Economic Accelerator program;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-55__para-b">
              <num>b</num>
              <content>
                <p>another matter being considered or about to be considered by the AEA Advisory Board.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-42-55__subclause-2">
              <num>2</num>
              <content>
                <p>The disclosure must be made as soon as possible after the relevant facts have come to the member’s knowledge.</p>
              </content>
            </hcontainer>

            <heading>Resignation</heading>

              <content>
                <p>A member of the *AEA Advisory Board may resign the member’s appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-42-60__subclause-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by <role refersTo="#minister">the Minister</role> or, if a later day is specified in the resignation, on that later day.</p>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-42-65">
            <num>42-65</num>
            <heading>Termination</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> may terminate the appointment of a member of the *AEA Advisory Board for misbehaviour, or if any of the following applies:</p>
            </content>
            <paragraph eId="schedule-1__clause-42-65__para-a">
              <num>a</num>
              <content>
                <p>the member is unable to perform the duties of the member’s office because of physical or mental incapacity;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-65__para-b">
              <num>b</num>
              <content>
                <p>the member:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-65__para-i">
              <num>i</num>
              <content>
                <p>becomes bankrupt; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-65__para-ii">
              <num>ii</num>
              <content>
                <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-65__para-iii">
              <num>iii</num>
              <content>
                <p>compounds with the member’s creditors; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-65__para-iv">
              <num>iv</num>
              <content>
                <p>makes an assignment of the member’s remuneration for the benefit of the member’s creditors;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-65__para-c">
              <num>c</num>
              <content>
                <p>the member is absent, except on leave of absence, from 3 consecutive meetings of the AEA Advisory Board;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42-65__para-d">
              <num>d</num>
              <content>
                <p>the member fails, without reasonable excuse, to comply with <ref href="#sec-42">section 42</ref>-50 or 42-55 (which deal with the disclosure of interests).</p>

            <num>42-70</num>
            <heading>Other terms and conditions</heading>
            <content>
              <p>A member of the *AEA Advisory Board holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined, in writing, by <role refersTo="#minister">the Minister</role>.</p>

            <heading>Priority managers</heading>

                <p><role refersTo="#secretary">The Secretary</role> may, on behalf of the Commonwealth, engage persons to be known as priority managers:</p>

                <p>the information is *Australia’s Economic Accelerator program information that was obtained or created by the officer in the course of the officer’s *official employment; and</p>

              <num>c</num>
              <content>
                <p>the disclosure did not occur, or the copy or record was not made, in the course of that official employment; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-181-15__para-d">
              <num>d</num>

                <p>any of the following circumstances exist:</p>
              </content>
            </paragraph>

                <p><role refersTo="#minister">The Minister</role> may make *Australia’s Economic Accelerator program information publicly available, if the information:</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>relates to programs of research in respect of which grants have been approved for the purposes of item 14 of the table in subsection 41-10(1); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-181-25__para-b">
              <num>b</num>
              <content>
                <p>is any of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-181-25__para-i">
              <num>i</num>

                <p>the name of a researcher;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-181-25__para-ii">
              <num>ii</num>

                <p>a description of the field of research;</p>
