              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Objects</heading>
          <content>
            <p>The objects of this Act are to drive greater accountability and transparency of the Commonwealth’s administration of the aged care system, and facilitate positive change for older Australians, by:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>establishing an independent Inspector-General of Aged Care to monitor, investigate and report on the Commonwealth’s administration of the aged care system, including by identifying systemic issues through independent reviews, and making recommendations for improvement; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>providing oversight of the Commonwealth’s administration of complaints management processes across the aged care system; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>establishing a framework for the Inspector-General of Aged Care to report publicly to <role refersTo="#minister">the Minister</role> and Parliament on the Commonwealth’s administration of the aged care system.</p>

        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Simplified outline of this Act</heading>
          <content>
            <p>This Act provides for the appointment of the Inspector-General of Aged Care, and establishes the Office of the Inspector-General of Aged Care.</p>
            <p>The Inspector-General is independent from other entities within the aged care system, to support the Inspector-General’s effective, impartial and transparent oversight of the system.</p>
            <p>The Inspector-General’s functions include oversight of the Commonwealth’s administration, governance and regulation of aged care. This includes conducting reviews into systemic issues and reporting to <role refersTo="#minister">the Minister</role> and Parliament on these matters. The reviews will not relate to individual complaints and actions.</p>
            <p>The Inspector-General has the power to compel a government entity to respond to the recommendations of a review and to publish that response in conjunction with the final report of the review.</p>
            <p>The Inspector-General’s functions also include monitoring and reporting on the Commonwealth’s implementation of the recommendations of the Aged Care Royal Commission.</p>
            <p>The Inspector-General will set out priorities and topics of review for the coming year through publishing an annual work plan.</p>
            <p>The Inspector-General has coercive information-gathering powers, which allow the Inspector-General to gather information relevant to the Inspector-General’s functions from Commonwealth entities or any other person or body.</p>
            <p>Persons who provide information to, or assist, the Inspector-General are afforded protections against victimisation, or are able to request their identity be kept confidential, to allow full and frank disclosures to be made.</p>
            <p>A regime of offences and penalties apply to breaches of the protections afforded and to unauthorised use or disclosure of information obtained under this Act.</p>

        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-accountable-authority">accountable authority</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
            <p><b><i>aged care</i></b><b><i> funding</i></b><b><i> </i></b><b><i>agreement</i></b> means:</p>
          </content>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>	(a)	an agreement entered into under subsection 73-1(3), 81-1(1), 82-1(1) or 83-1(1) of the <i>Aged Care Act 1997</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-aa">
            <num>aa</num>
            <content>
              <p>	(aa)	an arrangement made under <i>Aged Care Act 2024</i>;<ref href="#sec-264">section 264</ref> or 265 of the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>an agreement providing for an arrangement under which money is payable by the Commonwealth, or for a grant of financial assistance by the Commonwealth, and the arrangement or grant is for the purposes of a program specified in:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-i">
            <num>i</num>
            <content>
              <p>	(i)	an item of the table in <i>Financial Framework (Supplementary Powers) </i><i>Regulations 1</i><i>997</i>, to the extent that the program relates to aged care; or<ref href="#part-4">Part 4</ref> of Schedule 1AA to the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-ii">
            <num>ii</num>
            <content>
              <p>an item of the table in <ref href="#part-4">Part 4</ref> of Schedule 1AB to those regulations, to the extent that the program relates to aged care; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>an agreement of a kind specified in the regulations.</p>
            </content>
            <content>
              <p><term refersTo="#term-aged-care-law">aged care law</term> means <def>any of the following: 	(a)	a provision of the <i>Aged Care Act 1997</i>; 	(aa)	a provision of the <i>Aged Care Act 2024</i>; 	(b)	a provision of the <i>Aged Care Quality and Safety Commission Act 2018</i>; 	(c)	a provision of the <i>Aged Care (Transitional Provisions) Act 1997</i>; a provision of a legislative instrument made under an Act referred to in paragraph (a), (aa), (b) or (c); 	(e)	<i> National Health Reform Act 2011</i>, or regulations made for the purposes of that section;<ref href="#sec-131A">section 131A</ref> of the a provision of any other law of the Commonwealth specified in the regulations.</def></p>

          </paragraph>

            <num>a</num>
            <content>
              <p>	(a)	a provision of the <i>Aged Care Act 1997</i>;</p>
            </content>
          </paragraph>

              <p>a provision of any other law of the Commonwealth specified in the regulations.</p>
            </content>
            <content>
              <p><term refersTo="#term-aged-care-royal-commission">Aged Care Royal Commission</term> means <def>the Royal Commission into Aged Care Quality and Safety issued by the Governor-General by Letters Patent on 6 December 2018 (and including any later amendments of those Letters Patent).</def></p>
              <p><term refersTo="#term-australian-law">Australian law</term> means <def>a law of the Commonwealth, or of a State or Territory.</def></p>
              <p><b><i>authorised official</i></b>: see subsection 50(7).</p>
              <p><term refersTo="#term-civil-penalty-provision">civil penalty provision</term> has the same meaning as <def>in the Regulatory Powers Act.</def></p>
              <p><term refersTo="#term-commonwealth-entity">Commonwealth entity</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><b><i>draft review report</i></b>, in relation to a review under section 17: see subsection 21(1).</p>
              <p><term refersTo="#term-enforcement-body">enforcement body</term> has the same meaning as <def>in <ref href="">the Privacy Act 1988</ref>.</def></p>
              <p><term refersTo="#term-enforcement-related-activity">enforcement related activity</term> has the same meaning as <def>in <ref href="">the Privacy Act 1988</ref>.</def></p>

              <p><term refersTo="#term-inspector-general">Inspector-General</term> means <def>the Inspector-General of Aged Care referred to in <ref href="#sec-9">section 9</ref>.</def></p>
              <p><term refersTo="#term-office">Office</term> means <def>the Office of the Inspector-General of Aged Care established under <ref href="#sec-12">section 12</ref>.</def></p>
              <p><term refersTo="#term-official">official</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><term refersTo="#term-paid-work">paid work</term> means <def>work for financial gain or reward (whether as an employee, a self-employed person or otherwise).</def></p>
              <p><term refersTo="#term-premises">premises</term> includes <def>any land or place.</def></p>
              <p><term refersTo="#term-protected-information">protected information</term> means <def>any of the following: 	(a)	personal information within the meaning of the<i> Privacy Act 1988</i>; information that relates to the affairs of: 	(i)	a registered provider (within the meaning of the <i>Aged Care Act 2024</i>); or a party to an aged care funding agreement (other than the Commonwealth); information the disclosure of which would or could reasonably be expected to prejudice the effective working of a Commonwealth entity in the exercise of the entity’s powers or performance of the entity’s functions or duties under an aged care law.</def></p>

          </paragraph>

            <num>a</num>

              <p>	(a)	personal information within the meaning of the<i> Privacy Act 1988</i>;</p>

              <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>
              <p><b><i>sensitive information</i></b> is information the disclosure of which would be contrary to the public interest:</p>

            <content>
              <p>because it would prejudice the security, defence or international relations of the Commonwealth; or</p>
            </content>
          </paragraph>

              <p>because it would involve disclosing:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-i">
            <num>i</num>
            <content>
              <p>deliberations or decisions of the Cabinet, or of any committee of the Cabinet, of the Commonwealth or of a State; or</p>
            </content>
          </paragraph>

            <num>ii</num>
            <content>
              <p>deliberations or advice of the Federal Executive Council or the Executive Council of a State or the Northern Territory; or</p>

              <p>deliberations or decisions of the Australian Capital Territory Executive or of a committee of that Executive; or</p>

              <p>because it would reasonably be expected to prejudice the commercial interests of any person or body; or</p>

              <p>The Inspector-General may conduct reviews for the purposes of performing certain functions. The Inspector-General must publish a work plan for each financial year that sets out the reviews to be conducted during each financial year.</p>
              <p>The Inspector-General must conduct 2 reviews of the Commonwealth’s implementation of the recommendations of the Aged Care Royal Commission. Before conducting those reviews, the Inspector-General must publish 2 reports on the progress made by the Commonwealth towards implementing those recommendations.</p>
              <p>The Inspector-General must publish a report on each review. The Inspector-General may also publish reports on any other matter relating to the Inspector-General’s functions.</p>

                <p>The Inspector-General has the following functions:</p>

                <p>Paragraphs (1)(a) and (b) do not permit the Inspector-General to monitor and investigate only a single exercise of a power, or a single performance of a function or duty, under an aged care law.</p>

                <p>The Inspector-General has power to do all things necessary or convenient to be done for, or in connection with, the performance of the Inspector-General’s functions.</p>

            <heading>Independence of Inspector-General</heading>
            <subsection eId="part-2__dvs-2__sec-11__subsec-1">

                <p>Subject to this Act and to other laws of the Commonwealth, the Inspector-General:</p>

                  <p>has complete discretion in the performance of the Inspector-General’s functions and the exercise of the Inspector-General’s powers; and</p>

                  <p>is not subject to direction by any person in relation to the performance or exercise of those functions or powers.</p>

                <p>The Inspector-General must consult <role refersTo="#minister">the Minister</role> in preparing a work plan for a financial year. The Inspector-General may also consult any other person the Inspector-General considers appropriate.</p>

                <p>The Inspector-General must publish the work plan for a financial year on the Inspector-General’s website as soon as practicable after it has been finalised.</p>

                <p>A work plan prepared under subsection (1) is not a legislative instrument.</p>

                <p>The Inspector-General must publish the work plan, as varied, on the Inspector-General’s website as soon as practicable after the work plan has been varied.</p>

                <p>	(2)	The Minister may, in writing, direct the Inspector-General to conduct a review (a <b><i>directed review</i></b>) into a particular matter related to a function referred to in paragraphs 10(1)(a) to (d).</p>

                <p>In considering whether to give a direction under subsection (2) to conduct a directed review, <role refersTo="#minister">the Minister</role> must have regard to:</p>

                <num>a</num>
                <content>
                  <p>the objects of this Act; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-17__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the functions of the Inspector-General; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-17__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>the work plan for the financial year in which the directed review is to be conducted; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-17__subsec-3__para-d">
                <num>d</num>
                <content>
                  <p>whether the Inspector-General has sufficient resources to conduct the directed review.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-17__subsec-4">
              <num>4</num>

                <p>The Inspector-General must comply with a direction given under subsection (2).</p>
              </content>
            </subsection>

                <p>The Inspector-General may conduct a review into a particular matter related to a function referred to in paragraphs 10(1)(a) to (d) if requested in writing to do so by:</p>

                  <p><role refersTo="#secretary">the Secretary</role>; or</p>
                </content>
              </paragraph>

                  <p>a Minister administering an aged care law.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-17__subsec-8">

                <p>The Inspector-General is not required to comply with a request under subsection (7).</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-3__sec-18">
            <num>18</num>
            <heading>Notice of review</heading>
            <subsection eId="part-2__dvs-3__sec-18__subsec-1">
              <num>1</num>
              <content>
                <p>The Inspector-General starts a review under <ref href="#sec-17">section 17</ref> by giving notice in accordance with subsection (2).</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-18__subsec-2">
              <num>2</num>
              <content>
                <p>A notice under subsection (1) must:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>be in writing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>specify the day on which the review starts (which must be the day on which the notice is given); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>specify the terms of reference for the review; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>be given to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p><role refersTo="#minister">the Minister</role>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>if the review relates to the exercise of powers, or the performance of functions or duties, by an official of a Commonwealth entity—the head (however described) of the entity; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>	(iii)	if the review relates to the exercise of powers, or the performance of functions or duties, of an Appointed Commissioner under a provision of the <i>Aged Care Act 2024</i>—the Commissioner of the Aged Care Quality and Safety Commission; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-2__para-iv">
                <num>iv</num>
                <content>
                  <p>	(iv)	if the review relates to the exercise of powers, or the performance of functions or duties, under an aged care law other than a provision of the <i>Aged Care Act 2024</i>—the Secretary of the Department.</p>

            </subsection>
            <subsection eId="part-2__dvs-3__sec-18__subsec-2A">
              <num>2A</num>
              <content>
                <p>The Inspector-General must, as soon as practicable after giving the notice, cause the notice to be published on the Inspector-General’s website unless the Inspector-General is satisfied that doing so would adversely affect:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-2A__para-a">
                <num>a</num>
                <content>
                  <p>the proper conduct of the review or any other review under <ref href="#sec-17">section 17</ref>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-2A__para-b">
                <num>b</num>
                <content>
                  <p>the preparation of a draft review report or final review report.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-18__subsec-3">
              <num>3</num>
              <content>
                <p>The Inspector-General may, if the Inspector-General considers it appropriate to do so:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>give the notice to any other person or body; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-18__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>cause the notice to be published in any other manner that the Inspector-General thinks fit.</p>
                </content>
              </paragraph>
            </subsection>
          </section>

            <num>19</num>
            <heading>Inspector-General may invite submissions</heading>
            <content>
              <p>Inviting submissions</p>
            </content>
            <subsection eId="part-2__dvs-3__sec-19__subsec-1">
              <num>1</num>
              <content>
                <p>The Inspector-General may invite members of the public generally, or a particular person or body, to make submissions on a matter relating to a review under <ref href="#sec-17">section 17</ref>.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-19__subsec-2">
              <num>2</num>
              <content>
                <p>The Inspector-General has discretion in deciding matters connected with the process for inviting or making submissions, including:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-19__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>how to communicate an invitation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-19__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>who may make a submission; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-19__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>how submissions may be made.</p>
                </content>

                  <p>Requests for confidentiality</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-19__subsec-3">
              <num>3</num>
              <content>
                <p>If a person or body makes a submission, the person or body may request the Inspector-General:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-19__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>not to make the submission, or a part of the submission, available under <ref href="#sec-20">section 20</ref>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-19__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>not to include the submission, or a part of the submission, in the draft review report or the final review report.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-19__subsec-4">
              <num>4</num>
              <content>
                <p>The Inspector-General may agree to the request if the Inspector-General is satisfied that:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-19__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>the request is reasonable in the circumstances; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-19__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>agreeing to the request would not unduly impede the conduct of the review; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-19__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p>the person or body has made the submission in good faith.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-19__subsec-5">
              <num>5</num>
              <content>
                <p>However, a request under subsection (3) in relation to a submission made in relation to a review does not prevent the Inspector-General from having regard to the submission in conducting the review.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-19__subsec-6">
              <num>6</num>
              <content>
                <p>If a person or body makes a request under subsection (3) in relation to a submission, or a part of a submission, and the Inspector-General refuses the request:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-19__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>the person or body may withdraw the submission or the part of the submission; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-19__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>if the submission is a written submission—the person or body may require the submission, or the part of the submission, to be returned to the person or body.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-3__sec-20">
            <num>20</num>
            <heading>Submissions may be made publicly available</heading>
            <subsection eId="part-2__dvs-3__sec-20__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to subsections (2), (3) and (4), the Inspector-General may make available to the public generally, or to particular persons or bodies, a submission or a part of a submission (including a written record of an oral submission) made in response to an invitation under subsection 19(1).</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-20__subsec-2">
              <num>2</num>
              <content>
                <p>The Inspector-General must not make available under subsection (1) a submission, or a part of a submission, to the extent that:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-20__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>it names, or otherwise makes reasonably identifiable, an individual other than:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-20__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>a Minister of the Commonwealth, a State or a Territory; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-20__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>an individual who holds an office or appointment under a law of the Commonwealth, a State or a Territory; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-20__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>an SES employee or acting SES employee; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-20__subsec-2__para-iv">
                <num>iv</num>
                <content>
                  <p>an individual who made the submission, unless the submission is a disclosure that qualifies for protection under <ref href="#sec-54">section 54</ref> (confidentiality of identity); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-20__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>it contains information that the Inspector-General is satisfied is sensitive information.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-20__subsec-3">
              <num>3</num>
              <content>
                <p>The Inspector-General must not make available under subsection (1) a submission, or part of a submission, made by a person or body if:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-20__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the person or body requested the Inspector-General not to make the submission or the part of the submission available, and the Inspector-General agreed to the request; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-20__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the submission, or the part of a submission, was withdrawn by, or returned to, the person or body under subsection 19(6).</p>
                </content>
              </paragraph>

                <p>The Inspector-General must not make available under subsection (1) a written record of an oral submission made by a person unless the person has verified the content of the record.</p>

            <heading>Draft review report</heading>

                <p>	(1)	The Inspector-General must prepare a draft report (a <b><i>draft review report</i></b>) on a review under section 17.</p>

                <p>The draft review report must set out:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-21__subsec-2__para-a">

                <content>
                  <p>the preliminary findings of the review; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-21__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>a summary of the evidence and other material on which those preliminary findings are based; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-21__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>any proposed recommendations resulting from the review.</p>
                </content>

                <p>A comment on a draft review report must be made in writing.</p>
              </content>
            </subsection>
          </section>

            <heading>Opportunity to respond must be given before including certain information in draft review report</heading>
            <subsection eId="part-2__dvs-3__sec-22__subsec-1">
              <num>1</num>
              <content>
                <p>Before including in a draft review report a preliminary finding or proposed recommendation that is critical (either expressly or impliedly) of a government entity, a government official or any other person, the Inspector-General must give the head (however described) of the entity, the official or the other person concerned:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-22__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a statement setting out the finding or recommendation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-22__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a reasonable opportunity to respond to the finding or recommendation.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-22__subsec-2">
              <num>2</num>
              <content>
                <p>The response must be given in the manner and form specified by the Inspector-General.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-3__sec-23">

            <heading>Unauthorised disclosure of draft review reports etc.</heading>
            <subsection eId="part-2__dvs-3__sec-23__subsec-1">
              <num>1</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-23__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the person receives any of the following:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-23__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>a draft review report;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-23__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>a document relating to a preliminary finding or a proposed recommendation included in a draft review report;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-23__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>an extract from a report or document referred to in this paragraph; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-23__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the person discloses any information in the report, document or extract.</p>
                </content>

                  <p>in a comment made in accordance with subsection 21(3); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-23__subsec-2__para-b">

                  <p>in a response given in accordance with subsection 22(1); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-23__subsec-2__para-c">

                  <p>to a lawyer for the purpose of obtaining legal advice in connection with making such a comment or giving such a response; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-23__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>	(d)	to the Commonwealth Ombudsman, or another officer <i>Ombudsman Act 1976</i>; or<ref href="#sec-35__subsec-1">within the meaning of subsection 35(1)</ref> of the </p>

              <p>A draft review report or a final review report must not:</p>

                <p>include information that the Inspector-General is satisfied is sensitive information; or</p>
              </content>
            </paragraph>

                <p>name, or otherwise make reasonably identifiable, an individual other than:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-3__sec-26__para-i">

                <p>a Minister of the Commonwealth, a State or a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-3__sec-26__para-ii">

                <p>A review under subsection (1) must consider, in relation to each recommendation of the Aged Care Royal Commission:</p>

                <p>The Inspector-General must not hold office for a total of more than 10 years.</p>

            <heading>Acting appointments</heading>

              <p><role refersTo="#minister">The Minister</role> may, by written instrument, appoint a person to act as the Inspector-General:</p>

                <p>during a vacancy in the office of Inspector-General (whether or not an appointment has previously been made to the office); or</p>

                <p>during any period, or during all periods, when the Inspector-General:</p>
              </content>

                <p>The Inspector-General is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, the Inspector-General is to be paid the remuneration that is prescribed by the regulations.</p>

                <p>If the Inspector-General is appointed on a full-time basis, the Inspector-General has the recreation leave entitlements that are determined by the Remuneration Tribunal.</p>

              <content>
                <p>If the Inspector-General is appointed on a full-time basis, <role refersTo="#minister">the Minister</role> may grant the Inspector-General leave of absence, other than recreation leave, on the terms and conditions as to remuneration or otherwise that <role refersTo="#minister">the Minister</role> determines.</p>

            </subsection>

            <heading>Other terms and conditions</heading>

              <p>The Inspector-General holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by the Governor-General.</p>

            <heading>Resignation</heading>
            <subsection eId="part-3__dvs-2__sec-38__subsec-1">

                <p>The Inspector-General may resign the Inspector-General’s appointment by giving the Governor-General a written resignation.</p>

            </subsection>

                <p>The resignation takes effect on the day it is received by Governor-General or, if a later day is specified in the resignation, on that later day.</p>

                  <p>if the Inspector-General is unable to perform the duties of the Inspector-General’s office because of physical or mental incapacity.</p>

                  <p>compounds with the Inspector-General’s creditors; or</p>
                </content>
              </paragraph>

                  <p>makes an assignment of the Inspector-General’s remuneration for the benefit of the Inspector-General’s creditors; or</p>

                  <p>the Inspector-General is absent, except on leave of absence, for 14 consecutive days or for 28 days in any 12 months; or</p>

                  <p>the Inspector-General engages, except with <role refersTo="#minister">the Minister</role>’s approval, in paid work outside the duties of the Inspector-General’s office (see section 36); or</p>

                <p>The staff of the Office are to be:</p>

                </content>
              </paragraph>

                  <p>such other persons (if any) as the Inspector-General considers necessary to employ to assist the Inspector-General in the performance of the Inspector-General’s functions.</p>

                <p>	(2)	For the purposes of the <i>Public Service Act 1999</i>:</p>

                  <p>the Inspector-General and the APS employees assisting the Inspector-General together constitute a Statutory Agency; and</p>
                </content>

                  <p>	(b)	the Inspector-General<i> </i>is the Head of that Statutory Agency.</p>

            <heading>Persons assisting the Inspector-General</heading>
            <subsection eId="part-3__dvs-3__sec-41__subsec-1">

                <p>The Inspector-General may be assisted by:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-41__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	officers and employees of Agencies (within the meaning of the <i>Public Service Act 1999</i>), and of authorities of the Commonwealth, whose services are made available to the Inspector-General in connection with the performance of any of the Inspector-General’s functions; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-41__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>persons whose services are made available under arrangements made under subsection (2).</p>
                </content>
              </paragraph>
            </subsection>

                <p>The Inspector-General may, on behalf of the Commonwealth, make an arrangement with the appropriate authority or officer of:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-41__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a State or Territory government; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-41__subsec-2__para-b">

                <content>
                  <p>a State or Territory government authority;</p>
                </content>
                <content>
                  <p>under which the government or authority makes officers or employees available to the Inspector-General to perform services in connection with the performance of any of the Inspector-General’s functions.</p>

                <p>An arrangement under subsection (2) may provide for the Commonwealth to reimburse a State or Territory with respect to the services of a person to whom the arrangement relates.</p>

                <p>When performing services for the Inspector-General under this section, a person is subject to the directions of the Inspector-General.</p>

                <p>The Inspector-General may give a notice to a person under subsection (2) if the Inspector-General has reason to believe that the person has information or a document or thing that is relevant to the performance of any of the Inspector-General’s functions referred to in paragraphs 10(1)(a) to (d).</p>

                  <p>the period (which must be at least 14 days after the notice is given to the person) within which the person is required to comply with the notice; and</p>

                  <p>the manner in which the person is required to comply with the notice; and</p>

                <p>The Inspector-General may require answers provided under paragraph (2)(c) to be verified by, or given on, oath or affirmation, and provided either orally or in writing.</p>

                <p>The official to whom information or answers are verified or given may administer the oath or affirmation.</p>

            </subsection>

                <p>A person contravenes this subsection if:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-44__subsec-6__para-a">

                  <p>the person is given a notice under subsection (2); and</p>

              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-44__subsec-6__para-b">

                  <p>the person fails to comply with the notice.</p>

                <p>A person is liable to a civil penalty if:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-46__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the person gives information to an official of the Office; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-46__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the person does so knowing that the information:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-46__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>is false or misleading in a material particular; or</p>
                </content>
              </paragraph>

                  <p>the person produces a document to an official of the Office; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-47__subsec-1__para-b">

                  <p>the person does so knowing that the document:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-47__subsec-1__para-i">

                  <p>is false or misleading in a material particular; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-47__subsec-1__para-ii">

                  <p>stating that the document is, to the knowledge of the first-mentioned person, false or misleading in a material particular; and</p>

                <p>This section applies if a document or thing is produced to the Inspector-General under subsection 44(2).</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-48__subsec-2">
              <num>2</num>
              <content>
                <p>The Inspector-General:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-48__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>may make copies of the document or thing, or take extracts from the document; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-48__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>may retain possession of the document or thing for such period as is necessary for the purposes of the performance of any of the Inspector-General’s functions referred to in paragraphs 10(1)(a) to (d).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-48__subsec-3">
              <num>3</num>
              <content>
                <p>While the Inspector-General retains the document or thing, the Inspector-General must allow a person who would otherwise be entitled to inspect the document or view the thing:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-48__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>to do so at all reasonable times; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-48__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>to copy the document or thing.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-48__subsec-4">
              <num>4</num>
              <content>
                <p>Subsection (3) does not apply if:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-48__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>possession of the document or thing by the person could constitute an offence; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-48__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>inspecting or copying the document or thing (as the case requires) would compromise or damage the document or thing; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-48__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p>the Inspector-General is satisfied that allowing the person to inspect the document or view the thing would prejudice the performance of any of the Inspector-General’s functions referred to in paragraphs 10(1)(a) to (d).</p>

              </paragraph>
            </subsection>
          </section>

            <num>49</num>
            <heading>When documents and things must be returned</heading>
            <subsection eId="part-4__dvs-2__sec-49__subsec-1">
              <num>1</num>
              <content>
                <p>This section applies if the Inspector-General is satisfied that a document or thing produced to the Inspector-General under subsection 44(2) is not required (or is no longer required) for the purposes of the performance of any of the Inspector-General’s functions referred to in paragraphs 10(1)(a) to (d).</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-49__subsec-2">
              <num>2</num>
              <content>
                <p>The Inspector-General must take reasonable steps to return the document or thing to the person from whom it was received, or to the owner if that person is not entitled to possess it.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-49__subsec-3">
              <num>3</num>
              <content>
                <p>However, the Inspector-General does not have to take those steps if:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-49__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>possession of the document or thing by a person could constitute an offence; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-49__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the document or thing may otherwise be retained, destroyed or disposed of under a law, or an order of a court or tribunal, of the Commonwealth or of a State or a Territory; or</p>
                </content>
              </paragraph>

                <num>c</num>

                  <p>the document or thing is forfeited or forfeitable to the Commonwealth or is the subject of a dispute as to ownership.</p>

            <heading>Access to premises etc.</heading>
            <subsection eId="part-4__dvs-2__sec-50__subsec-1">

                <p>For the purposes of the performance of any of the Inspector-General’s functions referred to in paragraphs 10(1)(a) to (d), an authorised official may enter and remain on premises:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>if the premises are occupied by a person or body covered by subsection (2)—at all reasonable times; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>otherwise—at all reasonable times, if:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>the Inspector-General has certified, in writing, that the Inspector-General is satisfied that it is reasonably necessary for the authorised official to have access to the premises for the purposes of the performance of those functions; and</p>

              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>the certificate is in force.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-50__subsec-2">
              <num>2</num>
              <content>
                <p>For the purposes of paragraph (1)(a), this subsection covers the following:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a Commonwealth entity;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>a body (other than a Commonwealth entity) established by or under a law of the Commonwealth;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>a body established, otherwise than by or under a law of the Commonwealth, by the Governor-General;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>an incorporated company in which the Commonwealth has a controlling interest.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-50__subsec-3">
              <num>3</num>
              <content>
                <p>Before entering the premises, the authorised official must provide notice to:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>a member of the group of persons who is responsible for the executive decisions of the person or body occupying the premises; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>any other person who has authority or responsibility for, or significant influence over, planning, directing or controlling the activities of the person or body occupying the premises.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-50__subsec-4">
              <num>4</num>
              <content>
                <p>While remaining on the premises, the authorised official:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>is entitled to full and free access at all reasonable times to any documents or other property; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>may examine, make copies of or take extracts from any document; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p>for the purpose of making a copy of, or taking an extract from, a document, remove the document from the premises.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-50__subsec-5">
              <num>5</num>
              <content>
                <p>The authorised official is not entitled to enter or remain on the premises if:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>the occupier of the premises asks the authorised official to produce proof of the authorised official’s authority to enter and remain on the premises; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>the authorised official fails to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-5__para-i">
                <num>i</num>
                <content>
                  <p>if the authorised official is the Inspector-General—identify themselves as the Inspector-General; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-5__para-ii">
                <num>ii</num>
                <content>
                  <p>if the authorised official is not the Inspector-General—produce a written authority signed by the Inspector-General that states that the official is authorised to exercise powers or perform functions under this section; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-5__para-c">
                <num>c</num>
                <content>
                  <p>if paragraph (1)(b) applies—the authorised official fails to produce a certificate issued by the Inspector-General under subparagraph (1)(b)(i) in relation to the premises.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-50__subsec-6">
              <num>6</num>
              <content>
                <p>The occupier of the premises must provide the authorised official with all reasonable facilities and assistance for the effective exercise of powers under this section.</p>
              </content>
              <content>
                <p>Meaning of authorised official</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-50__subsec-7">
              <num>7</num>
              <content>
                <p>	(7)	An individual is an <b><i>authorised official</i></b> if the individual is:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>the Inspector-General; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-50__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>an official of the Office (other than the Inspector-General) who is authorised by the Inspector-General, in writing, to exercise powers or perform functions under this section.</p>
                </content>
                <content>
                  <p>Fault-based offence</p>
                </content>
              </paragraph>
            </subsection>

                <p>A person commits an offence if the person contravenes subsection (6).</p>
              </content>

                <p>An individual is not excused from giving information, producing a document or thing or answering a question under subsection 44(2) on the ground that giving the information, producing the document or thing or answering the question might tend to incriminate the individual in relation to an offence.</p>

                  <p>the giving of the information, the production of the document or thing or the answering of the question; and</p>

                  <p>any information, document or thing obtained as a direct or indirect consequence of the giving of the information, the production of the document or thing or the answering of the question;</p>

                  <p>are not admissible in evidence against the individual in criminal proceedings other than proceedings for an offence against <i>Criminal Code</i> (false or misleading information or documents) that relates to section 44.<ref href="#sec-137">section 137</ref>.1 or 137.2 of the </p>

                <p>If, at general law, an individual would otherwise be able to claim the privilege against self-exposure to a penalty (other than a penalty for an offence) in relation to giving information, producing a document or thing or answering a question under subsection 44(2), the individual is not excused from giving the information, producing the document or thing or answering the question under that provision on that ground.</p>

            <heading>Legal professional privilege</heading>
            <subsection eId="part-4__dvs-2__sec-52__subsec-1">
              <num>1</num>
              <content>
                <p>A person is not excused from giving information, producing a document or thing or answering a question under subsection 44(2) on the ground that doing so would disclose a communication protected against disclosure by legal professional privilege, if the communication is:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-52__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>legal advice given to a Minister or a Commonwealth entity; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-52__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a communication between an official of a Commonwealth entity and another person or body.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-52__subsec-2">
              <num>2</num>
              <content>
                <p>However:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-52__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the information given, document or thing produced or answer given; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-52__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the giving of the information, the production of the document or thing or the answering of the question; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-52__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>any information, document or thing obtained as a direct or indirect consequence of the giving of the information, the production of the document or thing or the answering of the question;</p>
                </content>
                <content>
                  <p>are not admissible in evidence against the person in any civil or criminal proceedings.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-52__subsec-3">
              <num>3</num>
              <content>
                <p>The fact that a person is not excused from giving information, producing a document or thing or answering a question under subsection 44(2) on the ground mentioned in subsection (1) does not otherwise affect a claim of legal professional privilege that anyone may make in relation to that information, document, thing or answer.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-4__dvs-2__sec-53">
            <num>53</num>
            <heading>Secrecy provisions</heading>
            <subsection eId="part-4__dvs-2__sec-53__subsec-1">
              <num>1</num>
              <content>
                <p>A person is not excused from giving information, producing a document or thing or answering a question under subsection 44(2) on the ground that doing so would breach a provision mentioned in subsection (2).</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-53__subsec-2">
              <num>2</num>
              <content>
                <p>Subject to subsection (3), the provisions for the purposes of subsection (1) are:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-53__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a provision of a law of the Commonwealth that purports to prohibit; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-53__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>anything done, under a provision of a law of the Commonwealth, to prohibit;</p>
                </content>
                <content>
                  <p>any of the following:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-53__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the use of information, or a document or thing;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-53__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>dealing with information, or a document or thing;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-53__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>making a record of information, or a copy of a document or thing;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-53__subsec-2__para-f">
                <num>f</num>
                <content>
                  <p>the disclosure or publication of information;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-53__subsec-2__para-g">
                <num>g</num>
                <content>
                  <p>the production of, or the publication of the contents of, a document;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-53__subsec-2__para-h">
                <num>h</num>
                <content>
                  <p>the production of a thing;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-53__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>access to information, a document or a thing;</p>
                </content>
                <content>
                  <p>regardless of whether the provision of the law of the Commonwealth:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-53__subsec-2__para-j">
                <num>j</num>
                <content>
                  <p>commenced before the commencement of this section; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-53__subsec-2__para-k">
                <num>k</num>
                <content>
                  <p>is expressed to apply despite any other law.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-53__subsec-3">
              <num>3</num>
              <content>
                <p>Subsection (2) does not apply to any of the following:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-53__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	a secrecy provision under the <i>My Health Records Act 2012</i>;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-53__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	a secrecy provision that is a provision of a taxation law within the meaning of the <i>Taxation Administration Act 1953</i>;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-53__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>	(c)	a secrecy provision in the <i>Ombudsman Act 1976</i>;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-53__subsec-3__para-d">
                <num>d</num>
                <content>
                  <p>a secrecy provision that is expressed by another law of the Commonwealth to have effect despite this Act;</p>
                </content>
              </paragraph>

                  <p>anything done under a provision referred to in paragraphs (a) to (d).</p>
                </content>
              </paragraph>

          <heading>Protections relating to disclosing information</heading>
          <content>
            <p>Subdivision A—Protecting identity of disclosers in certain circumstances</p>
          </content>
          <section eId="part-4__dvs-3__sec-54">
            <num>54</num>
            <heading>Disclosures qualifying for protection</heading>
            <subsection eId="part-4__dvs-3__sec-54__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	A disclosure of information by an individual (the <b><i>discloser</i></b>) qualifies for protection under this section if:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-54__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>before the disclosure is made:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-54__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>the discloser requests that identifying information about the discloser be protected as confidential; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-54__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>the Inspector-General agrees, in writing, to the request; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-54__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the disclosure is made to an official of the Office.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-54__subsec-2">
              <num>2</num>
              <content>
                <p>The request must:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-54__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>be made in writing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-54__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>be given to the Inspector-General; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-54__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>specify the nature of the information to be disclosed; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-54__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>be accompanied by any other documents or information specified in the regulations.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-54__subsec-3">
              <num>3</num>
              <content>
                <p>In deciding whether to agree to the request, the Inspector-General must have regard to:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-54__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the nature of the information to be disclosed; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-54__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>whether disclosing, or enabling a person to ascertain, identifying information about the discloser is likely to result in significant and direct detriment to the discloser; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-54__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>any other matter the Inspector-General considers relevant.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-4__dvs-3__sec-55">
            <num>55</num>
            <heading>Confidentiality of identity of disclosers</heading>
            <subsection eId="part-4__dvs-3__sec-55__subsec-1">
              <num>1</num>
              <content>
                <p>A person contravenes this subsection if:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-55__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	an individual (the <b><i>discloser</i></b>) makes a disclosure of information (the <b><i>qualifying disclosure</i></b>) that qualifies for protection under section 54; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-55__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	the person discloses any of the following (the <b><i>confidential information</i></b>):</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-55__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>identifying information about the discloser;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-55__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>any other information that is likely to lead to the identification of the discloser; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-55__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the confidential information is information that the person obtained directly or indirectly because of the qualifying disclosure; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-55__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>the disclosure referred to in paragraph (b) is not authorised under subsection (2).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-55__subsec-2">
              <num>2</num>
              <content>
                <p>A disclosure referred to in paragraph (1)(b) is authorised under this subsection if:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-55__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the disclosure is made to a member of the Australian Federal Police (within the meaning of the <i>Australian Federal Police Act 1979</i>); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-55__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the disclosure is made to a legal practitioner for the purpose of obtaining legal advice or legal representation in relation to the operation of this Subdivision; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-55__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the disclosure is made with the consent of the discloser; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-55__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>the disclosure is made to a person or body prescribed by the regulations; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-55__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>both of the following apply:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-55__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>the confidential information is in the public domain before the disclosure is made;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-55__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>the original disclosure of the confidential information into the public domain (before the disclosure is made) was not in contravention of subsection (1).</p>
                </content>
                <content>
                  <p>Fault-based offence</p>

                <p>	(1)	A person (the <b><i>first person</i></b>) is liable to a civil penalty if:</p>
              </content>

                  <p>the first person engages in conduct; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-56__subsec-1__para-b">

                  <p>	(b)	the first person’s conduct causes any detriment to another person (the <b><i>second person</i></b>); and</p>

                  <p>the first person engages in the conduct because the first person believes or suspects that the second person or a third person has done, may have done or intends to do any of the following things:</p>

                <num>i</num>
                <content>
                  <p>give information to a person exercising or performing any power or function under this Act;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-56__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>produce a document to a person exercising or performing any power or function under this Act;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-56__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>any other thing for the purpose of assisting in the performance of the functions, or the exercise of the powers, of the Inspector-General.</p>
                </content>

                <p>In proceedings for a civil penalty order against a person for a contravention of subsection (1), it is not necessary to prove that the second person or a third person has done, may have done or intends to do a thing mentioned in paragraph (1)(c).</p>

              <content>
                <p>Threatening to cause detriment to another person</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-56__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	A person (the <b><i>first person</i></b>) is liable to a civil penalty if:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-56__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the first person makes to another person (the <b><i>second person</i></b>) a threat to cause any detriment to the second person or to a third person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-56__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the first person:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-56__subsec-3__para-i">
                <num>i</num>

                  <p>intends the second person to fear that the threat will be carried out; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-56__subsec-3__para-ii">
                <num>ii</num>
                <content>
                  <p>is reckless as to causing the second person to fear that the threat will be carried out; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-56__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>the first person makes the threat because the first person believes or suspects that a person has done, may have done or intends to do any of the following things:</p>
                </content>
              </paragraph>

                <num>i</num>

                  <p>give information to a person exercising or performing any power or function under this Act;</p>
                </content>

                  <p>produce a document to a person exercising or performing any power or function under this Act;</p>

                <p>For the purpose of subsection (3), a threat may be:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-56__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>express or implied; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-56__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>conditional or unconditional.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-56__subsec-5">
              <num>5</num>
              <content>
                <p>In proceedings for a civil penalty order against a person for a contravention of subsection (3), it is not necessary to prove:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-56__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>that the person threatened actually feared that the threat would be carried out; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-56__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>that a person has done, may have done or intends to do a thing mentioned in paragraph (3)(c).</p>
                </content>
                <content>
                  <p>Exception—reasonable administrative action</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-56__subsec-6">
              <num>6</num>
              <content>
                <p>Subsections (1) and (3) do not apply if the conduct engaged in by the first person is administrative action that is reasonable to protect the second person from detriment.</p>

            <heading>Disclosures qualifying for protection</heading>

              <p>A disclosure of information by an individual qualifies for protection under this section if:</p>
            </content>
            <paragraph eId="part-4__dvs-3__sec-57__para-a">
              <num>a</num>
              <content>
                <p>the disclosure is made to an official of the Office; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-57__para-b">
              <num>b</num>
              <content>
                <p>the disclosure is made in compliance with:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-57__para-i">
              <num>i</num>
              <content>
                <p>a request made by the Inspector-General; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-57__para-ii">
              <num>ii</num>
              <content>
                <p>a notice given under subsection 44(2).</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-4__dvs-3__sec-58">
            <num>58</num>
            <heading>Disclosure that qualifies for protection not actionable etc.</heading>
            <subsection eId="part-4__dvs-3__sec-58__subsec-1">
              <num>1</num>
              <content>
                <p>If a person makes a disclosure that qualifies for protection under <ref href="#sec-57">section 57</ref>:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-58__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the person is not subject to any civil, criminal or administrative liability (including disciplinary action) for making the disclosure; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-58__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>no contractual or other remedy may be enforced, and no contractual or other right may be exercised, against the person on the basis of the disclosure.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-58__subsec-2">
              <num>2</num>
              <content>
                <p>Without limiting subsection (1):</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-58__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>if the disclosure is made in compliance with a request made by the Inspector-General—the person:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-58__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>has qualified privilege in proceedings for defamation in respect of the disclosure; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-58__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>is not, in the absence of malice on the person’s part, liable to an action for defamation at the suit of a person in respect of the disclosure; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-58__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if the disclosure is made in compliance with a notice given under subsection 44(2)—the person has absolute privilege in proceedings for defamation in respect of the disclosure; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-58__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>a contract to which the person is a party must not be terminated on the basis that the disclosure constitutes a breach of the contract.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-58__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	For the purpose of subparagraph (2)(a)(ii), <b><i>malice</i></b> includes ill will to the person concerned or any other improper motive.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-58__subsec-4">
              <num>4</num>
              <content>
                <p>This section does not limit or affect any right, privilege or immunity that a person has, apart from this section, as a defendant in proceedings, or an action, for defamation.</p>
              </content>
            </subsection>
          </section>

            <heading>Liability for false or misleading disclosures unaffected</heading>
            <subsection eId="part-4__dvs-3__sec-59__subsec-1">

                <p>Section 58 does not apply to civil, criminal or administrative liability (including disciplinary action) for knowingly making a disclosure that is false or misleading.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-59__subsec-2">

                <p>	(2)	Without limiting subsection (1), <i>Criminal Code</i> (false or misleading information or documents) that relates to the disclosure.<ref href="#sec-58">section 58</ref> does not apply to liability for an offence against <ref href="#sec-137">section 137</ref>.1 or 137.2 of the </p>

            </subsection>
          </section>
          <section eId="part-4__dvs-3__sec-60">
            <num>60</num>
            <heading>Person’s liability for own conduct not affected</heading>
            <content>
              <p>To avoid doubt, whether a person’s disclosure of their own conduct is a disclosure that qualifies for protection under <ref href="#sec-57">section 57</ref> does not affect the person’s liability for the conduct.</p>
            </content>
          </section>
          <section eId="part-4__dvs-3__sec-61">
            <num>61</num>
            <heading>Claims for protection</heading>
            <subsection eId="part-4__dvs-3__sec-61__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	If, in civil or criminal proceedings (the <b><i>primary proceedings</i></b>) instituted against a person in a court, the person makes a claim (relevant to the proceedings) that, because of section 58, the person is not subject to any civil, criminal or administrative liability for making a particular disclosure:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-61__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the person bears the onus of adducing or pointing to evidence that suggests a reasonable possibility that the claim is made out; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-61__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if the person discharges that onus—the party instituting the primary proceedings against the person bears the onus of proving that the claim is not made out; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-61__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the court must deal with the claim in separate proceedings; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-61__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>the court must adjourn the primary proceedings until the claim has been dealt with; and</p>
                </content>
              </paragraph>

              </paragraph>

                  <p>any information given by the person in the separate proceedings;</p>

              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-61__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>any other evidence adduced by the person in the separate proceedings;</p>
                </content>
                <content>
                  <p>is admissible in evidence against the person except in proceedings in respect of the falsity of the admission, information or evidence; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-61__subsec-1__para-f">
                <num>f</num>
                <content>
                  <p>if the person or another person gives evidence in the separate proceedings in support of the claim—giving that evidence does not amount to a waiver of privilege for the purposes of the primary proceedings or any other proceedings.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-61__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	To avoid doubt, a right under <i>Evidence Act 1995</i> not to be compelled to give evidence is a privilege for the purposes of paragraph (1)(f) of this section.<ref href="#sec-126K">section 126K</ref> of the </p>
              </content>
            </subsection>
          </section>
          <section eId="part-4__dvs-3__sec-62">
            <num>62</num>
            <heading>Protection has effect despite other Commonwealth laws</heading>
            <content>
              <p>Section 58 has effect despite any other provision of a law of the Commonwealth, unless:</p>
            </content>
            <paragraph eId="part-4__dvs-3__sec-62__para-a">
              <num>a</num>
              <content>
                <p>the provision is enacted after the commencement of this section; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-62__para-b">

                <p>the provision is expressed to have effect despite this Subdivision or that section.</p>
              </content>
            </paragraph>

          <heading>Secrecy of information</heading>

            <heading>Unauthorised use or disclosure of protected information</heading>

                <p>A person commits an offence if:</p>

                <num>a</num>

                  <p>the person is, or has been, an entrusted person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-63__subsec-1__para-b">

                  <p>the person has obtained information in the person’s capacity as an entrusted person; and</p>
                </content>
              </paragraph>

                <p>An entrusted person may use protected information, or disclose protected information to an enforcement body, if the person reasonably believes that the use or disclosure is reasonably necessary for, or directly related to, one or more enforcement related activities being conducted by, or on behalf of, that enforcement body.</p>

            </subsection>
            <subsection eId="part-4__dvs-4__sec-64__subsec-4">
              <num>4</num>
              <content>
                <p>An enforcement body to which protected information is disclosed under subsection (1) may use or disclose the information for the purposes of one or more enforcement related activities being conducted by, or on behalf of, that enforcement body.</p>

                <p>Use or disclosure required or authorised by another Australian law</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-4__sec-64__subsec-5">

                <p>An entrusted person may use or disclose protected information if the use or disclosure is required or authorised under an Australian law other than this Act.</p>

                <p>An entrusted person may use protected information, or disclose protected information to another person, if the information has already been lawfully made available to the public.</p>

                <p>Disclosure to integrity agency</p>

                <p>An entrusted person may disclose protected information to any of the following persons for the purposes of that person exercising the person’s powers, or performing the person’s functions or duties:</p>
              </content>
              <paragraph eId="part-4__dvs-4__sec-64__subsec-10__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the Commonwealth Ombudsman, or another officer <i>Ombudsman Act 1976</i>;<ref href="#sec-35__subsec-1">within the meaning of subsection 35(1)</ref> of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-64__subsec-10__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	the Australian Information Commissioner, a member of the staff of the Office of the Australian Information Commissioner, or a consultant engaged under the <i>Australian Information Commissioner Act 2010</i>.</p>

                  <p>Use or disclosure for certified purposes</p>

              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-4__sec-64__subsec-11">

                <p>An entrusted person may use or disclose protected information for the purpose of achieving one or more objects of this Act if the Inspector-General certifies, in writing, that it is necessary in the public interest for the person to use or disclose the information for that purpose.</p>
              </content>
              <content>
                <p>Disclosure for purposes of preventing serious threat to safety, health or well-being</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-4__sec-64__subsec-12">
              <num>12</num>
              <content>
                <p>An entrusted person may disclose:</p>
              </content>
              <paragraph eId="part-4__dvs-4__sec-64__subsec-12__para-a">
                <num>a</num>
                <content>
                  <p>protected information; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-64__subsec-12__para-b">
                <num>b</num>
                <content>
                  <p>any other information obtained by the person in the person’s capacity as an entrusted person;</p>
                </content>
                <content>
                  <p>if the disclosure:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-64__subsec-12__para-c">
                <num>c</num>
                <content>
                  <p>	(c)	is necessary to lessen or prevent a serious threat to the safety, health or well-being of an individual seeking to access, or accessing, funded aged care services (within the meaning of the <i>Aged Care Act 2024</i>); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-64__subsec-12__para-d">
                <num>d</num>
                <content>
                  <p>	(d)	is for the purpose of, or in relation to, reporting a past threat to an individual’s life, health or safety to an entity (within the meaning of the <i>Aged Care Act 2024</i>) that has regulatory, compliance or law enforcement functions.</p>
                </content>
              </paragraph>
            </subsection>
          </section>

        <heading>Compliance and enforcement</heading>

            <p>Civil penalty orders may be sought under Part 4 of the Regulatory Powers Act from a relevant court in relation to contraventions of civil penalty provisions of this Act.</p>
            <p>This Part also contains machinery provisions dealing with provisions of this Act where both civil and criminal consequences attach to a breach of the provision.</p>

          <heading>Civil penalty provisions</heading>

              <p>Each civil penalty provision of this Act is enforceable under Part 4 of the Regulatory Powers Act.</p>

              <p>For the purposes of Part 4 of the Regulatory Powers Act, the Inspector-General is an authorised applicant in relation to the civil penalty provisions of this Act.</p>

            </content>
          </subsection>

            <num>3</num>
            <content>
              <p>For the purposes of Part 4 of the Regulatory Powers Act, each of the following courts is a relevant court in relation to the civil penalty provisions of this Act:</p>

              <num>a</num>
              <content>
                <p>the Federal Court of Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-66__subsec-3__para-b">

                <p>the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>);</p>
              </content>
            </paragraph>

              <num>c</num>

                <p>a court of a State or Territory that has jurisdiction in relation to the matter.</p>

            </paragraph>
          </subsection>
        </section>

          <num>67</num>
          <heading>Physical elements of offences</heading>
          <subsection eId="part-5__sec-67__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	This section applies if a provision of this Act provides that a person contravening another provision of this Act (the <b><i>conduct rule provision</i></b>) commits an offence.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-67__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	For the purposes of applying Chapter 2 of the <i>Criminal Code</i> to the offence, the physical elements of the offence are set out in the conduct rule provision.</p>

          <heading>Contravening an offence provision or a civil penalty provision</heading>

              <p>	(1)	This section applies if a provision of this Act provides that a person contravening another provision of this Act (the <b><i>conduct provision</i></b>) commits an offence or is liable to a civil penalty.</p>

          </subsection>

            <num>2</num>
            <content>
              <p>	(2)	For the purposes of this Act, and the Regulatory Powers Act<i> </i>to the extent that it relates to this Act, a reference to a contravention of an offence provision or a civil penalty provision includes a reference to a contravention of the conduct provision.</p>

        <heading>Miscellaneous</heading>
        <section eId="part-6__sec-69">
          <num>69</num>
          <heading>Simplified outline of this Part</heading>
          <content>
            <p>This Part contains miscellaneous provisions, including provisions about protecting certain persons from civil liability, reporting requirements, and delegation of the Inspector-General’s powers.</p>
            <p>This Part also contains the general regulation-making power.</p>

        </section>

          <num>70</num>
          <heading>Protection from liability</heading>
          <subsection eId="part-6__sec-70__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	This section applies to the following persons (<b><i>protected persons</i></b>):</p>
            </content>
            <paragraph eId="part-6__sec-70__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an official of the Office;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a delegate of the Inspector-General;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a person who is authorised to perform a function or exercise a power of, or on behalf of, the Inspector-General;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>a person assisting a person referred to in paragraph (a), (b) or (c) in performing the Inspector-General’s functions or exercising the Inspector-General’s powers.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-70__subsec-2">
            <num>2</num>
            <content>
              <p>A protected person is not liable to civil proceedings for loss, damage or injury of any kind suffered by another person as a result of anything done, or omitted to be done, by the protected person in good faith in the performance or purported performance of a function or duty conferred by this Act, or the exercise or purported exercise of a power conferred by this Act.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-71">
          <num>71</num>
          <heading>Annual report</heading>
          <subsection eId="part-6__sec-71__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The annual report prepared by the Inspector-General and given to the Minister under <i>Public Governance, Performance and Accountability Act 2013</i> for a period must include:<ref href="#sec-46">section 46</ref> of the </p>
            </content>
            <paragraph eId="part-6__sec-71__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>information about the performance of the Inspector-General’s functions, including the number of reviews under <ref href="#dvs-3">Division 3</ref> of <ref href="#part-2">Part 2</ref>:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-71__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>started during the period; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-71__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>completed during the period; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-71__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>information and statistics about the exercise of the Inspector-General’s powers during the period, including:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-71__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the number of notices given by the Inspector-General under <ref href="#sec-44">section 44</ref>, and the circumstances in which each notice was given; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-71__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the number of times an authorised official has entered premises under <ref href="#sec-50">section 50</ref>, and the circumstances in which each entry occurred; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-71__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>any other matter prescribed by the regulations.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-71__subsec-2">
            <num>2</num>
            <content>
              <p>However, the report must not include information that the Inspector-General is satisfied is sensitive information.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-72">
          <num>72</num>
          <heading>Delegation by the Inspector-General</heading>
          <subsection eId="part-6__sec-72__subsec-1">
            <num>1</num>
            <content>
              <p>The Inspector-General may, in writing and subject to subsections (2) and (3), delegate any of the Inspector-General’s functions, powers or duties under this Act or the regulations, or under Part 4 of the Regulatory Powers Act (as that Part applies in relation to this Act), to an official of the Office:</p>
            </content>
            <paragraph eId="part-6__sec-72__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>who is an SES employee or acting SES employee; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-72__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>who holds, or is acting in, an Executive Level 2, or equivalent, position.</p>
              </content>

              <p>The Inspector-General must not delegate any of the Inspector-General’s functions, powers or duties under the following provisions:</p>

                <p><ref href="#sec-15">section 15</ref> (preparing an annual work plan);</p>
              </content>
            </paragraph>

                <p><ref href="#sec-16">section 16</ref> (varying an annual work plan);</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-72__subsec-2__para-c">
              <num>c</num>
              <content>
                <p><ref href="#sec-17">section 17</ref> (conducting a review);</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-72__subsec-2__para-d">
              <num>d</num>

                <p>subsection 24(1) (preparing a final report);</p>

                <p>subsection 29(2A) (publishing an extra report to Parliament);</p>

                <p>subparagraph 50(1)(b)(i) (certifying that it is reasonably necessary to enter non-Commonwealth premises);</p>

              <p>The Inspector-General may delegate any of the Inspector-General’s functions, powers or duties under the following provisions only to an SES employee or acting SES employee:</p>

                <p><ref href="#sec-18">section 18</ref> (notice of review);</p>

            </paragraph>

                <p>paragraph 50(7)(b) (authorised officials).</p>

            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-72__subsec-4">
            <num>4</num>
            <content>
              <p>In performing a delegated function or exercising a delegated power, the delegate must comply with any written directions of the Inspector-General.</p>

        <section eId="part-6__sec-73">
          <num>73</num>
          <heading>Regulations</heading>

            <p>The Governor-General may make regulations prescribing matters:</p>

              <p>required or permitted by this Act to be prescribed by the regulations; or</p>

              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
