            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p><b><i>entrusted person</i></b> means any of the following:</p>

                <p><role refersTo="#minister">the Minister</role>;</p>
              </content>
            </paragraph>

            </paragraph>

              <content>
                <p>an APS employee in the Department;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-4__para-d">
              <num>d</num>
              <content>
                <p>any other person employed or engaged by the Commonwealth to provide services to the Commonwealth in connection with the Department;</p>
              </content>
            </paragraph>

                <p>any other person who is:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-4__para-i">
              <num>i</num>

                <p>employed or engaged by the Commonwealth or a body corporate that is established by a law of the Commonwealth; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-4__para-ii">
              <num>ii</num>
              <content>
                <p>in a class of persons specified by rules made for the purposes of this subparagraph.</p>

            </paragraph>

            <heading>Simplified outline of this Part</heading>
            <content>
              <p>Entrusted persons and certain other persons can use or disclose information (referred to as relevant information) obtained or generated under this Act in accordance with this Part.</p>
              <p>Entrusted persons and certain other persons may commit an offence or be liable to a civil penalty if they use or disclose protected information other than in accordance with this Part.</p>
              <p>Note 1:	Each provision in <i>Privacy Act 1988</i> and other laws.<ref href="#dvs-2">Division 2</ref> provides an authorisation for the purposes of the </p>
              <p>Note 2:	Nothing in this Part prevents the Commonwealth from making agreements or other arrangements to impose conditions on the use or disclosure of relevant information by a person or body who obtains the information as a result of a disclosure authorised under <ref href="#dvs-2">Division 2</ref>.</p>

            <heading>Use or disclosure for the purposes of this Act</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-388__subclause-1">
              <num>1</num>
              <content>
                <p>An entrusted person or a person covered by subsection (2) may use or disclose relevant information in the course of or for the purposes of:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-388__para-a">
              <num>a</num>
              <content>
                <p>performing functions or duties, or exercising powers, under this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-388__para-b">
              <num>b</num>
              <content>
                <p>assisting another person to perform functions or duties, or exercise powers, under this Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-388__subclause-2">
              <num>2</num>
              <content>
                <p>The following persons are covered by this subsection:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-388__para-a">
              <num>a</num>
              <content>
                <p>a person employed or engaged by the Commonwealth or a body corporate that is established by a law of the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-388__para-b">
              <num>b</num>
              <content>
                <p>an authorised officer;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-388__para-c">
              <num>c</num>
              <content>
                <p>an approved auditor;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-388__para-d">
              <num>d</num>
              <content>
                <p>an approved assessor;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-388__para-e">
              <num>e</num>
              <content>
                <p>an accredited veterinarian;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-388__para-f">
              <num>f</num>
              <content>
                <p>a nominated export permit issuer;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-388__para-g">
              <num>g</num>
              <content>
                <p>an issuing officer.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-389">
            <num>389</num>
            <heading>Disclosure to foreign governments etc. for export, trade and other purposes</heading>
            <content>
              <p>An entrusted person may disclose relevant information to a foreign government, an authority or agency of a foreign government or an international body of an intergovernmental character, for the purposes of:</p>
            </content>
            <paragraph eId="schedule-1__clause-389__para-a">
              <num>a</num>
              <content>
                <p>the export of goods from Australian territory or export operations; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-389__para-b">
              <num>b</num>
              <content>
                <p>managing Australia’s international relations in respect of trade; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-389__para-c">
              <num>c</num>
              <content>
                <p>giving effect to Australia’s international obligations.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-390">
            <num>390</num>
            <heading>Use or disclosure for the purposes of certain Acts</heading>
            <content>
              <p>An entrusted person may use or disclose relevant information if the use or disclosure is for the purposes of the administration of this Act or another Act that is administered by <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-391">
            <num>391</num>
            <heading>Disclosure to a Commonwealth entity</heading>
            <content>
              <p><b>	</b>	An entrusted person may disclose relevant information to a Commonwealth entity if the disclosure is<i> </i>for the purposes of assisting the entity to perform its functions or duties or exercise its powers.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-392">
            <num>392</num>
            <heading>Disclosure to a court, tribunal etc.</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-392__subclause-1">
              <num>1</num>
              <content>
                <p>An entrusted person may disclose relevant information to a court exercising federal jurisdiction.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-392__subclause-2">
              <num>2</num>
              <content>
                <p>An entrusted person may disclose relevant information to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-392__para-a">
              <num>a</num>
              <content>
                <p>a court; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-392__para-b">
              <num>b</num>
              <content>
                <p>a tribunal, authority or person that has the power to require the answering of questions or the production of documents;</p>
              </content>
            </paragraph>
            <content>
              <p>for the purposes of the enforcement of a law of the Commonwealth or to assist the court, tribunal, authority or person to make or review an administrative decision that is required or authorised to be made under a law of the Commonwealth.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-393">
            <num>393</num>
            <heading>Disclosure for the purposes of law enforcement</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-393__subclause-1">
              <num>1</num>
              <content>
                <p>An entrusted person may disclose relevant information to a body mentioned in subsection (2) if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-393__para-a">
              <num>a</num>
              <content>
                <p>the entrusted person reasonably believes that disclosing the information is necessary for:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-393__para-i">
              <num>i</num>
              <content>
                <p>the enforcement of the criminal law; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-393__para-ii">
              <num>ii</num>
              <content>
                <p>the enforcement of a law imposing a pecuniary penalty; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-393__para-iii">
              <num>iii</num>
              <content>
                <p>the protection of public revenue; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-393__para-b">
              <num>b</num>
              <content>
                <p>the functions of the body include that enforcement or protection; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-393__para-c">
              <num>c</num>
              <content>
                <p>for a body mentioned in paragraph (2)(b) or (d)—the body has undertaken not to use or further disclose the information except in accordance with an agreement that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-393__para-i">
              <num>i</num>
              <content>
                <p>is in force between the Commonwealth and the State or Territory; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-393__para-ii">
              <num>ii</num>
              <content>
                <p>applies in relation to the information; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-393__para-d">
              <num>d</num>
              <content>
                <p>for a body mentioned in paragraph (2)(b) or (d)—the entrusted person is satisfied that the information will be used or further disclosed only in accordance with the agreement.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-393__subclause-2">
              <num>2</num>
              <content>
                <p>The bodies are the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-393__para-a">
              <num>a</num>
              <content>
                <p>a Commonwealth entity;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-393__para-b">
              <num>b</num>
              <content>
                <p>a State or Territory body;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-393__para-c">
              <num>c</num>
              <content>
                <p>the Australian Federal Police;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-393__para-d">
              <num>d</num>
              <content>
                <p>the police force or police service of a State or Territory.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-394">
            <num>394</num>
            <heading>Use or disclosure for research, policy development or data analysis</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-394__subclause-1">
              <num>1</num>
              <content>
                <p>An entrusted person may:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-394__para-a">
              <num>a</num>
              <content>
                <p>use relevant information; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-394__para-b">
              <num>b</num>
              <content>
                <p>disclose relevant information to an entrusted person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-394__para-c">
              <num>c</num>
              <content>
                <p>disclose relevant information to another person or body;</p>
              </content>
            </paragraph>
            <content>
              <p>for the purposes of the person or body undertaking research, policy development or data analysis to assist the Department with:</p>
              <p>unless:</p>
            </content>
            <paragraph eId="schedule-1__clause-394__para-d">
              <num>d</num>
              <content>
                <p>the administration of this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-394__para-e">
              <num>e</num>
              <content>
                <p>achieving one or more objects of this Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-394__subclause-2">
              <num>2</num>
              <content>
                <p>An entrusted person is not authorised under paragraph (1)(c) to disclose relevant information to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-394__para-a">
              <num>a</num>
              <content>
                <p>another person who is not employed or engaged by the Commonwealth or a body corporate that is established by a law of the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-394__para-b">
              <num>b</num>
              <content>
                <p>a body that is not a Commonwealth entity;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-394__para-c">
              <num>c</num>
              <content>
                <p>the other person or body has undertaken not to use or further disclose the information except in accordance with an agreement that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-394__para-i">
              <num>i</num>
              <content>
                <p>is in force between the Commonwealth and that person or body; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-394__para-ii">
              <num>ii</num>
              <content>
                <p>applies in relation to the information; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-394__para-d">
              <num>d</num>
              <content>
                <p>the entrusted person is satisfied that the information will be used or further disclosed only in accordance with the agreement.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-394__subclause-3">
              <num>3</num>
              <content>
                <p>An entrusted person is not authorised under paragraph (1)(c) to disclose relevant information unless the entrusted person is satisfied that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-394__para-a">
              <num>a</num>
              <content>
                <p>in the case of research, policy development or data analysis that could not proceed if personal information were de-identified before the relevant information is disclosed—only the minimum amount of personal information necessary to proceed is disclosed; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-394__para-b">
              <num>b</num>
              <content>

            <heading>Disclosure to State or Territory body</heading>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may disclose relevant information to a State or Territory body if:</p>

              <content>
                <p><role refersTo="#secretary">the Secretary</role> reasonably believes that disclosing the information is necessary for the purposes of the administration of a law of a State or Territory; and</p>

              <content>
                <p>the State or Territory body has undertaken not to use or further disclose the information except in accordance with an agreement that:</p>

                <p>is in force between the Commonwealth and the State or Territory; and</p>
              </content>
            </paragraph>

              <p><role refersTo="#secretary">The Secretary</role> may use or disclose relevant information if <role refersTo="#secretary">the Secretary</role> reasonably believes that:</p>

            </paragraph>

                <p>has the potential to cause harm on a nationally significant scale.</p>
              </content>
            </paragraph>

            <heading>Use or disclosure authorised by rules</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-397E__subclause-1">

                <p>A person may use relevant information if:</p>

              <num>a</num>
              <content>
                <p>the person is included in a class of persons prescribed by rules made for the purposes of this paragraph; and</p>
              </content>
            </paragraph>

                <p>the use is for a purpose prescribed by rules made for the purposes of this paragraph; and</p>
              </content>
            </paragraph>

                <p>the information is of a kind prescribed by rules made for the purposes of this paragraph; and</p>

            </paragraph>

            <heading>Meaning of protected information</heading>

                <p>	(1)	<b><i>Protected information</i></b> means information of any of the following kinds obtained or generated by a person:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-397F__para-a">
              <num>a</num>
              <content>
                <p>information (including commercially sensitive information) the disclosure of which could reasonably be expected to found an action by a person (other than the Commonwealth) for breach of a duty of confidence;</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-397F__para-b">
              <num>b</num>
              <content>
                <p>information the disclosure of which could reasonably be expected to prejudice the prevention, detection, investigation, prosecution or punishment of one or more offences;</p>

            <paragraph eId="schedule-1__clause-397F__para-c">
              <num>c</num>
              <content>
                <p>information the disclosure of which could reasonably be expected to prejudice the security, defence or international relations of Australia;</p>
              </content>
            </paragraph>

                <p>information of a kind prescribed by rules made for the purposes of this paragraph.</p>
              </content>
            </paragraph>
            <content>
              <p>Note 1:	The rules are made by the Secretary under <i>Legislation Act 2003</i>.<ref href="#sec-432">section 432</ref>. They are a disallowable legislative instrument and are subject to sunsetting under the </p>

                <p>prejudice the effective working of the Department; or</p>
              </content>
            </paragraph>

              </content>
            </paragraph>

              </content>
            </paragraph>

                <p>assisting another person to perform functions or duties, or exercise powers, under this Act; and</p>
              </content>
            </paragraph>

                <p>the information is protected information; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-397G__para-d">

                <p>The following persons are covered by this subsection:</p>

                <p>	(a)	a person employed or engaged by the Commonwealth<i> </i>or a body corporate that is established by a law of the Commonwealth;</p>

                <p>an authorised officer;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-397G__para-c">

                <p>this Act or another law of the Commonwealth; or</p>
              </content>
            </paragraph>

                <p>a law of a State or Territory prescribed by rules made for the purposes of this paragraph.</p>

            </paragraph>

                <p>Subsection (1) does not apply if the person uses or discloses the information in good faith:</p>

                <p>in the purported performance of functions or duties, or the purported exercise of powers, under this Act; or</p>
              </content>
            </paragraph>

                <p>in assisting another person in the purported performance of the other person’s functions or duties, or the purported exercise of the other person’s powers, under this Act.</p>

                <p>A person commits an offence if the person contravenes subsection (1).</p>
