          <p>		This Act is the <i>Classification (Publications, Films and Computer Games) Amendment</i><i> (Industry Self</i><i>-</i><i>Classification and Other Measures)</i><i> Act </i><i>2023</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

              <p>In classifying a publication, film or computer game under this Act, assume that the publication, film or game will be published only in the form in which it is considered for classification.</p>

            <num>12D</num>
            <heading>Classification of publications, films or computer games containing advertisements</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-12D__subclause-1">
              <num>1</num>
              <content>
                <p>A publication must not be classified if it contains an advertisement that has been refused approval.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-12D__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	An unclassified film (the <b><i>first film</i></b>) or unclassified computer game (the <b><i>first game</i></b>) must not be classified if it:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-12D__para-a">
              <num>a</num>
              <content>
                <p>contains an advertisement for a film or computer game with a higher classification than the classification the first film or first game would be given if it did not contain the advertisement; or</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>contains an advertisement for an unclassified film or unclassified computer game:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-12D__para-i">

                <p>that has been assessed in accordance with <ref href="#sec-31">section 31</ref> or under <ref href="#sec-33">section 33</ref> as being likely to have a higher classification than the classification the first film or first game would be given if it did not contain the advertisement; or</p>
              </content>

                <p>the likely classification of which has not been assessed in accordance with <ref href="#sec-31">section 31</ref> or under <ref href="#sec-33">section 33</ref>; or</p>

            <heading>Classification of publications, films and computer games by the Board</heading>
            <content>
              <p>A person may apply to the Board for the classification of a publication, film or a computer game for the Australian Capital Territory.</p>
            </content>
          </hcontainer>

                <p>Subject to subsection (4), an accredited person may, on request of the publisher or proposed publisher of a film or computer game, classify the film or computer game for the Australian Capital Territory.</p>

              <p>Note:	If the accredited person has been requested to complete further training under <ref href="#sec-22N">section 22N</ref>, the accredited person may not classify films or computer games until the person has completed the training: see subsection 22N(2).</p>

                <p>If a film or computer game, if classified, would be likely to be classified RC or X 18+, an accredited person may not classify the film or computer game.</p>

                <p>the Board is of the opinion that:</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-22L__para-i">
              <num>i</num>

                <p>had the film or computer game been classified by the Board, the Board would have given the film or computer game a different classification; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22L__para-ii">
              <num>ii</num>
              <content>
                <p>the consumer advice for the film or computer game is misleading, incorrect or grossly inadequate; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22L__para-iii">
              <num>iii</num>
              <content>
                <p>the consumer advice for the film or computer game uses a consumer advice term that is not included in the list determined by the Board under <ref href="#sec-12A">section 12A</ref> that was in force at the time the consumer advice was determined;</p>
              </content>
            </paragraph>

                <p>The Board may revoke the classification:</p>

                <p>if an application in accordance with subsection (7) is made <quantity refersTo="#deadline">within 3 months</quantity> after the day the classification takes effect or within such longer period specified in a determination under subsection (8)—on application.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-22L__subclause-3">
              <num>3</num>
              <content>
                <p>However, before the Board revokes the classification, the Director must give a notice in writing to the accredited person that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-22L__para-a">
              <num>a</num>
              <content>
                <p>states the grounds on which the Board is considering revoking the classification; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22L__para-b">
              <num>b</num>
              <content>
                <p>invites the accredited person to make, <quantity refersTo="#deadline">within 7 days</quantity> after receiving the notice, a submission to the Board as to why the Board should not revoke the classification.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-22L__subclause-4">
              <num>4</num>
              <content>
                <p>If, after considering any submission received within that period, the Board decides to revoke the classification, the Board must classify the film or computer game.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-22L__subclause-5">
              <num>5</num>
              <content>
                <p>The classification by the Board takes effect when it is included in either:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-22L__para-a">
              <num>a</num>
              <content>
                <p>the register, known as the National Classification Database, maintained by the Department; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22L__para-b">
              <num>b</num>
              <content>
                <p>any replacement register.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-22L__subclause-6">
              <num>6</num>
              <content>
                <p>The revocation of the classification takes effect immediately before the classification by the Board takes effect.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-22L__subclause-7">
              <num>7</num>
              <content>
                <p>For the purposes of paragraph (2)(c) an application must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-22L__para-a">
              <num>a</num>
              <content>
                <p>be in a form approved, in writing, by the Director; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22L__para-b">
              <num>b</num>
              <content>
                <p>if a class of persons is specified in a determination under subsection (8)—be made by a person included in that class; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22L__para-c">
              <num>c</num>
              <content>
                <p>be accompanied by the prescribed fee (if any).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-22L__subclause-8">
              <num>8</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> of the Department may, by legislative instrument, determine either or both of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-22L__para-a">
              <num>a</num>
              <content>
                <p>a specified period for the purposes of paragraph (2)(c);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22L__para-b">
              <num>b</num>
              <content>
                <p>a specified class of persons for the purposes of paragraph (7)(b).</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-22M">
            <num>22M</num>
            <heading>Secretary may accredit a person to classify films and computer games</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-22M__subclause-1">
              <num>1</num>
              <content>
                <p>A person may apply to <role refersTo="#secretary">the Secretary</role> of the Department for accreditation to classify films and computer games for the Australian Capital Territory.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-22M__subclause-2">
              <num>2</num>
              <content>
                <p>The application must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-22M__para-a">
              <num>a</num>
              <content>
                <p>be in a form approved, in writing, by <role refersTo="#secretary">the Secretary</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22M__para-b">
              <num>b</num>
              <content>
                <p>be accompanied by a declaration made by the person to the effect that the person:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22M__para-i">
              <num>i</num>
              <content>
                <p>has not been convicted of an offence against a law of the Commonwealth, or a law of a State or Territory, involving fraud or dishonesty; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22M__para-ii">
              <num>ii</num>
              <content>
                <p>has not been ordered to pay a pecuniary penalty for the contravention of a civil penalty provision of a law of the Commonwealth, or a law of a State or Territory, involving fraud or dishonesty.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-22M__subclause-3">
              <num>3</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may, in writing, accredit the person to classify films and computer games for the Australian Capital Territory for a specified period, if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-22M__para-a">
              <num>a</num>
              <content>
                <p>the person has made an application in accordance with subsection (2); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22M__para-b">
              <num>b</num>
              <content>
                <p>the person has, within the previous 12 months, completed approved training in classification; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22M__para-c">
              <num>c</num>
              <content>
                <p>the person has paid the accreditation fee (if any) that relates to the specified period; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22M__para-d">
              <num>d</num>
              <content>
                <p>there is no notice under <ref href="#sec-17B">section 17B</ref>, 17C, 22F, 22H or 22Q in force in relation to the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22M__para-e">
              <num>e</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> is not aware of any reason why the person is not a suitable person to classify films and computer games.</p>
              </content>
            </paragraph>
            <content>
              <p>Note 1:	For the approval of training, see <ref href="#sec-22S">section 22S</ref>.</p>
              <p>Note 2:	If the person has been requested to complete further training under 22N, <role refersTo="#secretary">the Secretary</role> may not accredit the person for a further period until the person has completed the training: see subsection 22N(2).</p>
              <p>Accreditation fee</p>
              <p>Spent convictions scheme not affected</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-22M__subclause-4">
              <num>4</num>
              <content>
                <p>For the purposes of paragraph (3)(c), the regulations may prescribe an accreditation fee in relation to a period to be paid by an accredited person for services that the Commonwealth (including the Board and <role refersTo="#secretary">the Secretary</role> of the Department) provides in administering the classification of films and computer games by accredited persons under this Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-22M__subclause-5">
              <num>5</num>
              <content>
                <p>A fee prescribed under subsection (4) must not be such as to amount to taxation.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-22M__subclause-6">
              <num>6</num>
              <content>
                <p>	(6)	Nothing in this section affects the operation of <i>Crimes Act 1914 </i>(which includes provisions that, in certain circumstances, relieve persons from the requirement to disclose spent convictions and require persons aware of such convictions to disregard them).<ref href="#part-VII">Part VII</ref>C of the </p>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-22N">
            <num>22N</num>
            <heading>Secretary may request accredited person complete further training</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-22N__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> of the Department may, in writing, request that an accredited person complete further approved training in classification within a specified period, if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-22N__para-a">
              <num>a</num>
              <content>
                <p>during the previous 12 months, the Board has revoked 2 or more classifications by the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22N__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> considers that the training is otherwise necessary or desirable to ensure that the person is adequately trained and competent to perform the functions of an accredited person under this Act.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	For the approval of training, see <ref href="#sec-22S">section 22S</ref>.</p>
              <p>Note:	If the person does not complete the further training with the specified period, the person’s accreditation may be revoked under <ref href="#sec-22P">section 22P</ref>.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-22N__subclause-2">
              <num>2</num>
              <content>
                <p>Until the person has completed the training:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-22N__para-a">
              <num>a</num>
              <content>
                <p>the person may not classify a film or computer game under <ref href="#sec-22K">section 22K</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22N__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> may not accredit the person to classify films and computer games.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-22P">
            <num>22P</num>
            <heading>Secretary may revoke accreditation</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-22P__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> of the Department may, in writing, revoke the accreditation of a person to classify films and computer games if <role refersTo="#secretary">the Secretary</role> is satisfied that one or more of the conditions mentioned in subsection (2) apply to the person.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-22P__subclause-2">
              <num>2</num>
              <content>
                <p>The conditions are as follows:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-22P__para-a">
              <num>a</num>
              <content>
                <p>during the previous 12 months, the Board has revoked 3 or more classifications by the person;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22P__para-b">
              <num>b</num>
              <content>
                <p>if <role refersTo="#secretary">the Secretary</role> has, under section 22N, requested the person complete further approved training in classification within a specified period—the person has not completed the training within the specified period;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22P__para-c">
              <num>c</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> becomes aware of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22P__para-i">
              <num>i</num>
              <content>
                <p>the person having made a declaration under subsection 22M(2) that is false or misleading in a material particular; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22P__para-ii">
              <num>ii</num>
              <content>
                <p>the person having been convicted of an offence against a law of the Commonwealth, or a law of a State or Territory, involving fraud or dishonesty; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22P__para-iii">
              <num>iii</num>
              <content>
                <p>the person having been ordered to pay a pecuniary penalty for the contravention of a civil penalty provision of a law of the Commonwealth, or a law of a State or Territory, involving fraud or dishonesty; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22P__para-iv">
              <num>iv</num>
              <content>
                <p><b>	</b>(iv)	the person having purported to classify a film or computer game as RC or X 18+; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22P__para-v">
              <num>v</num>
              <content>
                <p>any other reason why the person is not a suitable person to classify films and computer games;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22P__para-d">
              <num>d</num>
              <content>
                <p>the Board has revoked a classification by the person of a film or computer game on the grounds that had the film or computer game been classified by the Board, the Board would have given the film or computer game a classification of RC or X 18+;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22P__para-e">
              <num>e</num>
              <content>
                <p>the person meets any other condition prescribed by the regulations.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-22P__subclause-3">
              <num>3</num>
              <content>
                <p>If the accreditation of a person has been revoked under subsection (1), the person may not make an application under <ref href="#sec-22M">section 22M</ref> for the next 28 days.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-22Q">
            <num>22Q</num>
            <heading>Barring notice to accredited person</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-22Q__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> of the Department may give a written notice to a person if <role refersTo="#secretary">the Secretary</role> is satisfied that one or more of the conditions mentioned in subsection (2) apply to the person.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-22Q__subclause-2">
              <num>2</num>
              <content>
                <p>The conditions are as follows:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-22Q__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> has revoked the person’s accreditation under section 22P more than once;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22Q__para-b">
              <num>b</num>
              <content>
                <p>the Board has revoked 2 or more classifications by the person of films or computer games in the person’s most recent 3 accreditation periods and at least 2 of those classifications were revoked on the grounds that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22Q__para-i">
              <num>i</num>
              <content>
                <p>had the film or computer game been classified by the Board, the Board would have given the film or computer game a classification that is 2 or more levels higher or lower; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22Q__para-ii">
              <num>ii</num>
              <content>
                <p>had the film or computer game been classified by the Board, the Board would have given the film or computer game a classification of RC or X 18+; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22Q__para-iii">
              <num>iii</num>
              <content>
                <p>the consumer advice was grossly misleading, grossly incorrect or grossly inadequate;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22Q__para-c">
              <num>c</num>
              <content>
                <p>the Board has revoked a classification by the person of a film or computer game on the grounds that had the film or computer game been classified by the Board, the Board would have given the film or computer game a classification of RC or X 18+;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22Q__para-d">
              <num>d</num>
              <content>
                <p>the person has purported to classify a film or computer game as RC or X 18+;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22Q__para-e">
              <num>e</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> is of the opinion that the person knowingly made a declaration under subsection 22M(2) that is false or misleading in a material particular;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22Q__para-f">
              <num>f</num>
              <content>
                <p>the person meets any other condition prescribed by the regulations.</p>
              </content>
            </paragraph>
            <content>
              <p>Note 1:	If <role refersTo="#secretary">the Secretary</role> gives a notice to a person under this section, the person cannot be accredited while the notice remains in force: see paragraph 22M(3)(d).</p>
              <p>Note 2: 	The regulations may prescribe circumstances in which consumer advice is taken to be grossly misleading, grossly incorrect or grossly inadequate: see subsection 93(2).</p>

                <p>The notice takes effect from the date specified in the notice and continues in force for the period specified in the notice. The period must not exceed 5 years.</p>

            </paragraph>

                <p>be in a form approved by <role refersTo="#secretary">the Secretary</role> of the Department.</p>

                <p>Subsection (1) does not apply to a film if:</p>

                <p>	(a)	the film is a modified version of the film classified under the <i>Broadcasting Services Act 1992</i>, the <i>Australian Broadcasting Corporation Act 1983</i> or<i> </i>the <i>Special Broadcasting Service Act 1991</i><i> </i>(other than a film that only has modifications of a kind referred to subsection 21(2) or (3)); or</p>

            </paragraph>

                <p>the film contains an advertisement that has been refused approval under this Act.</p>
              </content>
            </paragraph>
          </hcontainer>

            <num>6HB</num>
            <heading>Reclassification of films taken to be classified by the Board</heading>
            <content>
              <p>If:</p>
              <p>then, despite any other provision of this Act, the film may be reclassified under <ref href="#part-2">Part 2</ref>.</p>
            </content>
            <paragraph eId="schedule-2__clause-6HB__para-a">
              <num>a</num>
              <content>
                <p>a film is taken to have been classified by the Board under this Act under <ref href="#sec-6H">section 6H</ref>A; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-6HB__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the post-classification publisher of the film considers that the classification<i> </i>is not in accordance with the Code or the classification guidelines; and</p>

                <p>the classification of the film has not been reviewed under <ref href="#part-5">Part 5</ref>; and</p>
