              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Object</heading>
          <content>
            <p>The object of this Act is to provide a funding mechanism:</p>
          </content>
          <paragraph eId="part-1__sec-2A__para-a">
            <num>a</num>
            <content>
              <p>to address acute housing needs, including the acute housing needs of:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-2A__para-i">
            <num>i</num>
            <content>
              <p>Indigenous persons; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-2A__para-ii">
            <num>ii</num>
            <content>
              <p>women; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-2A__para-iii">
            <num>iii</num>
            <content>
              <p>children; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-2A__para-iv">
            <num>iv</num>
            <content>
              <p>veterans; and</p>

              <p>to enable support to be provided to increase the availability of social housing and affordable housing.</p>

        </section>

          <num>3</num>
          <heading>Simplified outline of this Act</heading>
          <content>
            <p>•	This Act establishes the Housing Australia Future Fund, which will enhance the Commonwealth’s ability to:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>make grants in relation to acute housing needs, social housing or affordable housing; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>make payments to Housing Australia for the purposes of enabling Housing Australia to make grants and loans in relation to acute housing needs, social housing or affordable housing.</p>
            </content>
            <content>
              <p>•	The Housing Australia Future Fund consists of:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>the Housing Australia Future Fund Special Account; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>the investments of the Housing Australia Future Fund.</p>
            </content>
            <content>
              <p>•	The Future Fund Board is responsible for deciding how to invest the Housing Australia Future Fund. In doing so, the Future Fund Board is bound by the Housing Australia Future Fund Investment Mandate given to it by the responsible Ministers.</p>
              <p>•	A grant may be made in relation to acute housing needs, social housing or affordable housing.</p>
              <p>•	This Act establishes the Housing Australia Future Fund Payments Special Account.</p>
              <p>•	Amounts will be transferred from the Housing Australia Future Fund Special Account to the Housing Australia Future Fund Payments Special Account.</p>
              <p>•	The purpose of the Housing Australia Future Fund Payments Special Account is to make grants in relation to acute housing needs.</p>
              <p>•	Amounts will be transferred from the Housing Australia Future Fund Special Account to the Federation Reform Fund for the purposes of making grants to the States and Territories in relation to acute housing needs, social housing or affordable housing.</p>
              <p>•	Amounts will be transferred from the Housing Australia Future Fund Special Account to the Housing Australia Special Account for the purposes of enabling Housing Australia to make grants and loans in relation to acute housing needs, social housing or affordable housing.</p>

        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-aboriginal-person">Aboriginal person</term> has the same meaning as <def>in <ref href="">the Aboriginal and Torres Strait Islander Act 2005</ref>.</def></p>
            <p><term refersTo="#term-acquire">acquire</term> includes <def>acquire by way of issue.</def></p>
            <p><term refersTo="#term-agency">Agency</term> means <def>the Future Fund Management Agency.</def></p>
            <p><term refersTo="#term-appropriation-act">Appropriation Act</term> means <def>an Act appropriating money for expenditure out of the Consolidated Revenue Fund.</def></p>
            <p><term refersTo="#term-asset">asset</term> has the same meaning as <def>in <ref href="">the Future Fund Act 2006</ref>.</def></p>
            <p><term refersTo="#term-balance-of-the-housing-australia-future-fund">balance of the Housing Australia Future Fund</term> means <def>the sum of: amounts standing to the credit of the Housing Australia Future Fund Special Account; and the value of investments of the Housing Australia Future Fund.</def></p>

              <p><b><i>business entity</i></b> means:</p>

              <p>a company; or</p>
            </content>
          </paragraph>

              <p><term refersTo="#term-constitutional-corporation">constitutional corporation</term> means <def>a corporation to which paragraph 51(xx) of the Constitution applies.</def></p>
              <p><term refersTo="#term-de-facto-partner-of-a-person">de facto partner of a person</term> has the meaning given by <def><ref href="">the Acts Interpretation Act 1901</ref>.</def></p>
              <p><term refersTo="#term-derivative">derivative</term> means <def>a derivative (within the meaning of Chapter 7 of <ref href="">the Corporations Act 2001</ref>) that is a financial asset.</def></p>
              <p><term refersTo="#term-designated-annual-amount">designated annual amount</term> has the meaning given by <def><ref href="#sec-33B">section 33B</ref>.</def></p>
              <p><b><i>designated Minister </i></b>means:</p>

              <p>the Housing Minister; or</p>

              <p><b><i>family member</i></b> of a person means:</p>

              <p><term refersTo="#term-finance-department">Finance Department</term> means <def>the Department administered by the Finance Minister.</def></p>
              <p><term refersTo="#term-finance-minister">Finance Minister</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><term refersTo="#term-financial-asset">financial asset</term> has the same meaning as <def>in <ref href="">the Future Fund Act 2006</ref>.</def></p>
              <p><term refersTo="#term-future-fund-board">Future Fund Board</term> means <def>the Future Fund Board of Guardians established by <ref href="#sec-34">section 34</ref> of <ref href="">the Future Fund Act 2006</ref>.</def></p>
              <p><term refersTo="#term-future-fund-special-account">Future Fund Special Account</term> means <def>the Future Fund Special Account established by <ref href="#sec-12">section 12</ref> of <ref href="">the Future Fund Act 2006</ref>.</def></p>
              <p><term refersTo="#term-housing-australia-future-fund">Housing Australia Future Fund</term> means <def>the Housing Australia Future Fund established by <ref href="#sec-9">section 9</ref>.</def></p>
              <p><b><i>Housing Australia Future Fund investment function</i></b> of the Future Fund Board means:</p>

              <p><term refersTo="#term-housing-australia-future-fund-payments-special-account">Housing Australia Future Fund Payments Special Account</term> means <def>the Housing Australia Future Fund Payments Special Account established by <ref href="#sec-25">section 25</ref>.</def></p>
              <p><term refersTo="#term-housing-australia-future-fund-special-account">Housing Australia Future Fund Special Account</term> means <def>the Housing Australia Future Fund Special Account established by <ref href="#sec-10">section 10</ref>.</def></p>
              <p><term refersTo="#term-housing-australia-special-account">Housing Australia Special Account</term> means <def>the Housing Australia Special Account established by <ref href="#sec-47A">section 47A</ref> of <ref href="">the Housing Australia Act 2018</ref>.</def></p>
              <p><b><i>Housing Minister</i></b> means:</p>

              <p><role refersTo="#minister">the Minister</role> declared by the Prime Minister, by notifiable instrument, to be the Housing Minister for the purposes of this Act; or</p>

              <p>	(b)	if no declaration is in force under paragraph (a)—the Minister who administers the <i>Housing Australia</i><i> Act 2018</i>.</p>

              <p><term refersTo="#term-investment-manager">investment manager</term> means <def>a person or body (other than the Agency) who undertakes to do any or all of the following: invest amounts on behalf of the Future Fund Board; manage the investment of funds on behalf of the Future Fund Board; acquire derivatives on behalf of the Future Fund Board; manage derivatives on behalf of the Future Fund Board; enter into securities lending arrangements on behalf of the Future Fund Board; realise financial assets on behalf of the Future Fund Board; perform custodial functions in relation to the financial assets of the Future Fund Board.</def></p>

              <p>invest amounts on behalf of the Future Fund Board;</p>

            <content>
              <p><term refersTo="#term-investment-of-the-housing-australia-future-fund">investment of the Housing Australia Future Fund</term> means <def>a financial asset that, under a provision of this Act, is taken to be an investment of the Housing Australia Future Fund.</def></p>
              <p><term refersTo="#term-official-of-a-commonwealth-entity">official of a Commonwealth entity</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><term refersTo="#term-person">person</term> includes <def>a partnership.</def></p>
              <p><term refersTo="#term-realise">realise</term> includes <def>redeem or dispose of.</def></p>
              <p><b><i>responsible Ministers</i></b> means:</p>

              <p><b><i>stepchild</i></b>: without limiting who is a stepchild of another person for the purposes of this Act, a child of a de facto partner of the other person is the <b><i>stepchild</i></b> of the other person if the child would be the other person’s stepchild except that the other person is not legally married to the partner.</p>
              <p><term refersTo="#term-torres-strait-islander">Torres Strait Islander</term> has the same meaning as <def>in <ref href="">the Aboriginal and Torres Strait Islander Act 2005</ref>.</def></p>
              <p><term refersTo="#term-treasury-department">Treasury Department</term> means <def>the Department administered by the Treasurer.</def></p>
              <p><term refersTo="#term-value-of-an-investment-of-the-housing-australia-future-fund">value of an investment of the Housing Australia Future Fund</term> means <def>the market value of the investment. For this purpose, disregard anything that would prevent or restrict conversion of a financial asset to money.</def></p>
              <p><term refersTo="#term-veteran">veteran</term> has the same meaning as <def>in the Australian Veterans’ Recognition (Putting Veterans and Their Families First) Act 2019.</def></p>
              <p><b><i>Veterans</i></b><b><i>’</i></b><b><i> Affairs Minister</i></b> means the Minister who administers section 1 of the <i>Military Rehabilitation and Compensation Act 2004</i>.</p>

                <p>A grant under subsection (1) or (3) may be made by way of the reimbursement, or partial reimbursement, of costs or expenses.</p>

            <heading>Transfers from the Housing Australia Future Fund Special Account to the Housing Australia Future Fund Payments Special Account</heading>

                <p>If a designated Minister decides that one or more grants should be made under subsection 18(1) during a financial year beginning on or after <date date="2023-07-01">1 July 2023</date>, the designated Minister may, during the financial year, request the Finance Minister to transfer a specified amount (which must equal the total amount of the grants) from the Housing Australia Future Fund Special Account to the Housing Australia Future Fund Payments Special Account.</p>

                  <p>during a financial year, a designated Minister requests the Finance Minister under subsection (1) to transfer an amount from the Housing Australia Future Fund Special Account to the Housing Australia Future Fund Payments Special Account; and</p>

                <num>b</num>

                  <p>the Finance Minister is satisfied that the transfer will not:</p>

                  <p>if the financial year is the financial year beginning on <date date="2023-07-01">1 July 2023</date>—contravene section 36 (annual limit); or</p>

              <num>1</num>

                <p>If a designated Minister decides that a grant of financial assistance should be made to a State or Territory under subsection 18(3) during a financial year beginning on or after <date date="2023-07-01">1 July 2023</date>, the designated Minister may request the Finance Minister to transfer a specified amount (which must equal the amount of the grant) from the Housing Australia Future Fund Special Account to the Federation Reform Fund.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-4__sec-29__subsec-2">
              <num>2</num>
              <content>
                <p>If a designated Minister requests the Finance Minister under subsection (1) to transfer an amount from the Housing Australia Future Fund Special Account to the Federation Reform Fund, the Finance Minister must, by writing, direct that, on a specified day, a specified amount (which must equal the requested amount) is to be:</p>
              </content>

                <num>a</num>
                <content>
                  <p>debited from the Housing Australia Future Fund Special Account; and</p>
                </content>
              </paragraph>

                  <p>credited to the Federation Reform Fund.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-4__sec-29__subsec-3">

                <p>The direction must be expressed to be given in order to enable the amount to be debited from the Federation Reform Fund for the purpose of making the grant.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-4__sec-29__subsec-4">

              <content>
                <p>If the financial year is the financial year beginning on <date date="2023-07-01">1 July 2023</date>, the Finance Minister must not give a direction under subsection (2) if doing so would contravene section 36 (annual limit).</p>

                <p>If an amount has been credited under paragraph 29(2)(b) to the Federation Reform Fund for a purpose in relation to a grant of financial assistance to a State or Territory, the Treasurer must:</p>

                <content>
                  <p>ensure that the Federation Reform Fund is debited for the purposes of making the grant; and</p>
                </content>
              </paragraph>

                  <p>do so as soon as practicable after the amount has been credited.</p>

                <p>However, if the grant cannot be made, an amount equal to the credited amount is to be:</p>

            <num>1</num>
            <content>
              <p>	(1)	This section applies if, at the start of 1 June in a financial year beginning after 30 June 2024, the total amount (the <b><i>total debited amount</i></b>) that has been, or will be, debited from the Housing Australia Future Fund Special Account under sections 26, 29 and 33 during the financial year is less than the designated annual amount for the financial year.</p>

          </subsection>
          <subsection eId="part-4__sec-33A__subsec-2">
            <num>2</num>
            <content>
              <p>The Finance Minister must, in writing, direct that a specified amount (which must equal the designated annual amount for the financial year minus the total debited amount) is to be:</p>

              <num>a</num>
              <content>
                <p>debited from the Housing Australia Future Fund Special Account; and</p>
              </content>
            </paragraph>

                <p>credited to the Housing Australia Special Account;</p>
              </content>
              <content>
                <p>on a specified day before the end of the financial year.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-33A__subsec-3">
            <num>3</num>
            <content>
              <p>A direction under subsection (2) is not a legislative instrument.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-33A__subsec-4">
            <num>4</num>
            <content>
              <p>If the Finance Minister personally gives a direction under subsection (2), the Finance Minister must give a copy of the direction to the Housing Minister and the Treasurer.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-33A__subsec-5">
            <num>5</num>
            <content>
              <p>If a delegate of the Finance Minister gives a direction under subsection (2), the delegate must give a copy of the direction to the Treasury Department.</p>

        </section>

          <num>33B</num>
          <heading>Meaning of designated annual amount</heading>
          <content>
            <p>		The <b><i>designated annual amount</i></b> for a financial year is:</p>
          </content>
          <paragraph eId="part-4__sec-33B__para-a">
            <num>a</num>
            <content>
              <p>if a determination in force under <ref href="#sec-33C">section 33C</ref> specifies the amount applicable to the financial year—that amount; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-33B__para-b">
            <num>b</num>
            <content>
              <p>otherwise—$500 million.</p>
            </content>

          <num>33C</num>
          <heading>Determination of designated annual amount</heading>
          <subsection eId="part-4__sec-33C__subsec-1">
            <num>1</num>
            <content>
              <p>The responsible Ministers may, by legislative instrument, determine that, for the purposes of paragraph 33B(a), a specified amount is the designated annual amount for:</p>
            </content>
            <paragraph eId="part-4__sec-33C__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a specified financial year; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-33C__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a specified financial year and each subsequent financial year.</p>
              </content>

              <p>A determination under subsection (1) must not have the effect of reducing the designated annual amount for a financial year.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-33C__subsec-3">
            <num>3</num>
            <content>
              <p>A determination under subsection (1) may make provision for and in relation to the indexation of the designated annual amount for a financial year.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-33C__subsec-4">
            <num>4</num>
            <content>
              <p>A determination under subsection (1) must be made before the start of the first financial year to which the amount specified in the determination is applicable.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-33C__subsec-5">
            <num>5</num>
            <content>
              <p>In making a determination under subsection (1), the responsible Ministers must have regard to:</p>
            </content>
            <paragraph eId="part-4__sec-33C__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>the advice given by the Future Fund Board under <ref href="#sec-33D">section 33D</ref> in relation to the impact of the making of the determination on the ability of the Future Fund Board to comply with this Act and the Housing Australia Future Fund Investment Mandate; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-33C__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>such other matters (if any) as the responsible Ministers consider relevant.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-33C__subsec-6">
            <num>6</num>
            <content>
              <p>	(6)	If the responsible Ministers make a determination under subsection (1) (the <b><i>initial determination</i></b>), the responsible Ministers must ensure that a determination under subsection (1) is in force at all times after the initial determination is made.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-33C__subsec-7">
            <num>7</num>
            <content>
              <p>If the responsible Ministers vary a determination under subsection (1) to specify a different amount, the variation must be made before the start of the first financial year to which the varied amount is applicable.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-33D">
          <num>33D</num>
          <heading>Determination of designated annual amount—advice given by the Future Fund Board</heading>
          <subsection eId="part-4__sec-33D__subsec-1">
            <num>1</num>
            <content>
              <p>Before making a determination under subsection 33C(1), the responsible Ministers must give the Future Fund Board a written notice that:</p>
            </content>
            <paragraph eId="part-4__sec-33D__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>sets out a draft of the determination; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-33D__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>requires the Future Fund Board to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-33D__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>give advice to those Ministers about the impact of the making of the determination on the ability of the Future Fund Board to comply with this Act and the Housing Australia Future Fund Investment Mandate; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-33D__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>do so within the period specified in the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-33D__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>requires the Future Fund Board, in giving that advice, to have regard to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-33D__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the Housing Australia Future Fund Investment Mandate; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-33D__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>such other matters (if any) as are specified in the notice.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-33D__subsec-2">
            <num>2</num>
            <content>
              <p>The Future Fund Board must comply with a requirement in a notice under subsection (1).</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-33D__subsec-3">
            <num>3</num>
            <content>
              <p>A period specified under subparagraph (1)(b)(ii) must not be shorter than 60 days after the notice is given.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-33D__subsec-4">
            <num>4</num>
            <content>
              <p>A matter specified under subparagraph (1)(c)(ii) must not be inconsistent with:</p>
            </content>
            <paragraph eId="part-4__sec-33D__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-33D__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the Housing Australia Future Fund Investment Mandate.</p>

            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-33D__subsec-5">
            <num>5</num>
            <content>
              <p>Paragraph (1)(c) does not, by implication, limit the matters to which the Future Fund Board may have regard.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-33D__subsec-6">

              <p>The advice given by the Future Fund Board in accordance with subparagraph (1)(b)(i) must be tabled in each House of the Parliament with the relevant determination.</p>

          <heading>Indexation of designated annual amount</heading>

              <p>	(1)	At the start of each financial year (an <b><i>indexation year</i></b>) after the financial year ending on 30 June 2029, the designated annual amount is replaced by the amount worked out using the following formula:</p>
            </content>
          </subsection>

            <num>2</num>
            <content>
              <p>However, subsection (1) does not apply in relation to a financial year if a determination under subsection 33C(1) has been made in relation to that financial year or a previous financial year.</p>

              <p>	(3)	The <b><i>indexation factor</i></b> for an indexation year is the number worked out using the following formula:</p>

              <p>where:</p>
              <p><b><i>base quarter</i></b> means the last March quarter before the reference quarter.</p>
              <p><b><i>index number</i></b>, for a quarter, means the All Groups Consumer Price Index number (being the weighted average of the 8 capital cities) published by the Australian Statistician for that quarter.</p>
              <p><b><i>reference quarter</i></b> means the March quarter in the last year before the indexation year.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-33E__subsec-4">
            <num>4</num>
            <content>
              <p>An indexation factor is to be calculated to 3 decimal places (rounding up if the 4th decimal place is 5 or more).</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-33E__subsec-5">

              <p>Amounts worked out under subsection (1) are to be rounded to the nearest whole dollar (rounding 50 cents upwards).</p>

          <heading>Debits from the Housing Australia Special Account</heading>

              <p>If an amount has been credited under paragraph 33(4)(d) to the Housing Australia Special Account for a purpose in relation to a payment to Housing Australia, the Housing Minister must:</p>

                <p>ensure that the Housing Australia Special Account is debited for the purposes of making the payment; and</p>
              </content>
            </paragraph>

              <p>The main objects of the acquisition by the Future Fund Board of a financial asset as an investment of the Housing Australia Future Fund are to enhance the Commonwealth’s ability to transfer amounts in accordance with sections 26, 29, 33 and 33A.</p>

              <p>A return of capital, or any other financial distribution, relating to an investment of the Housing Australia Future Fund is to be credited to the Housing Australia Future Fund Special Account.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-40__subsec-3">
            <num>3</num>
            <content>
              <p>The Future Fund Board may realise an investment of the Housing Australia Future Fund.</p>
            </content>
          </subsection>

              <p>Upon realisation of an investment of the Housing Australia Future Fund, the proceeds of the investment are to be credited to the Housing Australia Future Fund Special Account.</p>

              <p>At any time before an investment of the Housing Australia Future Fund matures, the Future Fund Board may authorise the re-investment of the proceeds upon maturity in a financial asset investment with the same entity.           <heading>Housing Australia Future Fund Investment Mandate</heading>

              <p>The responsible Ministers may (subject to <ref href="#sec-43">section 43</ref>) give the Future Fund Board written directions about the performance of its Housing Australia Future Fund investment functions, and must give at least one such direction.</p>

                <p>the need to enhance the Commonwealth’s ability to make grants under <ref href="#sec-18">section 18</ref> and transfers under sections 33 and 33A; and</p>

              <num>c</num>
              <content>
                <p>such other matters as the responsible Ministers consider relevant.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-41__subsec-3">

              <p>	(3)	Directions under subsection (1) are to be known collectively as the <b><i>Housing Australia Future Fund</i></b><b><i> Investment Mandate</i></b>.</p>

              <p>Without limiting subsection (1), a direction under that subsection may set out the policies to be pursued by the Future Fund Board in relation to:</p>

              </content>
            </paragraph>

                <p>A policy relating to the allocation of financial assets must not be inconsistent with a policy relating to matters of risk and return.</p>
                <p>Relationship between directions and other provisions of this Act</p>
              </content>

          <heading>Obligation on Future Fund Board in performing investment functions</heading>

            <p>In performing its Housing Australia Future Fund investment function, the Future Fund Board must (subject to this Act and a direction under subsection 41(1)) seek to maximise the return earned on the Housing Australia Future Fund over the long term, consistent with international best practice for institutional investment.</p>
          </content>
        </section>
        <section eId="part-6__sec-43">
          <num>43</num>
          <heading>Limitation on Housing Australia Future Fund Investment Mandate</heading>
          <subsection eId="part-6__sec-43__subsec-1">
            <num>1</num>
            <content>
              <p>The responsible Ministers must not give a direction under subsection 41(1) that has the purpose, or has or is likely to have the effect, of directly or indirectly requiring the Future Fund Board to:</p>
            </content>
            <paragraph eId="part-6__sec-43__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>invest an amount standing to the credit of the Housing Australia Future Fund Special Account in a particular financial asset; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-43__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>acquire a particular derivative; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-43__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>allocate financial assets to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-43__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>a particular business entity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-43__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>a particular activity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-43__subsec-1__para-iii">

          <heading>Future Fund Board to be consulted on Housing Australia Future Fund Investment Mandate</heading>

              <p>Before giving the Future Fund Board a direction under subsection 41(1), the responsible Ministers must:</p>
            </content>
            <paragraph eId="part-6__sec-44__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>send a draft of the direction to the Future Fund Board; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-44__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>invite the Future Fund Board to make a submission to the responsible Ministers on the draft direction within a reasonable time limit specified by the responsible Ministers; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-44__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>consider any submission that is received from the Future Fund Board within that time limit.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-44__subsec-2">
            <num>2</num>
            <content>
              <p>Any submission made by the Future Fund Board on a draft direction in accordance with paragraph (1)(b) must be tabled in each House of the Parliament with the direction.</p>

          <heading>Compliance with Housing Australia Future Fund Investment Mandate</heading>

              <p>The Future Fund Board must take all reasonable steps to comply with the Housing Australia Future Fund Investment Mandate.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-45__subsec-2">
            <num>2</num>
            <content>
              <p>If the Future Fund Board becomes aware that it has failed to comply with the Housing Australia Future Fund Investment Mandate, the Board must give the responsible Ministers a written statement, as soon as practicable after becoming so aware:</p>
            </content>
            <paragraph eId="part-6__sec-45__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>informing the responsible Ministers of the failure to comply with the Investment Mandate; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-45__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>setting out the action that the Board proposes to take in order to comply with the Investment Mandate.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-45__subsec-3">
            <num>3</num>
            <content>
              <p>If the responsible Ministers are satisfied that the Future Fund Board has failed to comply with the Housing Australia Future Fund Investment Mandate, the responsible Ministers may, by written notice given to the Board, direct the Board:</p>
            </content>
            <paragraph eId="part-6__sec-45__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>to give the responsible Ministers, within a period specified in the notice, a written explanation for the failure to comply with the Investment Mandate; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-45__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>to take action specified in the notice, within a period specified in the notice, in order to comply with the Investment Mandate.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-45__subsec-4">
            <num>4</num>
            <content>
              <p>The Future Fund Board must comply with a direction under subsection (3).</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-45__subsec-5">

              <p>The Future Fund Board must not borrow money for a purpose in connection with the Housing Australia Future Fund unless the borrowing is authorised by subsection (2) or (3).</p>
            </content>
          </subsection>

            <content>
              <p>The Future Fund Board is authorised to borrow money for a purpose in connection with the Housing Australia Future Fund if:</p>
            </content>

                <p>the purpose of the borrowing is to enable the Board to cover settlement of a transaction for the acquisition of one or more financial assets; and</p>
              </content>
            </paragraph>

              <content>
                <p>at the time the relevant acquisition decision was made, it was likely that the borrowing would not be needed; and</p>
              </content>
            </paragraph>

                <p>the period of the borrowing does not exceed 7 days; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-47__subsec-2__para-d">

                <p>if the borrowing were to take place, the total amount borrowed by the Board would not exceed 10% of the balance of the Fund.</p>
              </content>
            </paragraph>
          </subsection>

              <p>The Future Fund Board is authorised to borrow money for a purpose in connection with the Housing Australia Future Fund if the borrowing takes place in such circumstances (if any) as are specified in the rules.</p>

        </section>

          <heading>Housing Australia Future Fund investment policies</heading>
          <subsection eId="part-6__sec-48__subsec-1">
            <num>1</num>
            <content>
              <p>The Future Fund Board must formulate written policies to be complied with by it in relation to the following matters in connection with the Housing Australia Future Fund:</p>
            </content>
            <paragraph eId="part-6__sec-48__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the investment strategy for the Fund;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-48__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>benchmarks and standards for assessing the performance of the Fund;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-48__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>risk management for the Fund;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-48__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>a matter relating to international best practice for institutional investment;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-48__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>a matter specified in the rules.</p>
              </content>

              <p>If there is a change in the Housing Australia Future Fund Investment Mandate, the Future Fund Board must review any relevant policies formulated under subsection (1).</p>

              <num>a</num>
              <content>
                <p>protecting the value of an investment of the Housing Australia Future Fund (other than a derivative); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-49__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>protecting the return on an investment of the Housing Australia Future Fund (other than a derivative); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-49__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>achieving indirect exposure to financial assets (other than derivatives) for a purpose in connection with the Housing Australia Future Fund; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-49__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>achieving transactional efficiency for a purpose in connection with the Housing Australia Future Fund;</p>
              </content>
              <content>
                <p>but must not acquire a derivative for the purpose of speculation or leverage.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-49__subsec-2">
            <num>2</num>
            <content>
              <p>The acquisition of a derivative under subsection (1) of this section must be consistent with the investment strategy embodied in a policy formulated by the Future Fund Board under subsection 48(1).</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-49__subsec-3">
            <num>3</num>
            <content>
              <p>A derivative acquired under subsection (1) of this section is to be held in the name of the Future Fund Board.</p>
            </content>
          </subsection>

            <content>
              <p>A derivative acquired under subsection (1) is taken to be an investment of the Housing Australia Future Fund.</p>

            <p>An asset is taken to be an investment of the Housing Australia Future Fund if the Future Fund Board becomes the holder of the financial asset as a result of:</p>

              <p>the Board’s holding of an investment of the Fund; or</p>
            </content>
          </paragraph>

              <p>the exercise of any rights or powers conferred on the Board in its capacity as the holder of an investment of the Fund.</p>

          </paragraph>
        </section>

          <heading>Securities lending arrangements</heading>
          <subsection eId="part-6__sec-51__subsec-1">
            <num>1</num>
            <content>
              <p>The Future Fund Board may enter into securities lending arrangements for a purpose in connection with the Housing Australia Future Fund.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-51__subsec-2">
            <num>2</num>
            <content>
              <p>Any money received by the Future Fund Board under a securities lending arrangement entered into under subsection (1) is to be credited to the Housing Australia Future Fund Special Account.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-51__subsec-3">
            <num>3</num>
            <content>
              <p>To avoid doubt, a securities lending arrangement entered into under subsection (1) may provide for the Future Fund Board to realise an investment of the Housing Australia Future Fund.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-51__subsec-4">
            <num>4</num>
            <content>
              <p>A financial asset is taken to be an investment of the Housing Australia Future Fund if, as the result of the operation of a securities lending arrangement entered into under subsection (1), the Future Fund Board becomes the holder of the financial asset.</p>

          </subsection>
        </section>

          <num>52</num>
          <heading>Investment managers</heading>
          <subsection eId="part-6__sec-52__subsec-1">
            <num>1</num>
            <content>
              <p>The Future Fund Board may engage one or more investment managers for purposes in connection with the Housing Australia Future Fund.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-52__subsec-2">
            <num>2</num>
            <content>
              <p>The Future Fund Board must not:</p>
            </content>
            <paragraph eId="part-6__sec-52__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>invest amounts under subsection 39(1); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-52__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>acquire derivatives under subsection 49(1); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-52__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>enter into a securities lending arrangement under subsection 51(1); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-52__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>realise financial assets that are investments of the Housing Australia Future Fund;</p>
              </content>
              <content>
                <p>unless the Board does so:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-52__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>through an investment manager engaged by the Board under subsection (1) of this section; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-52__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>in a manner approved, in writing, by the responsible Ministers.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-52__subsec-3">
            <num>3</num>
            <content>
              <p>The Future Fund Board must ensure that any investment manager engaged by the Board under subsection (1) operates within this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-52__subsec-4">
            <num>4</num>
            <content>
              <p>The Future Fund Board must ensure that any investment manager engaged by the Board under subsection (1) reports to the Board and the Agency on the state of the investments of the Housing Australia Future Fund at such times and in such manner as the Board determines.</p>

          </subsection>
        </section>
        <section eId="part-6__sec-53">
          <num>53</num>
          <heading>Refund of franking credits</heading>
          <content>
            <p>		A refund of a tax offset under the <i>Income Tax Assessment Act 1997</i> is to be credited to the Housing Australia Future Fund Special Account if:</p>
          </content>
          <paragraph eId="part-6__sec-53__para-a">
            <num>a</num>
            <content>
              <p>the Future Fund Board receives the refund; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-6__sec-53__para-b">
            <num>b</num>
            <content>
              <p>the tax offset is attributable to an investment of the Housing Australia Future Fund.</p>
            </content>

                <p>an asset held by the Board as an investment of the Housing Australia Future Fund has ceased to be a financial asset; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-54__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an asset acquired by the Board, purportedly as an investment of the Housing Australia Future Fund, is not a financial asset.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-54__subsec-2">
            <num>2</num>
            <content>
              <p>The Future Fund Board must realise the asset as soon as practicable after the Board becomes aware of the fact.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-54__subsec-3">
            <num>3</num>
            <content>
              <p>This Act (other than this section) applies in relation to the asset (including in relation to the realisation of the asset) as if the asset had been a financial asset, and an investment of the Housing Australia Future Fund, from the time of its acquisition by the Future Fund Board until the realisation.</p>

              <p>The Housing Minister must cause reviews of the operation of this Act to be conducted.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-65__subsec-2">
            <num>2</num>
            <content>
              <p>A review must consider:</p>
            </content>
            <paragraph eId="part-8__sec-65__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the extent to which grants under <ref href="#sec-18">section 18</ref>, and transfers under sections 33 and 33A, have improved housing outcomes for Australians; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-65__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the extent to which the operation of this Act is meeting the needs of Australians in relation to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-65__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>acute housing needs; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-65__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>social housing; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-65__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>affordable housing;</p>
              </content>
              <content>
                <p>as the housing market evolves and economic parameters shift.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-65__subsec-3">
            <num>3</num>
            <content>
              <p>Subsection (2) does not limit subsection (1).</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-65__subsec-4">
            <num>4</num>
            <content>
              <p>Before causing a review to be conducted, the Housing Minister must consult the responsible Ministers.</p>
            </content>
            <content>
              <p>Report of review etc.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-65__subsec-5">
            <num>5</num>
            <content>
              <p>The person or persons who conduct a review must give the Housing Minister a written report of the review.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-65__subsec-6">
            <num>6</num>
            <content>
              <p>The Housing Minister must cause a copy of:</p>
            </content>
            <paragraph eId="part-8__sec-65__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>the terms of reference for the review; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-65__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>the report of the review;</p>
              </content>
              <content>
                <p>to be tabled in each House of the Parliament within 15 sitting days of that House after the report of the review is given to the Housing Minister.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-65__subsec-7">
            <num>7</num>
            <content>
              <p>The Housing Minister must cause a copy of:</p>
            </content>
            <paragraph eId="part-8__sec-65__subsec-7__para-a">
              <num>a</num>
              <content>
                <p>the terms of reference for the review; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-65__subsec-7__para-b">
              <num>b</num>
              <content>
                <p>the report of the review;</p>
              </content>
              <content>
                <p>to be published on the internet as soon as practicable after the earliest day on which a copy of the report of the review is tabled in a House of the Parliament.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-65__subsec-8">
            <num>8</num>
            <content>
              <p>The Housing Minister must give a copy of the report of the review to each of the responsible Ministers.</p>
            </content>
            <content>
              <p>Timing of reviews</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-65__subsec-9">
            <num>9</num>
            <content>
              <p>The first review must be completed by <date date="2026-12-31">31 December 2026</date>.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-65__subsec-10">
            <num>10</num>
            <content>
              <p>Each subsequent review must be completed within 5 years after the completion of the previous review.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-65__subsec-11">

            <content>
              <p>For the purposes of this section, a review is completed when the report of the review is given to the Housing Minister under subsection (5).</p>

          </subsection>

          <heading>Rules</heading>
          <subsection eId="part-8__sec-66__subsec-1">
            <num>1</num>
            <content>
              <p>The Finance Minister may, by legislative instrument, make rules prescribing matters:</p>
            </content>
            <paragraph eId="part-8__sec-66__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-66__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-66__subsec-2">
            <num>2</num>
            <content>
              <p>To avoid doubt, the rules may not do the following:</p>
            </content>
            <paragraph eId="part-8__sec-66__subsec-2__para-a">

                <p>create an offence or civil penalty;</p>
