              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Simplified outline of this Act</heading>
          <content>
            <p>This Act establishes the National Housing Supply and Affordability Council as an independent advisory body to the Commonwealth Government on matters relating to housing supply and affordability.</p>

          <heading>Object</heading>
          <content>
            <p>The object of this Act is to establish an independent advisory body to advise the Commonwealth Government on matters relating to housing supply and affordability.</p>
          </content>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-appointed-member">appointed member</term> means <def>a member other than the member that is a Deputy Secretary.</def></p>
            <p><term refersTo="#term-chair">Chair</term> means <def>the Chair of the National Housing Supply and Affordability Council.</def></p>
            <p><term refersTo="#term-deputy-chair">Deputy Chair</term> means <def>the Deputy Chair of the National Housing Supply and Affordability Council.</def></p>
            <p><term refersTo="#term-deputy-secretary">Deputy Secretary</term> means <def>a Deputy Secretary of the Department.</def></p>
            <p><term refersTo="#term-member">member</term> means <def>a member of the National Housing Supply and Affordability Council and includes: the Chair; and the Deputy Chair; and the Deputy Secretary who is primarily responsible for housing policy matters.</def></p>

        <heading>The National Housing Supply and Affordability Council</heading>
        <section eId="part-2__sec-6">
          <num>6</num>
          <heading>Simplified outline of this Part</heading>
          <content>
            <p>The National Housing Supply and Affordability Council is established as an independent advisory body.</p>
            <p>The Council’s functions include:</p>
          </content>
          <paragraph eId="part-2__sec-6__para-a">
            <num>a</num>
            <content>
              <p>reporting to <role refersTo="#minister">the Minister</role> on matters relating to housing supply and affordability, on the Council’s own initiative and on request by <role refersTo="#minister">the Minister</role>; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-6__para-b">
            <num>b</num>
            <content>
              <p>advising <role refersTo="#minister">the Minister</role>, as requested, on matters relating to housing supply and affordability, including matters being considered at intergovernmental forums involving the Commonwealth; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-6__para-c">
            <num>c</num>
            <content>
              <p>	(c)	advising the Minister in relation to the total amount of grants of financial assistance to be made under the <i>Housing Australia Future Fund Act 2023</i>,<i> </i>and the total amount of payments to be made under paragraph 47C(1)(b) of the <i>Housing Australia Act 2018 </i>to Housing Australia, in a financial year.</p>

            <content>
              <p>The Council must annually report on its research into housing supply and affordability.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-7">
          <num>7</num>
          <heading>The National Housing Supply and Affordability Council</heading>
          <subsection eId="part-2__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>The National Housing Supply and Affordability Council is established by this section.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	For the purposes of paragraph (a) of the definition of <b><i>Department of State</i></b> in section 8 of the <i>Public Governance, Performance and Accountability Act 2013</i>, the National Housing Supply and Affordability Council is prescribed in relation to the Department.</p>

        </section>

          <num>8</num>
          <heading>Membership</heading>
          <content>
            <p>The National Housing Supply and Affordability Council consists of the following members:</p>
          </content>

            <num>a</num>
            <content>
              <p>the Chair;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-8__para-b">
            <num>b</num>
            <content>
              <p>the Deputy Chair;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-8__para-c">
            <num>c</num>
            <content>
              <p>the Deputy Secretary who is primarily responsible for housing policy matters;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-8__para-d">
            <num>d</num>
            <content>
              <p>at least 4 and no more than 7 other appointed members.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-9">
          <num>9</num>
          <heading>Functions</heading>
          <subsection eId="part-2__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p>The National Housing Supply and Affordability Council has the following functions:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>to report to <role refersTo="#minister">the Minister</role> on the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>any matters that the Council considers have the potential to materially impact housing supply and affordability;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>specific matters relating to housing supply and affordability, as requested by <role refersTo="#minister">the Minister</role>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to advise <role refersTo="#minister">the Minister</role>, as requested, on the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>matters relating to housing supply and affordability being considered at intergovernmental forums involving the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>specific matters relating to housing supply and affordability;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>	(c)	to advise the Minister in relation to the total amount of grants of financial assistance to be made under subsections 18(1) and (3) of the <i>Housing Australia Future Fund Act 2023 </i>in a financial year;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>	(d)	to advise the Minister in relation to the total amount of payments to be made under paragraph 47C(1)(b) of the <i>Housing Australia Act 2018 </i>to Housing Australia in a financial year;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>to undertake research on matters relating to housing supply and affordability for the purposes of giving reports referred to in paragraph (a) or advice referred to in paragraphs (b) to (d), including by:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>monitoring conditions in the housing system that impact housing supply and affordability, including in relation to home ownership, rental affordability, homelessness and the number of new social and affordable houses being built annually; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>working collaboratively with other Commonwealth bodies, State, Territory and local governments and other stakeholders in the housing system or homelessness sector to support the collection and publication of nationally consistent data on housing supply and affordability and on demand for affordable housing;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>any other function conferred by this Act or any other law of the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-g">
              <num>g</num>
              <content>
                <p>any other function that is incidental or conducive to the performance of any of the above functions.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting subsection (1), the Council may consider the following matters when performing its functions:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the performance of the housing system;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the need to build a strong evidence base to support advice on housing supply and affordability matters, including for the purposes of assessing the value for taxpayers of Commonwealth, State, Territory and local government investment in the housing system;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the impacts of the following on housing supply and affordability and on the demand for affordable housing:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>credit conditions;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>taxation;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>macro-prudential regulation;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-iv">
              <num>iv</num>
              <content>
                <p>rental market regulation;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-v">
              <num>v</num>
              <content>
                <p>other regulation of the housing system, such as in relation to land use, planning, zoning and building codes;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-vi">
              <num>vi</num>
              <content>
                <p>climate change;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-vii">
              <num>vii</num>
              <content>
                <p>demographic change;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-viii">
              <num>viii</num>
              <content>
                <p>socio-economic factors;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-ix">
              <num>ix</num>
              <content>
                <p>geographical location;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>the availability, quality and consistency of data on housing supply and affordability and on demand for affordable housing and how the data could be improved by:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>consulting widely with, and drawing on expertise from, other Commonwealth bodies, State, Territory and local governments and other stakeholders in the housing system or homelessness sector; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>building on the research of those bodies, governments and stakeholders and other bodies that undertake research into housing supply and affordability;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>the important role intergovernmental forums play in promoting cooperation between the Commonwealth and the States and Territories to improve housing supply and affordability, including cooperation to improve the availability, quality and consistency of data on housing supply and affordability and on demand for affordable housing;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>the need to improve housing outcomes for groups of people in need of housing (including groups experiencing or at particular risk of homelessness);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>the need to improve gender equality in housing outcomes;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-h">
              <num>h</num>
              <content>
                <p>the need to ensure climate resilience in housing supply.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-10">
          <num>10</num>
          <heading>Annual report</heading>
          <subsection eId="part-2__sec-10__subsec-1">
            <num>1</num>
            <content>
              <p>Each financial year, the National Housing Supply and Affordability Council must report to <role refersTo="#minister">the Minister</role> on the research into housing supply and affordability undertaken by the Council in that year.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-2">
            <num>2</num>
            <content>
              <p>A report under subsection (1) for a financial year must include:</p>
            </content>
            <paragraph eId="part-2__sec-10__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>an overview of the state of the housing system in the financial year, including the demand for, supply of and affordability of housing; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>an outline of the research undertaken by the Council in the financial year and any findings, conclusions or recommendations resulting from that research.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-3">
            <num>3</num>
            <content>
              <p>The report must be:</p>
            </content>
            <paragraph eId="part-2__sec-10__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>given to <role refersTo="#minister">the Minister</role> no later than 10 months after the end of the financial year; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>published on the Council’s website.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-11">
          <num>11</num>
          <heading>Minister may request reports and advice</heading>
          <subsection eId="part-2__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may request the National Housing Supply and Affordability Council:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>to undertake research and report on a specific matter relating to housing supply and affordability; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to advise on a specific matter relating to housing supply and affordability; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>to advise on a matter relating to housing supply and affordability being considered at an intergovernmental forum involving the Commonwealth.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may include in such a request terms of reference (including time frames) for the report or advice.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p>The Council must comply with such a request.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-4">
            <num>4</num>
            <content>
              <p>If such a request is made in writing, the request is not a legislative instrument.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-5">
            <num>5</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may withdraw or amend such a request at any time before the Council gives the report or advice to <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </subsection>
        </section>

          <num>12</num>
          <heading>Reports may be published</heading>
          <content>

              <p>The Chair of the National Housing Supply and Affordability Council must preside at all meetings at which the Chair is present.</p>

              <p>If the Chair is not present at a meeting but the Deputy Chair is present, the Deputy Chair must preside at the meeting.</p>

              <p>If neither the Chair nor the Deputy Chair is present at a meeting, the appointed members present must appoint one of themselves to preside at the meeting.</p>

          <heading>Quorum</heading>

              <p>At a meeting of the National Housing Supply and Affordability Council, a quorum is constituted by two-thirds of the number of appointed members.</p>

          </subsection>
          <subsection eId="part-3__sec-18__subsec-2">

            <content>
              <p>However, if:</p>
            </content>
            <paragraph eId="part-3__sec-18__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>	(a)	an appointed member is required by rules made for the purposes of <i>Public Governance, Performance and Accountability Act 2013</i> not to be present during the deliberations, or to take part in any decision, of the Council with respect to a particular matter; and<ref href="#sec-29">section 29</ref> of the </p>

                <p>when the appointed member leaves the meeting concerned there is no longer a quorum present;</p>

              <p>The person presiding at a meeting of the Council has a deliberative vote and, if the votes are equal, a casting vote.</p>

                  <p>during any period, or during all periods, when the Chair:</p>

                <p>An appointed member is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, the appointed member is to be paid the remuneration that is prescribed under subsection (4).</p>

            <heading>Terms and conditions</heading>

              <p>An appointed member holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by <role refersTo="#minister">the Minister</role>.</p>

            <heading>Disclosure of interests</heading>

                <p>	(1)	A disclosure by an appointed member under <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) must be made to the Minister.<ref href="#sec-29">section 29</ref> of the </p>

              <num>2</num>

                <p>Subsection (1) applies in addition to any rules made for the purposes of that section.</p>

            <heading>Resignation</heading>
            <subsection eId="part-4__dvs-2__sec-29__subsec-1">

                <p>An appointed member may resign the appointed member’s appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-29__subsec-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by <role refersTo="#minister">the Minister</role> or, if a later day is specified in the resignation, on that later day.</p>

            <heading>Termination of appointment</heading>
            <subsection eId="part-4__dvs-2__sec-30__subsec-1">
              <num>1</num>

                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of an appointed member:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-30__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>for misbehaviour; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-30__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if the appointed member is unable to perform the duties of the appointed member’s office because of physical or mental incapacity.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-30__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of an appointed member if:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-30__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the appointed member:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-30__subsec-2__para-i">

                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-30__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-30__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>compounds with the appointed member’s creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-30__subsec-2__para-iv">

                  <p>makes an assignment of the appointed member’s remuneration for the benefit of the appointed member’s creditors; or</p>

              <p>The Minister must cause a review of the effectiveness of this Act to be undertaken as soon as possible after <date date="2026-07-01">1 July 2026</date>.</p>

            <content>
              <p>The persons undertaking the review must give <role refersTo="#minister">the Minister</role> a written report of the review as soon as possible after the review is completed.</p>

            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a copy of the report of the review to be tabled in each House of the Parliament within 15 sitting days of that House after the report is given to <role refersTo="#minister">the Minister</role>.</p>
