          <p>		This Act is the <i>Health Insurance Amendment (</i><i>Professional Services Review Scheme</i><i>) </i><i>Act </i><i>2023</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

            <heading>Associate Director’s terms and conditions of appointment</heading>

                <p>An Associate Director holds office on a full-time or a part-time basis as specified in the instrument of appointment.</p>
              </content>
            </hcontainer>

              <num>2</num>
              <content>
                <p>An Associate Director holds office on such other terms and conditions (in respect of matters not provided for by this Act) as are determined in the instrument of appointment.</p>
              </content>

            <num>106ZFC</num>
            <heading>Outside employment</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-106ZFC__subclause-1">
              <num>1</num>
              <content>
                <p>A person who holds the office of an Associate Director on a full-time basis must not engage in any paid employment outside the duties of that office without <role refersTo="#minister">the Minister</role>’s written approval.</p>
              </content>
            </hcontainer>

              <num>2</num>
              <content>
                <p>A person who holds the office of an Associate Director on a part-time basis must not engage in any paid employment that, in <role refersTo="#minister">the Minister</role>’s opinion, conflicts with the proper performance of the Associate Director’s functions.</p>

            <num>106ZFD</num>
            <heading>Leave of absence</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-106ZFD__subclause-1">
              <num>1</num>
              <content>
                <p>If an Associate Director holds office on a full-time basis, the Associate Director has such recreational leave entitlements as are determined by the Remuneration Tribunal.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-106ZFD__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may grant an Associate Director leave of absence, other than recreational leave, on such terms and conditions as to remuneration or otherwise as <role refersTo="#minister">the Minister</role> determines in writing.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-106ZFE">
            <num>106ZFE</num>
            <heading>Resignation</heading>
            <content>
              <p>An Associate Director may resign by writing signed and delivered to <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-106ZFF">
            <num>106ZFF</num>
            <heading>Termination of an Associate Director’s appointment</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-106ZFF__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of an Associate Director:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-106ZFF__para-a">
              <num>a</num>
              <content>
                <p>for misbehaviour; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-106ZFF__para-b">
              <num>b</num>
              <content>
                <p>if the Associate Director is unable to perform the duties of the Associate Director’s office because of physical or mental incapacity.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-106ZFF__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may terminate an Associate Director’s appointment if the Associate Director:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-106ZFF__para-a">
              <num>a</num>
              <content>
                <p>becomes bankrupt, applies to take the benefit of any law for the relief of bankrupt or insolvent debtors, compounds with creditors or makes an assignment of remuneration for their benefit; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-106ZFF__para-b">
              <num>b</num>
              <content>
                <p>is appointed on a full-time basis and is absent from duty, except on leave of absence, for 14 consecutive days or for 28 days in any 12 months; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-106ZFF__para-c">
              <num>c</num>
              <content>
                <p>is appointed on a full-time basis and engages, except with <role refersTo="#minister">the Minister</role>’s approval, in paid employment outside the duties of the Associate Director’s office; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-106ZFF__para-d">
              <num>d</num>
              <content>
                <p>is appointed on a part-time basis and engages in paid employment that, in <role refersTo="#minister">the Minister</role>’s opinion, conflicts with the proper performance of the Associate Director’s duties.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-106ZFG">
            <num>106ZFG</num>
            <heading>Acting appointments</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> may appoint a person to act as an Associate Director:</p>
              <p>Note:	For rules that apply to acting appointments, see <i>Acts Interpretation Act 1901</i>.<ref href="#sec-33A">section 33A</ref> of the </p>
            </content>
            <paragraph eId="schedule-1__clause-106ZFG__para-a">
              <num>a</num>
              <content>
                <p>during a vacancy in the office of that Associate Director (whether or not an appointment has previously been made to the office); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-106ZFG__para-b">
              <num>b</num>
              <content>
                <p>during any period or during all periods when that Associate Director is absent from duty or from Australia or is, for any other reason, unable to perform the duties of the office.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-106ZFH">
            <num>106ZFH</num>
            <heading>Remuneration and allowances</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-106ZFH__subclause-1">
              <num>1</num>
              <content>
                <p>An Associate Director is to be paid such remuneration as is determined by the Remuneration Tribunal.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-106ZFH__subclause-2">
              <num>2</num>
              <content>
                <p>If no determination of that remuneration is in operation, an Associate Director is to be paid such remuneration as is specified in the regulations.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-106ZFH__subclause-3">
              <num>3</num>
              <content>
                <p>An Associate Director is to be paid such allowances as are specified in the regulations.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-106ZFH__subclause-4">
              <num>4</num>
              <content>
                <p>	(4)	This section has effect subject to the<i> Remuneration Tribunal Act 1973</i>.</p>

                <p>(1)	The amendments of sections 83, 84 and 85 of the <i>Health Insurance Act</i><i> 1973</i> made by Part 1 of this Schedule apply in relation to appointments made after the commencement of this Schedule.</p>
