          <p>		This Act is the <i>Migration Amendment</i> <i>(</i><i>Bridging Visa Conditions</i><i>)</i><i> Act </i><i>2023</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

                <p>	(a)	the first visa ceases to be in effect under subsection 82(3) because another Subclass 070 (Bridging (Removal Pending)) visa (the <b><i>second visa</i></b>) for the non-citizen comes into effect after the commencement of this subsection; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-b">
              <num>b</num>
              <content>
                <p>at the time the second visa was granted, there was no real prospect of the removal of the non-citizen from Australia becoming practicable in the reasonably foreseeable future.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-6">
              <num>6</num>
              <content>
                <p>	(6)	For the purposes of subparagraph (b)(ii) of the definition of <b><i>visa period</i></b> in subsection 5(1), the first visa is to be taken to have ceased to be in effect otherwise than under subsection 82(3).</p>

            <heading>At the end of section 73</heading>

              <p>Add:</p>
              <p>Note:	A bridging visa may be granted to an eligible non-citizen on application, or without an application, made by the eligible non-citizen (see <ref href="#sec-45">section 45</ref>).</p>

            <heading>Cessation by operation of law of certain bridging visas etc.</heading>

              <content>
                <p>This section applies if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-76A__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a non-citizen holds a Subclass 070 (Bridging (Removal Pending)) visa (the <b><i>first visa</i></b>) immediately before the commencement of this section; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76A__para-b">
              <num>b</num>
              <content>
                <p>the first visa was granted to the non-citizen without an application for the first visa being made by the non-citizen; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76A__para-c">
              <num>c</num>
              <content>
                <p>the first visa was granted during the period that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76A__para-i">
              <num>i</num>
              <content>
                <p>starts at the start of <date date="2023-11-08">8 November 2023</date>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76A__para-ii">
              <num>ii</num>
              <content>
                <p>ends immediately before the commencement of this section; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76A__para-d">
              <num>d</num>
              <content>
                <p>at the time the first visa was granted, there was no real prospect of the removal of the non-citizen from Australia becoming practicable in the reasonably foreseeable future.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-76A__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	Despite any other provision of this Act or the regulations,<i> </i>the first visa ceases to be in effect immediately after the commencement of this section.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	The visa period for the first visa ends when it ceases to be in effect under this subsection.</p>
              <p>Note:	The visa period for the second visa begins when it is taken to be granted.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-76A__subclause-3">
              <num>3</num>
              <content>
                <p>Despite any other provision of this Act or the regulations:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-76A__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the non-citizen is taken, immediately after the first visa ceases to be in effect under subsection (2), to have been granted another Subclass 070 (Bridging (Removal Pending)) visa (the <b><i>second visa</i></b>); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76A__para-b">
              <num>b</num>
              <content>
                <p>the second visa is taken to come into effect as soon as it is taken to be granted under paragraph (a) of this subsection.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-76A__subclause-4">
              <num>4</num>
              <content>
                <p>This Act and the regulations apply, after the commencement of this section, in relation to the second visa in the same way as they would apply in relation to a Subclass 070 (Bridging (Removal Pending)) visa granted under the regulations.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-76A__subclause-5">
              <num>5</num>
              <content>
                <p>Without limiting subsection (4), the following provisions of the regulations, as in force at the time the second visa is taken to be granted under paragraph (3)(a), apply in relation to the second visa:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-76A__para-a">
              <num>a</num>
              <content>
                <p>a provision specifying when a Subclass 070 (Bridging (Removal Pending)) visa is in effect;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76A__para-b">
              <num>b</num>
              <content>
                <p>a provision prescribing that a Subclass 070 (Bridging (Removal Pending)) visa permits the visa holder to remain in Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76A__para-c">
              <num>c</num>
              <content>
                <p>a provision specifying the mandatory conditions to which a Subclass 070 (Bridging (Removal Pending)) visa that is taken to be granted under paragraph (3)(a) is subject.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-76B">
            <num>76B</num>
            <heading>Offence relating to monitoring conditions of certain bridging visas</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-76B__subclause-1">
              <num>1</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-76B__para-a">
              <num>a</num>
              <content>
                <p>the person holds a Subclass 070 (Bridging (Removal Pending)) visa; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76B__para-b">
              <num>b</num>
              <content>
                <p>at the time the visa was granted, there was no real prospect of the removal of the person from Australia becoming practicable in the reasonably foreseeable future; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76B__para-c">
              <num>c</num>
              <content>
                <p>the visa is subject to a monitoring condition; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76B__para-d">
              <num>d</num>
              <content>
                <p>the person fails to comply with a requirement of the monitoring condition.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	Section 4K of the <i>Crimes Act 1914</i>, which deals with continuing and multiple offences, applies to this offence.</p>
              <p>Penalty:	<quantity refersTo="#custodialSentence">5 years imprisonment</quantity> or <quantity refersTo="#penaltyUnit">300 penalty units</quantity>, or both.</p>
              <p>Note:	A defendant bears an evidential burden in relation to the matter in this subsection (see subsection 13.3(3) of the <i>Criminal Code</i>).</p>
              <p><b><i>monitoring condition</i></b> is a mandatory condition that:</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-76B__subclause-2">
              <num>2</num>
              <content>
                <p>Subsection (1) does not apply if the person has a reasonable excuse.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-76B__subclause-4">
              <num>4</num>
              <content>
                <p>In this section:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-76B__para-a">
              <num>a</num>
              <content>
                <p>requires the holder of a Subclass 070 (Bridging (Removal Pending)) visa to do any of the following things:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76B__para-i">
              <num>i</num>
              <content>
                <p>to notify <role refersTo="#minister">the Minister</role> or Department of specified matters within a specified period or before or by a specified day;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76B__para-ii">
              <num>ii</num>
              <content>
                <p>to report at a specified time or times, and at a specified place or in a specified manner;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76B__para-iii">
              <num>iii</num>
              <content>
                <p>to attend at a specified place, on a specified day and at a specified time; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76B__para-b">
              <num>b</num>
              <content>
                <p>is not a prescribed condition.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-76C">
            <num>76C</num>
            <heading>Offence relating to requirement to remain at notified address</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-76C__subclause-1">
              <num>1</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-76C__para-a">
              <num>a</num>
              <content>
                <p>the person holds a Subclass 070 (Bridging (Removal Pending)) visa; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76C__para-b">
              <num>b</num>
              <content>
                <p>the visa is subject to a condition requiring the person to remain, between certain times of a day, at a particular address for the person for the day; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76C__para-c">
              <num>c</num>
              <content>
                <p>the person fails to comply with the requirement of the condition.</p>
              </content>
            </paragraph>
            <content>
              <p>Penalty:	<quantity refersTo="#custodialSentence">5 years imprisonment</quantity> or <quantity refersTo="#penaltyUnit">300 penalty units</quantity>, or both.</p>
              <p>Note:	A defendant bears an evidential burden in relation to the matter in this subsection (see subsection 13.3(3) of the <i>Criminal Code</i>).</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-76C__subclause-2">
              <num>2</num>
              <content>
                <p>Subsection (1) does not apply if the person has a reasonable excuse.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-76D">
            <num>76D</num>
            <heading>Offences relating to monitoring device and related monitoring equipment</heading>
            <content>
              <p>Requirement to wear monitoring device at all times</p>
              <p>Penalty:	<quantity refersTo="#custodialSentence">5 years imprisonment</quantity> or <quantity refersTo="#penaltyUnit">300 penalty units</quantity>, or both.</p>
              <p>Requirement to fit a monitoring device etc.</p>
              <p>Penalty:	<quantity refersTo="#custodialSentence">5 years imprisonment</quantity> or <quantity refersTo="#penaltyUnit">300 penalty units</quantity>, or both.</p>
              <p>Requirements relating to good working order of monitoring device etc.</p>
              <p>Penalty:	<quantity refersTo="#custodialSentence">5 years imprisonment</quantity> or <quantity refersTo="#penaltyUnit">300 penalty units</quantity>, or both.</p>
              <p>the person must notify an authorised officer of that as soon as practicable; and</p>
              <p>Note:	Section 4K of the <i>Crimes Act 1914</i>, which deals with continuing and multiple offences, applies to this offence.</p>
              <p>Penalty:	<quantity refersTo="#custodialSentence">5 years imprisonment</quantity> or <quantity refersTo="#penaltyUnit">300 penalty units</quantity>, or both.</p>
              <p>Exception</p>
              <p>Note:	A defendant bears an evidential burden in relation to the matter in this subsection (see subsection 13.3(3) of the <i>Criminal Code</i>).</p>
              <p>Definitions</p>
              <p><b><i>monitoring device</i></b> means any electronic device capable of being used to determine or monitor the location of a person or an object or the status of an object.</p>
              <p><b><i>related monitoring equipment</i></b>, for a monitoring device, means any electronic equipment necessary for operating the monitoring device.</p>

            <hcontainer name="subclause" eId="schedule-1__clause-76D__subclause-1">
              <num>1</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-76D__para-a">
              <num>a</num>
              <content>
                <p>the person holds a Subclass 070 (Bridging (Removal Pending)) visa; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76D__para-b">
              <num>b</num>
              <content>
                <p>the visa is subject to a condition requiring the person to wear a monitoring device at all times; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76D__para-c">
              <num>c</num>
              <content>
                <p>the person fails to comply with the requirement of the condition.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-76D__subclause-2">
              <num>2</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-76D__para-a">
              <num>a</num>
              <content>
                <p>the person holds a Subclass 070 (Bridging (Removal Pending)) visa; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76D__para-b">
              <num>b</num>
              <content>
                <p>the visa is subject to a condition requiring the person to allow an authorised officer to fit, install, repair or remove:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76D__para-i">
              <num>i</num>
              <content>
                <p>the person’s monitoring device; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76D__para-ii">
              <num>ii</num>
              <content>
                <p>any related monitoring equipment for the person’s monitoring device; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76D__para-c">
              <num>c</num>
              <content>
                <p>the person fails to comply with the requirement of the condition.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-76D__subclause-3">
              <num>3</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-76D__para-a">
              <num>a</num>
              <content>
                <p>the person holds a Subclass 070 (Bridging (Removal Pending)) visa; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76D__para-b">
              <num>b</num>
              <content>
                <p>the visa is subject to a condition requiring the person to take any specified steps, and any other reasonable steps, to ensure that the following remain in good working order:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76D__para-i">
              <num>i</num>
              <content>
                <p>the person’s monitoring device;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76D__para-ii">
              <num>ii</num>
              <content>
                <p>any related monitoring equipment for the person’s monitoring device; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76D__para-c">
              <num>c</num>
              <content>
                <p>the person fails to comply with the requirement of the condition.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-76D__subclause-4">
              <num>4</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-76D__para-a">
              <num>a</num>
              <content>
                <p>the person holds a Subclass 070 (Bridging (Removal Pending)) visa; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76D__para-b">
              <num>b</num>
              <content>
                <p>the visa is subject to a condition requiring that, if the person becomes aware that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76D__para-i">
              <num>i</num>
              <content>
                <p>the person’s monitoring device is not in good working order; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76D__para-ii">
              <num>ii</num>
              <content>
                <p>any related monitoring equipment for the person’s monitoring device is not in good working order;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76D__para-c">
              <num>c</num>
              <content>
                <p>the person fails to comply with the requirement of the condition.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-76D__subclause-6">
              <num>6</num>
              <content>
                <p>Subsections (1), (2), (3) and (4) do not apply if the person has a reasonable excuse.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-76D__subclause-7">
              <num>7</num>
              <content>

            <heading>Mandatory 1 year imprisonment for offences</heading>

              <p>If a person is convicted of an offence against <ref href="#sec-76B">section 76B</ref>, 76C or 76D, the court must impose a sentence of imprisonment of at least 1 year.</p>
            </content>

            <heading>Rules of natural justice do not apply to decision to grant certain bridging visas</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-76E__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	This section applies in relation to a decision to grant a non-citizen a Subclass 070 (Bridging (Removal Pending)) visa (the <b><i>first visa</i></b>) if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-76E__para-a">
              <num>a</num>
              <content>
                <p>the first visa is subject to one or more prescribed conditions; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76E__para-b">
              <num>b</num>
              <content>
                <p>at the time the first visa is granted, there is no real prospect of the removal of the non-citizen from Australia becoming practicable in the reasonably foreseeable future.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-76E__subclause-2">
              <num>2</num>
              <content>
                <p>For the avoidance of doubt, the rules of natural justice do not apply to the making of the decision.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-76E__subclause-3">
              <num>3</num>
              <content>
                <p>As soon as practicable after making the decision, <role refersTo="#minister">the Minister</role> must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-76E__para-a">
              <num>a</num>
              <content>
                <p>give the non-citizen, in the way that <role refersTo="#minister">the Minister</role> considers appropriate in the circumstances:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76E__para-i">
              <num>i</num>
              <content>
                <p>a written notice that sets out the decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76E__para-ii">
              <num>ii</num>
              <content>
                <p>any other prescribed information; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76E__para-b">
              <num>b</num>
              <content>
                <p>invite the person to make representations to <role refersTo="#minister">the Minister</role>, within the period and in the manner specified by <role refersTo="#minister">the Minister</role>, as to why the first visa should not be subject to one or more of the conditions prescribed for the purposes of paragraph (1)(a).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-76E__subclause-4">
              <num>4</num>
              <content>
                <p>	(4)	The Minister must grant the non-citizen another Subclass 070 (Bridging (Removal Pending)) visa (the <b><i>second visa</i></b>), under a prescribed provision of the regulations, that is not subject to any one or more of the conditions prescribed for the purposes of paragraph (1)(a) if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-76E__para-a">
              <num>a</num>
              <content>
                <p>the non-citizen makes representations in accordance with the invitation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-76E__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that the non-citizen does not pose a risk to the community.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	If <role refersTo="#minister">the Minister</role> grants the second visa, the first visa will cease to be in effect, and the visa period for the first visa will end, on the grant of the second visa (see subsections 68(4) and (5)).</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-76E__subclause-5">
              <num>5</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must give the non-citizen written notice of the decision and the reasons for the decision.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-5">
            <num>5</num>
            <heading>At the end of subsection 338(4)</heading>
            <content>
              <p>Add:</p>
              <p>; (c)	a decision to not grant a non-citizen a Subclass 070 (Bridging (Removal Pending)) visa under a provision of the regulations prescribed for the purposes of subsection 76E(4) that is not subject to any one or more of the conditions prescribed for the purposes of paragraph 76E(1)(a).</p>

                <p>Subclause (1) applies:</p>

                <p>If the holder does not comply with subclause (1), the holder must notify Immigration of the travel within 2 working days after departing on the travel.</p>

            <heading>The holder:</heading>
            <paragraph eId="schedule-2__clause-8615__para-a">
              <num>a</num>

                <p>must, within 5 working days of the grant, notify Immigration of the details of the holder’s association with, or membership of, any organisation (other than an organisation formed for a purpose of engaging in communications on governmental or political matters); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-8615__para-b">
              <num>b</num>
              <content>
                <p>must notify Immigration of any change in those details (including the beginning or end of any association or membership) within 2 working days after the change occurs.</p>
              </content>
            </paragraph>
            <content>
              <p>8616	(1)	The holder must notify Immigration of the details of any contact with the following within 2 working days after the contact occurs:</p>
            </content>
            <paragraph eId="schedule-2__clause-8615__para-a">
              <num>a</num>
              <content>
                <p>any individual, group or organisation that is alleged, or is known by the holder, to be engaging in criminal or other illegal activities;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-8615__para-b">
              <num>b</num>
              <content>
                <p>any individual, group or organisation that has previously engaged in, or has expressed an intention to engage in, criminal or other illegal activities.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-8615__subclause-2">
              <num>2</num>
              <content>
                <p>Subclause (1) does not apply to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-8615__para-a">
              <num>a</num>
              <content>
                <p>contact in the course of attending a therapeutic or rehabilitative service; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-8615__para-b">
              <num>b</num>
              <content>
                <p>contact in connection with legal proceedings or legal advice.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-8617">
            <num>8617</num>
            <heading>The holder must notify Immigration of each of the following matters within 5 working days after the matter occurs:</heading>
            <paragraph eId="schedule-2__clause-8617__para-a">
              <num>a</num>
              <content>
                <p>the holder receives, within any period of 30 days, an amount or amounts totalling AUD10 000 or more from one or more other persons;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-8617__para-b">
              <num>b</num>
              <content>
                <p>the holder transfers, within any period of 30 days, an amount or amounts totalling AUD10 000 or more to one or more other persons;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-8617__para-c">
              <num>c</num>
              <content>
                <p>the holder’s banking arrangements change.</p>
              </content>
            </paragraph>
            <content>
              <p>8618	(1)	If the holder incurs a debt or debts totalling AUD10 000 or more, the holder must notify Immigration within 5 working days after the holder incurs the debt or debts.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-2__clause-8617__subclause-2">
              <num>2</num>
              <content>
                <p>If the holder is declared bankrupt or otherwise experiences significant financial hardship, the holder must notify Immigration within 5 working days after the holder is so declared or the financial hardship begins, as the case may be.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-8617__subclause-3">
              <num>3</num>
              <content>
                <p>The holder must notify Immigration of any significant change in relation to the holder’s debts, bankruptcy or financial hardship within 5 working days after the change occurs.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-8619">
            <num>8619</num>
            <heading>The holder must, within 7 days after receiving an oral or written request from the Minister, provide evidence of the holder’s current financial circumstances.</heading>
            <content>
              <p>8620	(1)	The holder must, between 10 pm on one day and 6 am the next day or between such other times as are specified in writing by <role refersTo="#minister">the Minister</role>, remain at a notified address for the holder for those days.</p>
              <p><b><i>notified address</i></b> for a holder for a particular day or days means any of the following:</p>
              <p>8621	(1)	The holder must wear a monitoring device at all times.</p>
              <p>the holder must notify an authorised officer of that as soon as practicable.</p>
              <p><b><i>monitoring device</i></b> means any electronic device capable of being used to determine or monitor the location of a person or an object or the status of an object.</p>
              <p><b><i>related monitoring equipment</i></b>, for a monitoring device, means any electronic equipment necessary for operating the monitoring device.</p>
              <p>8622	(1)	If the holder has been convicted of an offence that involves a minor or any other vulnerable person, the holder must not perform any work, or participate in any regular organised activity, involving more than incidental contact with a minor or any other vulnerable person.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-2__clause-8619__subclause-2">
              <num>2</num>
              <content>
                <p>If <role refersTo="#minister">the Minister</role> specifies other times for the purposes of subclause (1), the times must not be more than 8 hours apart.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-8619__subclause-3">
              <num>3</num>
              <content>
                <p>In this clause:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-8619__para-a">
              <num>a</num>
              <content>
                <p>the address notified by the holder under condition 8513 or 8550;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-8619__para-b">
              <num>b</num>
              <content>
                <p>an address at which the holder stays regularly because of a close personal relationship with a person at that address, and which the holder has notified to Immigration for the purposes of this paragraph;</p>
              </content>
            </paragraph>

                <p>if, for the purposes of this paragraph, the holder notifies Immigration of an address for that day or those days no later than 12 pm on the day before that day or the earliest day of those days (as the case may be)—that address.</p>

              <num>2</num>
              <content>
                <p>The holder must allow an authorised officer to fit, install, repair or remove the following:</p>
              </content>

              <num>a</num>
              <content>
                <p>the holder’s monitoring device;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-8619__para-b">

                <p>any related monitoring equipment for the holder’s monitoring device.</p>

            </paragraph>

                <p>The holder must take any steps specified in writing by <role refersTo="#minister">the Minister</role>, and any other reasonable steps, to ensure that the following remain in good working order:</p>

              <num>a</num>
              <content>
                <p>the holder’s monitoring device;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-8619__para-b">

                <p>any related monitoring equipment for the holder’s monitoring device.</p>
              </content>
            </paragraph>

                <p>If the holder becomes aware that either of the following is not in good working order:</p>
              </content>

                <p>the holder’s monitoring device;</p>
              </content>
            </paragraph>

                <p>In this clause:</p>

                <p>Subclause (1) applies:</p>
              </content>

                <p>whether the work or activity is for reward or otherwise; and</p>

            <paragraph eId="schedule-2__clause-8619__para-b">

                <p>whether or not a working with children or vulnerable people check (however described) is required in relation to the work.</p>

            <heading>If the holder has been convicted of an offence that involves a minor or any other vulnerable person, the holder must not go within 200 metres of a school, childcare centre or day care centre.</heading>

            <heading>If the holder has been convicted of an offence involving violence or sexual assault, the holder must not contact, or attempt to contact, the victim of the offence or a member of the victim’s family.</heading>
