          <p>		This Act is the <i>Bankruptcy Amendment (Discharge from Bankruptcy)</i><i> Act </i><i>2023</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

        <heading>Schedules</heading>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

            <heading>Alteration of dates relating to statements of affairs and debtor’s petitions</heading>

            <num>3</num>
            <heading>Subsections 33A(1) and (2)</heading>
            <content>
              <p>Repeal the subsections, substitute:</p>
              <p>the Court may order that the debtor’s petition is to be treated for the purposes of sections 149 and 149A as having been accepted by the Official Receiver at a time before it was actually accepted.</p>
            </content>

              <num>1</num>
              <content>
                <p>If the Court is satisfied that a person believed on reasonable grounds that a statement of affairs that relates to the person’s bankruptcy was filed for the purposes of <ref href="#sec-54">section 54</ref>, 55, 56B, 56F or 57 at a time before it was actually filed, the Court may order that the statement of affairs is to be treated as having been filed at a time before it was actually filed.</p>
              </content>

              <num>2</num>

                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-3__para-a">
              <num>a</num>

                <p>the Court is satisfied that a person believed on reasonable grounds that a debtor’s petition that relates to the person’s bankruptcy had been presented before it was actually presented; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-b">
              <num>b</num>
              <content>
                <p>the debtor’s petition has been accepted by the Official Receiver;</p>
              </content>
            </paragraph>
          </hcontainer>

            <num>4</num>
            <heading>Subsection 33A(3)</heading>
            <content>
              <p>After “an order”, insert “under subsection (1) or (2)”.</p>

            <heading>After subsection 54(2)</heading>

                <p>If the Official Receiver accepts under subsection 57B(1) an updated statement of affairs filed in accordance with a notice under subsection 57B(3) for the purposes of paragraph (1)(a) or (2)(a) of this section, the bankrupt must give a copy of the statement to the trustee <quantity refersTo="#deadline">within 14 days</quantity> from the day the bankrupt receives notice of the acceptance.</p>

                <p>an updated statement of affairs has not been filed for the purposes of whichever of those paragraphs is applicable within the period specified in the notice.</p>

            <heading>Subsection 56F(1B)</heading>

                <p>an updated statement of affairs has not been filed for the purposes of whichever of those paragraphs is applicable within the period specified in the notice.</p>

            <heading>After Division 3 of Part IV</heading>

              <p>Insert:</p>

            <num>57B</num>
            <heading>Acceptance of statements of affairs by Official Receiver</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-57B__subclause-1">
              <num>1</num>
              <content>
                <p>The Official Receiver must either accept, or refuse to accept, a statement of affairs that is filed for the purposes of any of the following provisions (including an updated statement of affairs filed within the period specified for the purposes of paragraph (4)(c) in a notice under subsection (3)) <quantity refersTo="#deadline">within 14 days</quantity> from the day the statement of affairs is filed:</p>

              <num>a</num>
              <content>
                <p>subsection 54(1) or (2);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57B__para-b">
              <num>b</num>
              <content>
                <p>paragraph 55(2)(b);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57B__para-c">
              <num>c</num>
              <content>
                <p>paragraph 56B(3)(a) or (b);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57B__para-d">
              <num>d</num>
              <content>
                <p>paragraph 56F(1)(a) or (b);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57B__para-e">

            <content>
              <p>Note:	Subsections (6) and (7) provide certain exceptions to this rule.</p>
              <p>Note:	The Court may review an act done by the Official Receiver (see subsection 15(5) and <ref href="#sec-303">section 303</ref>).</p>
              <p>Note:	For variation of the notice (for example, to extend the period specified in the notice within which the updated statement may be filed), see subsection 33(3) of the <i>Acts Interpretation Act 1901</i>.</p>
              <p><b><i>filed</i></b> includes presented, lodged or given.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-57B__subclause-2">
              <num>2</num>
              <content>
                <p>The Official Receiver must accept the statement of affairs, unless the Official Receiver thinks that the statement of affairs is inadequate.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-57B__subclause-3">
              <num>3</num>
              <content>
                <p>The Official Receiver must give written notice of the decision under subsection (1) to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-57B__para-a">
              <num>a</num>
              <content>
                <p>for a statement of affairs filed for the purposes of subsection 54(1) or paragraph 55(2)(b), 56B(3)(a), 56F(1)(a) or 57(2)(a)—the person whose affairs the statement relates to; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57B__para-b">
              <num>b</num>
              <content>
                <p>for a statement of affairs filed for the purposes of subsection 54(2)—each of the joint debtors; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57B__para-c">
              <num>c</num>
              <content>
                <p>for a statement of affairs filed for the purposes of paragraph 56B(3)(b)—each of the petitioning members of the partnership; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57B__para-d">
              <num>d</num>
              <content>
                <p>for a statement of affairs filed for the purposes of paragraph 56F(1)(b)—the member, or each of the members, of the partnership who gave the statement of affairs; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57B__para-e">
              <num>e</num>
              <content>
                <p>for a statement of affairs filed for the purposes of paragraph 57(2)(b)—each of the petitioning debtors.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-57B__subclause-4">
              <num>4</num>
              <content>
                <p>If the Official Receiver refuses to accept the statement of affairs, the notice must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-57B__para-a">
              <num>a</num>
              <content>
                <p>specify the respects in which the Official Receiver thinks the statement of affairs is inadequate; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57B__para-b">
              <num>b</num>
              <content>
                <p>invite the person or persons to file an updated statement of affairs with the Official Receiver; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57B__para-c">
              <num>c</num>
              <content>
                <p>specify a period within which the updated statement may be filed, which must be at least 14 days from the day the notice is given.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-57B__subclause-5">
              <num>5</num>
              <content>
                <p>An updated statement of affairs filed within the period specified for the purposes of paragraph (4)(c) in a notice under subsection (3) is taken for all purposes:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-57B__para-a">
              <num>a</num>
              <content>
                <p>to have been filed for the purposes of the provision referred to in paragraph (1)(a), (b), (c), (d) or (e); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57B__para-b">
              <num>b</num>
              <content>
                <p>to replace the statement of affairs that the Official Receiver refused to accept.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-57B__subclause-6">
              <num>6</num>
              <content>
                <p>This section does not apply to a statement of affairs filed in connection with a debtor’s petition if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-57B__para-a">
              <num>a</num>
              <content>
                <p>subsection 55(3B) or 57(3B) applies in relation to the debtor’s petition; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57B__para-b">
              <num>b</num>
              <content>
                <p>subsection 56C(1) applies in relation to the debtor’s petition and the statement of affairs is not required to be filed under paragraph 56F(1)(a).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-57B__subclause-7">
              <num>7</num>
              <content>
                <p>This section (other than subsection (8)) ceases to apply to a statement of affairs filed in connection with a debtor’s petition if the Official Receiver rejects the debtor’s petition.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-57B__subclause-8">
              <num>8</num>
              <content>
                <p>Without limiting paragraph 12(1)(d), a report under that paragraph for a financial year must include the number of statements of affairs (including updated statements of affairs) filed with the Official Receiver during the financial year for which there is a failure to comply with subsection (1) of this section.</p>
              </content>
            </hcontainer>

                <p>In this section:</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-13">
            <num>13</num>
            <heading>Paragraph 77(1)(bb)</heading>
            <content>
              <p>Repeal the paragraph, substitute:</p>
              <p>advise <role refersTo="#trustee">the trustee</role> of any material change that occurred between the time the statement was filed and the later of the times mentioned in subparagraph (i) or (ii); and</p>
            </content>
            <paragraph eId="schedule-1__clause-13__para-bb">
              <num>bb</num>
              <content>
                <p>as soon as practicable after the later of the following times:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-i">
              <num>i</num>
              <content>
                <p>the time the bankrupt’s statement of affairs was accepted under subsection 57B(1);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-ii">
              <num>ii</num>
              <content>
                <p>the time the bankrupt became a bankrupt;</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-14">
            <num>14</num>
            <heading>Paragraph 77(1)(bc)</heading>
            <content>
              <p>Omit “occurred later”, substitute “occurs at or after the later of the times mentioned in subparagraph (bb)(i) or (ii)”.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-15">
            <num>15</num>
            <heading>Section 149</heading>
            <content>
              <p>Repeal the section, substitute:</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-149">
            <num>149</num>
            <heading>Automatic discharge</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-149__subclause-1">
              <num>1</num>
              <content>
                <p>A bankrupt is discharged from bankruptcy, by force of this subsection, at the end of the period of 3 years from whichever of the following dates is applicable:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-149__para-a">
              <num>a</num>
              <content>
                <p>for a bankruptcy because of a sequestration order—the date the statement of the bankrupt’s affairs accepted under subsection 57B(1) was filed;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-149__para-b">
              <num>b</num>
              <content>
                <p>for a bankruptcy because of a debtor’s petition (other than a bankruptcy to which paragraph (c) of this subsection applies)—the date the Official Receiver accepted the debtor’s petition;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-149__para-c">
              <num>c</num>
              <content>
                <p>for a bankruptcy, because of a debtor’s petition against a partnership, of a member of the partnership who did not join in presenting the petition—the date the statement of the bankrupt’s affairs accepted under subsection 57B(1) was filed.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-149__subclause-2">
              <num>2</num>
              <content>
                <p>Subsection (1) applies subject to <ref href="#sec-149A">section 149A</ref> (objection to discharge of bankruptcy).</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	See <i>Bankruptcy Amendment (Discharge from Bankruptcy) Act 2023</i> for provisions relating to the discharge from bankruptcy of persons that became bankrupt before the commencement of that Part.<ref href="#part-2">Part 2</ref> of Schedule 1 to the </p>

            <num>16</num>
            <heading>Subsection 149A(1)</heading>
            <content>

                <p>(7)	Subitem (8) applies if a thing done, or purportedly done, by or in relation to the person, or in relation to the bankruptcy,<i> </i>before commencement would, apart from this item, be wholly or partly invalid or ineffective only because the thing was done or purportedly done on the basis that the date on which the person filed his or her statement of affairs for the purposes of sections 149 and 149A of the <i>Bankruptcy Act 1966</i>, as in force at any time during the affected bankruptcy period, was the discharge reference date.</p>

                <p>Without limiting subitem (2), the thing done, or purportedly done, is taken for all purposes to be valid and effective, and to have always been valid and effective.</p>

                <p>For the purposes of applying this item in relation to civil or criminal proceedings, this item applies in relation to:</p>

                <p>civil and criminal proceedings instituted on or after commencement; and</p>
              </content>
            </paragraph>

                <p>civil proceedings, but not criminal proceedings, instituted before commencement, being proceedings that are concluded:</p>

            </paragraph>

            <heading>Court orders affecting the discharge reference date</heading>

              <content>
                <p>This item applies in relation to a person:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-32__para-a">
              <num>a</num>
              <content>
                <p>whose statement of affairs was accepted by the Official Receiver for filing before commencement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-32__para-b">
              <num>b</num>
              <content>
                <p>	(b)	who had not been discharged from bankruptcy by force of subsection 149(1) of the <i>Bankruptcy Act 1966</i> before commencement.</p>
              </content>
            </paragraph>

              <content>
                <p>(2)	Section 33A of the <i>Bankruptcy Act 1966</i>, as in force immediately before commencement, applies in relation to the bankrupt on and after commencement as if subsection (2) of that section, in addition to making an order of a kind mentioned in that subsection, also empowered the Court to determine that the person’s discharge reference date is to be treated as having been a date that is earlier than the date that would otherwise apply.</p>

            <heading>Entry of information on the National Personal Insolvency Index</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-33__subclause-1">

              <content>
                <p>This item applies if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-33__para-a">
              <num>a</num>
              <content>
                <p>before commencement, the Official Receiver accepted a statement of a debtor’s affairs for filing; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-33__para-b">
              <num>b</num>
              <content>
                <p>	(b)	regulations made under the <i>Bankruptcy Act 1966</i>, as in force at any time in the affected bankruptcy period, required the date on which the statement of affairs was filed with or given to the Official Receiver to be entered in the National Personal Insolvency Index.</p>
              </content>
            </paragraph>

                <p>By force of this subitem, those regulations are taken to apply, and always to have applied, in relation to the statement of affairs as if the date required to be entered were the discharge reference date for the bankruptcy.</p>

            <num>34</num>
            <heading>Compensation for acquisition of property</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-34__subclause-1">
              <num>1</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-34__para-a">
              <num>a</num>
              <content>
                <p>apart from this item, the operation of this Schedule would result in an acquisition of property (within the meaning of paragraph 51(xxxi) of the Constitution) from a person otherwise than on just terms (within the meaning of that paragraph); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-34__para-b">
              <num>b</num>
              <content>
                <p>the acquisition would be invalid because of paragraph 51(xxxi) of the Constitution;</p>
              </content>
            </paragraph>
            <content>
              <p>the Commonwealth is liable to pay a reasonable amount of compensation to the person.</p>

                <p>If the Commonwealth and the person do not agree on the amount of the compensation, the person may institute proceedings in the Federal Court of Australia for the recovery from the Commonwealth of such reasonable amount of compensation as the court determines.</p>
