            <heading>Object of this Act</heading>
            <content>
              <p>The object of this Act is to establish a National Occupational Respiratory Disease Registry that will record the incidence of occupational respiratory diseases in Australia and assist in preventing further worker exposure to respiratory disease-causing agents.</p>
            </content>

            <num>4</num>
            <heading>Simplified outline of this Act</heading>
            <content>
              <p>The Commonwealth is to establish the National Occupational Respiratory Disease Registry (<ref href="#sec-11">section 11</ref>).</p>
              <p>The National Registry is to include certain information in relation to individuals who have been diagnosed with, or are being treated for, an occupational respiratory disease (<ref href="#part-2">Part 2</ref>).</p>
              <p>The purposes of the National Registry (<ref href="#sec-13">section 13</ref>) relate to:</p>
            </content>
            <paragraph eId="part-1__dvs-1__sec-4__para-a">
              <num>a</num>
              <content>
                <p>providing access to information about occupational respiratory diseases; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__dvs-1__sec-4__para-b">
              <num>b</num>
              <content>
                <p>supporting the identification of industries, occupations, job tasks and workplaces where there is a risk of exposure to respiratory disease-causing agents; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__dvs-1__sec-4__para-c">
              <num>c</num>
              <content>
                <p>occupational respiratory disease matters more broadly.</p>
              </content>
              <content>
                <p>There are protections for sensitive information (<ref href="#part-3">Part 3</ref>).</p>
                <p>The Director-General of the CDC must publish an annual report including certain statistical information in relation to information included in the National Registry, and may publish or make available other reports in relation to information included in the National Registry (<ref href="#sec-26">section 26</ref>).</p>
                <p>Fees may be charged in relation to the disclosure of protected information in certain circumstances (<ref href="#sec-31">section 31</ref>).</p>
                <p>Certain matters are to be prescribed by rules made by <role refersTo="#minister">the Minister</role>, or determinations made by the Director-General of the CDC. The rules and determinations are disallowable legislative instruments (sections 12, 31 and 33).</p>

            <num>5</num>
            <heading>Act binds the Crown</heading>
            <content>
              <p>This Act binds the Crown in each of its capacities. However, it does not make the Crown liable to be prosecuted for an offence.</p>

            <heading>Act extends to external Territories</heading>
            <content>
              <p>This Act extends to every external Territory.</p>
            </content>

            <num>7</num>
            <heading>Concurrent operation of State and Territory laws</heading>
            <subsection eId="part-1__dvs-1__sec-7__subsec-1">
              <num>1</num>
              <content>
                <p>This Act does not exclude or limit the operation of a law of a State or Territory relating to the use, reporting or other disclosure of information concerning occupational respiratory diseases, to the extent that the law of the State or Territory is capable of operating concurrently with this Act.</p>
              </content>
            </subsection>
            <subsection eId="part-1__dvs-1__sec-7__subsec-2">
              <num>2</num>
              <content>
                <p>Without limiting subsection (1), this Act does not exclude or limit the concurrent operation of a law of a State or Territory to the extent that:</p>
              </content>
              <paragraph eId="part-1__dvs-1__sec-7__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the law makes an act or omission:</p>
                </content>
              </paragraph>
              <paragraph eId="part-1__dvs-1__sec-7__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>an offence; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-1__dvs-1__sec-7__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>subject to a civil penalty; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-1__dvs-1__sec-7__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>that (or any similar) act or omission is also:</p>
                </content>
              </paragraph>
              <paragraph eId="part-1__dvs-1__sec-7__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>an offence against a provision of this Act; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-1__dvs-1__sec-7__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>subject to a civil penalty under this Act.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-1__dvs-1__sec-7__subsec-3">
              <num>3</num>
              <content>
                <p>Subsection (2) applies even if the law of the State or Territory does any one or more of the following in relation to the offence or civil penalty:</p>
              </content>
              <paragraph eId="part-1__dvs-1__sec-7__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>provides for a penalty that differs from the penalty provided by this Act;</p>
                </content>
              </paragraph>
              <paragraph eId="part-1__dvs-1__sec-7__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>provides for fault elements that differ from the fault elements applicable to the offence or civil penalty provision created by this Act;</p>
                </content>
              </paragraph>
              <paragraph eId="part-1__dvs-1__sec-7__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>provides for defences or exceptions that differ from the defences or exceptions applicable to the offence or civil penalty provision created by this Act.</p>

          <heading>Interpretation</heading>
          <section eId="part-1__dvs-2__sec-8">
            <num>8</num>
            <heading>Definitions</heading>
            <content>
              <p>In this Act:</p>
              <p><term refersTo="#term-additional-notification-information">additional notification information</term> has the meaning given by <def>subsection 12(3).</def></p>
              <p><term refersTo="#term-approved-form">approved form</term> means <def>a form approved under <ref href="#sec-29">section 29</ref>.</def></p>
              <p><b><i>Australia</i></b>, when used in a geographical sense, includes every external Territory.</p>
              <p><term refersTo="#term-australian-centre-for-disease-control">Australian Centre for Disease Control</term> means <def>the Australian Centre for Disease Control established by <ref href="#sec-7">section 7</ref> of <ref href="">the Australian Centre for Disease Control Act 2025</ref>.</def></p>
              <p><term refersTo="#term-civil-penalty-provision">civil penalty provision</term> has the same meaning as <def>in the Regulatory Powers Act.</def></p>
              <p><term refersTo="#term-commercial-in-confidence">commercial-in-confidence</term> has the meaning given by <def><ref href="#sec-9">section 9</ref>.</def></p>
              <p><term refersTo="#term-commonwealth-authority">Commonwealth authority</term> means <def>a Commonwealth entity within the meaning of the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><term refersTo="#term-contracted-service-provider">contracted service provider</term> means <def>a person who is engaged under an agreement in force under <ref href="#sec-30">section 30</ref>.</def></p>
              <p><term refersTo="#term-director-general-of-the-cdc">Director-General of the CDC</term> means <def>the Director-General of the Australian Centre for Disease Control appointed under <ref href="#sec-10">section 10</ref> of <ref href="">the Australian Centre for Disease Control Act 2025</ref>.</def></p>
              <p><term refersTo="#term-enforcement-body">enforcement body</term> means <def>any of the following: the Australian Federal Police; 	(b)	the National Anti-Corruption Commissioner (within the meaning of the <i>National Anti</i><i>-</i><i>Corruption Commission Act 2022</i>); the Australian Crime Commission; the Office of the Director of Public Prosecutions.</def></p>

                <p>the Australian Federal Police;</p>

            </paragraph>

                <p><term refersTo="#term-enforcement-related-activity">enforcement related activity</term> has the same meaning as <def>in <ref href="">the Privacy Act 1988</ref>.</def></p>
                <p><term refersTo="#term-entity">entity</term> means <def>any of the following: a person; a partnership; any other unincorporated association or body; a trust; a part of another entity (under a previous application of this definition).</def></p>

                <p>a person;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__dvs-2__sec-8__para-b">

              <num>c</num>
              <content>
                <p>any other unincorporated association or body;</p>

                <p>a trust;</p>

            </paragraph>

                <p><term refersTo="#term-healthcare">healthcare</term> means <def>a health service <ref href="#sec-6__subsec-1">within the meaning of subsection 6(1)</ref> of <ref href="">the Privacy Act 1988</ref>.</def></p>
                <p><term refersTo="#term-minimum-notification-information">minimum notification information</term> has the meaning given by <def>subsection 12(2).</def></p>
                <p><term refersTo="#term-national-registry">National Registry</term> means <def>the National Occupational Respiratory Disease Registry established under <ref href="#sec-11">section 11</ref>.</def></p>
                <p><term refersTo="#term-non-prescribed-occupational-respiratory-disease">non-prescribed occupational respiratory disease</term> means <def>an occupational respiratory disease that is not a prescribed occupational respiratory disease.</def></p>
                <p><term refersTo="#term-occupational-respiratory-disease">occupational respiratory disease</term> means <def>a medical condition associated with an individual’s respiratory system that is likely to have been caused or exacerbated, in whole or in part, by the individual’s work or workplace.</def></p>
                <p><term refersTo="#term-personal-information">personal information</term> has the same meaning as <def>in <ref href="">the Privacy Act 1988</ref>.</def></p>
                <p><b><i>personal representative</i></b>, of an individual, means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__dvs-2__sec-8__para-a">
              <num>a</num>
              <content>
                <p>a parent or guardian of the individual, if the individual is incapable of managing the individual’s health affairs; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__dvs-2__sec-8__para-b">
              <num>b</num>
              <content>
                <p>a trustee of an estate of the individual, if the individual is under a legal disability; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__dvs-2__sec-8__para-c">
              <num>c</num>
              <content>
                <p>a person who holds an enduring power of attorney granted by the individual.</p>
              </content>
              <content>
                <p><term refersTo="#term-prescribed-medical-practitioner">prescribed medical practitioner</term> means <def>a medical practitioner of a kind prescribed by the rules.</def></p>
                <p><term refersTo="#term-prescribed-occupational-respiratory-disease">prescribed occupational respiratory disease</term> means <def>an occupational respiratory disease prescribed by the rules.</def></p>
                <p><term refersTo="#term-protected-information">protected information</term> means <def>personal information, workplace identifying information or information that is commercial-in-confidence, to the extent that the information is: included in the National Registry or obtained under, or in accordance with, this Act; or derived from a record of information that was included in the National Registry or was obtained under, or in accordance with, this Act; or derived from a disclosure or use of information that was included in the National Registry or was obtained under, or in accordance with, this Act.</def></p>

              <num>a</num>

                <p>included in the National Registry or obtained under, or in accordance with, this Act; or</p>
              </content>
            </paragraph>

                <p>derived from a record of information that was included in the National Registry or was obtained under, or in accordance with, this Act; or</p>
              </content>
            </paragraph>

                <p>derived from a disclosure or use of information that was included in the National Registry or was obtained under, or in accordance with, this Act.</p>

              <content>
                <p><term refersTo="#term-purposes-of-the-national-registry">purposes of the National Registry</term> means <def>the purposes set out in <ref href="#sec-13">section 13</ref>.</def></p>
                <p><term refersTo="#term-registration-authority">registration authority</term> means <def>an entity that is responsible under a law for registering members of a particular health profession.</def></p>
                <p><term refersTo="#term-regulatory-powers-act">Regulatory Powers Act</term> means <def>the Regulatory Powers (Standard Provisions) Act 2014.</def></p>
                <p><term refersTo="#term-relevant-state-or-territory-authority">relevant State or Territory authority</term> means <def>a State or Territory authority that: has functions in relation to, or that is responsible for or deals with, occupational health and safety in the State or Territory; or has functions in relation to, or that is responsible for or deals with, health in the State or Territory; or is prescribed by the rules. <b><i>r</i></b><b><i>esearch</i></b>: means research relating to occupational respiratory diseases; and includes research relating to the causes, incidence, prevalence, nature, extent and trends of occupational respiratory diseases.</def></p>

            </paragraph>

              <num>a</num>
              <content>
                <p>has functions in relation to, or that is responsible for or deals with, occupational health and safety in the State or Territory; or</p>

              <content>
                <p><term refersTo="#term-respiratory-disease-causing-agents">respiratory disease-causing agents</term> means <def>agents such as dusts, gases, fumes, vapours, mists, fungi and fibres that can cause or contribute to an occupational respiratory disease.</def></p>
                <p><term refersTo="#term-rules">rules</term> means <def>rules made under subsection 33(1).</def></p>
                <p><term refersTo="#term-state-or-territory-authority">State or Territory authority</term> has the same meaning as <def>in <ref href="">the Privacy Act 1988</ref>.</def></p>
                <p><term refersTo="#term-state-or-territory-health-minister">State or Territory Health Minister</term> means <def>the State or Territory Minister who is responsible, or principally responsible, for matters relating to health in the State or Territory.</def></p>
                <p><b><i>workplace identifying information</i></b>:</p>

            <heading>Meaning of commercial-in-confidence</heading>

              <p>		Information is <b><i>commercial</i></b><b><i>-</i></b><b><i>in</i></b><b><i>-</i></b><b><i>confidence</i></b> if a person demonstrates to the Minister that:</p>

              <p>The Commonwealth is to establish the National Occupational Respiratory Disease Registry (<ref href="#sec-11">section 11</ref>).</p>
              <p>The National Registry is to include certain information relating to individuals who have been diagnosed with, or are being treated for, an occupational respiratory disease (<ref href="#sec-12">section 12</ref>).</p>
              <p>The purposes of the National Registry (<ref href="#sec-13">section 13</ref>) relate to:</p>

                <p>providing access to information about occupational respiratory diseases; and</p>
              </content>
            </paragraph>

                <p>supporting the identification of industries, occupations, job tasks and workplaces where there is a risk of exposure to respiratory disease-causing agents; and</p>
              </content>
            </paragraph>

              <content>
                <p>occupational respiratory disease matters more broadly.</p>
              </content>
              <content>
                <p>A prescribed medical practitioner who has diagnosed an individual with an occupational respiratory disease may be authorised or required to notify the Director-General of the CDC of certain information in relation to the individual for inclusion in the National Registry. A prescribed medical practitioner who is treating an individual for an occupational respiratory disease may also notify the Director-General of the CDC of certain information in relation to the individual for inclusion in the National Registry (<ref href="#dvs-3">Division 3</ref>).</p>
                <p>The Director-General of the CDC may vary information included in the National Registry (<ref href="#dvs-4">Division 4</ref>).</p>

                <p>The Commonwealth must establish and keep a registry to be called the National Occupational Respiratory Disease Registry.</p>
              </content>
            </subsection>

                <p>The National Registry may be kept by electronic means.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-11__subsec-3">

                <p>Parts of the National Registry may be kept separate from each other, and be called different names.</p>
              </content>
            </subsection>

                <p>The National Registry is not a legislative instrument.</p>
              </content>
            </subsection>

            <heading>Contents of the National Registry</heading>
            <subsection eId="part-2__dvs-2__sec-12__subsec-1">
              <num>1</num>
              <content>
                <p>The National Registry may include the following information in relation to individuals who have been diagnosed with, or are being treated for, an occupational respiratory disease:</p>
              </content>

                <num>a</num>
                <content>
                  <p>minimum notification information;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>additional notification information;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>any other information that is relevant to the purposes of the National Registry and is determined by the Director-General of the CDC under subsection (4) for the purposes of this paragraph.</p>

              <num>2</num>
              <content>
                <p>	(2)	<b><i>M</i></b><b><i>inimum notification information</i></b> in relation to an individual who has been diagnosed with, or is being treated for, an occupational respiratory disease is information that is relevant to the purposes of the National Registry and is determined by the Director-General of the CDC under subsection (4) for the purposes of this subsection.</p>

              <num>3</num>
              <content>
                <p>	(3)	<b><i>Additional</i></b><b><i> notification information</i></b> in relation to an individual who has been diagnosed with, or is being treated for, an occupational respiratory disease is information (other than minimum notification information) that is relevant to the purposes of the National Registry and is determined by the Director-General of the CDC under subsection (4) for the purposes of this subsection.</p>

                <p>The Director-General of the CDC may, by legislative instrument, determine the following:</p>

            <heading>Purposes of the National Registry</heading>

                <p>The purposes of the National Registry are to facilitate the following:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>collecting, storing, analysing and publishing by electronic means information relating to the diagnosis and progression of occupational respiratory diseases in Australia;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>collecting, analysing and publishing statistics in relation to occupational respiratory diseases in Australia;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>providing statistics in relation to occupational respiratory diseases in Australia to States and Territories and to prescribed medical practitioners;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>for the benefit of the nation:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-1__para-i">

                  <p>monitoring the incidence of occupational respiratory diseases in Australia; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-1__para-ii">

                <content>
                  <p>taking preventative action;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-1__para-e">

                  <p>any activities that are incidental to the above purposes.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-13__subsec-2">

              <content>
                <p>The purposes of the National Registry also include to facilitate the following:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>supporting the identification of industries, occupations, job tasks and workplaces where there is a risk of exposure to respiratory disease-causing agents:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>to enable the application of timely and targeted interventions and prevention activities to reduce further worker exposure and disease; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>to assist with compliance and enforcement activities in relation to occupational health and safety matters;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>providing prescribed medical practitioners with access to information included in the National Registry in relation to an individual who has been diagnosed with an occupational respiratory disease for the purpose of providing healthcare to the individual in relation to the disease;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>monitoring the quality and effectiveness of policy and regulatory arrangements in relation to occupational respiratory diseases to inform and enhance policy development, programs and decision-making relating to the prevention of occupational respiratory diseases;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>planning, delivering and promoting healthcare and associated services in relation to occupational respiratory diseases;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>identifying individuals for inclusion in clinical trials or observational studies in relation to occupational respiratory diseases;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-2__para-f">
                <num>f</num>
                <content>
                  <p>research (<ref href="#sec-8">as defined in section 8</ref>);</p>
                </content>
              </paragraph>

            <heading>Notifying information about prescribed occupational respiratory diseases—diagnosing prescribed medical practitioner</heading>

              <p>Minimum notification information must be notified</p>
            </content>
            <subsection eId="part-2__dvs-3__sec-14__subsec-1">

                <p>If:</p>

                  <p>a prescribed medical practitioner diagnoses an individual with an occupational respiratory disease at or after the commencement of this Act; and</p>

                  <p>at the time the diagnosis is made, the occupational respiratory disease is a prescribed occupational respiratory disease;</p>
                </content>

                  <p>the prescribed medical practitioner must notify the Director-General of the CDC, in an approved form and by the time, or within the period, prescribed by the rules, of the minimum notification information in relation to the individual.</p>

                <p>A prescribed medical practitioner may correct or update information in relation to an individual under subsection (4) to make minor or technical changes (including to correct a minor error) without obtaining the individual’s consent. For any other changes, the prescribed medical practitioner must obtain the consent of the individual.</p>

            <heading>Notifying information about non-prescribed occupational respiratory diseases—diagnosing prescribed medical practitioner</heading>

                  <p>for the purpose of complying with a requirement under a law of a State or Territory, the medical practitioner is required to notify the Director-General of the CDC, in an approved form, of the diagnosis of that disease in relation to the individual;</p>

                  <p>the medical practitioner may, without obtaining the individual’s consent, notify the Director-General, in an approved form, of the minimum notification information in relation to the individual.</p>

              <num>4</num>
              <content>
                <p>A prescribed medical practitioner may correct or update information in relation to an individual under subsection (3) to make minor or technical changes (including to correct a minor error) without obtaining the individual’s consent. For any other changes, the prescribed medical practitioner must obtain the consent of the individual.</p>

                <p>If a prescribed medical practitioner has notified the Director-General of the CDC of the minimum notification information in relation to an individual under <ref href="#sec-14">section 14</ref>, 15, 16 or 17, the Director-General, or a contracted service provider, may request, in writing, the individual to give the Director-General, or the contracted service provider, additional notification information in relation to the individual as specified in the request.</p>

        <heading>Dealing with information in the National Registry</heading>

          <num>20</num>
          <heading>Simplified outline of this Part</heading>
          <content>
            <p>Information may be collected for inclusion in the National Registry (subsection 21(1)).</p>
            <p>Personal information, workplace identifying information and information that is commercial-in-confidence that is included in the National Registry, or is derived from information included in the National Registry, is protected information.</p>
            <p>Recording, disclosure and use of protected information is authorised in specific circumstances, including for the purposes of the National Registry, by prescribed medical practitioners and for research (sections 21 and 22).</p>
            <p>It is an offence for a person to make a record of, disclose or otherwise use protected information, without authorisation (<ref href="#sec-23">section 23</ref>).</p>
            <p>There are exceptions to the offence (sections 24 and 25).</p>
            <p>The Director-General of the CDC must publish an annual report including certain statistical information in relation to information included in the National Registry, and may publish or make available other reports in relation to information included in the National Registry (<ref href="#sec-26">section 26</ref>).</p>

              <num>a</num>

                <p>the person does so for the purposes of the National Registry and is:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-21__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>an officer or employee of the Commonwealth or a Commonwealth authority; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-21__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>engaged by the Commonwealth, or a Commonwealth authority, to perform work relating to the purposes of the National Registry; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-21__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>an officer or employee of a person referred to in subparagraph (ii), or engaged by a person referred to in subparagraph (ii) to perform work relating to the purposes of the National Registry; or</p>

                <p>the information is about a diagnosis, or the progression, of an occupational respiratory disease in relation to an individual;</p>

            </paragraph>

              <num>iii</num>
              <content>
                <p>the collection, recording, disclosure or use is for the purposes of providing healthcare to the individual in relation to the occupational respiratory disease; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-21__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>all of the following apply:</p>

            </paragraph>

                <p>the person is a prescribed medical practitioner;</p>

                <p>the person has diagnosed an individual with an occupational respiratory disease, or is treating an individual for an occupational respiratory disease;</p>

              <num>iii</num>
              <content>
                <p>the collection, recording, disclosure or use is for the purpose of checking whether information in relation to the individual is included in the National Registry; or</p>

                <p>the person does so for the purposes of performing the person’s functions or duties, or exercising the person’s powers, under this Act; or</p>

                <p>the collection, recording, disclosure or use is for the purposes of disclosing information to an enforcement body;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-21__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>the person reasonably believes that the information is reasonably necessary for, or directly related to, one or more enforcement related activities being conducted by, or on behalf of, the enforcement body; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-21__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>the information is disclosed to the person under this section, and the collection, recording, disclosure or use is for the purpose for which the information was disclosed to the person; or</p>
              </content>

              <num>h</num>
              <content>
                <p>the person does so for the purposes of court or tribunal proceedings, or in accordance with an order of a court or tribunal; or</p>

                <p>the person does so for the purposes of a coronial inquiry, or in accordance with an order of a coroner.</p>

              <p>However, the following information in relation to an individual must not be disclosed to a person under subsection (2) for the purposes of research:</p>

                <p>information that identifies, or could be used to identify, the most recent workplace, or the main workplace, where the individual was exposed to a respiratory disease-causing agent;</p>

              <num>b</num>
              <content>
                <p>information that identifies, or could be used to identify, the prescribed medical practitioner who notified information in relation to the individual under <ref href="#part-2">Part 2</ref>;</p>

              <num>c</num>
              <content>
                <p>any other kind of information that is prescribed by the rules.</p>

          <heading>Authorised dealings with information—Commonwealth authorities and State or Territory authorities</heading>

            <p>Commonwealth authorities</p>
          </content>
          <subsection eId="part-3__sec-22__subsec-1">

            <content>
              <p>The Director-General of the CDC, or a contracted service provider, may disclose any minimum notification information in relation to an individual that is included in the National Registry and is protected information:</p>
            </content>
            <paragraph eId="part-3__sec-22__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>to a Commonwealth authority prescribed by the rules; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>for purposes connected with the performance of functions, or the exercise of powers, of the Commonwealth authority.</p>
              </content>

              <p>The Director-General of the CDC, or a contracted service provider, may disclose to a relevant State or Territory authority, for a purpose referred to in paragraph 13(2)(a), (c), (d) or (f), any minimum notification information in relation to an individual that is included in the National Registry and is protected information if the individual:</p>

              <num>a</num>
              <content>
                <p>resides in the State or Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-3__para-b">

                <p>was exposed to a respiratory disease-causing agent in the State or Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-3__para-c">

                <p>was diagnosed with an occupational respiratory disease in the State or Territory.</p>

            <p>A person commits an offence if:</p>
          </content>

              <p>the person makes a record of, discloses or otherwise uses information; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-23__para-b">
            <num>b</num>
            <content>
              <p>the information is protected information; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-23__para-c">
            <num>c</num>
            <content>
              <p>the making of the record, disclosure or use, is not authorised by a provision of this Part.</p>
            </content>

          <heading>Exceptions relating to the person to whom the protected information relates</heading>

              <p>Section 23 does not apply to a person if:</p>

                <p>the person discloses protected information to the person to whom the information relates; or</p>

                <p>the person is the person to whom the protected information relates; or</p>
              </content>
            </paragraph>

                <p>the making of the record, disclosure or use of the protected information is in accordance with the express or implied consent of the person to whom the information relates.</p>

            </content>
          </paragraph>

              <p>The Director-General of the CDC must, as soon as practicable after 30 June in each year, publish a report including the following information:</p>
            </content>
            <paragraph eId="part-3__sec-26__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the number of notifications of each prescribed occupational respiratory disease made under <ref href="#dvs-3">Division 3</ref> of <ref href="#part-2">Part 2</ref> during the period of 12 months ending on that 30 June;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-26__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the number of notifications of each non-prescribed occupational respiratory disease made under <ref href="#dvs-3">Division 3</ref> of <ref href="#part-2">Part 2</ref> during the period of 12 months ending on that 30 June;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-26__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>aggregate information and statistics about the occupation, main job task, industry and State of residence of diagnosed individuals at the time they were exposed to respiratory disease-causing agents.</p>

              <p>The Director-General of the CDC may at any time, for the purposes of the National Registry:</p>
            </content>
            <paragraph eId="part-3__sec-26__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>prepare statistical reports at a national level relating to information that is:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-26__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>included in the National Registry; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-26__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>of a kind prescribed by the rules; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-26__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>make the reports available to relevant State or Territory authorities and prescribed medical practitioners.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-26__subsec-3">
            <num>3</num>
            <content>
              <p>The Director-General of the CDC may at any time, for the purposes of the National Registry, publish reports relating to information that is:</p>
            </content>
            <paragraph eId="part-3__sec-26__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>included in the National Registry; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-26__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>of a kind prescribed by the rules.</p>
              </content>
              <content>
                <p>The reports may include statistical and other information.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-26__subsec-4">
            <num>4</num>
            <content>
              <p>If protected information is to be published or otherwise made available under this section, the Director-General of the CDC must, before publishing the information or making it available, take such steps as are reasonable in the circumstances to ensure that the information is de-identified.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-26__subsec-5">
            <num>5</num>
            <content>
              <p>	(5)	For the purposes of subsection (4), information is <b><i>de</i></b><b><i>-</i></b><b><i>identified</i></b> if the information is no longer about:</p>
            </content>
            <paragraph eId="part-3__sec-26__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>an identifiable individual or an individual who is reasonably identifiable; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-26__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>an identified workplace, employer or business or a workplace, employer or business that is reasonably identifiable.</p>
              </content>
            </paragraph>
          </subsection>

              <p>If this Act commences on a day other than 1 July in a year, subsection (1) has effect in relation to the first report required to be published under that subsection as if each reference to the period of 12 months ending on that 30 June were a reference to the period starting on <date>the day this Act commences</date> and ending on that 30 June.</p>

            <p>The Director-General of the CDC may, in writing, approve a form for the purposes of a provision of this Act.</p>
          </content>
        </section>
        <section eId="part-4__sec-30">

          <heading>Agreements</heading>
          <content>
            <p>The Director-General of the CDC may, on behalf of the Commonwealth, engage a person under a written agreement to perform services for, or on behalf of, the Commonwealth in connection with functions of the Commonwealth or the Director-General under this Act.</p>
          </content>
        </section>
        <section eId="part-4__sec-31">
          <num>31</num>
          <heading>Fees</heading>
          <subsection eId="part-4__sec-31__subsec-1">
            <num>1</num>
            <content>
              <p>The Director-General of the CDC may, on behalf of the Commonwealth, charge a fee in relation to the disclosure of protected information to a person (other than a Commonwealth authority) under <ref href="#sec-21">section 21</ref> or 22 if the disclosure is made in response to a specific request by the person.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-31__subsec-2">
            <num>2</num>
            <content>
              <p>The amount of the fee that may be charged under subsection (1) is the amount:</p>
            </content>
            <paragraph eId="part-4__sec-31__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>determined by the Director-General of the CDC by legislative instrument; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-31__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>worked out in accordance with a method determined by the Director-General by legislative instrument.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-31__subsec-3">
            <num>3</num>
            <content>
              <p>A legislative instrument under paragraph (2)(a) or (b) may determine different amounts, or different methods for working out amounts (as the case may be), having regard to the form or manner in which protected information is disclosed.</p>

          </subsection>

            <num>4</num>
            <content>
              <p>A fee that is due and payable to the Commonwealth under subsection (1) may be recovered as a debt that is due to the Commonwealth by action in:</p>

                <p>the Federal Court of Australia; or</p>
              </content>
            </paragraph>

                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>

              <p>	(2)	Before making rules for the purposes of the definition of <b><i>prescribed occupational respiratory disease</i></b> in section 8, the Minister must:</p>

              <content>
                <p>consult the Director-General of the CDC; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-33__subsec-2__para-b">

                <p>consult the relevant State or Territory authorities of each State or Territory through the State or Territory Health Minister; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-33__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>have regard to the submissions (if any) made by the Director-General or a State or Territory Health Minister because of that consultation.</p>

              <p>To avoid doubt, the rules may not do the following:</p>

                <p>create an offence or civil penalty;</p>

                  <b>Editorial changes</b>
                </p>
                <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
                <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                  <b>Misdescribed amendments</b>
                </p>
                <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
                <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
