            <p>		This Act is the <i>Wage Justice for Early Childhood Education and Care Workers</i><i> </i><i>(</i><i>Special Account</i><i>)</i><i> Act </i><i>2024</i>.</p>

          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Objects</heading>
          <subsection eId="part-1__sec-3__subsec-1">
            <num>1</num>
            <content>
              <p>The object of this Act is to support remuneration increases for workers in the early childhood education and care sector, a sector that provides an essential service, in order to:</p>
            </content>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>address current workforce shortages by helping to attract and retain early childhood education and care workers; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>contribute to the ongoing professionalisation of the early childhood education and care sector; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>ensure that early childhood education and care remains accessible and affordable to families; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>encourage good faith bargaining and the making of enterprise agreements in the early childhood education and care sector.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-2">
            <num>2</num>
            <content>
              <p>Another object of this Act is to implement Australia’s international obligations under the Convention on the Rights of the Child done at New York on <date date="1989-11-20">20 November 1989</date>.</p>

          <num>4</num>
          <heading>Simplified outline of this Act</heading>
          <content>
            <p>This Act establishes the Wage Justice for Early Childhood Education and Care Workers Special Account to support remuneration increases for workers in the early childhood education and care sector.</p>
            <p>Amounts may be debited from the Account to make grants to approved providers to support those remuneration increases.</p>
          </content>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-account">Account</term> means <def>the Wage Justice for Early Childhood Education and Care Workers Special Account established by <ref href="#sec-8">section 8</ref>.</def></p>
            <p><term refersTo="#term-appropriation-act">Appropriation Act</term> means <def>an Act appropriating money for expenditure out of the Consolidated Revenue Fund.</def></p>
            <p><term refersTo="#term-approved-provider">approved provider</term> has the same meaning as <def>in the A New Tax System (Family Assistance) (Administration) Act 1999.</def></p>
            <p><term refersTo="#term-non-corporate-commonwealth-entity">non-corporate Commonwealth entity</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
            <p><term refersTo="#term-official">official</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
            <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>

          <num>6</num>
          <heading>Crown to be bound</heading>
          <subsection eId="part-1__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>This Act binds the Crown in each of its capacities.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>This Act does not make the Crown liable to be prosecuted for an offence.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-7">
          <num>7</num>
          <heading>Extension to external Territories</heading>
          <content>
            <p>This Act extends to every external Territory.</p>
          </content>

            <num>1</num>
            <content>
              <p>The Wage Justice for Early Childhood Education and Care Workers Special Account is established by this section.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	The Account is a special account for the purposes of the <i>Public Governance, Performance and Accountability Act 2013</i>.</p>

          <subsection eId="part-2__sec-8__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> is responsible for the Account.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-9">
          <num>9</num>
          <heading>Purpose of the Account</heading>
          <content>
            <p>The purpose of the Account is to make grants under <ref href="#sec-10">section 10</ref> to provide funding to support remuneration increases for workers in the early childhood education and care sector in order to facilitate access to quality early childhood education and care.</p>

        <heading>Grants</heading>
        <section eId="part-3__sec-10">
          <num>10</num>
          <heading>Grants</heading>
          <subsection eId="part-3__sec-10__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, on behalf of the Commonwealth, make a grant of financial assistance to a person or body (including a partnership) that is an approved provider, in relation to the remuneration of workers engaged by the provider.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-10__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting subsection (1), a grant under that subsection may be made by way of the reimbursement, or partial reimbursement, of costs or expenses.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-10__subsec-3">
            <num>3</num>
            <content>
              <p>Subsection (1) does not authorise the making of a loan.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-10__subsec-4">
            <num>4</num>
            <content>
              <p>A grant under subsection (1) must not be made to a person or body unless the person or body has applied for the grant.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-11">
          <num>11</num>
          <heading>Terms and conditions of grants</heading>
          <subsection eId="part-3__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>The terms and conditions of a grant made under <ref href="#sec-10">section 10</ref> must be set out in a written agreement between the Commonwealth and the recipient of the grant.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>The recipient must comply with the terms and conditions.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p>Without limiting subsection (1), the terms and conditions must:</p>
            </content>
            <paragraph eId="part-3__sec-11__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>include provisions to permit amounts paid to the recipient under the grant to be used in relation to the remuneration of workers within a class specified in the agreement for this purpose; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>include provisions to limit any increase in fees that may be charged by the recipient for providing early childhood education and care; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>provide for the circumstances in which the recipient must repay amounts to the Commonwealth.</p>
              </content>

                  <p>Note:	An amount repayable to the Commonwealth would be a debt due to the Commonwealth.</p>

              </authorialNote>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-4">
            <num>4</num>
            <content>
              <p>An agreement under subsection (1) is to be entered into, and may be varied and administered, by <role refersTo="#secretary">the Secretary</role> on behalf of the Commonwealth.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-12">
          <num>12</num>
          <heading>Application of this Act to approved providers that are not legal persons</heading>
          <subsection eId="part-3__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p>This Act applies to the following as if it were a person, but with the changes set out in this section:</p>
            </content>
            <paragraph eId="part-3__sec-12__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a partnership;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an unincorporated entity or body, other than a partnership.</p>
              </content>
              <content>
                <p>Partnerships</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-2">
            <num>2</num>
            <content>
              <p>An obligation that would otherwise be imposed on a partnership by this Act is imposed on each partner instead, but may be discharged by any of the partners.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-3">
            <num>3</num>
            <content>
              <p>A permission that would otherwise be conferred on a partnership by this Act is conferred on each partner instead, but may be exercised by any of the partners.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-4">
            <num>4</num>
            <content>
              <p>For the purposes of this Act, a change in the composition of a partnership does not affect the continuity of the partnership.</p>
            </content>
            <content>
              <p>Unincorporated entities</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-5">
            <num>5</num>
            <content>
              <p>An obligation that would otherwise be imposed by this Act on an unincorporated entity or body (other than a partnership) is imposed on each member of the entity or body’s governing body instead, but may be discharged by any of the members.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-6">
            <num>6</num>
            <content>
              <p>A permission that would otherwise be conferred on such an entity or body by this Act is conferred on each member of the entity or body’s governing body instead, but may be exercised by any of the members.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-13">
          <num>13</num>
          <heading>Conferral of powers on the Secretary</heading>
          <content>
            <p><role refersTo="#secretary">The Secretary</role> may exercise a power conferred on <role refersTo="#secretary">the Secretary</role> by an agreement under section 11.</p>

        </section>
        <section eId="part-3__sec-14">
          <num>14</num>
          <heading>Executive power of the Commonwealth</heading>
          <content>
            <p>This Part does not, by implication, limit the executive power of the Commonwealth.</p>
          </content>
        </section>
      </part>

        <num>4</num>
        <heading>Miscellaneous</heading>
        <section eId="part-4__sec-15">
          <num>15</num>
          <heading>Delegation by the Secretary</heading>
          <subsection eId="part-4__sec-15__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, by writing, delegate any or all of <role refersTo="#secretary">the Secretary</role>’s functions or powers under Part 3 to a person who:</p>
            </content>
            <paragraph eId="part-4__sec-15__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>is an official of a non-corporate Commonwealth entity; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-15__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>has the expertise appropriate to the function or power.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-15__subsec-2">
            <num>2</num>
            <content>
              <p>In performing functions, or exercising powers, under a delegation under subsection (1), the delegate must comply with any directions of <role refersTo="#secretary">the Secretary</role>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-16">
          <num>16</num>
          <heading>Transitional provision—funding agreements made under A New Tax System (Family Assistance) Act 1999</heading>
          <subsection eId="part-4__sec-16__subsec-1">
            <num>1</num>
            <content>
              <p>This section applies to a written agreement that is:</p>
            </content>
            <paragraph eId="part-4__sec-16__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	in effect under <i>A New Tax System (Family Assistance) Act 1999</i> immediately before 1 July 2025; and<ref href="#sec-85G">section 85G</ref>A of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-16__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>entered into under the program known as the ECEC Workforce Retention Payment program.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-16__subsec-2">
            <num>2</num>
            <content>
              <p>The written agreement has effect, on and after <date date="2025-07-01">1 July 2025</date>, as if it were a written agreement entered into for the purposes of section 11 of this Act for a grant under section 10 of this Act.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-17">
          <num>17</num>
          <heading>Sunset provision</heading>
          <content>
            <p>This Act ceases to have effect at the end of <date date="2028-06-30">30 June 2028</date>.</p>
          </content>
        </section>
        <section eId="part-4__sec-18">
          <num>18</num>
          <heading>Rules</heading>
          <subsection eId="part-4__sec-18__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
            </content>
            <paragraph eId="part-4__sec-18__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-18__subsec-2">
            <num>2</num>
            <content>
              <p>To avoid doubt, the rules may not do the following:</p>
            </content>
            <paragraph eId="part-4__sec-18__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>entry, search or seizure;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>impose a tax;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>directly amend the text of this Act.</p>
              </content>
