          <p>		This Act is the <i>Defence Trade Controls Amendment Act 2024</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

                <p>publish DSGL technology in Part 1 of the Defence and Strategic Goods List.</p>

            <num>2</num>
            <heading>Subsection 4(1)</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>Australian Military Sales Program item</i></b> means DSGL goods or DSGL technology specified in a determination in force under section 5AA.</p>
              <p><b><i>Australian </i></b><b><i>person</i></b> means:</p>
              <p><b><i>constitutional </i></b><b><i>DSGL</i></b><b><i> services</i></b>: see subsection 5B(2).</p>
              <p><b><i>constitutional supply</i></b>: see subsection 5B(1).</p>
              <p><b><i>covered security clearance</i></b> means a security clearance that:</p>
              <p><b><i>DSGL</i></b><b><i> goods</i></b> means goods within the scope of the Defence and Strategic Goods List, but does not include goods constituting technology, as defined in that list, that has been produced in the course of, or for the purposes of, fundamental research.</p>
              <p><b><i>DSGL</i></b><b><i> services</i></b> means the giving of assistance (including training) in relation to the design, development, engineering, manufacture, production, assembly, testing, repair, maintenance, modification, operation, demilitarisation, destruction, processing or use of DSGL goods that are, or DSGL technology that is, within the scope of Part 1 of the Defence and Strategic Goods List.</p>

              <num>a</num>
              <content>
                <p>the Commonwealth, a State or a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-b">
              <num>b</num>
              <content>
                <p>an authority of the Commonwealth, a State or a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-c">
              <num>c</num>
              <content>
                <p>an individual who is an Australian citizen; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-d">
              <num>d</num>
              <content>
                <p>an individual who is a permanent resident of Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-e">
              <num>e</num>
              <content>
                <p>a body corporate incorporated by or under a law of the Commonwealth or of a State or Territory.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-a">
              <num>a</num>
              <content>
                <p>is given:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-i">
              <num>i</num>
              <content>
                <p>by the Australian Government Security Vetting Agency or by another Commonwealth agency that is authorised or approved by the Commonwealth to issue security clearances; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-ii">
              <num>ii</num>
              <content>
                <p>by or on behalf of the Government of Canada, New Zealand, the United Kingdom or the United States of America, or an authority of any of those governments; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-b">
              <num>b</num>
              <content>
                <p>is of a kind prescribed by the regulations for the purposes of this definition.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-3">
            <num>3</num>
            <heading>Subsection 4(1) (definition of DSGL technology)</heading>
            <content>
              <p>Repeal the definition, substitute:</p>
              <p><b><i>DSGL</i></b><b><i> technology</i></b> means a thing that:</p>
            </content>
            <paragraph eId="schedule-1__clause-3__para-a">
              <num>a</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-i">
              <num>i</num>
              <content>
                <p>is technology, as defined in the Defence and Strategic Goods List, not including such technology that has been produced in the course of, or for the purposes of, fundamental research; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-ii">
              <num>ii</num>
              <content>
                <p>is software, as defined in that list; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-b">
              <num>b</num>
              <content>
                <p>is within the scope of that list.</p>
              </content>
            </paragraph>

          <hcontainer name="clause" eId="schedule-1__clause-4">
            <num>4</num>
            <heading>Subsection 4(1)</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>foreign </i></b><b><i>person</i></b> means a person other than an Australian person.</p>
              <p><b><i>fundamental research</i></b> means basic or applied research conducted in circumstances where the results of the research:</p>
              <p><b><i>permanent resident of Australia</i></b> means a person who is a permanent resident within the meaning of the <i>Australian Citizenship Act 2007</i>.</p>
              <p><b><i>relevant </i></b><b><i>DSGL</i></b><b><i> services</i></b>: see subsection 5C(2).</p>
              <p><b><i>relevant supply</i></b>: see subsection 5C(1).</p>

            <paragraph eId="schedule-1__clause-4__para-a">
              <num>a</num>
              <content>
                <p>are intended for public disclosure, or would ordinarily be published or shared broadly; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-4__para-b">
              <num>b</num>
              <content>
                <p>are not subject to any restrictions on disclosure (however imposed) for purposes connected with the security or defence of Australia or any foreign country.</p>
              </content>
            </paragraph>

            <heading>Australian Military Sales Program items</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine that specified DSGL goods or DSGL technology is an Australian Military Sales Program item.</p>

            <num>5B</num>
            <heading>Constitutional supplies and constitutional DSGL services</heading>
            <content>
              <p>Constitutional supplies</p>
              <p>Constitutional DSGL services</p>
              <p>Definitions</p>
              <p><b><i>constitutional corporation</i></b> means a corporation to which paragraph 51(xx) of the Constitution applies.</p>
              <p><b><i>constitutional trade or commerce</i></b> means trade or commerce:</p>

              <num>1</num>
              <content>
                <p>	(1)	A supply of DSGL goods or DSGL technology is a <b><i>constitutional supply</i></b> if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5B__para-a">
              <num>a</num>
              <content>
                <p>the supply is made by, or on behalf of, or to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-i">
              <num>i</num>
              <content>
                <p>a constitutional corporation; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-ii">
              <num>ii</num>
              <content>
                <p>a body corporate that is incorporated in a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-iii">
              <num>iii</num>
              <content>
                <p>	(iii)	a body corporate that is taken to be registered in a Territory under <i>Corporations Act 2001</i>; or<ref href="#sec-119A">section 119A</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-b">
              <num>b</num>
              <content>
                <p>the supply is made by, or on behalf of, or to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-i">
              <num>i</num>
              <content>
                <p>the government of a foreign country or of part of a foreign country; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-ii">
              <num>ii</num>
              <content>
                <p>an authority of the government of a foreign country; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-iii">
              <num>iii</num>
              <content>
                <p>an authority of the government of part of a foreign country; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-c">
              <num>c</num>
              <content>
                <p>the supply is made by or to an alien (within the meaning of paragraph 51(xix) of the Constitution); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-d">
              <num>d</num>
              <content>
                <p>the supply occurs wholly or partly outside Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-e">

                <p>	(2)	DSGL services are <b><i>constitutional </i></b><b><i>DSGL</i></b><b><i> services</i></b> if:</p>

              <num>a</num>
              <content>
                <p>the DSGL services are provided by, or on behalf of, or to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-i">
              <num>i</num>
              <content>
                <p>a constitutional corporation; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-ii">
              <num>ii</num>
              <content>
                <p>a body corporate that is incorporated in a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-iii">
              <num>iii</num>
              <content>
                <p>	(iii)	a body corporate that is taken to be registered in a Territory under <i>Corporations Act 2001</i>; or<ref href="#sec-119A">section 119A</ref> of the </p>

                <p>the DSGL services are provided by, or on behalf of, or to:</p>

                <p>the government of a foreign country or of part of a foreign country; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-ii">
              <num>ii</num>
              <content>
                <p>an authority of the government of a foreign country; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-iii">
              <num>iii</num>

                <p>an authority of the government of part of a foreign country; or</p>

                <p>the DSGL services are provided by or to an alien (within the meaning of paragraph 51(xix) of the Constitution); or</p>

                <p>the DSGL services are provided wholly or partly within a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-g">
              <num>g</num>
              <content>
                <p>the DSGL services are provided by way of a postal, telegraphic, telephonic or other like service (within the meaning of paragraph 51(v) of the Constitution).</p>
              </content>
            </paragraph>

              <content>
                <p>In this section:</p>
              </content>

            <paragraph eId="schedule-1__clause-5B__para-a">
              <num>a</num>

                <p>between Australia and places outside Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-b">
              <num>b</num>
              <content>
                <p>among the States; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5B__para-c">
              <num>c</num>
              <content>
                <p>within a Territory, between a State and a Territory or between 2 Territories.</p>
              </content>
            </paragraph>

            <num>5C</num>
            <heading>Relevant supplies and relevant DSGL services</heading>
            <content>

              <p>Excluded DSGL goods or DSGL technology</p>
              <p>Definitions</p>
              <p><b><i>place</i></b> includes:</p>
            </content>

              <num>1</num>
              <content>
                <p>	(1)	A supply of DSGL goods or DSGL technology is a <b><i>relevant supply</i></b> unless:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5C__para-a">
              <num>a</num>
              <content>
                <p>the supply is covered by subsection (1A), (1B) or (1C); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-b">
              <num>b</num>
              <content>
                <p>any requirements prescribed by the regulations for the purposes of this paragraph that apply in relation to the supply are satisfied.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-5C__subclause-1A">
              <num>1A</num>
              <content>
                <p>This subsection covers a supply of DSGL goods or DSGL technology if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5C__para-a">
              <num>a</num>
              <content>
                <p>the supply is to any of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-i">
              <num>i</num>
              <content>
                <p>an Australian person;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-ii">
              <num>ii</num>
              <content>
                <p>a citizen or permanent resident of the United Kingdom or United States of America;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-iii">
              <num>iii</num>
              <content>
                <p>a body corporate incorporated by or under a law of the United Kingdom or United States of America, or of part of either of those countries;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-iv">
              <num>iv</num>
              <content>
                <p>the Government of the United Kingdom or United States of America, or the government of part of either of those countries;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-v">
              <num>v</num>
              <content>
                <p>an authority of the Government of the United Kingdom or United States of America, or the government of part of either of those countries; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-b">
              <num>b</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-i">
              <num>i</num>
              <content>
                <p>the supply is to, or occurs wholly at, a place in Australia, the United Kingdom or the United States of America; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-ii">
              <num>ii</num>
              <content>
                <p>if the supply is the provision of access to DSGL technology—at the time of the provision of access, the person to whom the access is provided is in Australia, the United Kingdom or the United States of America; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-c">
              <num>c</num>
              <content>
                <p>the DSGL goods or DSGL technology is not:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-i">
              <num>i</num>
              <content>
                <p>an Australian Military Sales Program item; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-ii">
              <num>ii</num>
              <content>

                <p>the supply is made in accordance with an agreement or arrangement between Australia and one or more foreign countries, including an agreement, arrangement or understanding between a Minister and an official or authority of one or more foreign countries.</p>

                <p>This subsection covers a supply of DSGL technology if:</p>
              </content>

                <p>the supply is to any of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-i">
              <num>i</num>

                <p>a citizen or permanent resident of a foreign country that is specified in an instrument under subsection 15(4A);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-ii">
              <num>ii</num>
              <content>
                <p>a body corporate incorporated by or under a law of a foreign country that is specified in an instrument under that subsection; or of part of such a country;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-iii">
              <num>iii</num>
              <content>
                <p>the government of a foreign country that is specified in an instrument under that subsection, or of part of such a country;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-iv">
              <num>iv</num>
              <content>
                <p>an authority of the government of a foreign country that is specified in an instrument under that subsection, or the government of part of such a country; and</p>

            </paragraph>

                <p>any of the following applies:</p>

                <p>the supply occurs wholly at a place in Australia;</p>
              </content>
            </paragraph>

                <p>if the supply is the provision of access to DSGL technology—at the time of the provision of access, both the person providing the access and the person to whom the access is provided are in Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-c">
              <num>c</num>
              <content>
                <p>the DSGL goods or DSGL technology is not:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-i">
              <num>i</num>
              <content>
                <p>an Australian Military Sales Program item; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-ii">
              <num>ii</num>
              <content>
                <p>excluded by a determination in force under subsection (3).</p>
              </content>
            </paragraph>

                <p>	(2)	DSGL services are <b><i>relevant </i></b><b><i>DSGL</i></b><b><i> services</i></b> unless:</p>
              </content>

              <num>a</num>
              <content>
                <p>the provision of the DSGL services is covered by subsection (2A) or (2B); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-b">

              <content>
                <p>any requirements prescribed by the regulations for the purposes of this paragraph that apply in relation to the provision of the DSGL services are satisfied.</p>

            </paragraph>

              <content>
                <p>This subsection covers the provision of DSGL services if:</p>
              </content>
            </hcontainer>

                <p>the DSGL services are provided to any of the following:</p>

            </paragraph>

                <p>the DSGL services are received at a place in Australia, Canada, New Zealand, the United Kingdom or the United States of America; and</p>

                <p>the DSGL goods or DSGL technology to which the DSGL services relate is not:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-i">

                <p>an Australian Military Sales Program item; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5C__para-ii">
              <num>ii</num>

                <p>excluded by a determination in force under subsection (3).</p>

                <p>the supply is a relevant supply; and</p>

            </paragraph>

                <p>the supply is to an Australian Community member or a member of the United States Community; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-d">
              <num>d</num>
              <content>
                <p>the supply is for an activity referred to in Article 3(1)(a), (b), (c) or (d) of the Defense Trade Cooperation Treaty; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-e">
              <num>e</num>
              <content>
                <p>at the time of the supply, the original goods are listed in Part 1 of the Defense Trade Cooperation Munitions List; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-f">
              <num>f</num>
              <content>
                <p>at the time of the supply, the original goods are not listed in Part 2 of the Defense Trade Cooperation Munitions List.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-10A__subclause-6">
              <num>6</num>
              <content>
                <p>Subsection (1) does not apply if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10A__para-a">
              <num>a</num>
              <content>
                <p>the DSGL technology is supplied by or to a person who is a member of the Australian Defence Force, an APS employee, an employee of ASIO, an employee of ASIS, an employee of ASD, a member or special member of the Australian Federal Police or a member of the police force of a State or Territory; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-b">
              <num>b</num>
              <content>
                <p>the supply occurs in the course of the person’s duties as such a person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-c">
              <num>c</num>
              <content>
                <p>the DSGL technology is not:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-i">
              <num>i</num>
              <content>
                <p>an Australian Military Sales Program item; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-ii">
              <num>ii</num>
              <content>
                <p>specified in a determination in force under subsection 5C(3); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-iii">
              <num>iii</num>
              <content>
                <p>prescribed by the regulations for the purposes of this subparagraph.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-10A__subclause-7">
              <num>7</num>
              <content>
                <p>Subsection (1) does not apply if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10A__para-a">
              <num>a</num>
              <content>
                <p>the DSGL technology is supplied to a person who holds a covered security clearance; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-b">
              <num>b</num>
              <content>
                <p>the DSGL technology is not:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-i">
              <num>i</num>
              <content>
                <p>an Australian Military Sales Program item; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-ii">
              <num>ii</num>
              <content>
                <p>specified in a determination in force under subsection 5C(3); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-iii">
              <num>iii</num>
              <content>
                <p>prescribed by the regulations for the purposes of this subparagraph.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-10A__subclause-7A">
              <num>7A</num>
              <content>
                <p>Subsection (1) does not apply if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10A__para-a">
              <num>a</num>
              <content>
                <p>the DSGL technology is supplied to a person who is producing, or is to produce, one or more components of DSGL goods; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-b">
              <num>b</num>
              <content>
                <p>the supply is made in connection with the production of the components; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-c">
              <num>c</num>
              <content>
                <p>any requirements prescribed by the regulations for the purposes of this paragraph are satisfied.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-10A__subclause-8">
              <num>8</num>
              <content>
                <p>Subsection (1) does not apply in the circumstances prescribed by the regulations for the purposes of this subsection.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-10A__subclause-9">
              <num>9</num>
              <content>
                <p>In this section:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10A__para-a">
              <num>a</num>

                <p>a vehicle, vessel or aircraft; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-b">
              <num>b</num>
              <content>
                <p>an area of water; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10A__para-c">
              <num>c</num>
              <content>
                <p>a fixed or floating structure or installation of any kind.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-10B">
            <num>10B</num>
            <heading>Offence—certain supplies of DSGL goods or DSGL technology from outside Australia</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-10B__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	A person (the <b><i>supplier</i></b>) commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10B__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the supplier supplies (the <b><i>current supply</i></b>) DSGL goods, other than firearms, or DSGL technology to another person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-aa">
              <num>aa</num>
              <content>
                <p>the DSGL goods or DSGL technology is within the scope of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-i">
              <num>i</num>
              <content>
                <p>Part 1 of the Defence and Strategic Goods List; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-ii">
              <num>ii</num>
              <content>
                <p>the Sensitive List of Dual-use Goods and Technologies in Part 2 of the Defence and Strategic Goods List; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-iii">
              <num>iii</num>
              <content>
                <p>the Very Sensitive List of Dual-use Goods and Technologies in Part 2 of the Defence and Strategic Goods List; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-b">
              <num>b</num>
              <content>
                <p>the current supply is a constitutional supply; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-c">
              <num>c</num>
              <content>
                <p>the current supply is a relevant supply; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-d">
              <num>d</num>
              <content>
                <p>any of the following applies:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-i">
              <num>i</num>
              <content>
                <p>the current supply occurs wholly at a place outside Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-ii">
              <num>ii</num>
              <content>
                <p>the current supply is from a place outside Australia and is to a place outside Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-iii">
              <num>iii</num>
              <content>
                <p>if the current supply is the provision of access to DSGL technology—at the time of the provision of access, the supplier is outside Australia and the other person is outside Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-e">
              <num>e</num>
              <content>
                <p>	(e)	the supplier obtained the DSGL goods or DSGL technology as a direct or indirect result of the export or supply (the <b><i>earlier export or supply</i></b>) of the DSGL goods or DSGL technology:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-i">
              <num>i</num>
              <content>
                <p>from a place in Australia to a place outside Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-ii">
              <num>ii</num>
              <content>
                <p>if the earlier export or supply was the provision of access to DSGL technology—in circumstances where, at the time of the provision of access, the person providing access was in Australia and the person to whom access was provided was outside Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-f">
              <num>f</num>
              <content>
                <p>either of the following (whether or not obtained) was required in relation to the earlier export or supply:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-i">
              <num>i</num>
              <content>
                <p>	(i)	permission (however described) under regulations made under the <i>Customs Act 1901</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-ii">
              <num>ii</num>
              <content>
                <p>a permit given under <ref href="#sec-11">section 11</ref> of this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-g">
              <num>g</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-i">
              <num>i</num>
              <content>
                <p>the supplier does not hold a permit under <ref href="#sec-11">section 11</ref> authorising the current supply; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-ii">
              <num>ii</num>
              <content>
                <p>the current supply contravenes a condition of a permit that the supplier holds under <ref href="#sec-11">section 11</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-h">
              <num>h</num>
              <content>
                <p>there is no notice in force under subsection 14(1) in relation to the supplier and the current supply.</p>
              </content>
            </paragraph>
            <content>
              <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 10 years</quantity> or <quantity refersTo="#penaltyUnit">2,500 penalty units</quantity>, or both.</p>

                <p>if the supply is of incorporated goods—any of the original goods incorporated in the incorporated goods.</p>
              </content>
            </paragraph>

                <p>Subsection (1) does not apply if, in relation to the current supply:</p>

                <p>the DSGL goods or DSGL technology is supplied by or on behalf of a person or body to an officer or employee of the person or body; and</p>

              <content>
                <p>the officer or employee is:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-i">
              <num>i</num>
              <content>
                <p>an Australian citizen or permanent resident of Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-ii">
              <num>ii</num>
              <content>
                <p>a citizen or permanent resident of a foreign country that is specified in an instrument under subsection 15(4A); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-c">
              <num>c</num>
              <content>
                <p>the supply occurs in the course of the officer or employee’s duties as an officer or employee.</p>
              </content>
            </paragraph>

                <p>Subsection (1) does not apply if, in relation to the current supply:</p>

            <paragraph eId="schedule-1__clause-10B__para-ii">
              <num>ii</num>
              <content>
                <p>specified in a determination in force under subsection 5C(3); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-iii">
              <num>iii</num>
              <content>
                <p>prescribed by the regulations for the purposes of this subparagraph.</p>
              </content>
            </paragraph>

                <p>Subsection (1) does not apply if, in relation to the current supply:</p>
              </content>
            </hcontainer>

                <p>the DSGL goods or DSGL technology is supplied to a person who holds a covered security clearance; and</p>

                <p>specified in a determination in force under subsection 5C(3); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-iii">
              <num>iii</num>
              <content>
                <p>prescribed by the regulations for the purposes of this subparagraph.</p>
              </content>
            </paragraph>

                <p>Subsection (1) does not apply if the earlier export or supply, the current supply or any intervening supply of the DSGL goods or DSGL technology is to the person who originally produced the DSGL goods or DSGL technology.</p>

              <num>8B</num>
              <content>
                <p>Subsection (1) does not apply if:</p>
              </content>
            </hcontainer>

                <p>the DSGL goods or DSGL technology is within the scope of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-i">
              <num>i</num>
              <content>
                <p>the Sensitive List of Dual-use Goods and Technologies in Part 2 of the Defence and Strategic Goods List; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-ii">
              <num>ii</num>
              <content>
                <p>the Very Sensitive List of Dual-use Goods and Technologies in Part 2 of the Defence and Strategic Goods List; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-b">
              <num>b</num>
              <content>
                <p>any of the following applies:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-i">
              <num>i</num>

                <p>the current supply occurs wholly at a place in a foreign country that is specified in an instrument under subsection 15(4A);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-ii">
              <num>ii</num>
              <content>
                <p>the current supply is from or to a place in a foreign country that is specified in an instrument under subsection 15(4A);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-iii">
              <num>iii</num>
              <content>
                <p>if the current supply is the provision of access to DSGL technology—at the time of the provision of access, the supplier or the other person mentioned in paragraph (1)(a) is in a foreign country that is specified in an instrument under subsection 15(4A).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-10B__subclause-8C">
              <num>8C</num>
              <content>
                <p>Subsection (1) does not apply if a period prescribed by the regulations for the purposes of this subsection, in relation to DSGL goods or DSGL technology of that kind, has elapsed since the day the earlier export or supply was made.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-10B__subclause-8D">
              <num>8D</num>
              <content>
                <p>Subsection (1) does not apply if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10B__para-a">
              <num>a</num>
              <content>
                <p>the earlier export or supply was made in accordance with a permission or permit mentioned in paragraph (1)(f); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10B__para-b">
              <num>b</num>
              <content>
                <p>the permission or permit was granted before the commencement of this section.</p>
              </content>
            </paragraph>

                <p>Subsection (1) does not apply in the circumstances prescribed by the regulations for the purposes of this subsection.</p>

                <p>	(1)	A person (the <b><i>provider</i></b>) commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10C__para-a">
              <num>a</num>
              <content>
                <p>the provider provides DSGL services to another person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-b">
              <num>b</num>
              <content>
                <p>the other person is a foreign person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-c">
              <num>c</num>
              <content>
                <p>the DSGL services are constitutional DSGL services; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-d">
              <num>d</num>
              <content>
                <p>the DSGL services are relevant DSGL services; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-e">
              <num>e</num>
              <content>
                <p>the provider is an Australian person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-ea">
              <num>ea</num>
              <content>
                <p>the provider provides the DSGL services at or from a place outside Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-eb">
              <num>eb</num>
              <content>
                <p>the other person receives the DSGL services at a place outside Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-f">
              <num>f</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-i">
              <num>i</num>
              <content>
                <p>the provider does not hold a permit under <ref href="#sec-11">section 11</ref> authorising the provision of the DSGL services; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-ii">
              <num>ii</num>
              <content>
                <p>the provision of the DSGL services contravenes a condition of a permit that the provider holds under <ref href="#sec-11">section 11</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-g">
              <num>g</num>
              <content>
                <p>there is no notice in force under subsection 14(1) in relation to the provider and the provision of the DSGL services.</p>
              </content>
            </paragraph>
            <content>
              <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 10 years</quantity> or <quantity refersTo="#penaltyUnit">2,500 penalty units</quantity>, or both.</p>

                <p>the DSGL services are provided to an Australian Community member or a member of the United States Community; and</p>
              </content>
            </paragraph>

                <p>the DSGL services are for an activity referred to in Article 3(1)(a), (b), (c) or (d) of the Defense Trade Cooperation Treaty; and</p>

                <p>if the DSGL services are provided in relation to incorporated goods—any of the original goods incorporated in the incorporated goods; and</p>

                <p>the provision of the DSGL services occurs in the course of the officer or employee’s duties as an officer or employee.</p>

                <p>Subsection (1) does not apply if:</p>
              </content>
            </hcontainer>

                <p>the DSGL services are provided in support of a lawful supply of DSGL goods or DSGL technology; and</p>
              </content>
            </paragraph>

                <p>the DSGL services solely consist of training with respect to, or the performance of, maintenance relating to the DSGL goods or DSGL technology; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-c">
              <num>c</num>
              <content>
                <p>the maintenance covered by the training, or which is performed, is limited to inspection, testing, calibration or repair (including overhaul, reconditioning and one-to-one replacement of any defective items, parts or components); and</p>
              </content>
            </paragraph>

              <num>d</num>
              <content>
                <p>the maintenance covered by the training, or which is performed, does not include any modification, enhancement, upgrade or other form of alteration or improvement that:</p>

                <p>enhances the performance or capability of the DSGL goods or DSGL technology; and</p>
              </content>

                <p>is not only an alteration or improvement in relation to the reliability or maintainability of the DSGL goods or DSGL technology.</p>
              </content>
            </paragraph>

                <p>Subsection (1) does not apply if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10C__para-a">

                <p>the DSGL services are provided by or to a person who is a member of the Australian Defence Force, an APS employee, an employee of ASIO, an employee of ASIS, an employee of ASD, a member or special member of the Australian Federal Police or a member of the police force of a State or Territory; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-b">
              <num>b</num>
              <content>
                <p>the provision of the DSGL services occurs in the course of the person’s duties as such a person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-c">
              <num>c</num>
              <content>
                <p>the DSGL services are not provided in relation to DSGL goods or DSGL technology that is:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-i">
              <num>i</num>
              <content>
                <p>an Australian Military Sales Program item; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-ii">
              <num>ii</num>
              <content>
                <p>specified in a determination in force under subsection 5C(3); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-iii">
              <num>iii</num>
              <content>
                <p>prescribed by the regulations for the purposes of this subparagraph.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-10C__subclause-7">
              <num>7</num>
              <content>
                <p>Subsection (1) does not apply if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10C__para-a">
              <num>a</num>
              <content>
                <p>the DSGL services are provided to a person who holds a covered security clearance; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-b">
              <num>b</num>
              <content>
                <p>the DSGL services are not provided in relation to DSGL goods or DSGL technology that is:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-i">
              <num>i</num>
              <content>
                <p>an Australian Military Sales Program item; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-ii">
              <num>ii</num>
              <content>
                <p>specified in a determination in force under subsection 5C(3); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10C__para-iii">
              <num>iii</num>
              <content>
                <p>prescribed by the regulations for the purposes of this subparagraph.</p>
              </content>
            </paragraph>

                <p>Subsection (1) does not apply if:</p>
              </content>
            </hcontainer>

                <p>the DSGL services are provided in connection with a lawful supply of DSGL goods or DSGL technology that occurred before the commencement of this section; and</p>

                <p>the DSGL services are provided under a contract, agreement or arrangement entered into before the commencement of this section.</p>

                <p>the provision of constitutional DSGL services.</p>

                <p>Without limiting subsection (1), an application by a person under that subsection may do one or more of the following:</p>

                <p>cover 2 or more activities by the person;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-17__para-b">

                <p>cover one or more activities by the person for a period described in the application;</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-17__para-c">

                <p>	(2A)	An application by a person under subsection (1), that covers one or more activities by the person for one or more projects described in the application, may also cover one or more activities by one or more other persons (each of whom is a <b><i>project participant</i></b>) for those projects.</p>

                <p><role refersTo="#minister">the Minister</role> must decide whether or not to give the person a permit for each activity, by the person, covered by the application; and</p>

                <p>if subsection (2A) of this section applies—<role refersTo="#minister">the Minister</role> must decide whether or not to give each project participant a permit for each activity, by the participant, covered by the application.</p>

              <num>4</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may give a person a permit for a specified activity if <role refersTo="#minister">the Minister</role> is satisfied that the activity would not prejudice the security, defence or international relations of Australia.</p>
              </content>

            <hcontainer name="subclause" eId="schedule-1__clause-17__subclause-5">
              <num>5</num>
              <content>
                <p>Without limiting subsection (4), a permit given by <role refersTo="#minister">the Minister</role> may do one or more of the following:</p>
              </content>

            <paragraph eId="schedule-1__clause-17__para-a">
              <num>a</num>
              <content>
                <p>cover 2 or more activities;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-17__para-b">
              <num>b</num>
              <content>
                <p>cover one or more specified activities for a period specified in, or worked out in accordance with, the permit;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-17__para-c">
              <num>c</num>
              <content>
                <p>cover one or more specified activities for one or more specified projects.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-17__subclause-6">

                <p>If <role refersTo="#minister">the Minister</role> refuses to give a person a permit for an activity covered by the application, <role refersTo="#minister">the Minister</role> must give the person notice of the refusal and the reasons for the refusal.</p>

                <p>promoting compliance with this Act, whether by the person to whom the permit is given or any other person; or</p>

                <p>managing risks associated with persons contravening this Act.</p>
              </content>
            </paragraph>

                <p>To avoid doubt, an obligation mentioned in subsection (7A) may apply before, at or after the time an activity covered by the permit is done.</p>

            <heading>At the end of section 11</heading>

                <p>any other provision of this Act to the extent it relates to those sections.</p>

                <p>the provision of particular constitutional DSGL services.</p>

                <p>if that supply were the provision of access to DSGL technology—in circumstances where, at the time of the provision of access, the person providing access was in Australia and the person to whom access was provided was outside Australia.</p>
