          <p>		This Act is the <i>Offshore Petroleum and Greenhouse Gas Storage Legislation Amendment (Safety and Other Measures)</i> <i>Act 2024</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

                <p>	(1)	For the purposes of this Act, a person is <b><i>diving</i></b> if the person:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-24B__para-a">
              <num>a</num>
              <content>
                <p>is in a chamber inside which the ambient pressure is equal to or higher than the hydrostatic pressure at a depth of 1 metre in seawater (whether or not the chamber is submerged in water or another liquid); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-24B__para-b">
              <num>b</num>
              <content>
                <p>is submerged in water or another liquid and the person’s lungs are subjected to a pressure greater than atmospheric pressure (whether or not the person is wearing a wetsuit or other protective clothing); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-24B__para-c">
              <num>c</num>
              <content>
                <p>is in a manned submersible craft that is submerged in water or another liquid.</p>
              </content>
            </paragraph>

                <p>	(2)	For the purposes of this Act, <b><i>diving</i></b> includes (subject to subsection (3)):</p>

                <p>diving using a snorkel; and</p>
              </content>
            </paragraph>

                <p>	(3)	For the purposes of this Act, <b><i>diving</i></b> does not include:</p>

                <p>diving using a snorkel for the purpose of conducting an environmental survey; or</p>
              </content>
            </paragraph>

                <p>diving without the use of any breathing apparatus for that purpose.</p>
              </content>
            </paragraph>

            <heading>Diving operations</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-24C__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	For the purposes of this Act, <b><i>diving operations</i></b> are any regulated operations (within the meaning of Part 6.9) that consist of one or more dives.</p>
              </content>
            </hcontainer>

              <num>2</num>
              <content>
                <p>For the purposes of this Act, a diving operation:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-24C__para-a">
              <num>a</num>
              <content>
                <p>begins when the diver, or first diver, who takes part in the operation starts to prepare to dive; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-24C__para-b">
              <num>b</num>
              <content>
                <p>ends when the diver, or last diver, who takes part in the operation:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-24C__para-i">
              <num>i</num>
              <content>
                <p>leaves the water, or the chamber or environment, in which the dive took place; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-24C__para-ii">
              <num>ii</num>
              <content>
                <p>has completed any necessary decompression procedures; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-24C__para-c">
              <num>c</num>
              <content>
                <p>includes the time taken for therapeutic recompression if that is necessary.</p>
              </content>
            </paragraph>

                <p>if the dispute relates to the reasonable costs of attending the training—such matters as the NOPSEMA inspector considers relevant that may affect whether the costs are reasonable;</p>

                <p>any other matter the NOPSEMA inspector considers relevant.</p>

                <p>as a result, there is, or may be, a risk to the health or safety of any person; and</p>
              </content>
            </paragraph>

                <p>that risk is directly related to the diving operations being carried out on or from the dive vessel.</p>
              </content>
            </paragraph>

                <p>This subclause covers the following persons:</p>

                <p>the diving contractor for the diving operations being carried out on or from the dive vessel;</p>
              </content>
            </paragraph>

                <p>the diving supervisor for those diving operations.</p>
              </content>
            </paragraph>
