            <p>		This Act is the <i>Appropriation Act (No. 2) 2024-202</i><i>5</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p>Any information in column 3 of the table is not part of this Act. Information may be inserted in this column, or information in it may be edited, in any published version of this Act.</p>

        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-acquisition">acquisition</term> has the same meaning as <def>in the GST Act.</def></p>
            <p><term refersTo="#term-administered-assets-and-liabilities-item">administered assets and liabilities item</term> means <def>an amount set out in Schedule 2 in relation to a non-corporate entity opposite the heading “Administered Assets and Liabilities”.</def></p>
            <p><term refersTo="#term-administered-item">administered item</term> means <def>an amount set out in Schedule 2 opposite an outcome for a non-corporate entity under the heading “New Administered Outcomes”.</def></p>
            <p><b><i>corporate entity</i></b> means:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>	(a)	a corporate Commonwealth entity within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>a Commonwealth company within the meaning of that Act.</p>
            </content>
            <content>
              <p><term refersTo="#term-corporate-entity-item">corporate entity item</term> means <def>the amount set out in Schedule 2 in relation to a corporate entity under the heading “Non-operating”.</def></p>
              <p><term refersTo="#term-current-year">current year</term> means <def>the financial year ending on 30 June 2025.</def></p>
              <p><term refersTo="#term-expenditure">expenditure</term> means <def>payments for expenses, acquiring assets, making loans or paying liabilities.</def></p>
              <p><term refersTo="#term-finance-minister">Finance Minister</term> means <def>the Minister administering this Act.</def></p>
              <p><term refersTo="#term-gst-act">GST Act</term> means <def>the A New Tax System (Goods and Services Tax) Act 1999, as it applies because of <ref href="#dvs-177">Division 177</ref> of that Act.</def></p>
              <p><b><i>GST qualifying amount</i></b> means:</p>

                <p>Note:	Under <ref href="#dvs-17">Division 17</ref>7 of the GST Act, that Act applies notionally to the Commonwealth and Commonwealth entities. They are therefore notionally liable to pay GST, are notionally entitled to input tax credits and notionally have adjustments.</p>

          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>an input tax credit (within the meaning of the GST Act); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>a decreasing adjustment (within the meaning of the GST Act).</p>
            </content>
            <content>
              <p><term refersTo="#term-importation">importation</term> has the same meaning as <def>in the GST Act.</def></p>
              <p><term refersTo="#term-item">item</term> means <def>any of the following: a State, ACT, NT and local government item; an administered item; an administered assets and liabilities item; an other departmental item; a corporate entity item.</def></p>

            <num>a</num>
            <content>
              <p>a State, ACT, NT and local government item;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>an administered item;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>an administered assets and liabilities item;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-d">
            <num>d</num>
            <content>
              <p>an other departmental item;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-e">
            <num>e</num>
            <content>
              <p>a corporate entity item.</p>
            </content>
            <content>
              <p><b><i>non</i></b><b><i>-</i></b><b><i>corporate entity</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>	(a)	a non-corporate Commonwealth entity within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>the High Court.</p>
            </content>
            <content>
              <p><term refersTo="#term-other-departmental-item">other departmental item</term> means <def>an amount set out in Schedule 2 in relation to a non-corporate entity opposite the heading “Equity Injections”.</def></p>
              <p><term refersTo="#term-portfolio-budget-statements">Portfolio Budget Statements</term> means <def>the Portfolio Budget Statements that were tabled in the Senate or the House of Representatives in relation to the Bill for this Act.</def></p>
              <p><term refersTo="#term-portfolio-statements">portfolio statements</term> means <def>the Portfolio Budget Statements.</def></p>
              <p><term refersTo="#term-special-account">special account</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><term refersTo="#term-state-act-nt-and-local-government-item">State, ACT, NT and local government item</term> means <def>an amount set out in Schedule 2 opposite an outcome for a non-corporate entity under the heading “Payments to States, ACT, NT and local government”.</def></p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Portfolio statements</heading>
          <content>
            <p>		The portfolio statements are declared to be relevant documents for the purposes of <i>Acts Interpretation Act 1901</i>.<ref href="#sec-15A">section 15A</ref>B of the </p>
          </content>

              <p>Note:	See paragraph 15AB(2)(g) of the <i>Acts Interpretation Act 1901</i> which provides that the material that may be considered in the interpretation of a provision of an Act includes any document that is declared by the Act to be a relevant document.</p>

        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Notional transactions between entities that are part of the Commonwealth</heading>
          <content>
            <p>For the purposes of this Act, notional transactions between non-corporate entities are to be treated as if they were real transactions.</p>
          </content>

              <p>Note:	This section applies, for example, to a “payment” between non-corporate entities that are both part of the Commonwealth. One of the effects of this section is that the payment will be debited from an appropriation for the paying non-corporate entity, even though no payment is actually made from the Consolidated Revenue Fund. This is consistent with <i>Public Governance, Performance and Accountability Act 2013</i>.<ref href="#sec-76">section 76</ref> of the </p>

            <p>The total of the items specified in Schedule 2 is $24,589,880,000.</p>

          <num>7</num>
          <heading>State, ACT, NT and local government items</heading>
          <subsection eId="part-2__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>The amount specified in a State, ACT, NT and local government item for an outcome for a non-corporate entity may be applied for the purpose of making payments to or for the States, the Australian Capital Territory, the Northern Territory and local government authorities for the purpose of contributing to achieving that outcome.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>If the portfolio statements indicate that activities of a particular kind were intended to be treated as activities in respect of a particular outcome, then expenditure for the purpose of carrying out those activities is taken to be expenditure for the purpose of contributing to achieving the outcome.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-8">
          <num>8</num>
          <heading>Administered items</heading>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>The amount specified in an administered item for an outcome for a non-corporate entity may be applied for expenditure for the purpose of contributing to achieving that outcome.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>If the portfolio statements indicate that activities of a particular kind were intended to be treated as activities in respect of a particular outcome, then expenditure for the purpose of carrying out those activities is taken to be expenditure for the purpose of contributing to achieving the outcome.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-9">
          <num>9</num>
          <heading>Administered assets and liabilities items</heading>
          <subsection eId="part-2__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p>The amount specified in an administered assets and liabilities item for a non-corporate entity may be applied for expenditure for the purpose of contributing to achieving any outcome specified for the entity:</p>
            </content>

              <num>a</num>
              <content>
                <p>in Schedule 2 to this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	in Schedule 1 to the <i>Appropriation Act (No. 1) 202</i><i>4</i><i>-</i><i>202</i><i>5</i>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p>If the portfolio statements indicate that activities of a particular kind were intended to be treated as activities in respect of a particular outcome, then expenditure for the purpose of carrying out those activities is taken to be expenditure for the purpose of contributing to achieving the outcome.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-10">
          <num>10</num>
          <heading>Other departmental items</heading>
          <content>
            <p>The amount specified in an other departmental item for a non-corporate entity may be applied for the departmental expenditure of the entity.</p>
          </content>
        </section>
        <section eId="part-2__sec-11">
          <num>11</num>
          <heading>Corporate entity items</heading>
          <subsection eId="part-2__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>The amount specified in a corporate entity item for a corporate entity may be paid to the entity to be applied for the purposes of the entity.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>an Act provides that a corporate entity must be paid amounts that are appropriated by the Parliament for the purposes of the entity; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>Schedule 2 contains a corporate entity item for that entity;</p>
              </content>
              <content>
                <p>then the entity must be paid the full amount specified in the item.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
      </part>

        <heading>Advance to the Finance Minister</heading>

          <num>12</num>
          <heading>Advance to the Finance Minister</heading>
          <subsection eId="part-3__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p>This section applies if the Finance Minister is satisfied that there is an urgent need for expenditure, in the current year, that is not provided for, or is insufficiently provided for, in Schedule 2:</p>
            </content>
            <paragraph eId="part-3__sec-12__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>because of an erroneous omission or understatement; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>because the expenditure was unforeseen until after the last day on which it was practicable to provide for it in the Bill for this Act before that Bill was introduced into the House of Representatives.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-2">
            <num>2</num>
            <content>
              <p>This Act has effect as if Schedule 2 were amended, in accordance with a determination of the Finance Minister, to make provision for so much (if any) of the expenditure as the Finance Minister determines.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-3">
            <num>3</num>
            <content>
              <p>The total of the amounts determined under subsection (2) cannot be more than $600 million.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-4">

            <content>
              <p>	(4)	A determination made under subsection (2) is a legislative instrument, but neither <i>Legislation Act 2003</i> applies to the determination.<ref href="#sec-42">section 42</ref> (disallowance) nor <ref href="#part-4">Part 4</ref> of Chapter 3 (sunsetting) of the </p>

            <content>
              <p>	(1)	The debit limit for the current year for the purposes of <i>Federal Financial Relations Act 2009</i> is $5,000,000,000.<ref href="#sec-9">section 9</ref> of the </p>
            </content>

              <p>National partnership payments</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	The debit limit for the current year for the purposes of <i>Federal Financial Relations Act 2009</i> is $37,000,000,000.<ref href="#sec-16">section 16</ref> of the </p>

          </subsection>
        </section>

          <num>14</num>
          <heading>Adjustments for GST</heading>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="part-4__sec-14__para-a">
            <num>a</num>
            <content>
              <p>a payment in respect of an acquisition or importation is made in reliance on a debit limit specified in <ref href="#sec-13">section 13</ref>; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-14__para-b">
            <num>b</num>
            <content>
              <p>a GST qualifying amount arises for that acquisition or importation;</p>
            </content>
            <content>
              <p>then the debit limit is increased by the amount of the GST qualifying amount.</p>
            </content>
          </paragraph>
        </section>

        <heading>Miscellaneous</heading>
        <section eId="part-5__sec-15">
          <num>15</num>
          <heading>Crediting amounts to special accounts</heading>
          <content>
            <p>If any of the purposes of a special account is a purpose that is covered by an item (whether or not the item expressly refers to the special account), then amounts may be debited against the appropriation for that item and credited to that special account.</p>
          </content>
        </section>
        <section eId="part-5__sec-16">
          <num>16</num>
          <heading>Conditions etc. applying to State, ACT, NT and local government items</heading>
          <subsection eId="part-5__sec-16__subsec-1">
            <num>1</num>
            <content>
              <p>This section applies to any payment made out of money appropriated by a State, ACT, NT and local government item for an outcome specified in column 2 of the table in Schedule 1.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-16__subsec-2">
            <num>2</num>
            <content>
              <p>The payment:</p>
            </content>
            <paragraph eId="part-5__sec-16__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>must be made on the terms and conditions (if any) from time to time determined, in the way described in subsection (3), as applying to payments made:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-16__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>in relation to the outcome; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-16__subsec-2__para-ii">
              <num>ii</num>
              <content>

                <p>out of money appropriated by an annual Appropriation Act; and</p>

                <p>must be made in accordance with any determination in writing made by <role refersTo="#minister">the Minister</role> specified, in column 4 of the table in Schedule 1, for the outcome as to amounts and times of payments.</p>

          </subsection>
          <subsection eId="part-5__sec-16__subsec-3">
            <num>3</num>
            <content>
              <p>The way of determining the terms and conditions applying to payments described in paragraph (2)(a) is for <role refersTo="#minister">the Minister</role> specified, in column 3 of the table in Schedule 1, for the outcome to make the determination in writing before or after the commencement of this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-16__subsec-4">
            <num>4</num>
            <content>
              <p>Determinations mentioned in paragraph (2)(a) and determinations made under paragraph (2)(b) are not legislative instruments.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-16__subsec-5">
            <num>5</num>
            <content>
              <p>This section does not limit the Commonwealth’s power to:</p>
            </content>
            <paragraph eId="part-5__sec-16__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>apply terms and conditions to payments made out of money that is not appropriated by a State, ACT, NT and local government item; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-16__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>determine the amounts and times of those payments.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-5__sec-17">
          <num>17</num>
          <heading>Appropriation of the Consolidated Revenue Fund</heading>
          <content>
            <p>		The Consolidated Revenue Fund is appropriated as necessary for the purposes of this Act, including the operation of this Act as affected by the <i>Public Governance, Performance and Accountability Act 2013</i>.</p>
          </content>
        </section>
        <section eId="part-5__sec-18">
          <num>18</num>
          <heading>Repeal of this Act</heading>
          <content>
            <p>This Act is repealed at the start of <date date="2027-07-01">1 July 2027</date>.</p>
          </content>
