            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

      <section eId="sec-4">
        <num>4</num>
        <heading>Review of operation of amendments</heading>
        <subsection eId="sec-4__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> must cause an independent review to be conducted of the operation of the amendments made by Schedules 1, 3 and 4 to this Act and any regulations or other legislative instruments made for the purposes of those amendments.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-2">
          <num>2</num>
          <content>
            <p>The review must commence no later than <date date="2027-07-01">1 July 2027</date>.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-3">
          <num>3</num>
          <content>
            <p>The persons who conduct the review must give the Minister a written report of the review <quantity refersTo="#deadline">within 6 months</quantity> after the commencement of the review.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-4">
          <num>4</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> must cause a copy of the report to be tabled in each House of the Parliament within 15 sitting days of that House after the report is given to <role refersTo="#minister">the Minister</role>.</p>

                <p>exported from Australia.</p>

            </paragraph>

            <heading>After section 7</heading>
            <content>
              <p>Insert:</p>

            <num>7AAA</num>
            <heading>Minister may determine that goods are therapeutic goods</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-7AAA__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine that, for the purposes of this Act, specified goods (other than goods declared not to be therapeutic goods under an order in force under section 7 and goods covered by a determination under subsection 7AA(1) or (2) (excluded goods)):</p>
              </content>

              <num>a</num>
              <content>
                <p>are therapeutic goods; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-7AAA__para-b">
              <num>b</num>
              <content>
                <p>when used, advertised, or presented for supply in a particular way, are therapeutic goods.</p>
              </content>
            </paragraph>

              <num>2</num>
              <content>
                <p>Before making a determination under subsection (1), <role refersTo="#minister">the Minister</role>:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-7AAA__para-a">
              <num>a</num>
              <content>
                <p>must have regard to the following matters:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-7AAA__para-i">
              <num>i</num>
              <content>
                <p>whether it is likely that the specified goods, if not regulated under this Act, might harm the health of members of the public;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-7AAA__para-ii">
              <num>ii</num>
              <content>
                <p>whether it is appropriate in all the circumstances to apply the national system of controls relating to the quality, safety, efficacy and performance of therapeutic goods established by this Act to regulate the specified goods;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-7AAA__para-iii">
              <num>iii</num>
              <content>
                <p>whether the kinds of risks from the specified goods to which members of the public might be exposed could be more appropriately dealt with under another regulatory scheme; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-7AAA__para-b">
              <num>b</num>
              <content>
                <p>may have regard to any other relevant matter.</p>
              </content>
            </paragraph>

            <heading>After paragraph 8(1)(b)</heading>
            <content>
              <p>Insert:</p>
              <p>Therapeutic Goods Act 1989</p>
            </content>
            <paragraph eId="schedule-1__clause-5__para-ba">
              <num>ba</num>
              <content>
                <p>goods in relation to which <role refersTo="#minister">the Minister</role> is considering making a determination under subsection 7AAA(1) (goods that are therapeutic goods); or</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-6">
            <num>6</num>
            <heading>Subsection 3(1)</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>commercial quantity</i></b> of a kind of vaping goods means the quantity of that kind of vaping goods prescribed by the regulations.</p>
              <p><b><i>evidential burden</i></b>, in relation to a matter, means the burden of adducing or pointing to evidence that suggests a reasonable possibility that the matter exists or does not exist.</p>

            <num>7</num>
            <heading>Subsection 3(1) (definition of manufacture)</heading>
            <content>
              <p>After “therapeutic goods”, insert “, or vaping goods,”.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-8">
            <num>8</num>
            <heading>Subsection 3(1)</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>medical practitioner</i></b> means a person who is registered or licensed as a medical practitioner under a law of a State or an internal Territory that provides for the registration or licensing of medical practitioners.</p>
              <p><b><i>nurse practitioner</i></b> means a person who is registered, or authorised (however described) to practise, as a nurse practitioner by or under a law of a State or an internal Territory that provides for the registration of nurse practitioners, or the authorisation of persons to practise as nurse practitioners.</p>
              <p><b><i>pharmacist</i></b> means a person who is registered as a pharmacist under a law of a State or an internal Territory that provides for the registration of pharmacists.</p>

            <heading>Subsection 3(1) (paragraph (c) of the definition of supply)</heading>

              <p><b><i>vaping goods</i></b> has the meaning given by section 41P.</p>
              <p><b><i>vaping substance</i></b> has the meaning given by section 41P.</p>

            <heading>Simplified outline of this Chapter</heading>
            <content>
              <p>The importation into Australia of vaping goods, and the manufacture, supply or possession of vaping goods in Australia, is prohibited, subject to some exceptions. A person may commit an offence or be liable to a civil penalty for contravening the prohibitions (see <ref href="#part-4A">Part 4A</ref>-2).</p>
              <p>Definitions of <b><i>vaping goods</i></b> and related terms are set out in Division 2 of this Part. Vaping goods includes vaping substances, vaping accessories, vaping devices and goods determined by the Minister to be vaping goods.</p>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine that specified vaping goods, or a specified class of vaping goods, may be supplied or possessed in Australia:</p>
              <p><role refersTo="#secretary">The Secretary</role> may, on application by a person, give the person consent to manufacture, supply or possess vaping goods. The consent may be given unconditionally or subject to conditions, and in respect of particular vaping goods or classes of vaping goods. In deciding whether to give a consent, <role refersTo="#secretary">the Secretary</role> must comply with the decision-making principles (if any) determined by <role refersTo="#minister">the Minister</role> by legislative instrument. A person may commit an offence or be liable to a civil penalty if conditions of a consent are breached (see Part 4A-3).</p>

                <p>by a specified person, or a specified class of persons; and</p>
              </content>
            </paragraph>

            <heading>Relationship with other Chapters of this Act</heading>
            <content>
              <p>An offence provision or civil penalty provision in this Chapter does not limit the generality of an offence provision or civil penalty provision in any other Chapter, and those provisions in other Chapters do not limit the generality of offence provisions or civil penalty provisions in this Chapter.</p>

            <heading>Meaning of vaping goods and related terms</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-41P__subclause-1">
              <num>1</num>
              <content>
                <p>In this Act:</p>
              </content>
            </hcontainer>
            <content>
              <p><b><i>vaping accessory</i></b> means a cartridge, capsule, pod or other vessel:</p>
              <p><b><i>vaping device</i></b> means:</p>
              <p>Note:	Examples of devices that are not vaping devices include the following:</p>
              <p><b><i>vaping goods</i></b> means any of the following goods:</p>
              <p>Note:	This definition is affected by subsection (2).</p>
              <p><b><i>vaping substance</i></b>:</p>
              <p>Minister may determine that goods are or are not vaping goods etc.</p>
            </content>
            <paragraph eId="schedule-1__clause-41P__para-a">
              <num>a</num>
              <content>
                <p>that is for use in, or with, a vaping device; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41P__para-b">
              <num>b</num>
              <content>
                <p>whether or not the cartridge, capsule, pod or other vessel:</p>
              </content>
            </paragraph>

                <p>the presentation of goods includes matters in relation to:</p>
              </content>
            </paragraph>

                <p>the name of the goods; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41P__para-ii">
              <num>ii</num>
              <content>
                <p>the labelling and packaging of the goods; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41P__para-iii">
              <num>iii</num>
              <content>
                <p>any advertising or informational material associated with the use or supply of the goods; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41P__para-b">
              <num>b</num>
              <content>
                <p>goods are taken to be presented as being a particular kind of goods even if the presentation:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41P__para-i">
              <num>i</num>
              <content>
                <p>is capable of being misleading or confusing as to the content or proper use or identification of the goods; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41P__para-ii">
              <num>ii</num>
              <content>
                <p>suggests that the goods have ingredients, components or characteristics that they do not have.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-41P__subclause-3">

                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine that, for the purposes of this Act, specified goods or specified classes of goods:</p>

                <p>are or are not vaping goods; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41P__para-b">

                <p>when used, advertised, or presented for use or supply in a particular way, are or are not vaping goods.</p>

              <num>ii</num>

                <p>the vaping goods are not the subject of a determination by <role refersTo="#secretary">the Secretary</role>, published on the Department’s website, that the supply of the goods be stopped or should cease because <role refersTo="#secretary">the Secretary</role> is satisfied that the supply of the goods compromises public health and safety or the goods do not conform with a standard applicable to the goods; or</p>

                <p>is otherwise approved under those regulations to import the vaping goods; or</p>

              <num>ii</num>
              <content>
                <p>the supply occurs in accordance with the licence or authority; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-e">

                <p>both of the following apply:</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-i">

                <p><role refersTo="#secretary">the Secretary</role> has given the person a consent under subsection 41RC(1) to supply the vaping goods;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-ii">
              <num>ii</num>

                <p>the supply occurs in accordance with the consent; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-f">
              <num>f</num>
              <content>
                <p>in the case of vaping goods that are covered by a determination made by <role refersTo="#minister">the Minister</role> under section 41R:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-i">
              <num>i</num>
              <content>
                <p>the person is specified in the determination, or is included in a class of persons specified in the determination, in relation to those goods; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-ii">
              <num>ii</num>
              <content>
                <p>the supply occurs in accordance with the determination.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-41QB__subclause-8">

                <p>This subsection applies in relation to the supply of the vaping goods by the person if:</p>

                <p>	(a)	the person (the <b><i>recipient</i></b>) to whom the vaping goods are supplied is the holder of a licence in force under Part 3-3 of this Act that authorises a step in the manufacture of vaping goods; or</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-b">
              <num>b</num>
              <content>
                <p>the recipient is a wholesaler, pharmacist, medical practitioner or nurse practitioner who is the holder of a licence, or is otherwise authorised, to supply one or more substances included in Schedule 4 to the current Poisons Standard under a law of the State or Territory in which the recipient carries on a business, practises or is employed; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-c">
              <num>c</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> has given the recipient a consent under subsection 41RC(1) to supply the vaping goods; or</p>

            </paragraph>

                <p>in the case of vaping goods that are covered by a determination made by <role refersTo="#minister">the Minister</role> under section 41R—the recipient is specified in the determination, or is included in a class of persons specified in the determination, in relation to those goods.</p>

                <p>This subsection applies in relation to the supply of the vaping goods by the person if:</p>

                <p>the vaping goods are therapeutic goods that are entered on the Register; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-b">
              <num>b</num>
              <content>
                <p>both of the following apply:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-i">
              <num>i</num>
              <content>
                <p>the vaping goods are therapeutic goods that are exempt goods under regulations made for the purposes of subsection 18(1) or an exempt device under regulations made for the purposes of subsection 41HA(1), and the sponsor has given <role refersTo="#secretary">the Secretary</role> a notice in compliance with the exemption;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-ii">
              <num>ii</num>
              <content>
                <p>the vaping goods are not the subject of a determination by <role refersTo="#secretary">the Secretary</role>, published on the Department’s website, that the supply of the goods be stopped or should cease because <role refersTo="#secretary">the Secretary</role> is satisfied that the supply of the goods compromises public health and safety or the goods do not conform with a standard applicable to the goods; or</p>

            </paragraph>

                <p>the person is a medical practitioner or nurse practitioner who is the holder of a licence, or is otherwise authorised, to supply one or more substances included in Schedule 4 to the current Poisons Standard under a law of the State or Territory in which the supply occurs.</p>

              <content>
                <p>This subsection applies in relation to the supply of the vaping goods by the person if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-41QB__para-a">
              <num>a</num>
              <content>
                <p>the supply is:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-i">
              <num>i</num>
              <content>
                <p>to another person for use by that person for smoking cessation, management of nicotine dependence or another indication determined by <role refersTo="#minister">the Minister</role> under section 41RA; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-ii">
              <num>ii</num>
              <content>
                <p>to another person, who is the carer of a third person, for use by the third person for smoking cessation, management of nicotine dependence or another indication determined by <role refersTo="#minister">the Minister</role> under section 41RA; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-b">
              <num>b</num>
              <content>
                <p>if the vaping goods are, or contain, a vaping substance—the vaping substance is in final dosage form; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-c">
              <num>c</num>
              <content>
                <p>the supply is:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-i">
              <num>i</num>
              <content>
                <p>in accordance with this Act (apart from this section); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QB__para-ii">
              <num>ii</num>
              <content>
                <p>consistent with the person’s authority to supply the vaping goods under a law of the State or Territory in which the supply occurs.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-41QB__subclause-12">
              <num>12</num>
              <content>
                <p>	(12)	For the purposes of paragraph (11)(b), a vaping substance is in <b><i>final dosage form</i></b> if the vaping substance is in a form that can be administered to a person without any change or modification (other than vaporisation).</p>

            </paragraph>

                <p>A person contravenes this subsection if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-41QC__para-a">
              <num>a</num>
              <content>
                <p>the person possesses a quantity of a kind of vaping goods in Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-b">
              <num>b</num>
              <content>
                <p>the quantity is at least the commercial quantity of that kind of vaping goods.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-a">
              <num>a</num>
              <content>
                <p>for an individual—<quantity refersTo="#penaltyUnit">7,000 penalty units</quantity>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-b">
              <num>b</num>
              <content>
                <p>for a body corporate—<quantity refersTo="#penaltyUnit">70,000 penalty units</quantity>.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-41QC__subclause-11">
              <num>11</num>
              <content>
                <p>A person who contravenes subsection (10) in relation to a kind of vaping goods commits a separate contravention of that subsection in respect of each unit of the quantity of vaping goods of that kind possessed by the person in Australia.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-41QC__subclause-11A">
              <num>11A</num>
              <content>
                <p>Subsections (1) to (3) and (10) and (11) do not apply in relation to the possession of a quantity of a kind of vaping goods by the person if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-41QC__para-a">
              <num>a</num>
              <content>
                <p>the vaping goods have been lawfully supplied to the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-b">
              <num>b</num>
              <content>
                <p>the vaping goods are for use by the person personally; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-c">
              <num>c</num>
              <content>
                <p>the quantity is less than 5 times the commercial quantity of that kind of vaping goods.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-41QC__subclause-12">
              <num>12</num>
              <content>
                <p>Subsections (1) to (11) do not apply if subsections (13) and (14) apply in relation to the possession of the vaping goods by the person.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-41QC__subclause-13">
              <num>13</num>
              <content>
                <p>This subsection applies in relation to the possession of the vaping goods by the person if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-41QC__para-a">
              <num>a</num>
              <content>
                <p>the vaping goods are therapeutic goods that are entered on the Register; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-b">
              <num>b</num>
              <content>
                <p>both of the following apply:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-i">
              <num>i</num>
              <content>
                <p>the vaping goods are therapeutic goods that are exempt goods under regulations made for the purposes of subsection 18(1) or an exempt device under regulations made for the purposes of subsection 41HA(1), and the sponsor has given <role refersTo="#secretary">the Secretary</role> a notice in compliance with the exemption;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-ii">
              <num>ii</num>
              <content>
                <p>the vaping goods are not the subject of a determination by <role refersTo="#secretary">the Secretary</role>, published on the Department’s website, that the supply of the goods be stopped or should cease because <role refersTo="#secretary">the Secretary</role> is satisfied that the supply of the goods compromises public health and safety or the goods do not conform with a standard applicable to the goods; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-c">
              <num>c</num>
              <content>
                <p>the vaping goods are covered by a determination made by <role refersTo="#minister">the Minister</role> under section 41R.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-41QC__subclause-14">
              <num>14</num>
              <content>
                <p>This subsection applies in relation to the possession of the vaping goods by the person if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-41QC__para-a">
              <num>a</num>
              <content>
                <p>the person:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-i">
              <num>i</num>
              <content>
                <p>	(i)	is the holder of a licence and a permission, granted under regulations made for the purposes of <i> Customs Act 1901</i>, to import the vaping goods; or<ref href="#sec-50">section 50</ref> of the</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-ii">
              <num>ii</num>
              <content>
                <p>is otherwise approved under those regulations to import the vaping goods; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-b">
              <num>b</num>
              <content>
                <p>the person is the holder of a licence in force under <ref href="#part-3">Part 3</ref>-3 of this Act that authorises a step in the manufacture of the vaping goods; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-c">
              <num>c</num>
              <content>
                <p>the person is the holder of a conformity assessment document that applies to the vaping goods; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-d">
              <num>d</num>
              <content>
                <p>both of the following apply:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-i">
              <num>i</num>
              <content>
                <p>the person is a wholesaler, pharmacist, medical practitioner or nurse practitioner who is the holder of a licence, or is otherwise authorised, to supply one or more substances included in Schedule 4 to the current Poisons Standard under a law of the State or Territory in which the person possesses the goods;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-ii">
              <num>ii</num>
              <content>
                <p>the possession of the goods is in accordance with the licence or authority; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-e">
              <num>e</num>
              <content>
                <p>both of the following apply:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-i">
              <num>i</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> has given the person a consent under subsection 41RC(1) to possess the vaping goods;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-ii">
              <num>ii</num>
              <content>
                <p>the possession is in accordance with the consent; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-f">
              <num>f</num>
              <content>
                <p>in the case of vaping goods that are covered by a determination made by <role refersTo="#minister">the Minister</role> under section 41R:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-i">
              <num>i</num>
              <content>
                <p>the person is specified in the determination, or is included in a class of persons that is specified in the determination, in relation to those goods; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QC__para-ii">
              <num>ii</num>
              <content>
                <p>the possession is in accordance with the determination.</p>
              </content>
            </paragraph>

              <p>(whether or not the premises are used wholly or predominantly for that purpose).</p>

            </paragraph>

                <p>the vaping goods are therapeutic goods that are exempt goods under regulations made for the purposes of subsection 18(1) or an exempt device under regulations made for the purposes of subsection 41HA(1), and the sponsor has given <role refersTo="#secretary">the Secretary</role> a notice in compliance with the exemption;</p>

                <p>the vaping goods are not the subject of a determination by <role refersTo="#secretary">the Secretary</role>, published on the Department’s website, that the supply of the goods be stopped or should cease because <role refersTo="#secretary">the Secretary</role> is satisfied that the supply of the goods compromises public health and safety or the goods do not conform with a standard applicable to the goods; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QD__para-c">
              <num>c</num>
              <content>
                <p>the vaping goods are covered by a determination made by <role refersTo="#minister">the Minister</role> under section 41R.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-41QD__subclause-8">
              <num>8</num>
              <content>
                <p>This subsection applies in relation to the possession of the vaping goods by the person if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-41QD__para-a">
              <num>a</num>
              <content>
                <p>both of the following apply:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QD__para-i">
              <num>i</num>
              <content>
                <p>the person is a pharmacist, medical practitioner or nurse practitioner who is the holder of a licence, or is otherwise authorised, to supply one or more substances included in Schedule 4 to the current Poisons Standard under a law of the State or Territory in which the person possesses the goods;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QD__para-ii">
              <num>ii</num>
              <content>
                <p>the possession of the goods is in accordance with the licence or authority; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QD__para-b">
              <num>b</num>
              <content>
                <p>both of the following apply:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QD__para-i">
              <num>i</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> has given the person a consent under subsection 41RC(1) to possess the vaping goods;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QD__para-ii">
              <num>ii</num>
              <content>
                <p>the possession is in accordance with the consent; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QD__para-c">
              <num>c</num>
              <content>
                <p>in the case of vaping goods that are covered by a determination made by <role refersTo="#minister">the Minister</role> under section 41R:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QD__para-i">
              <num>i</num>
              <content>
                <p>the person is specified in the determination, or is included in a class of persons that is specified in the determination, in relation to those goods; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QD__para-ii">
              <num>ii</num>
              <content>
                <p>the possession is in accordance with the determination.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-41QD__subclause-9">
              <num>9</num>
              <content>
                <p>Subsections (1) to (5) do not apply in relation to the possession of a quantity of a kind of vaping goods by the person if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-41QD__para-a">
              <num>a</num>
              <content>
                <p>the vaping goods are for use by the person personally; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QD__para-b">
              <num>b</num>
              <content>
                <p>the quantity is not more than the permitted quantity of that kind of vaping goods.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-41QD__subclause-10">
              <num>10</num>
              <content>
                <p>In this section:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-41QD__para-a">
              <num>a</num>

                <p>an owner, lessee or occupier of retail premises in Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QD__para-b">
              <num>b</num>
              <content>
                <p>a person conducting a business or undertaking at, or in connection or association with, retail premises in Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QD__para-c">
              <num>c</num>
              <content>
                <p>a director, officer or agent of a person referred to in paragraph (a) or (b);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QD__para-d">
              <num>d</num>
              <content>
                <p>a person performing work in any capacity (including, but not limited to, an employee or a contractor) for, or on behalf of, a person referred to in paragraph (a), (b) or (c) at, or in connection or association with, retail premises in Australia.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QD__para-a">
              <num>a</num>
              <content>
                <p>from which goods or services are available for supply, or are supplied, to a consumer; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41QD__para-b">
              <num>b</num>
              <content>
                <p>that are used in connection with the supply of goods or services to a consumer;</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-41QE">
            <num>41QE</num>
            <heading>Exceptions etc. to civil penalty provisions—burden of proof</heading>
            <content>
              <p>If, in proceedings for a pecuniary penalty order against a person for a contravention of a civil penalty provision in this Chapter, the person wishes to rely on any exception, exemption, excuse, qualification or justification that applies in relation to the civil penalty provision, then the person bears an evidential burden in relation to that matter.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-41R">
            <num>41R</num>
            <heading>Minister may determine that specified vaping goods may be supplied or possessed in Australia in specified circumstances etc.</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine that specified vaping goods, or a specified class of vaping goods, may be supplied or possessed in Australia:</p>
              <p>Note:	Conditions may, for example, relate to the value or amount of specified vaping goods or the manner in which specified vaping goods may be supplied.</p>

              <num>a</num>
              <content>
                <p>by a specified person, or a specified class of persons; and</p>
              </content>
            </paragraph>

                <p>in the circumstances (if any) specified in the determination; and</p>
              </content>
            </paragraph>

                <p>subject to the conditions (if any) specified in the determination.</p>

            <heading>Minister may determine other indications for which vaping goods may be used</heading>

              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine, for the purposes of paragraph 41QB(11)(a), indications (other than smoking cessation or management of nicotine dependence) for which vaping goods may be used.</p>

            <heading>Application to Secretary for consent to manufacture, supply or possess vaping goods</heading>

                <p>A person may apply to <role refersTo="#secretary">the Secretary</role> for consent to manufacture, supply or possess vaping goods.</p>

                <p>An application under subsection (1) must be in accordance with a form approved by <role refersTo="#secretary">the Secretary</role>.</p>

                <p>on a specified kind of data processing device; or</p>
              </content>
            </paragraph>

            <heading>Secretary may give consent</heading>

              <num>1</num>

              <num>a</num>
              <content>
                <p>	(a)	a person (the <b><i>applicant</i></b>) has applied to the Secretary under section 41RB for consent to manufacture, supply or possess vaping goods; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41RC__para-b">
              <num>b</num>
              <content>
                <p>the applicant has complied with any requirements made by <role refersTo="#secretary">the Secretary</role> under subsection 41RB(3) in relation to the application;</p>
              </content>
            </paragraph>
            <content>
              <p><role refersTo="#secretary">the Secretary</role> must decide whether to give, or refuse to give, the consent.</p>
              <p>Note:	A person may commit an offence or be liable to a civil penalty if the person does an act or omits to do an act and the act or omission breaches a condition of a consent given under subsection (1): see <ref href="#sec-41R">section 41R</ref>D.</p>

                <p><role refersTo="#secretary">The Secretary</role> may give a consent under subsection (1):</p>

                <p>in respect of particular vaping goods or classes of vaping goods.</p>

            </paragraph>

                <p>In making a decision under subsection (1), <role refersTo="#secretary">the Secretary</role> must comply with the decision-making principles (if any) determined under subsection (2B).</p>

              <num>2B</num>
              <content>
                <p>	(2B)	The Minister may, by legislative instrument, determine principles (<b><i>decision</i></b><b><i>-</i></b><b><i>making principles</i></b>) that the Secretary must comply with in making a decision under subsection (1).</p>

                <p>Without limiting subsection (4), conditions in an authorisation of advertising may relate to any of the following:</p>

                <p>the nature of the audience to which the advertising is targeted;</p>
              </content>
            </paragraph>

                <p>the form of the advertising;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42DZC__para-c">
              <num>c</num>
              <content>
                <p>the content of the advertising;</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-42DZC__para-d">
              <num>d</num>
              <content>
                <p>representations or information on:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42DZC__para-i">
              <num>i</num>

                <p>the labels of specified vaping goods or a specified class of vaping goods; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42DZC__para-ii">
              <num>ii</num>
              <content>
                <p>the packages in which specified vaping goods or a specified class of vaping goods are contained; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42DZC__para-iii">
              <num>iii</num>
              <content>
                <p>any material included with the package in which specified vaping goods or a specified class of vaping goods are contained.</p>
              </content>
            </paragraph>

            <heading>Offences—no authorisation or conditions of authorisation not complied with</heading>

                <p>A person commits an offence if:</p>

            <paragraph eId="schedule-1__clause-42DZD__para-i">
              <num>i</num>

                <p>no authorisation under <ref href="#sec-42D">section 42D</ref>ZC is in force in relation to the advertising; or</p>

                <p>an authorisation under <ref href="#sec-42D">section 42D</ref>ZC is in force in relation to the advertising, but the advertising does not include representations or information as specified in the authorisation, or the advertising is not otherwise in accordance with the authorisation, or the advertising does not comply with a condition to which the authorisation is subject.</p>

                <p>an authorisation under <ref href="#sec-42D">section 42D</ref>ZC is in force in relation to the advertising, but the advertising does not include representations or information as specified in the authorisation, or the advertising is not otherwise in accordance with the authorisation, or the advertising does not comply with a condition to which the authorisation is subject.</p>

                <p>A person who contravenes subsection (1) or (2) commits a separate offence in respect of each day (including a day of a conviction for the offence or any later day) during which the contravention continues.</p>

                <p><role refersTo="#secretary">The Secretary</role> may, by written notice given to a person apparently responsible for disseminating, or for causing the disseminating of, generic information in relation to vaping goods to the public or a section of the public, require the person to give to <role refersTo="#secretary">the Secretary</role> specified information, or to produce to <role refersTo="#secretary">the Secretary</role> specified documents, relating to the dissemination.</p>

              <num>3</num>
              <content>
                <p>The person must give the information, or produce the documents, to <role refersTo="#secretary">the Secretary</role>:</p>

                <p>within the period, of not less than 14 days after the day the notice is given, specified in the notice or within such longer period as <role refersTo="#secretary">the Secretary</role> allows; and</p>

                <p>in the form specified in the notice.</p>

                <p>If, in relation to the dissemination of generic information in relation to vaping goods to the public or a section of the public, <role refersTo="#secretary">the Secretary</role> is satisfied that there has been a contravention of this Act or the regulations, <role refersTo="#secretary">the Secretary</role> may, in writing, direct a person apparently responsible for the dissemination, or for causing the dissemination, to do one or more of the following:</p>

                <p>the harm or injury has resulted, will result, is likely to result, would result, or would be likely to result, because of the contravention.</p>

                <p><role refersTo="#secretary">the Secretary</role> reasonably suspects that there has been a contravention of this Act or the regulations in relation to:</p>

                <p>the advertising of the vaping goods; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42DZN__para-ii">

                <p>the dissemination of generic information in relation to the vaping goods to the public or a section of the public; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-42DZN__para-b">

                <p><role refersTo="#secretary">the Secretary</role> is satisfied that it is in the public interest to issue the notice.</p>

            <heading>Forfeiture of things seized under search warrant in certain circumstances</heading>

                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-52AAA__para-a">
              <num>a</num>
              <content>
                <p>an authorised person seizes a thing under a warrant issued under <ref href="#sec-50">section 50</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAA__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> believes, on reasonable grounds, that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAA__para-i">
              <num>i</num>
              <content>
                <p>the thing has been imported, manufactured or supplied in contravention of this Act or an instrument made under this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAA__para-ii">
              <num>ii</num>
              <content>
                <p>the thing has been in the possession, custody or control of a person in contravention of this Act or an instrument made under this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAA__para-iii">
              <num>iii</num>
              <content>
                <p>a requirement under this Act, or an instrument made under this Act, has not been complied with in relation to the thing;</p>
              </content>
            </paragraph>
            <content>
              <p>the thing is forfeited to the Commonwealth.</p>
              <p>Notice of forfeiture</p>
              <p>Proceedings may be commenced for declaration that thing is not forfeited to the Commonwealth</p>
              <p>Secretary may retain or dispose of forfeited thing</p>
              <p>then:</p>
              <p>Note:	See also <ref href="#sec-54">section 54</ref> (offences and forfeiture).</p>
            </content>

              <num>2</num>
              <content>
                <p>	(2)	The Secretary must give a written notice (a <b><i>forfeiture </i></b><b><i>notice</i></b>) in accordance with subsection (3) to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-52AAA__para-a">
              <num>a</num>
              <content>
                <p>the owner of the thing; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAA__para-b">
              <num>b</num>
              <content>
                <p>if the owner cannot be identified after reasonable inquiry—the person who had possession, custody or control of the thing immediately before it was seized.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-52AAA__subclause-3">
              <num>3</num>
              <content>
                <p>The forfeiture notice must identify the thing and state the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-52AAA__para-a">
              <num>a</num>
              <content>
                <p>the day the thing was seized;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAA__para-b">
              <num>b</num>
              <content>
                <p>that the thing was seized under a warrant issued under <ref href="#sec-50">section 50</ref> of this Act and the grounds on which it was seized;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAA__para-c">
              <num>c</num>
              <content>
                <p>that the thing is forfeited to the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAA__para-d">
              <num>d</num>
              <content>
                <p>that the owner of the thing, or the person who had possession, custody or control of the thing immediately before it was seized, may, <quantity refersTo="#deadline">within 2 months</quantity> beginning on the day the forfeiture notice is given, commence proceedings against the Commonwealth in a court of competent jurisdiction for a declaration that the thing is not forfeited to the Commonwealth.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-52AAA__subclause-4">
              <num>4</num>
              <content>
                <p>The owner of the thing, or the person who had possession, custody or control of the thing immediately before it was seized, may, subject to subsection (5), commence proceedings in a court of competent jurisdiction for a declaration that the thing is not forfeited to the Commonwealth.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-52AAA__subclause-5">
              <num>5</num>
              <content>
                <p>Proceedings:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-52AAA__para-a">
              <num>a</num>
              <content>
                <p>may be commenced under subsection (4) even if the forfeiture notice required to be given under subsection (2) in relation to the thing has not yet been given; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAA__para-b">
              <num>b</num>
              <content>
                <p>may only be commenced before the end of the period of 2 months beginning on the day the forfeiture notice is given.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-52AAA__subclause-6">
              <num>6</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-52AAA__para-a">
              <num>a</num>
              <content>
                <p>the owner of the thing, or the person who had possession, custody or control of the thing immediately before it was seized, does not, within the period of 2 months beginning on the day the forfeiture notice was given, commence proceedings against the Commonwealth for a declaration that the thing is not forfeited to the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAA__para-b">
              <num>b</num>
              <content>
                <p>the owner of the thing, or the person who had possession, custody or control of the thing immediately before it was seized, commences such proceedings within that 2 month period, but at the end of the proceedings (including an appeal to a court in relation to the proceedings), the court has not made a declaration that the thing is not forfeited to the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAA__para-c">
              <num>c</num>
              <content>
                <p>the thing is condemned as forfeited to the Commonwealth; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAA__para-d">
              <num>d</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> may cause notice of the forfeiture of the thing to be published on the Department’s website; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAA__para-e">
              <num>e</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> may:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAA__para-i">
              <num>i</num>
              <content>
                <p>retain the thing for the purpose of proceedings in respect of which the thing may afford evidence; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAA__para-ii">
              <num>ii</num>
              <content>
                <p>cause the thing to be disposed of in such manner as <role refersTo="#secretary">the Secretary</role> directs.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-52AAB">
            <num>52AAB</num>
            <heading>Return or retention of thing declared not to be forfeited to the Commonwealth</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-52AAB__subclause-1">
              <num>1</num>
              <content>
                <p>This section applies in relation to a thing if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-52AAB__para-a">
              <num>a</num>
              <content>
                <p>the thing was forfeited to the Commonwealth under subsection 52AAA(1); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAB__para-b">
              <num>b</num>
              <content>
                <p>a court has made a declaration that the thing is not forfeited to the Commonwealth under that subsection.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-52AAB__subclause-2">
              <num>2</num>
              <content>
                <p>Sections 48H and 48J do not apply in relation to the thing.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-52AAB__subclause-3">
              <num>3</num>
              <content>
                <p>At the end of 120 days after the declaration referred to in paragraph (1)(b) was made, an authorised person must take reasonable steps to return the thing to the person from whom it was seized unless:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-52AAB__para-a">
              <num>a</num>
              <content>
                <p>proceedings in respect of which the thing may afford evidence were commenced before the end of the 120 days and have not been completed (including an appeal to a court in relation to those proceedings); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAB__para-b">
              <num>b</num>
              <content>
                <p>an authorised person may retain the thing because of an order under subsection (6); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAB__para-c">
              <num>c</num>
              <content>
                <p>an authorised person is otherwise authorised (by a law, or an order of a court, of the Commonwealth or of a State or Territory) to retain, destroy or dispose of the thing.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-52AAB__subclause-4">
              <num>4</num>
              <content>
                <p>The thing may be returned under subsection (3) either unconditionally or on such terms and conditions as <role refersTo="#secretary">the Secretary</role> sees fit.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-52AAB__subclause-5">
              <num>5</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may apply to an issuing officer for an order that an authorised person may retain the thing for a further period. The application must be made:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-52AAB__para-a">
              <num>a</num>
              <content>
                <p>before the end of 120 days after the declaration referred to in paragraph (1)(b) was made; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAB__para-b">
              <num>b</num>
              <content>
                <p>if an order has been made under subsection (6)—before the end of the period specified in the most recent order made under that subsection.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-52AAB__subclause-6">
              <num>6</num>
              <content>
                <p>If the issuing officer is satisfied that it is necessary for an authorised person to continue to retain the thing:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-52AAB__para-a">
              <num>a</num>
              <content>
                <p>for the purposes of an investigation as to whether an offence against this Act has been committed; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAB__para-b">
              <num>b</num>
              <content>
                <p>to enable evidence of an offence against this Act to be secured for the purposes of a prosecution; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAB__para-c">
              <num>c</num>
              <content>
                <p>for the purposes of an investigation as to whether a civil penalty provision has been contravened; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAB__para-d">
              <num>d</num>
              <content>
                <p>to enable evidence of a contravention of a civil penalty provision to be secured for the purposes of civil proceedings;</p>
              </content>
            </paragraph>
            <content>
              <p>the issuing officer may order that an authorised person may retain the thing for a period (not exceeding 3 years) specified in the order.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-52AAB__subclause-7">
              <num>7</num>
              <content>
                <p>Before making an application under subsection (5), <role refersTo="#secretary">the Secretary</role> must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-52AAB__para-a">
              <num>a</num>
              <content>
                <p>take reasonable steps to discover who has an interest in the retention of the thing; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-52AAB__para-b">
              <num>b</num>
              <content>
                <p>if it is practicable to do so, notify each person who <role refersTo="#secretary">the Secretary</role> believes to have such an interest of the proposed application.</p>
              </content>
            </paragraph>

                <p>(2)	Subitems (3) and (4) apply in relation to a legislative instrument made under paragraph 52D(2)(b) of the <i>Therapeutic Goods Act 1989</i> that:</p>

              <content>
                <p>is made on or after the commencement of this Schedule; and</p>

                <p>The legislative instrument must not commence before the end of the period in which it could be disallowed in either House of the Parliament.</p>

                <p>(5)	A person must not make an application under subsection 52EAA(1) of the <i>Therapeutic </i><i>Goods Act 1989</i> for:</p>

              <num>a</num>
              <content>
                <p>an amendment of the entry relating to nicotine inserted into Schedule 3 to the current Poisons Standard by this Schedule; or</p>

              <num>b</num>
              <content>
                <p>an amendment of the entry relating to nicotine inserted into Schedule 4 to the current Poisons Standard by this Schedule; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-20__para-c">
              <num>c</num>
              <content>
                <p>any amendment related to the entries relating to nicotine referred to in paragraphs (a) and (b) of this subitem.</p>
