              <p>Omit “an employee of that person, has recorded on the account, or on the receipt, for fees in respect of the service or, if an assignment has been made, or an agreement has been entered into, in accordance with <ref href="#sec-20A">section 20A</ref>, in relation to the medicare benefit in respect of the service, on the form of the assignment or agreement, as the case may be,”, substitute “a person authorised by that person, has recorded”.</p>

            <heading>Subsections 20A(1), (2) and (2A)</heading>

              <p>Repeal the subsections, substitute:</p>
              <p>Bulk billing assignments</p>
              <p>Note 1:	The professional must, if asked to, give the assignor a copy of the terms of the agreement: see subsection 127(1).</p>
              <p>Note 2:	Regulations made for the purposes of paragraph 127(2)(c) may require the professional to give the assignor other notifications.</p>
              <p>Simplified billing assignments: basic rule</p>
            </content>

              <num>1</num>
              <content>
                <p>	(1)	An eligible person (the <b><i>assignor</i></b>) to whom a medicare benefit is or will be payable in respect of a professional service may enter into an agreement to assign the assignor’s right to the payment of the medicare benefit if:</p>
              </content>

            <paragraph eId="schedule-1__clause-3__para-a">
              <num>a</num>
              <content>
                <p>the professional service is or will be rendered to the assignor or to another eligible person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the agreement is entered into with the person by whom, or on whose behalf, the professional service is or will be rendered (the <b><i>professional</i></b>); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-c">
              <num>c</num>
              <content>
                <p>the agreement provides that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-i">
              <num>i</num>
              <content>
                <p>the assignor assigns the assignor’s right to the payment of the medicare benefit to the professional at the time the agreement is entered into or when the medicare benefit becomes payable (whichever is the later); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-ii">
              <num>ii</num>
              <content>
                <p>the professional accepts the assignment in full payment of the medical expenses that have been or will be incurred in respect of the professional service by the assignor; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-d">
              <num>d</num>
              <content>
                <p>any requirements specified in the regulations are met.</p>
              </content>
            </paragraph>

              <num>2</num>
              <content>
                <p>	(2)	An eligible person (the <b><i>assignor</i></b>) to whom a medicare benefit would, apart from this section, be payable in respect of a professional service is taken to have assigned the assignor’s right to the payment of the medicare benefit if:</p>

              <num>a</num>
              <content>
                <p>the professional service is rendered to the assignor or another eligible person while hospital treatment or hospital-substitute treatment is provided to the assignor or that other eligible person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the assignor has entered into a complying health insurance policy with a private health insurer (the <b><i>insurer</i></b>); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-c">
              <num>c</num>
              <content>
                <p>under the policy, the assignor is covered (wholly or partly) for liability to pay fees and charges in respect of the professional service; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-d">
              <num>d</num>
              <content>
                <p>a claim is made under <ref href="#sec-20B">section 20B</ref> for the medicare benefit that would, apart from this section, be payable to the assignor in respect of the professional service; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-e">
              <num>e</num>
              <content>
                <p>subsection 20AAA(1), (3) or (5) applies to the assignor’s right to the payment of the medicare benefit in respect of the professional service.</p>
              </content>
            </paragraph>

                <p>If the right to payment of a medicare benefit is taken to be assigned under subsection (2) of this section, it is taken to be assigned to the person specified in subsection 20AAA(2), (4) or (6).</p>

                <p>Without limiting this section, regulations prescribing requirements for the purposes of this section may specify:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-6__para-a">
              <num>a</num>
              <content>
                <p>requirements relating to the content of agreements to be entered into, or the manner and form in which the agreements are to be entered into; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-b">
              <num>b</num>
              <content>
                <p>requirements relating to information that must be given and the manner and form in which the information must be given; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-c">
              <num>c</num>
              <content>
                <p>requirements relating to the giving of notifications before or at the time agreements are entered into, or before or after information is given.</p>
              </content>
            </paragraph>

              <p>Insurer has arrangement with professional etc.</p>
              <p>Note:	The insurer or approved billing agent must notify the assignor <quantity refersTo="#deadline">within 6 months</quantity> of being paid the medicare benefit: see subsection 127(3).</p>
              <p>Request made by assignor</p>
              <p>Note 1:	The operator of the hospital, the organization or the professional (as the case may be) must, if asked to, give the assignor a copy of the terms of a request made under paragraph (3)(a): see subsection 127(4).</p>
              <p>Note 2:	The operator of the hospital, the organization or the professional (as the case may be) must give the assignor a notification as soon as practicable after a request is modified under paragraph (3)(b): see subsection 127(5).</p>
              <p>Note:	The insurer or approved billing agent must notify the assignor <quantity refersTo="#deadline">within 6 months</quantity> of being paid the medicare benefit: see subsection 127(3).</p>
              <p>Complications and related urgent unplanned services</p>
              <p>Note:	The insurer or approved billing agent must notify the assignor <quantity refersTo="#deadline">within 6 months</quantity> of being paid the medicare benefit: see subsection 127(3).</p>
              <p>Treatment provided under authorisation of operator of hospital or organization</p>
              <p>Note:	In this Act, a hospital is a facility for which a declaration under subsection 121-5(6) of the <i>Private Health Insurance Act 2007</i> is in force: see subsection 3(1) of this Act and subsection 121-5(5) of the <i>Private Health Insurance Act 2007</i>.</p>
              <p>Regulations</p>
              <p>Note:	Regulations made for the purposes of paragraph (c) of this subsection may specify that paragraph 127(6)(c) applies. Subsection 127(6) is a civil penalty provision.</p>

            <hcontainer name="subclause" eId="schedule-1__clause-20AAA__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	For the purposes of paragraph 20A(2)(e), this subsection applies to the assignor’s right to the payment of a medicare benefit in respect of a professional service rendered by, or on behalf of, a person (the <b><i>professional</i></b>) while hospital treatment or hospital-substitute treatment is provided if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-20AAA__para-a">
              <num>a</num>
              <content>
                <p>any of the following conditions is satisfied:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-i">
              <num>i</num>
              <content>
                <p>the insurer concerned has an arrangement with the professional for the provision of treatment to persons insured by the insurer;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-ii">
              <num>ii</num>
              <content>
                <p>in the case of hospital treatment authorised by the operator of a hospital (see subsection (7))—the insurer has an arrangement with the operator of the hospital for the provision of treatment to persons insured by the insurer, and the operator of the hospital has an arrangement with the professional under which treatment is provided to persons insured by the insurer;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-iii">
              <num>iii</num>
              <content>
                <p>in the case of hospital-substitute treatment authorised by an organization (see subsection (7))—the insurer has an arrangement with the organization for the provision of treatment to persons insured by the insurer, and the organization has an arrangement with the professional under which treatment is provided to persons insured by the insurer; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-b">
              <num>b</num>
              <content>
                <p>the arrangement or arrangements (as the case may be) cover (wholly or partly) a liability of the insurer, the operator of the hospital or the organization to pay fees and charges in respect of the professional service; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-c">
              <num>c</num>
              <content>
                <p>the right to payment of the medicare benefit has not been assigned under an agreement entered into under subsection 20A(1).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-20AAA__subclause-2">
              <num>2</num>
              <content>
                <p>For the purposes of subsection 20A(2A), if subsection (1) of this section applies to the assignor’s right to the payment of the medicare benefit in respect of the professional service, it is taken to be assigned to whichever of the following is applicable:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-20AAA__para-a">
              <num>a</num>
              <content>
                <p>if the claim for the medicare benefit is made by an approved billing agent—the approved billing agent;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-b">
              <num>b</num>
              <content>
                <p>otherwise—the insurer.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-20AAA__subclause-3">
              <num>3</num>
              <content>
                <p>	(3)	For the purposes of paragraph 20A(2)(e), this subsection applies to the assignor’s right to the payment of a medicare benefit in respect of a professional service rendered by, or on behalf of, a person (the <b><i>professional</i></b>) while hospital treatment or hospital-substitute treatment is provided if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-20AAA__para-a">
              <num>a</num>
              <content>
                <p>	(a)	unless paragraph (b) applies—the medicare benefit is covered by a request made by the assignor for the purposes of this paragraph, in accordance with requirements specified in the regulations, to the following person (the <b><i>responsible </i></b><b><i>provider</i></b>):</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-i">
              <num>i</num>
              <content>
                <p>in the case of hospital treatment authorised by the operator of a hospital (see subsection (7))—the operator of the hospital;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-ii">
              <num>ii</num>
              <content>
                <p>in the case of hospital-substitute treatment authorised by an organization (see subsection (7))—the organization;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-iii">
              <num>iii</num>
              <content>
                <p>in the case of hospital-substitute treatment to which subparagraph (ii) does not apply—the professional; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-b">
              <num>b</num>
              <content>
                <p>if a request mentioned in paragraph (a) has been modified, in accordance with requirements specified in the regulations, after the professional service is rendered, by the responsible provider or a person authorised by the responsible provider—the medicare benefit is covered by the request as modified; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-c">
              <num>c</num>
              <content>
                <p>the request, or the request as modified (as the case may be), provides that the assignor’s right to the payment of the medicare benefit in respect of the professional service is to be assigned to the insurer concerned or an approved billing agent; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-d">
              <num>d</num>
              <content>
                <p>any requirements specified in the regulations are met; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-e">
              <num>e</num>
              <content>
                <p>the right to payment of the medicare benefit has not been assigned under an agreement entered into under subsection 20A(1), or because of the operation of subsection (1) or (5) of this section.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-20AAA__subclause-4">
              <num>4</num>
              <content>
                <p>For the purposes of subsection 20A(2A), if subsection (3) of this section applies to the assignor’s right to the payment of the medicare benefit in respect of the professional service, it is taken to be assigned to the insurer or approved billing agent mentioned in paragraph (3)(c) of this section.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-20AAA__subclause-5">
              <num>5</num>
              <content>
                <p>	(5)	For the purposes of paragraph 20A(2)(e), this subsection applies to the assignor’s right to the payment of a medicare benefit in respect of a professional service rendered by, or on behalf of, a person (the <b><i>professional</i></b>) while hospital treatment or hospital-substitute treatment is provided if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-20AAA__para-a">
              <num>a</num>
              <content>
                <p>	(a)	another professional service (the <b><i>related professional service</i></b>) is rendered while the hospital treatment or hospital-substitute treatment is provided; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-b">
              <num>b</num>
              <content>
                <p>the right to payment of the medicare benefit in respect of the related professional service is taken to be assigned to the insurer concerned or an approved billing agent because of the operation of subsection (1) or (3) of this section; and</p>

                <p>the professional service:</p>
              </content>
            </paragraph>

                <p>is rendered for a complication that arises during the related professional service; or</p>

                <p>is unplanned but is rendered during planned treatment of which the related professional service is part, and is, in the view of the professional, necessary and urgent; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-d">
              <num>d</num>
              <content>
                <p>the right to payment of the medicare benefit has not been assigned under an agreement entered into under subsection 20A(1), or because of the operation of subsection (1) of this section.</p>
              </content>
            </paragraph>

              <num>6</num>
              <content>
                <p>For the purposes of subsection 20A(2A), if subsection (5) of this section applies to the assignor’s right to the payment of the medicare benefit in respect of the professional service, it is taken to be assigned to the insurer or approved billing agent mentioned in paragraph (5)(b) of this section.</p>

              <num>7</num>
              <content>
                <p>For the purposes of this section, the operator of a hospital, or an organization, authorises the provision of hospital treatment, or hospital-substitute treatment, to a patient if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-20AAA__para-a">
              <num>a</num>
              <content>
                <p>the operator of the hospital, or the organization, is a body corporate or a body politic; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-b">
              <num>b</num>
              <content>
                <p>the treatment is provided:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-i">
              <num>i</num>
              <content>
                <p>by a person who is authorised by the operator of the hospital, or the organization, to provide the treatment; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-ii">
              <num>ii</num>
              <content>
                <p>under the management or control of such a person.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-20AAA__subclause-8">
              <num>8</num>
              <content>
                <p>Without limiting this section, regulations prescribing requirements for the purposes of this section may specify:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-20AAA__para-a">
              <num>a</num>
              <content>
                <p>requirements relating to the content of requests or modifications to be made, or the manner and form in which the requests or modifications are to be made; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-b">
              <num>b</num>
              <content>
                <p>requirements relating to information that must be given and the manner and form in which the information must be given; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-c">
              <num>c</num>
              <content>
                <p>requirements relating to the giving of notifications at the time or after modifications are made, or before or after information is given; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20AAA__para-d">
              <num>d</num>
              <content>
                <p>in relation to the making or modifying of a request—the circumstances in which the request may be made or modified.</p>
              </content>
            </paragraph>

            <heading>Subsections 20B(1) to (3)</heading>

              <p>Repeal the subsections, substitute:</p>

                <p>in the manner and form (if any) approved, by notifiable instrument, by the Chief Executive Medicare; and</p>
              </content>
            </paragraph>

                <p>within the period of 2 years, or such further period as is allowed in accordance with subsection (3A), after the rendering of the service.</p>

                <p>the medicare benefit is paid to the insurer or approved billing agent; and</p>

            </paragraph>

            </paragraph>
            <paragraph eId="schedule-1__clause-127__para-ii">
              <num>ii</num>

                <p><quantity refersTo="#deadline">within 6 months</quantity> of the payment.</p>

            </paragraph>

                <p>	(b)	an eligible person (the <b><i>assignor</i></b>) makes a request for the purposes of paragraph 20AAA(3)(a) to the responsible provider; and</p>

                <p>the assignor asks the responsible provider for a copy of the terms of the request; and</p>
              </content>
            </paragraph>

                <p>the responsible provider does not ensure that the assignor is given a copy of the terms of the request as soon as practicable after the assignor asks for it.</p>

                <p>A person contravenes this subsection if:</p>

                <p>	(b)	an eligible person (the <b><i>assignor</i></b>) makes a request for the purposes of paragraph 20AAA(3)(a) to the responsible provider; and</p>

            </paragraph>

              <content>
                <p>the responsible provider, or a person authorised by the responsible provider, modifies the request as mentioned in paragraph 20AAA(3)(b); and</p>

              <num>d</num>
              <content>
                <p>the responsible provider does not ensure that the assignor is given a notification:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-127__para-i">

                <p>in accordance with any requirements specified in the regulations; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-127__para-ii">
              <num>ii</num>

                <p>as soon as practicable after modifying the request.</p>

                <p>A person contravenes this subsection if:</p>

                <p>give a notification to an eligible person; or</p>
              </content>
            </paragraph>

                <p>	(b)	the professional service was rendered by, or on behalf of, a person (the <b><i>professional</i></b>) while hospital treatment or hospital-substitute treatment was provided.</p>

            </paragraph>

                <p>The records must be kept in:</p>

                <p>an electronic form; or</p>

                <p>on the commencement of this Schedule, the pathology service had not yet been rendered.</p>

              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration.
