          <p>		This Act is the <i>Criminal Code Amendment (Deepfake Sexual Material)</i><i> Act </i><i>2024</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p>Note:	Paragraph (b) includes images, videos or audio depicting a person that have been edited or entirely created using digital technology (including artificial intelligence), generating a realistic but false depiction of the person. Examples of such material are “deepfakes”.</p>
              <p>Note:	A defendant bears an evidential burden in relation to the matters in subsection (3). See subsection 13.3(3).</p>

              <heading>Using a carriage service to transmit sexual material without consent</heading>

                <p><b><i>transmit</i></b> includes make available, publish, distribute, advertise and promote.</p>

                  <p>	(1)	A person (the <b><i>first person</i></b>) commits an offence if:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-a">
                <num>a</num>
                <content>
                  <p>the first person uses a carriage service to transmit material of another person; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-b">
                <num>b</num>
                <content>
                  <p>the other person is, or appears to be, 18 years of age or older; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-c">
                <num>c</num>
                <content>
                  <p>the material depicts, or appears to depict:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-i">
                <num>i</num>
                <content>
                  <p>the other person engaging in a sexual pose or sexual activity (whether or not in the presence of other persons); or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-ii">
                <num>ii</num>
                <content>
                  <p>a sexual organ or the anal region of the other person; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-iii">
                <num>iii</num>
                <content>
                  <p>if the other person is female—the other person’s breasts; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-d">
                <num>d</num>
                <content>
                  <p>the first person:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-i">
                <num>i</num>
                <content>
                  <p>knows that the other person does not consent to the transmission of the material; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-ii">
                <num>ii</num>
                <content>
                  <p>is reckless as to whether the other person consents to the transmission of the material.</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-a">
                <num>a</num>
                <content>
                  <p>(a)	the definition of <b><i>child abuse material</i></b>; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-b">
                <num>b</num>
                <content>
                  <p>the offences relating to child abuse material in Subdivision D.</p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17A__subclause-2">
                <num>2</num>
                <content>
                  <p>For the purposes of subsection (1), it is irrelevant whether the material transmitted:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-a">
                <num>a</num>
                <content>
                  <p>is in an unaltered form; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-b">
                <num>b</num>
                <content>
                  <p>has been created, or altered in any way, using technology.</p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17A__subclause-3">
                <num>3</num>
                <content>
                  <p>Subsection (1) does not apply if:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-a">
                <num>a</num>
                <content>
                  <p>transmitting the material is necessary for, or of assistance in:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-i">
                <num>i</num>
                <content>
                  <p>enforcing a law of the Commonwealth, a State or a Territory; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-ii">
                <num>ii</num>
                <content>
                  <p>monitoring compliance with, or investigating a contravention of, a law of the Commonwealth, a State or a Territory; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-b">
                <num>b</num>
                <content>
                  <p>transmitting the material is for the purposes of proceedings in a court or tribunal; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-c">
                <num>c</num>
                <content>
                  <p>transmitting the material is for a genuine medical or scientific purpose; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-d">
                <num>d</num>
                <content>
                  <p>a reasonable person would consider transmitting the material to be acceptable, having regard to the following:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-i">
                <num>i</num>
                <content>
                  <p>the nature and content of the material;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-ii">
                <num>ii</num>
                <content>
                  <p>the circumstances in which the material was transmitted;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-iii">
                <num>iii</num>
                <content>
                  <p>the age, intellectual capacity, vulnerability or other relevant circumstances of the person depicted, or appearing to be depicted, in the material;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-iv">
                <num>iv</num>
                <content>
                  <p>the degree to which the transmission of the material affects the privacy of the person depicted, or appearing to be depicted, in the material;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-v">
                <num>v</num>
                <content>
                  <p>the relationship between the person transmitting the material and the person depicted, or appearing to be depicted, in the material;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17A__para-vi">
                <num>vi</num>
                <content>
                  <p>any other relevant matters.</p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17A__subclause-4">
                <num>4</num>
                <content>
                  <p>In this section:</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17A__subclause-5">
                <num>5</num>
                <content>
                  <p>	(5)	In this section, being <b><i>reckless</i></b> in relation to consent includes not giving any thought to whether or not the person is consenting.</p>
                </content>
              </hcontainer>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17AA">
              <num>474.17AA</num>
              <heading>Aggravated offences involving transmission of sexual material without consent</heading>
              <content>
                <p>Aggravated offence—transmission of sexual material without consent after certain civil penalty orders were made</p>
                <p>Aggravated offence—creation or alteration of sexual material transmitted without consent</p>
              </content>
              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17AA__subclause-1">
                <num>1</num>
                <content>
                  <p>A person commits an offence against this subsection if:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-5__subclause-474-17AA__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the person commits an offence (the <b><i>underlying offence</i></b>) against subsection 474.17A(1); and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17AA__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	before the commission of the underlying offence, 3 or more civil penalty orders were made against the person under the <i>Regulatory Powers (Standard Provisions) Act 2014</i> in relation to either or both of the following:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17AA__para-i">
                <num>i</num>
                <content>
                  <p>	(i)	contraventions of subsection 75(1) of the <i>Online Safety Act 2021</i>;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17AA__para-ii">
                <num>ii</num>
                <content>
                  <p>	(ii)	contraventions of <i>Online Safety Act 2021</i> that relate to removal notices given under section 89 of that Act.<ref href="#sec-91">section 91</ref> of the </p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17AA__subclause-2">
                <num>2</num>
                <content>
                  <p>There is no fault element for the physical element described in paragraph (1)(a) other than the fault elements (however described), if any, for the underlying offence.</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17AA__subclause-3">
                <num>3</num>
                <content>
                  <p>To avoid doubt, a person does not commit the underlying offence for the purposes of paragraph (1)(a) if the person has a defence to the underlying offence.</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17AA__subclause-4">
                <num>4</num>
                <content>
                  <p>Absolute liability applies to paragraph (1)(b).</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17AA__subclause-5">
                <num>5</num>
                <content>
                  <p>A person commits an offence against this subsection if:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-5__subclause-474-17AA__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the person commits an offence (the <b><i>underlying offence</i></b>) against subsection 474.17A(1); and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17AA__para-b">
                <num>b</num>
                <content>
                  <p>the person was responsible for the creation or alteration of the material.</p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17AA__subclause-6">
                <num>6</num>
                <content>
                  <p>There is no fault element for the physical element described in paragraph (5)(a) other than the fault elements (however described), if any, for the underlying offence.</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17AA__subclause-7">
                <num>7</num>
                <content>
                  <p>To avoid doubt, a person does not commit the underlying offence for the purposes of paragraph (5)(a) if the person has a defence to the underlying offence.</p>

              <num>474.17AB</num>
              <heading>Double jeopardy etc. provisions—offences involving transmission of sexual material without consent</heading>
              <content>
                <p>Double jeopardy</p>
                <p>When conviction must be set aside</p>
                <p>the court must set aside the conviction.</p>
                <p>the setting aside of the conviction does not prevent proceedings from being instituted against the person for an offence against subsection 474.17A(1) or 474.17AA(5) in relation to the conduct that constituted the aggravated offence.</p>

              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17AB__subclause-1">
                <num>1</num>
                <content>
                  <p>	(1)	A person who has been convicted or acquitted of an offence (the <b><i>aggravated offence</i></b>) specified in column 1 of an item of the following table may not be convicted of an offence specified in column 2 of the item in relation to the conduct that constituted the aggravated offence.</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17AB__subclause-2">
                <num>2</num>
                <content>
                  <p>Subsection (1) does not prevent an alternative verdict under <ref href="#sec-474">section 474</ref>.17B.</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17AB__subclause-3">
                <num>3</num>
                <content>
                  <p>	(3)	A person who has been convicted or acquitted of an offence (the <b><i>underlying offence</i></b>) against subsection 474.17A(1) may not be convicted of an offence against subsection 474.17AA(1) or (5) in relation to the conduct that constituted the underlying offence.</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17AB__subclause-4">
                <num>4</num>
                <content>
                  <p>If:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-5__subclause-474-17AB__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	a person has been convicted by a court of an offence against subsection 474.17AA(1) on the basis that 3 or more civil penalty orders were made against the person under the <i>Regulatory Powers (Standard Provisions) Act 2014</i> in relation to either or both of the following:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17AB__para-i">
                <num>i</num>
                <content>
                  <p>	(i)	contraventions of subsection 75(1) of the <i>Online Safety Act 2021</i>;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17AB__para-ii">
                <num>ii</num>
                <content>
                  <p>	(ii)	contraventions of <i>Online Safety Act 2021</i> that relate to removal notices given under section 89 of that Act; and<ref href="#sec-91">section 91</ref> of the </p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17AB__para-b">
                <num>b</num>
                <content>
                  <p>one or more of those civil penalty orders are set aside or reversed on appeal; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17AB__para-c">
                <num>c</num>
                <content>
                  <p>if the civil penalty orders covered by paragraph (b) of this subsection had never been made, the person could not have been convicted of the offence; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17AB__para-d">
                <num>d</num>
                <content>
                  <p>the person applies to the court for the conviction to be set aside;</p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-474-17AB__subclause-5">
                <num>5</num>
                <content>
                  <p>If:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-5__subclause-474-17AB__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	a person has been convicted by a court of an offence (the <b><i>aggravated offence</i></b>) against subsection 474.17AA(1); and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-5__subclause-474-17AB__para-b">
                <num>b</num>
                <content>
                  <p>the court sets aside the conviction under subsection (4) of this section;</p>
                </content>
              </paragraph>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-6">
            <num>6</num>
            <heading>Section 474.17B of the Criminal Code</heading>
            <content>
              <p>Repeal the section, substitute:</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-6__subclause-474-17B">
              <num>474.17B</num>
              <heading>Alternative verdict if aggravated offence not proven</heading>
              <hcontainer name="subclause" eId="schedule-1__clause-6__subclause-474-17B__subclause-1">
                <num>1</num>
                <content>
                  <p>If, on a trial of a person for an offence specified in column 1 of an item of the following table, the trier of fact:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-6__subclause-474-17B__para-a">
                <num>a</num>
                <content>
                  <p>is not satisfied that the person is guilty of the offence; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-6__subclause-474-17B__para-b">
                <num>b</num>
                <content>
                  <p>is satisfied beyond reasonable doubt that the person is guilty of an offence against a provision specified in column 2 of the item;</p>
                </content>
              </paragraph>
              <content>
                <p>it may find the person not guilty of the offence specified in column 1 but guilty of an offence specified in column 2 of that item.</p>
              </content>
              <hcontainer name="subclause" eId="schedule-1__clause-6__subclause-474-17B__subclause-2">
                <num>2</num>
                <content>
                  <p>Subsection (1) applies only if the person has been accorded procedural fairness in relation to the finding of guilt for the offence specified in column 2 of the relevant item.</p>
                </content>
              </hcontainer>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-7">
            <num>7</num>
            <heading>Application of amendments</heading>
            <content>
