          <p>		This Act is the <i>Telecommunications Amendment (SMS Sender ID Regist</i><i>er</i><i>)</i><i> Act </i><i>2024</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

            <heading>Simplified outline of this Part</heading>
            <content>
              <p>•	The ACMA must ensure that the SMS Sender ID Register is established and maintained.</p>
              <p>•	The SMS Sender ID Register is a register of sender identifications that have been accepted by the ACMA. Other information may be contained in the register.</p>
              <p>•	Various approved entities may apply to the ACMA to have a sender identification accepted.</p>
              <p>•	The ACMA may make determinations relating to:</p>

            <heading>Definition of sender identification</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-484C__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	A <b><i>sender identification</i></b> is one or more of the things covered by subsection (2) that is a message header that is, or is to be, used in a communication that is, or is to be, sent using any of the following services:</p>

              <content>
                <p>a short message service;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484C__para-b">
              <num>b</num>
              <content>
                <p>a multimedia message service;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484C__para-c">
              <num>c</num>
              <content>
                <p>if another service is specified in an instrument under subsection (4)—that other service.</p>
              </content>
            </paragraph>

                <p>	(3)	Despite subsection (1), a message header is not a <b><i>sender identification</i></b> if the message header consists only of numbers.</p>

                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, specify a service for the purposes of paragraph (1)(c).</p>

                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, specify a thing for the purposes of paragraph (2)(d).</p>

            <num>484D</num>
            <heading>Definition of spoofing sender identification</heading>
            <content>
              <p>		A sender identification is a <b><i>spoofing sender identification</i></b> if:</p>
            </content>
            <paragraph eId="schedule-1__clause-484D__para-a">
              <num>a</num>
              <content>
                <p>the sender identification is a message header that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484D__para-i">
              <num>i</num>
              <content>
                <p>identifies, or purportedly identifies, an entity covered by subsection 484F(2); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484D__para-ii">
              <num>ii</num>
              <content>
                <p>identifies, or purportedly identifies, a thing or matter; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484D__para-b">
              <num>b</num>
              <content>
                <p>if that message header were used in a communication, that use would be likely to cause a reasonable person to believe that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484D__para-i">
              <num>i</num>
              <content>
                <p>if subparagraph (a)(i) applies—the entity sent the communication or authorised the sending of the communication; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484D__para-ii">
              <num>ii</num>
              <content>
                <p>if subparagraph (a)(ii) applies—the purpose of the communication is to give information that is true in relation to the thing or matter; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484D__para-c">
              <num>c</num>
              <content>
                <p>that belief would be incorrect.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-484E">
            <num>484E</num>
            <heading>SMS Sender ID Register</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-484E__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	The ACMA must establish, or arrange for a person (a <b><i>contracted service provider</i></b>) to establish on behalf of the ACMA, a register to be known as the SMS Sender ID Register.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484E__subclause-2">
              <num>2</num>
              <content>
                <p>The ACMA must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-484E__para-a">
              <num>a</num>
              <content>
                <p>maintain the entire register; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484E__para-b">
              <num>b</num>
              <content>
                <p>	(b)	arrange for a person (a <b><i>contracted service provider</i></b>) to maintain, on behalf of the ACMA, the entire register; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484E__para-c">
              <num>c</num>
              <content>
                <p>	(c)	maintain some of the content of the register and arrange for a person (a <b><i>contracted service provider</i></b>) to maintain, on behalf of the ACMA, the remaining content of the register.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-484E__subclause-3">
              <num>3</num>
              <content>
                <p>The register is to contain:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-484E__para-a">
              <num>a</num>
              <content>
                <p>each sender identification that is accepted under subsection 484G(4); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484E__para-b">
              <num>b</num>
              <content>
                <p>any other kind of information determined under subsection (8) of this section.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-484E__subclause-4">
              <num>4</num>
              <content>
                <p>If a determination made under subsection 484L(1) specifies a period for the purposes of this subsection, a sender identification that is accepted under subsection 484G(4) must be entered in the register before the end of that period.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484E__subclause-5">
              <num>5</num>
              <content>
                <p>The register is to be kept in electronic form.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484E__subclause-6">
              <num>6</num>
              <content>
                <p>The register is not a legislative instrument.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484E__subclause-7">
              <num>7</num>
              <content>
                <p>The ACMA may:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-484E__para-a">
              <num>a</num>
              <content>
                <p>	(a)	make the following information publicly available (to the extent that the information is not personal information within the meaning of the <i>Privacy Act 1988</i>):</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484E__para-i">
              <num>i</num>
              <content>
                <p>sender identifications contained in the register;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484E__para-ii">
              <num>ii</num>
              <content>
                <p>the identities of the entities to which those sender identifications relate; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484E__para-b">
              <num>b</num>
              <content>
                <p>	(b)	disclose some or all of the information (including personal information within the meaning of the <i>Privacy Act 1988</i>) in the register to a Commonwealth entity (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>) if:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484E__para-i">
              <num>i</num>
              <content>
                <p>the disclosure is for the purposes of assisting the entity to perform its functions or duties; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484E__para-ii">
              <num>ii</num>
              <content>
                <p>the disclosure is for the purposes of assisting the entity to exercise its powers.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-484E__subclause-8">
              <num>8</num>
              <content>
                <p>	(8)	The Minister may, by legislative instrument, determine one or more kinds of information (including personal information within the meaning of the <i>Privacy Act 1988</i>) for the purposes of paragraph (3)(b). The Minister must be satisfied that each kind of information relates to sender identifications covered by paragraph (3)(a).</p>

            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484E__subclause-9">
              <num>9</num>
              <content>
                <p>The ACMA must comply with subsection (1) as soon as practicable after the commencement of this subsection.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484E__subclause-10">
              <num>10</num>
              <content>
                <p>Subsections (3) and (4) have effect subject to this Part.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	For example, <ref href="#sec-484H">section 484H</ref> provides for the removal of entries from the register.</p>
            </content>

                <p>This subsection covers the following entities:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-484F__para-a">
              <num>a</num>
              <content>
                <p>an individual;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484F__para-b">
              <num>b</num>
              <content>
                <p>a body corporate;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484F__para-c">
              <num>c</num>
              <content>
                <p>a corporation sole;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484F__para-d">
              <num>d</num>
              <content>
                <p>a body politic;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484F__para-e">
              <num>e</num>
              <content>
                <p>	(e)	a government entity (within the meaning of the <i>A New Tax System (Australian Business Number) Act 1999</i>);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484F__para-f">
              <num>f</num>
              <content>
                <p>a partnership;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484F__para-g">
              <num>g</num>
              <content>
                <p>any other unincorporated association or body of persons;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484F__para-h">
              <num>h</num>
              <content>
                <p>a trust;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484F__para-i">
              <num>i</num>
              <content>
                <p>	(i)	a superannuation fund (within the meaning of the <i>Superannuation Industry (Supervision) Act 1993</i>).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-484F__subclause-3">
              <num>3</num>
              <content>
                <p>An application by an entity under subsection (1) must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-484F__para-a">
              <num>a</num>
              <content>
                <p>be made in the form approved under subsection (10); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484F__para-b">
              <num>b</num>
              <content>
                <p>contain such information as the form requires; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484F__para-c">
              <num>c</num>
              <content>
                <p>	(c)	be accompanied by the applicable charge (if any) fixed by a determination under <i>Australian Communications and Media Authority Act 2005</i>; and<ref href="#sec-60">section 60</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484F__para-d">
              <num>d</num>
              <content>
                <p>comply with any requirements determined under subsection 484L(1) of this Act for the purposes of this paragraph.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-484F__subclause-4">
              <num>4</num>
              <content>
                <p>Without limiting the requirements that may be determined for the purposes of paragraph (3)(d), the requirements may include the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-484F__para-a">
              <num>a</num>
              <content>
                <p>requirements relating to the making of the application;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484F__para-b">
              <num>b</num>
              <content>
                <p>requirements relating to the verification of the applicant’s identity.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-484F__subclause-5">
              <num>5</num>
              <content>
                <p>The ACMA must, in writing, grant the entity an approval under this section if the application complies with subsection (3).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484F__subclause-6">
              <num>6</num>
              <content>
                <p>The ACMA must, in writing, refuse to grant the entity an approval under this section if the application does not comply with subsection (3).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484F__subclause-7">
              <num>7</num>
              <content>
                <p>The ACMA may, in writing, revoke an entity’s approval under this section if the ACMA is satisfied that it would be appropriate in all the circumstances to revoke the approval.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484F__subclause-8">
              <num>8</num>
              <content>
                <p>The ACMA must give the entity written notice of a decision under subsection (5), (6) or (7).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484F__subclause-9">
              <num>9</num>
              <content>
                <p>If the decision was made by the operation of a computer program referred to in subsection 484J(1), the notice under subsection (8) of this section must also notify the entity of the making of the decision by the operation of the computer program.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484F__subclause-10">
              <num>10</num>
              <content>
                <p>The ACMA may, by writing, approve a form for the purposes of paragraph (3)(a). The ACMA must publish the form on its website.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-484G">
            <num>484G</num>
            <heading>Application for registration of sender identifications</heading>
            <content>
              <p>Application</p>
              <p>Acceptance of sender identifications</p>
              <p>Note:	If one or more sender identifications are accepted, those sender identifications must be included in the SMS Sender ID Register (see subsection 484E(3)).</p>
              <p>Refusal of sender identifications where criteria not met</p>
              <p>Refusal of application where criteria not met</p>
              <p>Notice of decision</p>
              <p>Note:	The notice must also include a statement about review rights (see <ref href="#sec-557">section 557</ref>).</p>

                <p>An entity that holds an approval under <ref href="#sec-484F">section 484F</ref> may apply to the ACMA for one or more sender identifications to be registered in the SMS Sender ID Register.</p>

                <p>The application must:</p>

                <p>requirements relating to the making of the application;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484G__para-b">

                <p>requirements relating to the verification of the applicant’s identity.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-484G__subclause-4">
              <num>4</num>
              <content>
                <p>The ACMA must, in writing, accept one or more sender identifications specified in an application made under subsection (1) if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-484G__para-a">
              <num>a</num>
              <content>
                <p>the criteria (if any) determined under subsection 484L(1) for the purposes of this paragraph are met in relation to those sender identifications; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484G__para-b">
              <num>b</num>
              <content>
                <p>the criteria (if any) determined under subsection 484L(1) for the purposes of this paragraph are met in relation to the application; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484G__para-c">
              <num>c</num>
              <content>
                <p>the application complies with subsection (2) of this section.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-484G__subclause-5">
              <num>5</num>
              <content>
                <p>Without limiting the criteria that may be determined under subsection 484L(1) for the purposes of paragraph (4)(a) of this section, the criteria may relate to ensuring that a spoofing sender identification is not accepted under subsection (4) of this section.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484G__subclause-6">
              <num>6</num>
              <content>
                <p>The ACMA must, in writing, refuse one or more sender identifications specified in an application made under subsection (1) if the criteria (if any) determined under subsection 484L(1) for the purposes of paragraph (4)(a) of this section are not met in relation to those sender identifications.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484G__subclause-7">
              <num>7</num>
              <content>
                <p>The ACMA must, in writing, refuse an application made under subsection (1) if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-484G__para-a">
              <num>a</num>
              <content>
                <p>the criteria (if any) determined under subsection 484L(1) for the purposes of paragraph (4)(b) of this section are not met in relation to the application; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484G__para-b">
              <num>b</num>
              <content>
                <p>the application does not comply with subsection (2) of this section.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-484G__subclause-8">
              <num>8</num>
              <content>
                <p>The ACMA must give the applicant written notice of a decision to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-484G__para-a">
              <num>a</num>
              <content>
                <p>accept one or more sender identifications specified in the application; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484G__para-b">
              <num>b</num>
              <content>
                <p>refuse one or more sender identifications specified in the application; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484G__para-c">
              <num>c</num>
              <content>
                <p>refuse the application.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-484G__subclause-9">
              <num>9</num>
              <content>
                <p>If the decision was made by the operation of a computer program referred to in subsection 484J(1), the notice under subsection (8) of this section must also notify the applicant of the making of the decision by the operation of the computer program.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-484H">
            <num>484H</num>
            <heading>Removal of entries from the SMS Sender ID Register</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-484H__subclause-1">
              <num>1</num>
              <content>
                <p>The ACMA may remove an entry from the SMS Sender ID Register if the ACMA is satisfied that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-484H__para-a">
              <num>a</num>
              <content>
                <p>the sender identification covered by the entry is offensive or misleading or deceptive; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484H__para-b">
              <num>b</num>
              <content>
                <p>the sender identification covered by the entry is a spoofing sender identification; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484H__para-c">
              <num>c</num>
              <content>
                <p>it would be appropriate in all the circumstances to remove the entry.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-484H__subclause-2">
              <num>2</num>
              <content>
                <p>The ACMA is not required to observe any requirements of the natural justice hearing rule in exercising the power under subsection (1).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484H__subclause-3">
              <num>3</num>
              <content>
                <p>Subsection (1) does not limit a determination made under subsection 484L(4) about the matter mentioned in paragraph 484L(4)(c).</p>

            <num>484J</num>
            <heading>Automation of administrative action</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-484J__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	The Chair of the ACMA may, in writing, arrange for the use<i>, </i>under<i> </i>the<i> </i>Chair’s oversight, of computer programs to take administrative action that may, or must, be taken by the ACMA under this Part.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484J__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	<b><i>Administrative action</i></b> is:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-484J__para-a">
              <num>a</num>
              <content>
                <p>making a decision under subsection 484F(5) or (6); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484J__para-b">
              <num>b</num>
              <content>
                <p>making a decision under subsection 484G(4), (6) or (7); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484J__para-c">
              <num>c</num>
              <content>
                <p>giving a notice under subsection 484F(8) or 484G(8); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484J__para-d">
              <num>d</num>

                <p>doing, or refusing or failing to do, anything related to making a decision under subsection 484F(5) or (6) or 484G(4), (6) or (7).</p>

            <hcontainer name="subclause" eId="schedule-1__clause-484J__subclause-4">
              <num>4</num>
              <content>
                <p>The ACMA may make a decision in substitution for a decision the ACMA is treated as having taken under subsection (3) if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-484J__para-a">
              <num>a</num>
              <content>
                <p>in any case—the ACMA is satisfied that the decision taken by the operation of the computer program is not correct; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484J__para-b">
              <num>b</num>
              <content>
                <p>if the decision taken by the operation of the computer program is a decision under subsection 484G(4) to accept one or more sender identifications—the ACMA is satisfied that one or more of those sender identifications are spoofing sender identifications.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-484J__subclause-5">
              <num>5</num>
              <content>
                <p>The substituted decision takes effect on:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-484J__para-a">
              <num>a</num>
              <content>
                <p>if the ACMA specifies the day on which the substituted decision takes effect (which may be earlier than the day the substituted decision is made)—that specified day; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-484J__para-b">
              <num>b</num>
              <content>
                <p>otherwise—the day of the decision taken by the operation of the computer program.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-484J__subclause-6">
              <num>6</num>
              <content>
                <p>An arrangement under subsection (1) is not a legislative instrument.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484J__subclause-7">
              <num>7</num>
              <content>
                <p>The Chair of the ACMA may, in writing, delegate the Chair’s power under subsection (1) to a member of the ACMA staff who is an SES employee or acting SES employee.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-484K">
            <num>484K</num>
            <heading>Oversight and safeguards for automation of administrative action</heading>
            <content>
              <p>Chair to ensure administrative action is action that could be validly taken</p>

              <num>1</num>
              <content>
                <p>The Chair of the ACMA must take all reasonable steps to ensure that administrative action taken by the operation of a computer program under an arrangement under subsection 484J(1) is administrative action that the ACMA could validly take under this Part.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484K__subclause-2">
              <num>2</num>
              <content>
                <p>Without limiting subsection (1), the Chair of the ACMA must do the things (if any) prescribed by the regulations for the purposes of this subsection.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484K__subclause-3">
              <num>3</num>
              <content>
                <p>A failure to comply with subsection (1) or (2) does not affect the validity of the administrative action taken by the operation of a computer program under an arrangement under subsection 484J(1).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484K__subclause-4">
              <num>4</num>
              <content>
                <p>If, under subsection 484J(4), the ACMA makes a decision in substitution for a decision the ACMA is treated as having taken under subsection 484J(3), the ACMA must, <quantity refersTo="#deadline">within 14 days</quantity> of the making of the substituted decision, give the entity the subject of the substituted decision written notice of the substituted decision.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-484K__subclause-5">
              <num>5</num>
              <content>
                <p>If the Chair of the ACMA makes an arrangement under subsection 484J(1) in relation to particular provisions of this Part, the Chair must cause a statement to be published on the ACMA’s website:</p>

              <num>a</num>
              <content>
                <p>to the effect that the Chair has made such an arrangement; and</p>
              </content>
            </paragraph>

                <p>setting out those particular provisions.</p>

            </paragraph>

                <p>	(6)	The Chair of the ACMA, when preparing the ACMA’s annual report under <i>Public Governance, Performance and Accountability Act 2013</i> for a period, must include the following information in that report:<ref href="#sec-46">section 46</ref> of the </p>
