            <heading>Objects of this Act</heading>
            <content>
              <p>The objects of this Act are:</p>

                <p>to reduce the incidence of gender-based violence in higher education; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__dvs-1__sec-3__para-b">

                <p>to establish national standards and requirements for higher education providers to prevent and respond to gender-based violence; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__dvs-1__sec-3__para-c">
              <num>c</num>
              <content>
                <p>to establish a regulatory framework to monitor and enforce compliance with the national standards and requirements.</p>

            <heading>Simplified outline of this Act</heading>
            <content>
              <p>This Act provides for a national code, the National Higher Education Code to Prevent and Respond to Gender-based Violence.</p>
              <p>The national code applies to higher education providers, and can impose various requirements on them in relation to gender-based violence. The national code is a legislative instrument made by <role refersTo="#minister">the Minister</role>.</p>
              <p>The purpose of the national code, and the kinds of requirements that the national code can impose on higher education providers, are set out in <ref href="#part-3">Part 3</ref>.</p>
              <p>A higher education provider that fails to comply with the national code may be liable to a civil penalty. This Act also includes other compliance and enforcement powers, including compliance notices and powers under the Regulatory Powers Act.</p>
              <p><role refersTo="#secretary">The Secretary</role> and authorised officers must comply with the basic principles for regulation set out in Part 2 when exercising compliance and enforcement powers, and any other powers under this Act or legislative instruments made under this Act (including the national code).</p>
              <p><role refersTo="#secretary">The Secretary</role> may use, disclose and publish certain information collected under this Act, including information about compliance and enforcement activities carried out in relation to higher education providers.</p>
              <p>There is a delayed application for the civil penalty provisions, compliance notices and certain other compliance and enforcement powers in this Act. These begin to apply to different kinds of higher education providers on <date date="2026-01-01">1 January 2026</date> or <date date="2027-01-01">1 January 2027</date> (see section 46).</p>

          <heading>Definitions</heading>

            <heading>Definitions</heading>
            <content>
              <p>In this Act:</p>
              <p><b><i>Australia</i></b>, when used in a geographical sense, includes the external Territories.</p>
              <p><term refersTo="#term-authorised-officer">authorised officer</term> means <def>a person appointed as an authorised officer under <ref href="#sec-33">section 33</ref>.</def></p>
              <p><term refersTo="#term-civil-penalty-provision">civil penalty provision</term> has the same meaning as <def>in the Regulatory Powers Act.</def></p>
              <p><term refersTo="#term-commonwealth-body">Commonwealth body</term> includes <def>a Department of State and an authority or agency of the Commonwealth.</def></p>
              <p><term refersTo="#term-constitutional-corporation">constitutional corporation</term> means <def>a corporation to which paragraph 51(xx) of the Constitution applies.</def></p>
              <p><term refersTo="#term-evidential-material">evidential material</term> has the same meaning as <def>in the Regulatory Powers Act.</def></p>
              <p><term refersTo="#term-gender-based-violence">gender-based violence</term> means <def>any form of physical or non-physical violence, harassment, abuse or threats, based on gender, that results in, or is likely to result in, harm, coercion, control, fear or deprivation of liberty or autonomy.</def></p>
              <p><term refersTo="#term-higher-education-provider">higher education provider</term> means <def>a registered higher education provider (within the meaning of the TEQSA Act) that is: a constitutional corporation; or a body corporate that is established by or under a law of the Commonwealth or a Territory.</def></p>

                <p><term refersTo="#term-national-code">national code</term> means <def>the National Higher Education Code to Prevent and Respond to Gender-based Violence in force under <ref href="#part-3">Part 3</ref>.</def></p>
                <p><term refersTo="#term-national-student-ombudsman">National Student Ombudsman</term> means <def>the National Student Ombudsman established by <ref href="#sec-21A">section 21A</ref>B of <ref href="">the Ombudsman Act 1976</ref>.</def></p>
                <p><term refersTo="#term-premises">premises</term> includes <def>the following: a structure, building, vehicle, vessel or aircraft; a place (whether or not enclosed or built on); a part of a thing referred to in paragraph (a) or (b).</def></p>

              <content>
                <p><term refersTo="#term-protected-information">protected information</term> has the meaning given by <def>subsection 42(5).</def></p>
                <p><term refersTo="#term-regulatory-powers-act">Regulatory Powers Act</term> means <def>the Regulatory Powers (Standard Provisions) Act 2014.</def></p>
                <p><term refersTo="#term-rules">rules</term> means <def>rules made by the Minister under <ref href="#sec-50">section 50</ref>.</def></p>
                <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>
                <p><term refersTo="#term-state-or-territory-body">State or Territory body</term> includes <def>a Department of State and an authority or agency of the State or Territory.</def></p>
                <p><b><i>TEQSA</i></b> (short for Tertiary Education Quality and Standards Agency) has the same meaning as in the TEQSA Act.</p>
                <p><term refersTo="#term-teqsa-act">TEQSA Act</term> means <def><ref href="">the Tertiary Education Quality and Standards Agency Act 2011</ref>.</def></p>

              <p><role refersTo="#secretary">The Secretary</role> complies with the principle of regulatory necessity if <role refersTo="#secretary">the Secretary</role>’s exercise of the power does not burden the higher education provider any more than is reasonably necessary.</p>

            <heading>Principle of proportionate regulation</heading>

              <p><role refersTo="#secretary">The Secretary</role> complies with the principle of proportionate regulation if <role refersTo="#secretary">the Secretary</role>’s exercise of the power is in proportion to:</p>

                <p>any non-compliance; or</p>
              </content>
            </paragraph>

                <p>by the higher education provider with this Act and legislative instruments made under this Act.</p>

              <p>The purpose of the national code is to provide national standards for higher education providers in connection with preventing and responding to gender-based violence, and the national code may impose requirements on higher education providers in connection with that purpose.</p>

                <p>The purpose of the national code is to provide national standards for higher education providers in connection with preventing and responding to gender-based violence, so that:</p>

                  <p>study, work, social and living environments are safe, respectful and inclusive for staff and students; and</p>
                </content>
              </paragraph>

                <content>
                  <p>providers work to prevent, reduce and eliminate gender-based violence to the greatest extent possible; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-16__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>providers effectively respond to gender-based violence in a way that prioritises and protects safety, health and wellbeing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-16__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>providers address the factors that drive and contribute to gender-based violence; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-16__subsec-1__para-e">
                <num>e</num>
                <content>
                  <p>providers have effective governance arrangements in place to prevent and respond to gender-based violence across all of their operations and at all levels of their organisations.</p>

              <content>
                <p>Without limiting subsection (1), the national standards that the national code may provide include standards relating to:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-16__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>gender-based violence involving students or staff of a provider or people receiving services from a provider, whether or not other people are also involved; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-16__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>gender-based violence that occurs on premises owned or controlled by a provider, or in any other place.</p>
                </content>
              </paragraph>

            <heading>Contents of the national code</heading>

                <p>The national code may impose requirements on higher education providers in connection with the purpose of the national code.</p>

                  <p>require providers to prepare, and give effect to, plans, policies and procedures for preventing and responding to gender-based violence;</p>

                  <p>require providers to impose requirements relating to preventing and responding to gender-based violence on employees and prospective employees, and other people engaged by providers;</p>

                  <p>impose requirements relating to the use of non-disclosure agreements, or other ways of imposing or enforcing confidentiality, in connection with disclosures of gender-based violence;</p>

                  <p>require providers to provide education and training for students and staff about gender-based violence, including on how to prevent and respond to gender-based violence;</p>

                  <p>require providers to make support services available to people who have experienced gender-based violence;</p>

                  <p>impose requirements on providers in relation to student accommodation;</p>
                </content>

                  <p>require providers to impose, through contracts or other arrangements, requirements relating to gender-based violence on other entities (such as entities that provide student accommodation);</p>

                  <p>require providers to prepare reports relating to gender-based violence;</p>
                </content>
              </paragraph>

                  <p>require providers to provide plans, policies, procedures and reports to <role refersTo="#secretary">the Secretary</role>;</p>

                  <p>	(p)	require providers to give effect to recommendations relating to gender-based violence that are made, from time to time, by the National Student Ombudsman under the <i>Ombudsman Act 1976</i>;</p>

                  <p>include any other matters that <role refersTo="#minister">the Minister</role> considers are necessary or convenient to give effect to the purpose of the national code.</p>

                <p>	(3)	Despite subsection 14(2) of the <i>Legislation Act 2003</i>, the national code may apply, adopt or incorporate, with or without modification, any matter contained in any instrument or other writing as in force or existing from time to time.</p>

            <heading>Notification of the national code</heading>
            <subsection eId="part-3__dvs-2__sec-18__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> must give each higher education provider written notice of:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-18__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the making or amendment of the national code; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-18__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the day on which the national code or amendment takes effect for the provider; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-18__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the way in which the provider may access the text of the national code in force on that day.</p>
                </content>
              </paragraph>
            </subsection>

                <p>However, a failure to comply with subsection (1) does not affect the validity of the national code or an amendment of the national code.</p>

                <p>A higher education provider must, in accordance with any rules made for the purposes of subsection (2), keep records relating to the provider’s compliance with this Act and legislative instruments made under this Act.</p>

                <p>The rules may require a higher education provider to give information to <role refersTo="#secretary">the Secretary</role> for the purposes of <role refersTo="#secretary">the Secretary</role>’s functions or powers under this Act.</p>

                <p>The rules may provide for any or all of the following for the purposes of subsection (1):</p>

                <p>This section applies in relation to a higher education provider if the provider becomes aware, or could reasonably be expected to have become aware:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-23__subsec-1__para-a">

                  <p>that information given to <role refersTo="#secretary">the Secretary</role> by the provider under section 22 is, or has become, inaccurate in a material particular; or</p>

              </paragraph>

                <num>b</num>
                <content>
                  <p>that the provider has contravened this Act or a legislative instrument made under this Act; or</p>
                </content>
              </paragraph>

                  <p>that the provider is likely, in the future, to contravene this Act or a legislative instrument made under this Act.</p>

                <p>The higher education provider must notify the Secretary, in writing, of a matter mentioned in paragraph (1)(a), (b) or (c) <quantity refersTo="#deadline">within 14 days</quantity> after the provider becomes aware, or could reasonably be expected to have become aware, of the matter.</p>

                </content>

                <p>This section applies to a person if <role refersTo="#secretary">the Secretary</role> reasonably believes that:</p>

                  <p>the person:</p>

              </paragraph>

                  <p>is a higher education provider; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-27__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>is, or was, connected with a higher education provider; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-27__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the person is capable of giving information, or producing a document or a thing, that is relevant to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-27__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p><role refersTo="#secretary">the Secretary</role>’s functions under this Act or a legislative instrument made under this Act; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-27__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>assessing the higher education provider’s compliance with this Act or a legislative instrument made under this Act.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-27__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may, by written notice given to the person, require the person:</p>
              </content>
              <paragraph eId="part-5__dvs-3__sec-27__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>to give the information to <role refersTo="#secretary">the Secretary</role>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-27__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>to produce the document or thing to <role refersTo="#secretary">the Secretary</role>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-27__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>to make copies of the document and produce the copies to <role refersTo="#secretary">the Secretary</role>;</p>
                </content>
                <content>
                  <p>within the period and in the manner specified in the notice.</p>
                </content>
              </paragraph>
            </subsection>

                <p>The notice:</p>
              </content>
              <paragraph eId="part-5__dvs-3__sec-27__subsec-3__para-a">
                <num>a</num>

                  <p>must not specify a period shorter than 14 days after the notice is given, unless <role refersTo="#secretary">the Secretary</role> reasonably considers that a shorter period, that is at least 24 hours after the notice is given, is necessary; and</p>

                  <p>must set out the effect of subsection (5).</p>

                  <p>for the purposes of monitoring compliance with this Act or a legislative instrument made under this Act; or</p>
                </content>
              </paragraph>

                  <p>for the purposes of investigating a contravention or apparent contravention of a civil penalty provision of this Act; or</p>

                  <p>to enable evidence to be secured for the purposes of a civil penalty proceeding.</p>

            <heading>Returning documents or things produced</heading>

                <p>If:</p>
              </content>

                <num>a</num>
                <content>
                  <p>a document (other than a copy of a document) or thing is produced to <role refersTo="#secretary">the Secretary</role> under section 27; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-29__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#secretary">the Secretary</role> can no longer retain the document or thing under paragraph 28(1)(b);</p>
                </content>
                <content>
                  <p><role refersTo="#secretary">the Secretary</role> must take reasonable steps to return it, unless it is forfeited or forfeitable to the Commonwealth or is the subject of a dispute as to ownership.</p>
                </content>
              </paragraph>
            </subsection>

                <p>The document or thing must be returned to the person who produced it (or to the owner if the person who produced it is not entitled to possess it).</p>

            <heading>Disposal if documents or things cannot be returned</heading>

              <p><role refersTo="#secretary">The Secretary</role> may dispose of a document or thing in such manner as <role refersTo="#secretary">the Secretary</role> considers appropriate if:</p>

                <p>the document or thing is produced to <role refersTo="#secretary">the Secretary</role> under section 27; and</p>

            </paragraph>

                <p>under <role refersTo="#secretary">the Secretary</role> is required to take reasonable steps to return the document or thing to a person; and<ref href="#sec-29">section 29</ref>, </p>

                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__dvs-3__sec-30__para-i">

                <p><role refersTo="#secretary">the Secretary</role> cannot, despite making reasonable efforts, locate the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__dvs-3__sec-30__para-ii">
              <num>ii</num>
              <content>
                <p>the person has refused to take possession of the document or thing.</p>
              </content>
            </paragraph>

                <p>A person is not excused from:</p>
              </content>

                <num>a</num>

                  <p>giving information; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-31__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>producing a document (including a copy of a document) or thing;</p>
                </content>
                <content>
                  <p>under <ref href="#sec-27">section 27</ref> on the ground that doing so might tend to incriminate the person or expose the person to a penalty.</p>
                </content>
              </paragraph>
            </subsection>

              <num>2</num>
              <content>
                <p>However, in the case of an individual, none of the following:</p>
              </content>
              <paragraph eId="part-5__dvs-3__sec-31__subsec-2__para-a">
                <num>a</num>

                  <p>the information given;</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-31__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the document, copy or thing produced;</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-31__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the giving of the information or the producing of the document, copy or thing;</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-31__subsec-2__para-d">

                  <p>any information, document or thing obtained as a direct or indirect consequence of giving the information or producing the document, copy or thing;</p>
                </content>

                  <p>is admissible in evidence against the individual:</p>
                </content>
              </paragraph>

                <num>e</num>

                  <p>in civil proceedings for the recovery of a penalty; or</p>
                </content>
              </paragraph>

                  <p>in criminal proceedings, other than proceedings for an offence against:</p>
                </content>
              </paragraph>

                  <p>	(i)	<i>Criminal Code</i> (which deals with false or misleading information or documents) that relates to this Act; or<ref href="#sec-137">section 137</ref>.1 or 137.2 of the </p>

                  <p>specify a reasonable period within which the provider must take, or refrain from taking, the specified action; and</p>

                <p>Before disclosing particular information to the public under subsection (1) in relation to a higher education provider, <role refersTo="#secretary">the Secretary</role> must give the provider a written notice stating:</p>

                <content>
                  <p>that <role refersTo="#secretary">the Secretary</role> proposes to disclose information to the public in relation to the provider; and</p>
                </content>

                <num>b</num>
                <content>
                  <p>the particular information that is proposed to be disclosed; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-2__sec-43__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the manner in which the information is proposed to be disclosed; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-2__sec-43__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>that the provider may give the Secretary, <quantity refersTo="#deadline">within 14 days</quantity> after the day the notice is given, a written response in relation to the proposed disclosure.</p>

            </subsection>

              <num>3</num>

                <p>In deciding whether to disclose information to the public under subsection (1) in relation to a higher education provider, <role refersTo="#secretary">the Secretary</role> must take into account the response (if any) given by the provider under paragraph (2)(d).</p>

                <p>If <role refersTo="#secretary">the Secretary</role> discloses information to the public under subsection (1) in relation to a higher education provider, <role refersTo="#secretary">the Secretary</role> must ensure that the information is accurate and kept up-to-date.</p>

            <heading>Disclosing information to the public—information specified in the national code</heading>

                <p><role refersTo="#secretary">The Secretary</role> may disclose to the public, in such manner as <role refersTo="#secretary">the Secretary</role> considers appropriate, any information provided to <role refersTo="#secretary">the Secretary</role> in accordance with a requirement included in the national code for the purposes of paragraph 17(2)(l) for any of the following purposes:</p>

                <p><role refersTo="#secretary">The Secretary</role> must, as soon as practicable after the end of each financial year, prepare a report on the performance of functions and exercise of powers under this Act, and the operation of the national code, during that year.</p>

                  <p>if the function or power is delegated to an APS employee who holds or performs the duties of a specified office or position—whether the office or position is sufficiently senior for the employee to perform the function or exercise the power; or</p>

                <p>In performing a function or exercising a power delegated under this section, the delegate must comply with any written directions of <role refersTo="#secretary">the Secretary</role>.</p>

            <heading>Compensation for acquisition of property</heading>
            <subsection eId="part-8__dvs-3__sec-49__subsec-1">
              <num>1</num>
              <content>
                <p>If the operation of:</p>
              </content>
              <paragraph eId="part-8__dvs-3__sec-49__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>this Act; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-8__dvs-3__sec-49__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a legislative instrument made under this Act;</p>
                </content>
                <content>
                  <p>would result in an acquisition of property (within the meaning of paragraph 51(xxxi) of the Constitution) from a person otherwise than on just terms (within the meaning of that paragraph), the Commonwealth is liable to pay a reasonable amount of compensation to the person.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-8__dvs-3__sec-49__subsec-2">
              <num>2</num>
              <content>
                <p>If the Commonwealth and the person do not agree on the amount of the compensation, the person may institute proceedings in:</p>
              </content>
              <paragraph eId="part-8__dvs-3__sec-49__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the Federal Court of Australia; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-8__dvs-3__sec-49__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the Supreme Court of a State or Territory;</p>
                </content>
                <content>
                  <p>for the recovery from the Commonwealth of such reasonable amount of compensation as the court determines.</p>
                </content>
              </paragraph>
            </subsection>
          </section>

            <num>50</num>
            <heading>Rules</heading>
            <subsection eId="part-8__dvs-3__sec-50__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
              </content>
              <paragraph eId="part-8__dvs-3__sec-50__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>required or permitted by this Act to be prescribed by the rules; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-8__dvs-3__sec-50__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-8__dvs-3__sec-50__subsec-2">
              <num>2</num>
              <content>
                <p>To avoid doubt, the rules may not do the following:</p>
              </content>

                  <p>create an offence or civil penalty;</p>
                </content>
              </paragraph>

                  <p>provide powers of:</p>
                </content>
              </paragraph>

                  <p>arrest or detention; or</p>
