          <p>		This Act is the <i>Health Legislation Amendment (Improved Medicare Integrity and Other Measures) Act 2025.</i></p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

              <p>Omit all the words after “within”, substitute:</p>
              <p>the following period after the rendering of the professional service, or such further period as is allowed in accordance with subsection (3A):</p>

            <heading>Definition of relevant offence</heading>

                <p>	(1)	For the purposes of this Act, a <b><i>relevant offence</i></b> is any of the following:</p>
              </content>

              <num>a</num>
              <content>
                <p>	(a)	an offence against the <i>Health Insurance Act 1973</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3A__para-b">
              <num>b</num>
              <content>
                <p>	(b)	an offence against the <i>National Health Act 1953</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3A__para-c">
              <num>c</num>
              <content>
                <p>	(c)	an offence against the <i>Health and Other Services (Compensation) Act 1995</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3A__para-d">
              <num>d</num>
              <content>
                <p>	(d)	an offence against the <i>Medical Indemnity Act 2002</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3A__para-e">

                <p>	(e)	an offence against the <i>Dental Benefits Act 2008</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3A__para-f">

                <p>	(f)	an offence against the <i>Midwife Professional Indemnity (Commonwealth Contribution) Scheme Act 2010</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3A__para-g">
              <num>g</num>
              <content>
                <p>	(g)	an offence against <i>Criminal Code</i>, that relates to:<ref href="#dvs-134">Division 134</ref>, 135, 136, 137, 141, 142, 144, 145, 372 or 400 of the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3A__para-i">
              <num>i</num>
              <content>
                <p>a claim for payment in respect of a professional service, dental service or supply or purported supply of pharmaceutical benefits; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3A__para-ii">
              <num>ii</num>
              <content>
                <p>an indemnity scheme payment; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3A__para-iii">
              <num>iii</num>
              <content>
                <p>	(iii)	a Commonwealth contribution (within the meaning of the <i>Midwife Professional Indemnity (Commonwealth Contribution) Scheme Act 2010</i>);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3A__para-h">
              <num>h</num>
              <content>
                <p>	(h)	an offence against <i>Crimes Act 1914</i>, or section 11.1, 11.2, 11.2A, 11.3, 11.4 or 11.5 of the <i>Criminal Code</i>, that relates to an offence mentioned in another paragraph of this subsection.<ref href="#sec-6">section 6</ref> of the </p>
              </content>
            </paragraph>

              <num>2</num>

                <p>In this section:</p>
              </content>
            </hcontainer>
            <content>
              <p><b><i>dental service</i></b> has the same meaning as in the <i>Dental Benefits Act 2008</i>.</p>
              <p><b><i>indemnity scheme payment</i></b> has the same meaning as in the <i>Medical Indemnity Act 2002</i>.</p>
              <p><b><i>professional service</i></b> has the same meaning as in the <i>Health Insurance Act 1973</i>.</p>

            <heading>Subsection 8U(1)</heading>
            <content>
              <p>Omit “within the previous 60 days”.</p>
            </content>

            <heading>Paragraph 8ZG(3)(d)</heading>

              <p>Repeal the paragraph, substitute:</p>

                <p>(1)	The definition of <b><i>relevant offence</i></b> under section 3A of the <i>Human Services (Medicare) Act 1973</i>, as inserted by this Part, applies in relation to conduct that:</p>

              <content>
                <p>constitutes or may constitute an offence; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-b">

                <p>occurs before, on or after the commencement of this Part.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-13__subclause-2">

                <p>(2)	Paragraphs 8ZG(3)(d) and 8ZGA(3)(d) of the <i>Human Services (Medicare) Act 1973</i>, as inserted by this Part, apply in relation to a reproduction of data if:</p>

                <p>the reproduction is created as a result of entry to premises under a warrant issued under that Act; and</p>

                <p>if the Chief Executive Medicare has, under subsection 129AACA(4), extended the period specified in the notice—the extended period; or</p>
