          <p>		This Act is the <i>Competition and Consumer Amendment (Australian Energy Regulator Separation) Act 2025</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p>In addition to any other functions conferred on the Commission, the Commission may provide the AER with supports and resources (including corporate and information technology resources) to assist in the administration of the AER.</p>

            <heading>Section 44AB</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>AER State/Territory energy law</i></b> means any of the following laws:</p>
              <p>being those provisions as in force from time to time.</p>
            </content>
            <paragraph eId="schedule-1__clause-4__para-a">
              <num>a</num>
              <content>
                <p>a uniform energy law that applies as a law of a State or Territory;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-4__para-b">
              <num>b</num>
              <content>
                <p>a law of a State or Territory that applies a law mentioned in paragraph (a) as a law of its own jurisdiction;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-4__para-c">
              <num>c</num>
              <content>
                <p>any other provisions of a law of a State or Territory that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-4__para-i">
              <num>i</num>
              <content>
                <p>relate to energy; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-4__para-ii">
              <num>ii</num>
              <content>
                <p>are prescribed by the regulations for the purposes of this paragraph;</p>

                <p>The AER may be assisted by:</p>

              <num>a</num>
              <content>
                <p>	(a)	officers and employees of Agencies (within the meaning of the <i>Public Service Act 1999</i>), and of authorities of the Commonwealth, whose services are made available to the AER in connection with the performance of any of the AER’s functions; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-44AACA__para-b">
              <num>b</num>
              <content>
                <p>persons whose services are made available under arrangements made under subsection (2).</p>
              </content>
            </paragraph>

                <p>The AER may, on behalf of the Commonwealth, make an arrangement with the appropriate authority or officer of:</p>
              </content>

                <p>a State or Territory government; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-44AACA__para-b">

            </paragraph>
            <content>
              <p>under which the government or authority makes officers or employees available to the AER to perform services in connection with the performance of any of the AER’s functions.</p>

                <p>An arrangement under subsection (2) may provide for the Commonwealth to reimburse a State or Territory with respect to the services of a person to whom the arrangement relates.</p>

              <p><b><i>amending Act</i></b> means the <i>Competition and Consumer Amendment (Australian Energy Regulator Separation) Act 202</i><i>5</i>.</p>
              <p><b><i>commencement day</i></b> means 1 July 2026.</p>

            <heading>Enterprise Agreement</heading>

                <p>The ACCC Enterprise Agreement:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-5__para-a">
              <num>a</num>
              <content>
                <p>continues, on and from <date>the commencement day</date>, to cover and apply to APS employees:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-5__para-i">
              <num>i</num>
              <content>
                <p>who it covered and applied to immediately before <date>the commencement day</date>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-5__para-ii">
              <num>ii</num>
              <content>
                <p>who, on <date>the commencement day</date>, are members of the staff of the AER; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-5__para-b">
              <num>b</num>
              <content>
                <p>covers and applies to APS employees who are at the classification levels covered by the ACCC Enterprise Agreement whose employment as a member of the staff of the AER commences on or after <date>the commencement day</date>.</p>

                <p>On and after <date>the commencement day</date>, the ACCC Enterprise Agreement covers and applies to the AER Chair as the Agency Head of the APS employees who are members of the staff of the AER.</p>

              <num>3</num>
              <content>
                <p>This item does not prevent the variation or termination of the ACCC Enterprise Agreement in accordance with law.</p>

                <p>This item does not prevent the terms and conditions of employment of APS employees who are members of the staff of the AER from being varied on or after <date>the commencement day</date>:</p>

                <p>On and from <date>the commencement day</date>, the ACCC Enterprise Agreement has effect in relation to the AER as if:</p>

                <p>a reference to the Chairperson were a reference to the AER Chair; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-6__para-b">

                <p>a reference to the Australian Competition and Consumer Commission, or the ACCC, were a reference to the AER.</p>
              </content>
            </paragraph>

                <p>To avoid doubt, this item does not prevent the ACCC Enterprise Agreement from being varied or terminated on or after <date>the commencement day</date>.</p>

            <num>7</num>
            <heading>Transitional rules</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-7__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-7__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Schedule to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-7__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Schedule.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-7__subclause-2">
              <num>2</num>
              <content>
                <p>Without limiting subitem (1), the rules may prescribe matters of a transitional nature (including prescribing any saving or application provisions) relating to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-7__para-a">
              <num>a</num>
              <content>
                <p>the application of the ACCC Enterprise Agreement to members of the staff of the AER who are APS employees; or</p>
              </content>
            </paragraph>

              <content>
                <p>the enactment of the amending Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-7__subclause-3">

                <p>To avoid doubt, the rules may not do the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-7__para-a">
              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-7__para-b">
              <num>b</num>
              <content>
                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-7__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-7__para-ii">
              <num>ii</num>
              <content>
                <p>entry, search or seizure;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-7__para-c">
              <num>c</num>
              <content>
                <p>impose a tax;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-7__para-d">
              <num>d</num>
              <content>
                <p>set an amount to be appropriated from the Consolidated Revenue Fund;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-7__para-e">
              <num>e</num>
              <content>
                <p>	(e)	directly amend the text of the <i>Competition and Consumer Act 2010</i> or the amending Act.</p>
