            <p>		This Act is the <i>Environment Information Australia </i><i>Act</i><i> 2025</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p>Any information in column 3 of the table is not part of this Act. Information may be inserted in this column, or information in it may be edited, in any published version of this Act.</p>

        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Objects</heading>
          <content>
            <p>The objects of this Act are to:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>establish the Head of Environment Information Australia; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>improve the availability and accessibility of high quality national environmental information and data; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>improve accountability in relation to matters affecting the environment, including government policy and programs, through regular, comprehensive and transparent reporting.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Simplified outline of this Act</heading>
          <content>
            <p>There is to be a Head of Environment Information Australia.</p>
            <p>The Head has various functions that relate to providing access to, assessing and reporting on environmental information and data.</p>
            <p>The Head is not subject to the direction of any person in performing certain functions.</p>
            <p>The Head is to be an SES employee in the Department. The Head may be assisted by APS employees in the Department and contractors.</p>
            <p>Broadly, this Act relies on the legislative power that the Commonwealth has under the Constitution with respect to:</p>
          </content>

            <num>a</num>
            <content>
              <p>the executive power of the Commonwealth; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>matters incidental to the execution of any of the legislative powers of the Parliament or the executive power of the Commonwealth.</p>
            </content>
            <content>
              <p><ref href="#part-4">Part 4</ref>, which deals with information and confidentiality, also relies on these powers to some extent, as well as other legislative powers including powers on which other Acts referred to in the Part rely.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-australian-jurisdiction">Australian jurisdiction</term> has the same meaning as <def>in <ref href="">the Environment Protection and Biodiversity Conservation Act 1999</ref>.</def></p>
            <p><term refersTo="#term-ceo">CEO</term> has the same meaning as <def>in <ref href="">the National Environmental Protection Agency Act 2025</ref>.</def></p>
            <p><term refersTo="#term-civil-penalty-provision">civil penalty provision</term> has the meaning given by <def>the Regulatory Powers Act.</def></p>
            <p><term refersTo="#term-commonwealth-entity">Commonwealth entity</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
            <p><term refersTo="#term-departmental-information">departmental information</term> means <def>information obtained or generated under, or in accordance with:</def></p>

              <p>an Act (other than this Act) administered by <role refersTo="#minister">the Minister</role>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>an instrument made under such an Act.</p>
            </content>
            <content>
              <p><term refersTo="#term-eia-information">EIA information</term> means <def>information obtained or generated by an entrusted person under, or in accordance with: this Act or an instrument made under this Act; or an Act or instrument that confers functions on the Head of Environment Information Australia.</def></p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>this Act or an instrument made under this Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>an Act or instrument that confers functions on the Head of Environment Information Australia.</p>
            </content>
            <content>
              <p><b><i>entrusted person </i></b>means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>the Head of Environment Information Australia; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>an APS employee in the Department; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>a person engaged under <role refersTo="#secretary">the Secretary</role> who assists the Head to perform the functions or exercise the powers of the Head; or<ref href="#sec-43">section 43</ref>, or a person otherwise engaged by </p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-d">
            <num>d</num>
            <content>
              <p>any other person performing functions or exercising powers under this Act who is prescribed by the rules.</p>
            </content>
            <content>
              <p><term refersTo="#term-environment">environment</term> has the same meaning as <def>in <ref href="">the Environment Protection and Biodiversity Conservation Act 1999</ref>.</def></p>
              <p><term refersTo="#term-environmental-economic-accounts">environmental economic accounts</term> means <def>statistical accounts that describe the condition of the environment and its relationship with the economy.</def></p>
              <p><term refersTo="#term-fundamental-principles-of-official-statistics">Fundamental Principles of Official Statistics</term> means <def>the Fundamental Principles of Official Statistics endorsed by resolution of the General Assembly of the United Nations on 29 January 2014, as in force from time to time.</def></p>
              <p><b><i>national environmental goals</i></b>: see subsection 16(3).</p>
              <p><b><i>national environmental law</i></b><i> </i>means:</p>

            <content>
              <p><i>	</i>(a)	the <i>Environment Protection and Biodiversity Conservation Act 1999</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>	(b)	the <i>National Environmental Protection Agency</i><i> Act 2025</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>an Act that is prescribed, or provisions of an Act that are prescribed, by the rules for the purposes of this paragraph; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-d">
            <num>d</num>
            <content>
              <p>a legislative instrument made under an Act, or under provisions of an Act, mentioned in any of paragraphs (a) to (c).</p>
            </content>
            <content>
              <p><term refersTo="#term-official">official</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><term refersTo="#term-personal-information">personal information</term> has the same meaning as <def>in <ref href="">the Privacy Act 1988</ref>.</def></p>
              <p><b><i>protected information</i></b>: relevant information obtained by an entrusted person is <b><i>protected</i></b><i> </i><b><i>information </i></b>if disclosure of the information could reasonably be expected to:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>if the disclosure is by the entrusted person—found an action by a person (other than the Commonwealth) for breach of a duty of confidence; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>prejudice the effective working of government; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>prejudice the prevention, detection, investigation, prosecution or punishment of one or more offences; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-d">
            <num>d</num>
            <content>
              <p>endanger a person’s life or physical safety; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-e">
            <num>e</num>
            <content>
              <p>prejudice the protection of public safety or the environment.</p>
            </content>
            <content>
              <p><term refersTo="#term-regulatory-powers-act">Regulatory Powers Act</term> means <def>the Regulatory Powers (Standard Provisions) Act 2014.</def></p>
              <p><b><i>relevant information</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>EIA information; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>departmental information.</p>
            </content>
            <content>
              <p><term refersTo="#term-rules">rules</term> means <def>rules made under <ref href="#sec-51">section 51</ref>.</def></p>
              <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>
              <p><b><i>State of the Environment report</i></b>: see subsection 12(1).</p>
              <p><b><i>State or Territory government body </i></b>means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>a Department of State of a State or Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>an agency of a State or Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>an authority of a State or Territory.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>Crown to be bound</heading>
          <content>
            <p>This Act binds the Crown in each of its capacities.</p>
          </content>
        </section>
        <section eId="part-1__sec-7">
          <num>7</num>
          <heading>Extension to external Territories</heading>
          <content>
            <p>This Act extends to every external Territory.</p>
          </content>

        <heading>Establishment, functions and powers</heading>

          <heading>Simplified outline of this Part</heading>
          <content>
            <p>This Part sets out the functions of the Head of Environment Information Australia.</p>
            <p>The Head is responsible for providing <role refersTo="#minister">the Minister</role>, <role refersTo="#ceo">the CEO</role> and the public with access to high quality information and data relating to the environment, <role refersTo="#minister">the Minister</role>’s functions under certain laws and the functions of <role refersTo="#ceo">the CEO</role>.</p>
            <p>Other key functions of the Head include:</p>

              <p>preparing and publishing reports on the state of the environment; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-8__para-b">

              <p>establishing and maintaining environmental economic accounts.</p>

          </paragraph>

          <heading>Head of Environment Information Australia</heading>
          <content>
            <p>There is to be a Head of Environment Information Australia.</p>
          </content>
        </section>
        <section eId="part-2__sec-10">
          <num>10</num>
          <heading>Functions</heading>
          <content>
            <p>The Head of Environment Information Australia has the following functions:</p>
          </content>
          <paragraph eId="part-2__sec-10__para-a">
            <num>a</num>
            <content>
              <p>to provide <role refersTo="#minister">the Minister</role> with access to high quality information and data relating to:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-10__para-i">
            <num>i</num>
            <content>
              <p>the environment; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-10__para-ii">
            <num>ii</num>
            <content>
              <p>matters in respect of which <role refersTo="#minister">the Minister</role> has functions under a national environmental law;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-10__para-b">
            <num>b</num>
            <content>
              <p>to provide <role refersTo="#ceo">the CEO</role> with access to high quality information and data relating to:</p>
            </content>
          </paragraph>

              <p>the environment; and</p>
            </content>
          </paragraph>

              <p>anything incidental or conducive to the performance of any of the functions mentioned elsewhere in this section.</p>

        </section>
        <section eId="part-2__sec-11">
          <num>11</num>
          <heading>Independence</heading>
          <content>
            <p>The Head of Environment Information Australia is not subject to the direction of <role refersTo="#secretary">the Secretary</role> or <role refersTo="#minister">the Minister</role>, or anyone else, in performing:</p>

            <num>a</num>
            <content>
              <p>the functions mentioned in the following provisions:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-11__para-i">
            <num>i</num>

            </content>
          </paragraph>
          <paragraph eId="part-2__sec-11__para-ii">

              <p>paragraph 10(e) (establish and maintain environmental economic accounts); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-11__para-b">
            <num>b</num>

              <p>any other function that is prescribed by the rules for the purposes of this paragraph.</p>

          </paragraph>

        <section eId="part-2__sec-12">
          <num>12</num>
          <heading>State of the Environment reports</heading>
          <content>
            <p>Head to prepare and publish reports</p>
          </content>
          <subsection eId="part-2__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Head of Environment Information Australia must, on or before 15 December every second year, prepare and publish a report on the environment in the Australian jurisdiction (a <b><i>State of the Environment report</i></b>) on a website maintained by the Department.</p>

              <p>Preparation and content of reports</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-2">
            <num>2</num>
            <content>
              <p>A State of the Environment report must:</p>
            </content>
            <paragraph eId="part-2__sec-12__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>contain information about, and analysis of trends relating to, the state of the environment; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>contain information about, and analysis relating to progress towards meeting, the national environmental goals; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>deal with any other matters prescribed by the rules for the purposes of this paragraph.</p>
              </content>
              <content>
                <p>This subsection does not limit the content of the report.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-3">
            <num>3</num>
            <content>
              <p>In particular, a State of the Environment report is to draw on and reflect the knowledge and insights of:</p>
            </content>
            <paragraph eId="part-2__sec-12__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>persons with scientific expertise in relation to the state of the environment; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>Aboriginal and Torres Strait Islander peoples, recognising the significance of Aboriginal and Torres Strait Islander peoples’ knowledge of the management of land and the conservation and sustainable use of biodiversity.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-4">
            <num>4</num>
            <content>
              <p>The Head may, in preparing a State of the Environment report, seek assistance, input or information from such persons as the Head determines.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-13">
          <num>13</num>
          <heading>Environmental economic accounts</heading>
          <content>
            <p>Environmental economic accounts</p>
          </content>
          <subsection eId="part-2__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p>The Head of Environment Information Australia:</p>
            </content>
            <paragraph eId="part-2__sec-13__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>must establish and maintain environmental economic accounts; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>may also choose to maintain environmental economic accounts established other than by the Head.</p>
              </content>
              <content>
                <p>The Head must establish and maintain the accounts, as relevant, in accordance with the Fundamental Principles of Official Statistics.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p>The accounts must not contain protected information.</p>
            </content>
            <content>
              <p>ABS assistance</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-3">
            <num>3</num>
            <content>
              <p>The Head is to seek the assistance of the Australian Bureau of Statistics in establishing and maintaining the accounts.</p>
            </content>
            <content>
              <p>Statements of environmental economic accounts</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-4">
            <num>4</num>
            <content>
              <p>The Head must, at least once every 12 months, prepare and give to <role refersTo="#minister">the Minister</role> a statement of one or more of the accounts.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-5">
            <num>5</num>
            <content>
              <p>The Head may decide which account or accounts to prepare a statement of.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-6">
            <num>6</num>
            <content>
              <p>The statement:</p>
            </content>
            <paragraph eId="part-2__sec-13__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>must:</p>
              </content>
            </paragraph>

              <num>i</num>
              <content>
                <p>summarise the account or accounts; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-6__para-ii">
              <num>ii</num>
              <content>
                <p>for an account previously summarised in a statement—summarise the changes made to the account since it was most recently summarised; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>may deal with any other matters the Head considers appropriate.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-7">

              <p>The statement must not contain protected information.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-14">
          <num>14</num>
          <heading>National environmental information assets</heading>
          <subsection eId="part-2__sec-14__subsec-1">
            <num>1</num>
            <content>
              <p>This section applies if the Head of Environment Information Australia reasonably believes that data or information held by, or a data system maintained by, a Commonwealth entity, a State or Territory government body, or any other person or body, is critical to:</p>
            </content>
            <paragraph eId="part-2__sec-14__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a matter in respect of which <role refersTo="#ceo">the CEO</role> has functions; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a matter in respect of which <role refersTo="#minister">the Minister</role> has functions under a national environmental law.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-2">
            <num>2</num>
            <content>
              <p>The Head may, in writing, declare the data, information or system, or part of the system, to be a national environmental information asset.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-3">
            <num>3</num>
            <content>
              <p>The Head must, as soon as practicable after making a declaration under subsection (2), give written notice of the declaration to the entity, person or body that holds or maintains the data, information or system.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-4">
            <num>4</num>
            <content>
              <p>At any time while one or more declarations are in force, the Head must maintain a register of national environmental information assets.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-5">

              <p>The register must be published on a website maintained by the Department.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-6">

              <p>The rules may prescribe:</p>
            </content>

              <num>a</num>
              <content>
                <p>the information that must be included in the register; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-6__para-b">
              <num>b</num>

                <p>the circumstances in which the holder of a national environmental information asset may notify the Head of a proposed change to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-6__para-i">
              <num>i</num>
              <content>
                <p>the content of the asset; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-6__para-ii">
              <num>ii</num>

                <p>the availability or accessibility of the asset.</p>

            </paragraph>
          </subsection>

        <heading>Minister’s responsibilities in relation to Head of Environment Information Australia’s functions</heading>

            <p>This Part sets out <role refersTo="#minister">the Minister</role>’s responsibilities in relation to certain functions of the Head of Environment Information Australia.</p>
            <p><role refersTo="#minister">The Minister</role> is to respond to the Head’s State of the Environment reports, including by specifying environmental goals to be achieved (the Head reports on progress towards meeting these: see Part 2). <role refersTo="#minister">The Minister</role> must, at least every 12 months, table any statement of environmental economic accounts prepared by the Head in each House of the Parliament.</p>

          <heading>Response to State of the Environment reports</heading>

              <p><role refersTo="#minister">The Minister</role> must, no later than 6 months after the day a State of the Environment report is published under section 12, arrange for a response to the report to be tabled in each House of the Parliament.</p>

              <p>The response must specify:</p>
            </content>
            <paragraph eId="part-3__sec-16__subsec-2__para-a">

              <num>b</num>

                <p>the period within which the targets are to be achieved.</p>

                <p>This subsection does not limit the content of the response.</p>

              <p>	(3)	The <b><i>national environmental goals</i></b>, at a time, are the targets specified in the response most recently tabled in accordance with subsection (1).</p>

                <p>the Head reasonably believes that the disclosure of the information is necessary for the purposes of:</p>

                <p>performing functions or exercising powers of the Head; or</p>
              </content>
            </paragraph>

                <p>The Head of Environment Information Australia may disclose EIA information to a body mentioned in subsection (2) if:</p>

                  <p>the Head reasonably believes that the disclosure of the information is necessary for:</p>
                </content>
              </paragraph>

                  <p>the enforcement of the criminal law; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-22__subsec-1__para-ii">

                  <p>the enforcement of a law imposing a pecuniary penalty; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-22__subsec-1__para-iii">

              </paragraph>

              <p>The Head of Environment Information Australia may disclose EIA information if the Head reasonably believes that the disclosure is necessary to prevent or lessen a serious risk to human health.</p>

            <heading>Disclosure of protected information for the purposes of the Head’s functions and powers</heading>

                <p>The Head of Environment Information Australia may disclose EIA information that is protected information to a person if:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-25__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the disclosure is for the purposes of performing functions or exercising powers of the Head; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-25__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the Head is satisfied that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-25__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>the information is not personal information; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-25__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>the disclosure of the information to the person could not reasonably be expected to found an action by a person (other than the Commonwealth) for breach of a duty of confidence; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-25__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>	(iii)	the disclosure will be made in such a way that harm of a kind mentioned in paragraphs (b) to (e) of the definition of <b><i>protected information</i></b> will be appropriately mitigated, including by conditions (if any) imposed on the person’s use or disclosure of the information.</p>

                <p>To avoid doubt, subsection (1) does not affect authorisations to disclose protected information under other provisions of this Part.</p>

                <p>Subsection (1) does not authorise:</p>
              </content>

                  <p>the disclosure of protected information for the purposes of the Head’s function under paragraph 10(c) to provide the public with access to high quality information and data relating to the environment; or</p>
                </content>
              </paragraph>

                  <p>the publication of protected information for the purposes of the Head’s function under paragraph 10(d) to prepare and publish State of the Environment reports.</p>

                <p>if those summaries or statistics do not enable the identification of a person.</p>

          <heading>Use and disclosure of departmental information</heading>

            <heading>Disclosure of protected information for the purposes of the Head’s functions and powers</heading>

                <p>The Head of Environment Information Australia may disclose departmental information that is protected information to a person if:</p>
              </content>
              <paragraph eId="part-4__dvs-4__sec-35__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the disclosure is for the purposes of performing functions or exercising powers of the Head; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-35__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the Head is satisfied that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-35__subsec-1__para-i">

                  <p>the information is not personal information; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-35__subsec-1__para-ii">

                  <p>the disclosure of the information to the person could not reasonably be expected to found an action by a person (other than the Commonwealth) for breach of a duty of confidence; and</p>

                  <p>	(iii)	the disclosure will be made in such a way that harm of a kind mentioned in paragraphs (b) to (e) of the definition of <b><i>protected information</i></b> will be appropriately mitigated, including by conditions (if any) imposed on the person’s use or disclosure of the information.</p>

            <num>2</num>
            <content>
              <p>Without limiting subsection (1), a review must consider whether, and to what extent, this Act has:</p>
            </content>
            <paragraph eId="part-6__sec-50__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>improved the availability and accessibility of high quality national environmental information and data; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-50__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>improved accountability for matters that affect the environment through regular, comprehensive and transparent reporting.</p>
              </content>
              <content>
                <p>Frequency of reviews</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-50__subsec-3">
            <num>3</num>
            <content>
              <p>The first review must be completed within 5 years after the commencement of this section.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-50__subsec-4">
            <num>4</num>
            <content>
              <p>Each subsequent review must be completed within 5 years after the completion of the previous review.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-50__subsec-5">
            <num>5</num>
            <content>
              <p>For the purposes of subsections (3) and (4), a review is completed on the day after the day the report of the review is given to <role refersTo="#minister">the Minister</role>.</p>

            <content>
              <p>Report of review</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-50__subsec-6">
            <num>6</num>
            <content>
              <p>The person who, or body that, conducts a review must give <role refersTo="#minister">the Minister</role> a written report of the review.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-50__subsec-7">
            <num>7</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must arrange for a copy of the report to be tabled in each House of the Parliament, within 15 sitting days of that House after <role refersTo="#minister">the Minister</role> receives the report.</p>

            <content>
              <p>Response to review</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-50__subsec-8">
            <num>8</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must arrange for a response to the review to be:</p>
            </content>
            <paragraph eId="part-6__sec-50__subsec-8__para-a">
              <num>a</num>
              <content>
                <p>tabled in each House of the Parliament, <quantity refersTo="#deadline">within 6 months</quantity> of the day a copy of the report of the review is tabled in that House; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-50__subsec-8__para-b">
              <num>b</num>
              <content>
                <p>published on a website maintained by the Department, as soon as practicable after a copy of the report is first tabled in a House of the Parliament.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-6__sec-51">
          <num>51</num>
          <heading>Rules</heading>
          <subsection eId="part-6__sec-51__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
            </content>
            <paragraph eId="part-6__sec-51__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-51__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-51__subsec-2">
            <num>2</num>
            <content>
              <p>To avoid doubt, the rules may not do the following:</p>
            </content>
            <paragraph eId="part-6__sec-51__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-51__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-51__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-51__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>entry, search or seizure;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-51__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>impose a tax;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-51__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-51__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>directly amend the text of this Act.</p>
