        <heading>Short title</heading>
        <content>
          <p>		This Act is the <i>Environment Protection and Biodiversity Conservation (Customs Charges Imposition)</i><i> Act </i><i>2025</i>.</p>
        </content>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

            <p>Any information in column 3 of the table is not part of this Act. Information may be inserted in this column, or information in it may be edited, in any published version of this Act.</p>

      <section eId="sec-3">
        <num>3</num>
        <heading>Act binds the Crown</heading>
        <content>
          <p>This Act binds the Crown in right of each of the States, of the Australian Capital Territory and of the Northern Territory. However, it does not bind the Crown in right of the Commonwealth.</p>

      <section eId="sec-4">
        <num>4</num>
        <heading>Extension to external Territories</heading>
        <content>
          <p>This Act extends to the external Territories.</p>
        </content>
      </section>
      <section eId="sec-5">
        <num>5</num>
        <heading>Extra-territorial application</heading>
        <content>
          <p>This Act extends to acts, omissions, matters and things outside Australia.</p>
        </content>
      </section>
      <section eId="sec-6">
        <num>6</num>
        <heading>Act does not impose tax on property of a State</heading>
        <subsection eId="sec-6__subsec-1">
          <num>1</num>
          <content>
            <p>This Act does not impose a tax on property of any kind belonging to a State.</p>
          </content>
        </subsection>
        <subsection eId="sec-6__subsec-2">
          <num>2</num>
          <content>
            <p>In this section:</p>
          </content>
          <content>
            <p><b><i>property of any kind belonging to a State</i></b> has the same meaning as in section 114 of the Constitution.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>Imposition of charges</heading>
        <subsection eId="sec-7__subsec-1">
          <num>1</num>
          <content>
            <p>	(1)	The regulations may prescribe a charge in relation to a prescribed matter connected with the administration of the <i>Environment Protection and Biodiversity Conservation Act 1999</i> or regulations made under that Act.</p>
          </content>
        </subsection>
        <subsection eId="sec-7__subsec-2">
          <num>2</num>
          <content>
            <p>Charges prescribed under subsection (1) are imposed as taxes.</p>
          </content>
        </subsection>
        <subsection eId="sec-7__subsec-3">
          <num>3</num>
          <content>
            <p>Two or more charges may be prescribed in relation to the same matter, and a single charge may be prescribed in relation to 2 or more matters.</p>
          </content>
        </subsection>
        <subsection eId="sec-7__subsec-4">
          <num>4</num>
          <content>
            <p>This section imposes a charge only so far as that charge is a duty of customs <ref href="#sec-55">within the meaning of section 55</ref> of the Constitution.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-8">
        <num>8</num>
        <heading>Matters relating to amount of charges</heading>
        <subsection eId="sec-8__subsec-1">
          <num>1</num>
          <content>
            <p>The regulations may prescribe a charge under subsection 7(1):</p>
          </content>
          <paragraph eId="sec-8__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>by specifying an amount as the charge; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>by specifying a method for calculating the amount of the charge.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-8__subsec-2">
          <num>2</num>
          <content>
            <p>Before the Governor-General makes a regulation under subsection 7(1) prescribing a charge in relation to a matter, <role refersTo="#minister">the Minister</role> must be satisfied that the amount of the charge is set at a level that is designed to recover no more than the Commonwealth’s likely costs in connection with the matter.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-9">
        <num>9</num>
        <heading>Exemptions from charges</heading>
        <content>
          <p>The regulations may provide for exemptions from a charge prescribed under subsection 7(1).</p>
        </content>
      </section>
      <section eId="sec-10">
        <num>10</num>
        <heading>Regulations</heading>
        <content>
          <p>The Governor-General may make regulations prescribing matters:</p>
        </content>
        <paragraph eId="sec-10__para-a">
          <num>a</num>
          <content>
            <p>required or permitted by this Act to be prescribed by the regulations; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-10__para-b">
          <num>b</num>
          <content>
            <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
