              <p>Any information in column 3 of the table is not part of this Act. Information may be inserted in this column, or information in it may be edited, in any published version of this Act.</p>

          <heading>Object</heading>
          <content>
            <p>The object of this Act is to establish the National Environmental Protection Agency to support the delivery of accountable, efficient, outcomes-focused and transparent environmental regulatory decision-making.</p>
          </content>

          <num>4</num>
          <heading>Simplified outline of this Act</heading>
          <content>
            <p>This Act establishes NEPA, short for the National Environmental Protection Agency, and provides for the appointment of <role refersTo="#ceo">the CEO</role> of NEPA.</p>
            <p><role refersTo="#ceo">The CEO</role> has the functions conferred on <role refersTo="#ceo">the CEO</role> by this Act and a number of other environmental laws mentioned in section 13. <role refersTo="#ceo">The CEO</role> also has functions of advising and assisting <role refersTo="#minister">the Minister</role> in relation to any of <role refersTo="#minister">the Minister</role>’s functions and powers under those laws.</p>
            <p><role refersTo="#minister">The Minister</role> may give <role refersTo="#ceo">the CEO</role> a statement of <role refersTo="#minister">the Minister</role>’s expectations for <role refersTo="#ceo">the CEO</role> and NEPA. However, <role refersTo="#minister">the Minister</role>’s statement of expectations cannot affect <role refersTo="#ceo">the CEO</role>’s independence by directing <role refersTo="#ceo">the CEO</role> in the performance or exercise of <role refersTo="#ceo">the CEO</role>’s functions or powers. <role refersTo="#ceo">The CEO</role> must respond to any statement of expectations with a statement of intent.</p>
            <p><role refersTo="#ceo">The CEO</role> may establish an advisory group to advise and assist <role refersTo="#ceo">the CEO</role> in relation to <role refersTo="#ceo">the CEO</role>’s functions and powers. <role refersTo="#ceo">The CEO</role> must consider any advice received but is not bound by the advice.</p>
            <p>This Act also contains a regime for the use and disclosure of information obtained under any Act conferring functions on <role refersTo="#ceo">the CEO</role>. There are civil penalties for the use or disclosure of protected information in certain circumstances.</p>

        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-advisory-group">advisory group</term> means <def>the group established by the CEO under subsection 55(1).</def></p>
            <p><b><i>CEO</i></b>: see section 12.</p>
            <p><term refersTo="#term-civil-penalty-provision">civil penalty provision</term> has the same meaning as <def>in the Regulatory Powers Act.</def></p>
            <p><term refersTo="#term-commonwealth-entity">Commonwealth entity</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
            <p><term refersTo="#term-commonwealth-reserve">Commonwealth reserve</term> has the same meaning as <def>in <ref href="">the Environment Protection and Biodiversity Conservation Act 1999</ref>.</def></p>
            <p><term refersTo="#term-conservation-zone">conservation zone</term> has the same meaning as <def>in <ref href="">the Environment Protection and Biodiversity Conservation Act 1999</ref>.</def></p>
            <p><b><i>entrusted person</i></b> means:</p>
          </content>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p><role refersTo="#ceo">the CEO</role>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>a member of the staff referred to in <ref href="#sec-53">section 53</ref>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>a person whose services are made available to NEPA under <ref href="#sec-54">section 54</ref>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-d">
            <num>d</num>
            <content>
              <p>	(d)	a person engaged under <i>Public Governance, Performance and Accountability Act 2013</i> by the CEO under a written agreement to assist in, or advise in relation to, the performance of the CEO’s functions; or<ref href="#sec-23">section 23</ref> of the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-e">
            <num>e</num>
            <content>
              <p>a person employed or engaged by a person mentioned in paragraph (d) of this definition to assist in, or advise in relation to, the performance of <role refersTo="#ceo">the CEO</role>’s functions; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-f">
            <num>f</num>
            <content>
              <p>any other person prescribed by the rules.</p>
            </content>
            <content>
              <p><term refersTo="#term-environment">environment</term> has the same meaning as <def>in <ref href="">the Environment Protection and Biodiversity Conservation Act 1999</ref>.</def></p>
              <p><b><i>matter protected</i></b> by a provision of Part 3 of the <i>Environment Protection and Biodiversity Conservation Act 1999</i> has the same meaning as in that Act.</p>
              <p><b><i>NEPA</i></b>: see subsection 9(1).</p>
              <p><term refersTo="#term-official">official</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><term refersTo="#term-paid-work">paid work</term> means <def>work for financial gain or reward (whether as an employee, a self-employed person or otherwise).</def></p>
              <p><b><i>protected information</i></b>: relevant information obtained by an entrusted person is <b><i>protected information</i></b> if disclosure of the information could reasonably be expected to:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>if the disclosure is by the entrusted person—found an action by a person (other than the Commonwealth) for breach of a duty of confidence; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>prejudice the effective working of government; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>prejudice the prevention, detection, investigation, prosecution or punishment of one or more offences; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-d">
            <num>d</num>
            <content>
              <p>endanger a person’s life or physical safety; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-e">
            <num>e</num>
            <content>
              <p>prejudice the protection of public safety or the environment.</p>
            </content>
            <content>
              <p><b><i>registrable decision</i></b>: see section 19.</p>
              <p><term refersTo="#term-regulatory-powers-act">Regulatory Powers Act</term> means <def>the Regulatory Powers (Standard Provisions) Act 2014.</def></p>
              <p><term refersTo="#term-relevant-information">relevant information</term> means <def>information obtained or generated by an entrusted person under, or in accordance with: this Act or an instrument made under this Act; or an Act or an instrument that confers functions on <role refersTo="#ceo">the CEO</role>; or the Regulatory Powers Act to the extent that it applies in relation to an Act mentioned in paragraph (a) or (b).</def></p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>this Act or an instrument made under this Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>an Act or an instrument that confers functions on <role refersTo="#ceo">the CEO</role>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>the Regulatory Powers Act to the extent that it applies in relation to an Act mentioned in paragraph (a) or (b).</p>
            </content>
            <content>
              <p><term refersTo="#term-rules">rules</term> means <def>rules made under <ref href="#sec-63">section 63</ref>.</def></p>
              <p><term refersTo="#term-statement-of-expectations">statement of expectations</term> means <def>the statement issued by the Minister under <ref href="#sec-16">section 16</ref>.</def></p>
              <p><b><i>State or Territory government body</i></b> means:</p>
            </content>
          </paragraph>

            <content>
              <p>a Department of State of a State or Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>

              <p>an agency of a State or Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>an authority of a State or Territory.</p>
            </content>
          </paragraph>
        </section>

          <num>6</num>
          <heading>Crown to be bound</heading>
          <content>
            <p>This Act binds the Crown in each of its capacities.</p>
          </content>
        </section>

          <heading>Extension to external Territories</heading>

            <p>This Act extends to every external Territory.</p>

              <p>This Part establishes the office of <role refersTo="#ceo">the CEO</role> of NEPA. It also establishes NEPA for the purposes of assisting <role refersTo="#ceo">the CEO</role> in the performance of <role refersTo="#ceo">the CEO</role>’s functions. <role refersTo="#ceo">The CEO</role> is the accountable authority of NEPA.</p>

                <p>	(1)	The National Environmental Protection Agency (<b><i>NE</i></b><b><i>PA</i></b>) is established by this section.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-9__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	For the purposes of the finance law (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>):</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-9__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>NEPA is a listed entity; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-9__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#ceo">the CEO</role> is the accountable authority of NEPA; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-9__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the following persons are officials of NEPA:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-9__subsec-2__para-i">

                  <p><role refersTo="#ceo">the CEO</role>;</p>
                </content>
              </paragraph>

                  <p>the staff referred to in <ref href="#sec-53">section 53</ref>;</p>

                  <p>the functions of <role refersTo="#ceo">the CEO</role> referred to in section 13.</p>

            <heading>Functions of the CEO</heading>

                <p><role refersTo="#ceo">The CEO</role> has the functions conferred on <role refersTo="#ceo">the CEO</role> by the following laws:</p>

                  <p>any other functions that are conferred on <role refersTo="#ceo">the CEO</role> by:</p>

                  <p>the rules; or</p>
                </content>
              </paragraph>

                <p><role refersTo="#ceo">The CEO</role> has power to do all things necessary or convenient to be done for or in connection with the performance of <role refersTo="#ceo">the CEO</role>’s functions.</p>

            <heading>Independence of the CEO</heading>
            <content>
              <p>Subject to this Act and any other Act, <role refersTo="#ceo">the CEO</role> has discretion in the performance or exercise of <role refersTo="#ceo">the CEO</role>’s functions or powers and is not subject to direction by any person in relation to the performance or exercise of those functions or powers.</p>

        <heading>Responsibilities in relation to functions</heading>

              <p><role refersTo="#minister">The Minister</role> may give <role refersTo="#ceo">the CEO</role> a statement of <role refersTo="#minister">the Minister</role>’s expectations for <role refersTo="#ceo">the CEO</role> and NEPA. <role refersTo="#ceo">The CEO</role> must respond to any such statement of expectations with a statement of intent.</p>
              <p><role refersTo="#ceo">The CEO</role> must establish and maintain on NEPA’s website registers containing information in relation to certain decisions of <role refersTo="#ceo">the CEO</role> (called registrable decisions) and any other matters prescribed by the rules that relate to a law mentioned in section 13.</p>

                <p>	(1)	The Minister may, at any time, prepare and give a written statement (a <b><i>statement of expectations</i></b>) to the CEO that sets out the Minister’s expectations for the CEO and NEPA.</p>

              <num>2</num>
              <content>
                <p>A statement of expectations cannot direct <role refersTo="#ceo">the CEO</role> in the performance or exercise of <role refersTo="#ceo">the CEO</role>’s functions or powers.</p>

              <num>3</num>
              <content>
                <p>In preparing a statement of expectations, <role refersTo="#minister">the Minister</role> must:</p>
              </content>

                <content>
                  <p>have regard to any matters prescribed by the rules; and</p>
                </content>
              </paragraph>

                  <p>prepare the statement in accordance with any requirements prescribed by the rules.</p>
                </content>
              </paragraph>

                <p>	(1)	If the Minister issues a statement of expectations, the CEO must prepare and give the Minister a written response (a <b><i>statement of intent</i></b>).</p>

                <p>In preparing a statement of intent, <role refersTo="#ceo">the CEO</role> must:</p>

            <heading>Definition of registrable decision</heading>
            <content>
              <p>		A decision of the CEO is a <b><i>registrable decision</i></b> if the decision is prescribed as a registrable decision by:</p>

              <content>
                <p>for a decision under an Act—that Act or the rules; or</p>
              </content>
            </paragraph>

              </content>
            </paragraph>

            <heading>Suspension of registers</heading>
            <subsection eId="part-3__dvs-3__sec-22__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may suspend the operation of a register if <role refersTo="#ceo">the CEO</role> is satisfied:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-22__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the suspension is required so that maintenance can be carried out; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-22__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>it is prudent to suspend the operation of the register in order to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-22__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>ensure the integrity of the register; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-22__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>prevent, mitigate or minimise abuse of the register; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-22__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>prevent, mitigate or minimise criminal activity involving the register.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-22__subsec-2">

                <p>If <role refersTo="#ceo">the CEO</role> suspends the operation of a register:</p>
              </content>

                  <p><role refersTo="#ceo">the CEO</role> must publish a notice on NEPA’s website informing the public of the suspension; and</p>
                </content>
              </paragraph>

                <content>
                  <p><role refersTo="#ceo">the CEO</role> may defer taking action in relation to the register until the suspension ends.</p>

          </section>

            <num>23</num>
            <heading>Certain information not required to be published on registers</heading>
            <content>
              <p><role refersTo="#ceo">The CEO</role> is not required to publish information on a register if <role refersTo="#ceo">the CEO</role> considers that publishing the information would, or could be reasonably expected to:</p>
            </content>

              <content>
                <p>endanger public safety; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-23__para-b">

                <p>	(b)	cause damage to a matter protected by a provision of Part 3 of the <i>Environment Protection and Biodiversity Conservation Act 1999</i>; or</p>

            <heading>Disclosure of relevant information to Commonwealth entities</heading>
            <content>
              <p><role refersTo="#ceo">The CEO</role> may disclose relevant information to a Commonwealth entity if <role refersTo="#ceo">the CEO</role> is satisfied the disclosure is for the purposes of assisting the entity to perform its functions or exercise its powers.</p>

            <num>27</num>
            <heading>Disclosure of relevant information to State or Territory government body</heading>
            <content>
              <p><role refersTo="#ceo">The CEO</role> may disclose relevant information to a State or Territory government body if:</p>
            </content>

              <num>a</num>
              <content>
                <p><role refersTo="#ceo">the CEO</role> reasonably believes that the disclosure of the information is necessary for the purposes of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-27__para-i">
              <num>i</num>
              <content>
                <p>performing functions or exercising powers of <role refersTo="#ceo">the CEO</role>; or</p>
              </content>
            </paragraph>

              <content>
                <p>the administration of a State or Territory law; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-27__para-b">

                <p>the State or Territory government body has undertaken not to use or disclose the information except in accordance with an agreement that:</p>
              </content>
            </paragraph>

                <p>is in force between the Commonwealth and the State or Territory; and</p>
              </content>
            </paragraph>

                  <p>a State or Territory government body;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-28__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the Australian Federal Police;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-28__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>the police force or police service of a State or Territory.</p>
                </content>
              </paragraph>

            <heading>Disclosure to reduce serious risk to human health</heading>

              <p><role refersTo="#ceo">The CEO</role> may disclose relevant information if <role refersTo="#ceo">the CEO</role> reasonably believes that the disclosure is necessary to prevent or lessen a serious risk to human health.</p>

            <heading>Use and disclosure for the purposes of an Act administered by the Minister</heading>

                <p>A person must not be appointed as <role refersTo="#ceo">the CEO</role> unless <role refersTo="#minister">the Minister</role> is satisfied that:</p>

                  <p>the person has knowledge of, or experience in, both of the following matters:</p>

                  <p>public sector administration or governance;</p>
                </content>
              </paragraph>

                  <p>the person does not have any interests, pecuniary or otherwise, that conflict or could conflict with the proper performance of <role refersTo="#ceo">the CEO</role>’s functions.</p>

                  <p>Period and basis of appointment</p>
                </content>
              </paragraph>
            </subsection>

              <num>3</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> is to be appointed on a full-time basis.</p>
              </content>
            </subsection>

                <p><role refersTo="#ceo">The CEO</role> must not be reappointed more than once.</p>
              </content>
            </subsection>

                <p><role refersTo="#ceo">The CEO</role> holds office for the period specified in the instrument of appointment. The period must not exceed 5 years.</p>

            <heading>Acting appointments</heading>
            <subsection eId="part-5__dvs-2__sec-46__subsec-1">

                <p><role refersTo="#minister">The Minister</role> may, by written instrument, appoint a person to act as <role refersTo="#ceo">the CEO</role>:</p>

                <num>a</num>
                <content>
                  <p>during a vacancy in the office of CEO (whether or not an appointment has previously been made to the office); or</p>
                </content>
              </paragraph>

                <num>b</num>
                <content>
                  <p>during any period, or during all periods, when <role refersTo="#ceo">the CEO</role>:</p>
                </content>
              </paragraph>

                <num>i</num>
                <content>
                  <p>is absent from duty or from Australia; or</p>
                </content>
              </paragraph>

                  <p>is, for any reason, unable to perform the duties of the office.</p>

            <heading>Terms and conditions</heading>

              <p><role refersTo="#ceo">The CEO</role> holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by <role refersTo="#minister">the Minister</role>.</p>

            <heading>Remuneration</heading>

                <p><role refersTo="#ceo">The CEO</role> is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, <role refersTo="#ceo">the CEO</role> is to be paid the remuneration that is prescribed under subsection (4).</p>

            </subsection>

              <num>2</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> is to be paid the allowances that are prescribed under subsection (4).</p>

                <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>

                <p><role refersTo="#ceo">The CEO</role> has the recreation leave entitlements that are determined by the Remuneration Tribunal.</p>

            </subsection>

              <content>
                <p><role refersTo="#minister">The Minister</role> may grant <role refersTo="#ceo">the CEO</role> leave of absence, other than recreation leave, on the terms and conditions as to remuneration or otherwise that <role refersTo="#minister">the Minister</role> determines.</p>

          </section>

            <num>50</num>
            <heading>Other paid work</heading>
            <content>
              <p><role refersTo="#ceo">The CEO</role> must not engage in paid work outside the duties of <role refersTo="#ceo">the CEO</role>’s office without <role refersTo="#minister">the Minister</role>’s approval.</p>

            <num>51</num>
            <heading>Resignation</heading>
            <subsection eId="part-5__dvs-2__sec-51__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may resign <role refersTo="#ceo">the CEO</role>’s appointment by giving the Governor-General a written resignation.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-51__subsec-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by the Governor-General or, if a later day is specified in the resignation, on that later day.</p>

            </subsection>

            <num>52</num>
            <heading>Termination of appointment</heading>
            <content>
              <p>The Governor-General may terminate the appointment of <role refersTo="#ceo">the CEO</role>:</p>

                <p>for misbehaviour; or</p>

                  <p>the procedures to be followed by the group or its members in providing advice or assistance.</p>

                <p>If <role refersTo="#ceo">the CEO</role> determines terms of reference under paragraph (7)(a), <role refersTo="#ceo">the CEO</role> must publish the terms of reference on NEPA’s website as soon as practicable afterwards.</p>

                <p>whether, and to what extent, <role refersTo="#ceo">the CEO</role> and NEPA have met the expectations set out in any statements of expectations given by <role refersTo="#minister">the Minister</role> in the period; and</p>

              <p>As soon as practicable after <role refersTo="#minister">the Minister</role> receives the report, <role refersTo="#minister">the Minister</role> must arrange for:</p>

                <p>a copy to be given to <role refersTo="#ceo">the CEO</role>; and</p>

                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>

                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>

            </paragraph>
