            <heading>Object of Part</heading>
            <content>
              <p>The object of this Part is to provide for the Government of the Commonwealth, as the national Government of Australia, to implement a national gun buyback scheme in response to the antisemitic terrorist attack at Bondi Beach on <date date="2025-12-14">14 December 2025</date>.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-2">
            <num>2</num>
            <heading>Definitions</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-2__subclause-1">
              <num>1</num>
              <content>
                <p>In this Part:</p>
              </content>
            </hcontainer>
            <content>
              <p><b><i>AFP Minister</i></b><b> </b>means the Minister administering the <i>Australian Federal Police Act 1979</i>.</p>
              <p><b><i>buyback period</i></b>, for a State, means:</p>
              <p><b><i>national firearms program</i></b> means:</p>
              <p><b><i>qualifying compensation</i></b> has the meaning given by item 3.</p>
              <p><b><i>State</i></b> includes the Australian Capital Territory and the Northern Territory.</p>
            </content>
            <paragraph eId="schedule-2__clause-2__para-a">
              <num>a</num>
              <content>
                <p>the period beginning on <date date="2026-01-01">1 January 2026</date> and ending on <date date="2027-12-31">31 December 2027</date>, unless paragraph (b) applies; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-2__para-b">
              <num>b</num>
              <content>
                <p>if a different period is determined by the AFP Minister under subitem (2) for that State—that period.</p>
              </content>
            </paragraph>

                <p>the commitments made or affirmed, or other measures agreed, by National Cabinet, on <date date="2025-12-15">15 December 2025</date>, relating to firearms licencing, reducing the number of firearms in the community or any other matter connected with firearms; and</p>

            <paragraph eId="schedule-2__clause-2__para-b">
              <num>b</num>
              <content>
                <p>any other measures determined by the AFP Minister under subitem (3).</p>
              </content>
            </paragraph>

              <num>2</num>
              <content>
                <p>(2)	For the purposes of paragraph (b) of the definition of <b><i>buyback period </i></b>in subitem (1), the AFP Minister may, by notifiable instrument, determine a period for a State, on the recommendation of the Minister of that State who is responsible for police matters.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-2__subclause-3">
              <num>3</num>
              <content>
                <p>(3)	For the purposes of paragraph (b) of the definition of <b><i>national firearms program </i></b>in subitem (1), the AFP Minister may, by notifiable instrument, determine measures if the AFP Minister is satisfied those measures are in relation to firearms.</p>
              </content>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-3">
            <num>3</num>
            <heading>Qualifying compensation paid by a State</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-3__subclause-1">
              <num>1</num>
              <content>
                <p>(1)	Compensation paid by a State is <b><i>qualifying compensation</i></b> to the extent that the compensation is paid during the buyback period for the State under a compensation scheme:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-3__para-a">
              <num>a</num>
              <content>
                <p>set up by the State to support the national firearms program; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-3__para-b">
              <num>b</num>
              <content>
                <p>approved by the AFP Minister under subitem (2).</p>

              <p>		An <b><i>adverse criminal intelligence assessment</i></b> is a criminal intelligence assessment in respect of a person that contains:</p>
            </content>
            <paragraph eId="schedule-2__clause-54__para-a">
              <num>a</num>
              <content>
                <p>any opinion or advice, or any qualification of any opinion or advice, or any information, that is or could be prejudicial to the interests of the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54__para-b">
              <num>b</num>
              <content>
                <p>a recommendation that prescribed administrative action be taken or not be taken in respect of the person, being a recommendation the implementation of which would be prejudicial to the interests of the person.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-54A">
            <num>54A</num>
            <heading>Meaning of prescribed administrative action</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-54A__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	<b><i>Prescribed administrative action </i></b>means the exercise of any power, or the performance of any function, in relation to any of the following decisions under a law of a State or Territory:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-54A__para-a">
              <num>a</num>
              <content>
                <p>a decision about whether to issue a firearms licence or otherwise relating to the issue of such a licence (including in relation to conditions);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54A__para-b">
              <num>b</num>
              <content>
                <p>a decision about whether to renew, revoke, vary or suspend a licence mentioned in paragraph (a).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-54A__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	Action is also <b><i>prescribed administrative action</i></b> if the action relates to or affects:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-54A__para-a">
              <num>a</num>
              <content>
                <p>access by a person to any information or place, access to which is controlled or limited under:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54A__para-i">
              <num>i</num>
              <content>
                <p>	(i)	the <i>Aviation Transport Security Act 2004</i> or regulations under that Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54A__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	the <i>Maritime Transport and Offshore Facilities Security Act 2003 </i>or regulations under that Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54A__para-iii">
              <num>iii</num>
              <content>
                <p>an Act prescribed by the regulations for the purposes of this subparagraph, or a legislative instrument under that Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54A__para-b">
              <num>b</num>
              <content>
                <p>a person’s ability to perform an activity in relation to, or involving, a thing (other than information or a place), if that ability is controlled or limited under:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54A__para-i">
              <num>i</num>
              <content>
                <p>	(i)	the <i>Aviation Transport Security Act 2004</i> or regulations under that Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54A__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	the <i>Maritime Transport and Offshore Facilities Security Act 2003 </i>or regulations under that Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54A__para-iii">
              <num>iii</num>
              <content>
                <p>an Act prescribed by the regulations for the purposes of this subparagraph, or a legislative instrument under that Act.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-54B">
            <num>54B</num>
            <heading>Meaning of serious and organised crime</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-54B__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	For the purposes of this Part, <b><i>serious and organised crime</i></b> means a federal offence that may have been committed, may presently be being committed, or may in future be committed, in circumstances involving:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-54B__para-a">
              <num>a</num>
              <content>
                <p>2 or more offenders; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54B__para-b">
              <num>b</num>
              <content>
                <p>substantial planning or organisation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54B__para-c">
              <num>c</num>
              <content>
                <p>the use of sophisticated methods and techniques.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-54B__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	A <b><i>federal offence </i></b>is an offence:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-54B__para-a">
              <num>a</num>
              <content>
                <p>against a law of the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54B__para-b">
              <num>b</num>
              <content>
                <p>against a law of a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54B__para-c">
              <num>c</num>
              <content>
                <p>against a law of a State that has a federal aspect;</p>
              </content>
            </paragraph>
            <content>
              <p>that is:</p>
              <p>Note:	For the definitions of <b><i>State </i></b>and <b><i>Territory</i></b>, see subsection 4(1).</p>
            </content>
            <paragraph eId="schedule-2__clause-54B__para-d">
              <num>d</num>
              <content>
                <p>punishable by imprisonment for a period of 2 years or more; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54B__para-e">
              <num>e</num>
              <content>
                <p>prescribed by the regulations for the purposes of this paragraph.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-54C">
            <num>54C</num>
            <heading>Making criminal intelligence assessments</heading>
            <content>
              <p>General</p>
              <p>Note:	The making of criminal intelligence assessments is separate to, and does not affect, the ACC’s function of providing strategic criminal intelligence assessments to the Board (as referred to in paragraph 7A(e)) and the Board’s function of disseminating those strategic criminal intelligence assessments (as referred to in paragraph 7C(1)(g)).</p>
              <p>Certain criminal intelligence assessments that are not adverse</p>
              <p>Note:	<role refersTo="#ceo">The CEO</role> may arrange for the use of a computer program to make criminal intelligence assessments to which this subsection applies: see section 54G.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-2__clause-54C__subclause-1">
              <num>1</num>
              <content>
                <p>The ACC may make criminal intelligence assessments for purposes related to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-54C__para-a">
              <num>a</num>
              <content>
                <p>firearms background checks; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54C__para-b">
              <num>b</num>
              <content>
                <p>background checks required or permitted by any of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54C__para-i">
              <num>i</num>
              <content>
                <p>	(i)	the <i>Aviation Transport Security Act 2004</i> or regulations under that Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54C__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	the <i>Maritime Transport and Offshore Facilities Security Act 2003</i> or regulations under that Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54C__para-iii">
              <num>iii</num>
              <content>
                <p>an Act prescribed by the regulations for the purposes of subparagraph 54A(2)(a)(iii) or (b)(iii), or a legislative instrument under that Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-54C__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may, by legislative instrument, determine the following in relation to the making of criminal intelligence assessments:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-54C__para-a">
              <num>a</num>
              <content>
                <p>the matters that must be taken into account;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54C__para-b">
              <num>b</num>
              <content>
                <p>the manner in which those matters must be taken into account;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54C__para-c">
              <num>c</num>
              <content>
                <p>the matters that must not be taken into account.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-54C__subclause-3">
              <num>3</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> must not make a determination under subsection (2) unless <role refersTo="#ceo">the CEO</role> has consulted <role refersTo="#minister">the Minister</role>.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-54C__subclause-4">
              <num>4</num>
              <content>
                <p>If the ACC, in making a criminal intelligence assessment, considers that making an adverse criminal intelligence assessment in respect of a person would prejudice law enforcement or intelligence interests, the ACC may decide not to make the assessment.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-54C__subclause-5">
              <num>5</num>
              <content>
                <p>To avoid doubt, for the purposes of performing the function in subsection (1), the ACC may:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-54C__para-a">
              <num>a</num>
              <content>
                <p>make a criminal intelligence assessment at any time for purposes related to a background check that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54C__para-i">
              <num>i</num>
              <content>
                <p>is being undertaken; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54C__para-ii">
              <num>ii</num>
              <content>
                <p>has previously been undertaken; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54C__para-b">
              <num>b</num>
              <content>
                <p>make more than one criminal intelligence assessment for purposes related to the same background check.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-54C__subclause-6">
              <num>6</num>
              <content>
                <p>	(6)	Despite subsections (1) and (2), the ACC must make a criminal intelligence assessment in respect of a person that is not an adverse criminal intelligence assessment if the person is not identified<i> </i>in a search of intelligence held by the ACC that is conducted in accordance with the instructions issued by the CEO under subsection (7).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-54C__subclause-7">
              <num>7</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> must, in writing, issue instructions about the conducting of searches for the purposes of subsection (6).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-54C__subclause-8">
              <num>8</num>
              <content>
                <p>Instructions issued under subsection (7) are not a legislative instrument.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-54D">
            <num>54D</num>
            <heading>Giving criminal intelligence assessments to Commonwealth agencies</heading>
            <content>
              <p>Criminal intelligence assessments that are not adverse</p>
              <p>Note:	<role refersTo="#ceo">The CEO</role> may arrange for the use of a computer program to give certain kinds of criminal intelligence assessments to Commonwealth agencies: see section 54G.</p>
              <p>Adverse criminal intelligence assessments</p>
            </content>
            <hcontainer name="subclause" eId="schedule-2__clause-54D__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	The ACC may give a criminal intelligence assessment, that is not an adverse criminal intelligence assessment, in respect of a person to a Commonwealth agency<i> </i>for purposes related to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-54D__para-a">
              <num>a</num>
              <content>
                <p>a firearms background check of the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54D__para-b">
              <num>b</num>
              <content>
                <p>a background check of the person that is required or permitted by any of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54D__para-i">
              <num>i</num>
              <content>
                <p>	(i)	the <i>Aviation Transport Security Act 2004</i> or regulations under that Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54D__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	the <i>Maritime Transport and Offshore Facilities Security Act 2003</i> or regulations under that Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54D__para-iii">
              <num>iii</num>
              <content>
                <p>an Act prescribed by the regulations for the purposes of subparagraph 54A(2)(a)(iii) or (b)(iii), or a legislative instrument under that Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-54D__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	Despite subsection (1), the ACC must give a criminal intelligence assessment, that is not an adverse criminal intelligence assessment, in respect of a person to a Commonwealth agency<i> </i>for purposes mentioned in subsection (1) if the criminal intelligence assessment is made in accordance with subsection 54C(6).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-54D__subclause-3">
              <num>3</num>
              <content>
                <p>	(3)	The CEO may cause an adverse criminal intelligence assessment in respect of a person to be given to a Commonwealth agency<i> </i>for purposes related to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-54D__para-a">
              <num>a</num>
              <content>
                <p>a firearms background check of the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54D__para-b">
              <num>b</num>
              <content>
                <p>a background check of the person that is required or permitted by any of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54D__para-i">
              <num>i</num>
              <content>
                <p>	(i)	the <i>Aviation Transport Security Act 2004</i> or regulations under that Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54D__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	the <i>Maritime Transport and Offshore Facilities Security Act 2003</i> or regulations under that Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54D__para-iii">
              <num>iii</num>
              <content>
                <p>an Act prescribed by the regulations for the purposes of subparagraph 54A(2)(a)(iii) or (b)(iii), or a legislative instrument under that Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-54D__subclause-4">
              <num>4</num>
              <content>
                <p>If <role refersTo="#ceo">the CEO</role> considers that giving a Commonwealth agency an adverse criminal intelligence assessment in respect of a person would prejudice law enforcement or intelligence interests or security, <role refersTo="#ceo">the CEO</role> may decide not to cause the assessment to be given to the agency.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-54D__subclause-5">
              <num>5</num>
              <content>
                <p>An adverse criminal intelligence assessment given to a Commonwealth agency under subsection (3) must be accompanied by:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-54D__para-a">
              <num>a</num>
              <content>
                <p>a statement of the grounds for the assessment (which is taken to be part of the assessment); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54D__para-b">
              <num>b</num>
              <content>
                <p>if, under subsection (7), <role refersTo="#ceo">the CEO</role> makes a certificate in relation to information contained in the assessment—a copy of the certificate.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-54D__subclause-6">
              <num>6</num>
              <content>
                <p>The statement of the grounds for the adverse criminal intelligence assessment must contain all information that the ACC relied on in making the assessment, other than:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-54D__para-a">
              <num>a</num>
              <content>
                <p>subject to subsection (8), information in relation to which <role refersTo="#ceo">the CEO</role> has made a certificate under subsection (7); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54D__para-b">
              <num>b</num>
              <content>
                <p>information the disclosure of which would be contrary to a law of the Commonwealth, a State or a Territory.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-54D__subclause-7">
              <num>7</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may certify, in writing, that <role refersTo="#ceo">the CEO</role> is satisfied that disclosing particular information contained in an adverse criminal intelligence assessment, including particular information contained in the statement of the grounds for the assessment, to the person in respect of whom the assessment was made would prejudice law enforcement or intelligence interests or security.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-54D__subclause-8">
              <num>8</num>
              <content>
                <p>If <role refersTo="#ceo">the CEO</role> makes a certificate under subsection (7) in relation to information, <role refersTo="#ceo">the CEO</role> may decide not to cause the information to be given to a Commonwealth agency under subsection (3) or (5). However, <role refersTo="#minister">the Minister</role> may, after consulting <role refersTo="#ceo">the CEO</role>, direct <role refersTo="#ceo">the CEO</role> to cause the information to be given to the Commonwealth agency.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-54D__subclause-9">
              <num>9</num>
              <content>
                <p>A certificate made under subsection (7) is not a legislative instrument.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-54D__subclause-10">
              <num>10</num>
              <content>
                <p>If the direction under subsection (8) is made in writing, the direction is not a legislative instrument.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-54E">
            <num>54E</num>
            <heading>Person to be notified of adverse criminal intelligence assessment</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-54E__subclause-1">
              <num>1</num>
              <content>
                <p>If an adverse criminal intelligence assessment in respect of a person is given to a Commonwealth agency under subsection 54D(3), the Commonwealth agency must give written notice of the assessment to the person.</p>
              </content>
            </hcontainer>
            <content>

                <p>The written notice must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-54E__para-a">
              <num>a</num>
              <content>
                <p>be given to the person before the end of the period of 14 days beginning on the day after:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54E__para-i">
              <num>i</num>
              <content>
                <p>unless subparagraph (ii) applies—the day the adverse criminal intelligence assessment is given to the Commonwealth agency; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54E__para-ii">
              <num>ii</num>
              <content>
                <p>if a certificate under subsection (6) that was in force in relation to the adverse criminal intelligence assessment is subsequently revoked—the day the certificate is revoked; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54E__para-b">
              <num>b</num>
              <content>
                <p>inform the person of the making of the adverse criminal intelligence assessment; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54E__para-c">
              <num>c</num>
              <content>
                <p>include the statement of the grounds for the adverse criminal intelligence assessment that was given to the Commonwealth agency (other than information in relation to which <role refersTo="#ceo">the CEO</role> has made a certificate under subsection 54D(7)); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54E__para-d">
              <num>d</num>
              <content>
                <p>contain information concerning the person’s right to apply to the Tribunal for a review of the adverse criminal intelligence assessment.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-54E__subclause-3">
              <num>3</num>
              <content>
                <p>Subsection (1) does not apply if the adverse criminal intelligence assessment is given to the Commonwealth agency in relation to any of the following decisions under a law of a State or Territory:</p>
              </content>

            <paragraph eId="schedule-2__clause-54E__para-a">
              <num>a</num>
              <content>
                <p>a decision about whether to issue a firearms licence or otherwise relating to the issue of such a licence (including in relation to conditions);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54E__para-b">
              <num>b</num>
              <content>
                <p>a decision about whether to renew, revoke, vary or suspend a licence a licence mentioned in paragraph (a).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-54E__subclause-4">
              <num>4</num>
              <content>
                <p>Despite subsection (3), subsection (1) does apply in the circumstances prescribed by the regulations for the purposes of this subsection.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-54E__subclause-5">
              <num>5</num>
              <content>
                <p>Subsection (1) does not apply if a certificate made under subsection (6) is in force in relation to the adverse criminal intelligence assessment.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-54E__subclause-6">
              <num>6</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may certify, in writing, that <role refersTo="#minister">the Minister</role> is satisfied that the withholding of notice to a person of the making of an adverse criminal intelligence assessment in respect of the person is essential to either or both of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-54E__para-a">
              <num>a</num>
              <content>
                <p>avoiding prejudice to law enforcement or intelligence interests;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54E__para-b">
              <num>b</num>
              <content>
                <p>security.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-54E__subclause-7">
              <num>7</num>
              <content>
                <p>If <role refersTo="#minister">the Minister</role> makes a certificate under subsection (6) in relation to an adverse criminal intelligence assessment, <role refersTo="#minister">the Minister</role> must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-54E__para-a">
              <num>a</num>
              <content>
                <p>give a copy of the certificate to the Commonwealth agency to which the assessment was given under subsection 54D(3); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-54E__para-b">
              <num>b</num>
              <content>
                <p>before the end of the following periods (unless the certificate is revoked earlier), consider whether to revoke the certificate:</p>
              </content>
            </paragraph>

                <p><role refersTo="#ceo">The CEO</role> must take all reasonable steps to ensure that specified criminal intelligence assessment action taken by the operation of a computer program under an arrangement under subsection 54G(1) is specified criminal intelligence assessment action that the ACC could validly take under section 54C or 54D.</p>

            <heading>Applications to Tribunal</heading>

                <p>An application may be made to the Tribunal for review of a decision of the ACC under <ref href="#sec-54C">section 54C</ref> to make an adverse criminal intelligence assessment.</p>

                <p>a decision about whether to issue a firearms licence or otherwise relating to the issue of such a licence (including in relation to conditions);</p>

                <p>a decision about whether to renew, revoke, vary or suspend a licence mentioned in paragraph (a).</p>

            <heading>Restriction on further assessments after review</heading>

              <p>If the Tribunal has made findings upon a review of an adverse criminal intelligence assessment, the ACC must not make a further criminal intelligence assessment in respect of the person concerned that is not in accordance with those findings except on the basis of matters occurring after the review or of evidence that was not available at the time of the review.</p>

            <heading>Costs</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-54L__subclause-1">
              <num>1</num>

                <p>The Tribunal may order that costs reasonably incurred by an applicant under <ref href="#sec-54J">section 54J</ref> in connection with the application, or any part of those costs that is determined by the Tribunal, be paid by the Commonwealth if:</p>

                <p>the applicant was, in the opinion of the Tribunal, successful, or substantially successful, in the application for review; and</p>

                <p>the Tribunal is satisfied that it is appropriate to make the order in all the circumstances of the case.</p>

                <p>A person commits an offence if:</p>

                <p>the person is, or has been:</p>

                <p>a member or an officer of the Tribunal; or</p>

                <p>an officer or employee of a Commonwealth agency to which an adverse criminal intelligence assessment has been given under subsection 54D(3); and</p>

                <p>the person makes a record of, discloses or otherwise uses information; and</p>
              </content>
            </paragraph>

                <p>the information was obtained by the person by reason of, or in the course of, the performance or exercise of the person’s functions, duties or powers as a member or an officer of the Tribunal, or as an officer or employee of the agency; and</p>

              <num>d</num>
              <content>
                <p>the information is, is contained in, or relates to, a criminal intelligence assessment.</p>
              </content>
            </paragraph>
            <content>
              <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 2 years</quantity> or <quantity refersTo="#penaltyUnit">120 penalty units</quantity>, or both.</p>
              <p>Note 1:	A defendant bears an evidential burden in relation to a matter in subsection (2) (see subsection 13.3(3) of the <i>Criminal Code</i>).</p>
              <p>Note 2:	Section 276 of the ART Act also deals with the disclosure of certain information and documents by members and officers of the Tribunal.</p>

                <num>ii</num>

                  <p>the person performs work for such a business; and</p>
                </content>
              </paragraph>

                  <p>the business owner holds a licence or permit (however described):</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-212__subclause-474-45J__para-i">
                <num>i</num>
                <content>
                  <p>that was granted by a State or a Territory or an authority of a State or a Territory; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-212__subclause-474-45J__para-ii">
                <num>ii</num>
                <content>
                  <p>that authorises the manufacture, repair, maintenance or modification of those firearms, firearm accessories, firearm parts, firearm magazines or explosives or other lethal devices; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-212__subclause-474-45J__para-iii">
                <num>iii</num>
                <content>
                  <p>that is in force; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-212__subclause-474-45J__para-c">
                <num>c</num>
                <content>
                  <p>the material relates to those firearms, firearm accessories, firearm parts, firearm magazines or explosives or other lethal devices; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-212__subclause-474-45J__para-d">
                <num>d</num>
                <content>
                  <p>the conduct is in connection with the carrying on of that business.</p>
                </content>
              </paragraph>

                <content>
                  <p>Subsection 474.45G(1) or 474.45H(1) does not apply to engaging in conduct by a person in relation to material if:</p>

                <num>a</num>
                <content>
                  <p>the person holds a licence or permit (however described):</p>
                </content>
              </paragraph>

                <num>i</num>
                <content>
                  <p>that was granted by a State or a Territory or an authority of a State or a Territory; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-212__subclause-474-45J__para-ii">
                <num>ii</num>
                <content>
                  <p>that authorises the manufacture, repair, maintenance or modification of firearms, firearm accessories, firearm parts, firearm magazines or explosives or other lethal devices; and</p>

                  <p>the material relates to those firearms, firearm accessories, firearm parts, firearm magazines or explosives or other lethal devices.</p>

                  <p>Subsection 474.45G(1) or 474.45H(1) does not apply to engaging in conduct in relation to material if:</p>

                  <p>the conduct is necessary for enforcing a law of:</p>

              </paragraph>

              <paragraph eId="schedule-2__clause-212__subclause-474-45J__para-iii">

                  <p>the conduct is necessary for monitoring compliance with, or investigating a contravention of, a law of:</p>
                </content>
              </paragraph>

                <num>i</num>
                <content>
                  <p>the Commonwealth; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-212__subclause-474-45J__para-ii">
                <num>ii</num>

                  <p>a State; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-212__subclause-474-45J__para-iii">

                  <p>the conduct is for the purposes of proceedings in a court or tribunal; or</p>

                  <p>both:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-212__subclause-474-45J__para-i">
                <num>i</num>
                <content>
                  <p>the conduct is necessary for, or of assistance in, conducting scientific, academic or historical research; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-212__subclause-474-45J__para-ii">
                <num>ii</num>
                <content>
                  <p>the conduct is reasonable in the circumstances for the purpose of conducting that scientific, academic or historical research; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-212__subclause-474-45J__para-e">
                <num>e</num>
                <content>
                  <p>both:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-212__subclause-474-45J__para-i">

                  <p>the conduct is in connection with the performance by a public official of the official’s duties or functions; and</p>

                  <p>the conduct is reasonable in the circumstances for the purpose of the public official performing that duty or function; or</p>
