            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p>Repeal the section, substitute:</p>

            <heading>Notice of application</heading>
            <content>
              <p>The Board must, as soon as practicable after receiving an application for review, give written notice of the application to:</p>
            </content>
            <paragraph eId="schedule-1__clause-352C__para-a">
              <num>a</num>
              <content>
                <p>in any case—the Commission; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-352C__para-b">
              <num>b</num>
              <content>
                <p>the Chief of the Defence Force, in either of the following cases:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-352C__para-i">
              <num>i</num>
              <content>
                <p>for an application relating to a service injury or disease—if the applicant was a member at the time the application was made;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-352C__para-ii">
              <num>ii</num>
              <content>
                <p>for an application relating to a person’s service death—if the person was a member at the time of death.</p>
              </content>
            </paragraph>

            <heading>Subsection 352G(1)</heading>
            <content>
              <p>Repeal the subsection, substitute:</p>
            </content>

                <p>The parties to a review are:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-2__para-a">
              <num>a</num>
              <content>
                <p>the applicant for the review; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-b">
              <num>b</num>
              <content>
                <p>the Commission; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-c">
              <num>c</num>
              <content>
                <p>if the Chief of the Defence Force gives the Board a notice under subsection (1A)—the Chief of the Defence Force.</p>
              </content>
            </paragraph>

                <p>The Chief of the Defence Force may, as soon as practicable after receiving notice of an application to which paragraph 352C(b) applies, give written notice to the Board electing to be a party to the review.</p>

            <heading>Subsection 353B(1)</heading>
            <content>
              <p>Repeal the subsection, substitute:</p>

              <content>
                <p>The Board must give a copy of its decision under <ref href="#sec-353A">section 353A</ref> to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-3__para-a">
              <num>a</num>
              <content>
                <p>in any case—each party to the review; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-b">
              <num>b</num>
              <content>
                <p>unless the Chief of the Defence Force is a party to the review—the Chief of the Defence Force, in either of the following cases:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-i">
              <num>i</num>
              <content>
                <p>for an application relating to a service injury or disease—if the applicant was a member at the time the decision was made;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-ii">
              <num>ii</num>
              <content>
                <p>for an application relating to a person’s service death—if the person was a member at the time of death.</p>
              </content>
            </paragraph>
          </hcontainer>

            <heading>Paragraph 353B(3)(a)</heading>
            <content>
              <p>Repeal the paragraph, substitute:</p>
            </content>

              <num>a</num>
              <content>
                <p>a person notified under subsection (1) may, <quantity refersTo="#deadline">within 28 days</quantity> after the day a copy of the decision is given to the person, make a request to the Board for a written statement of the Board’s reasons for its decision; and</p>
              </content>
            </paragraph>
          </hcontainer>

            <num>5</num>
            <heading>Paragraph 353C(10)(a)</heading>
            <content>
              <p>Repeal the paragraph, substitute:</p>
            </content>
            <paragraph eId="schedule-1__clause-5__para-a">
              <num>a</num>
              <content>
                <p>in any case—give notice of the dismissal to each party to the review; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-aa">
              <num>aa</num>
              <content>
                <p>unless the Chief of the Defence Force is a party to the review—give notice of the dismissal to the Chief of the Defence Force, in either of the following cases;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-i">
              <num>i</num>
              <content>
                <p>for an application relating to a service injury or disease—if the applicant was a member at the time of the dismissal;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-ii">
              <num>ii</num>
              <content>
                <p>for an application relating to a person’s service death—if the person was a member at the time of death; and</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-6">
            <num>6</num>
            <heading>Paragraph 353C(10)(b)</heading>
            <content>
              <p>Omit “the notice must include”, substitute “include in the notice”.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-7">
            <num>7</num>
            <heading>Subsections 353R(3), (4) and (5)</heading>
            <content>
              <p>Repeal the subsections, substitute:</p>
              <p>Military Rehabilitation and Compensation (Consequential and Transitional Provisions) Act 2004</p>
            </content>

                <p>An application under subsection (1):</p>
              </content>
            </hcontainer>

                <p>must be lodged at a place approved by the Commission under subsection 323(2); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-7__para-b">
              <num>b</num>
              <content>
                <p>is taken to have been made on a day determined under subsection 323(2).</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-8">
            <num>8</num>
            <heading>Subsection 12(4)</heading>
            <content>
              <p>Omit “has received compensation”, substitute “has made a claim or application for compensation that has not been finally determined, or has received or is receiving compensation,”.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9">
            <num>9</num>
            <heading>Paragraph 12(5)(b)</heading>
            <content>
              <p>Repeal the paragraph, substitute:</p>
            </content>
            <paragraph eId="schedule-1__clause-9__para-b">
              <num>b</num>
              <content>
                <p>the first-mentioned person:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9__para-i">
              <num>i</num>
              <content>
                <p>has made an application that has not been finally determined for a pension that is payable under <ref href="#sec-13">section 13</ref> of the VEA in respect of the death; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9__para-ii">
              <num>ii</num>
              <content>
                <p>is receiving a pension that is paid under <ref href="#sec-13">section 13</ref>, 13A or 13B of the VEA in respect of the death; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9__para-c">
              <num>c</num>
              <content>
                <p>before the date of commencement, the first-mentioned person had not been eligible for compensation under Chapter 5 of the MRCA in respect of the death.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-10">
            <num>10</num>
            <heading>Subsection 12(6)</heading>
            <content>
              <p>Repeal the subsection, substitute:</p>
              <p>Note 1:	If the person has made a claim or application for such compensation under the relevant Act that has not been finally determined, the relevant Act may continue to apply in relation to the claim or application (see <ref href="#sec-88">section 88</ref> or 89).</p>
              <p>Note 2:	In some circumstances, even if this subsection applies to a person, the person may not be entitled to a lump sum payment under paragraph 234(1)(a) of the MRCA: see subsection (5B) of this section.</p>
              <p>Note:	If paragraph (5A)(b) or (c) of this section does not apply in relation to the person, the person is not entitled to compensation payable under paragraph 234(1)(a) of the MRCA, or any other provision of <ref href="#part-2">Part 2</ref>, 3 or 4 of Chapter 5 of the MRCA (see subsection (4) of this section).</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-10__subclause-5A">
              <num>5A</num>
              <content>
                <p>Subsections (4) and (5) do not apply to a person in relation to compensation under <ref href="#part-2">Part 2</ref>, 3 or 4 of Chapter 5 of the MRCA for a particular matter if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10__para-a">
              <num>a</num>
              <content>
                <p>	(a)	before the date of commencement, the person was eligible for compensation for that matter under the DRCA or the VEA (the <b><i>relevant Act</i></b>); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-b">
              <num>b</num>
              <content>
                <p>in a case in which the person has made a claim or application for compensation for that matter under the relevant Act—that claim or application has been finally determined; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-c">
              <num>c</num>
              <content>
                <p>the person has not received, and is not receiving, compensation for that matter under the relevant Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-d">
              <num>d</num>
              <content>
                <p>the relevant Act (as in force after the date of commencement) does not authorise a claim or application for compensation for that matter.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-10__subclause-5B">
              <num>5B</num>
              <content>
                <p>A person is not entitled to the amount of compensation payable under paragraph 234(1)(a) of the MRCA in respect of the death of another person if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10__para-a">
              <num>a</num>
              <content>
                <p>the death occurred before the date of commencement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-b">
              <num>b</num>
              <content>
                <p>the death was war-caused, or defence-caused, within the meaning of the VEA; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-c">
              <num>c</num>
              <content>
                <p>paragraphs (5A)(a), (b) and (c) of this section apply in relation to the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-d">
              <num>d</num>
              <content>
                <p>before the date of commencement:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-i">
              <num>i</num>
              <content>
                <p>the person was eligible for compensation in respect of the death under <ref href="#sec-13">section 13</ref> of the VEA; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-ii">
              <num>ii</num>
              <content>
                <p>the person was not eligible for compensation in respect of the death under <ref href="#sec-17">section 17</ref> of the DRCA or <ref href="#sec-233">section 233</ref> of the MRCA.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-10__subclause-6">
              <num>6</num>
              <content>
                <p>Subsection (6A) applies if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10__para-a">
              <num>a</num>
              <content>
                <p>a member dies on or after the date of commencement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-b">
              <num>b</num>
              <content>
                <p>compensation is being paid to a wholly dependent partner of the member under <ref href="#sec-13A">section 13A</ref> of the VEA in respect of the death of the member; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-c">
              <num>c</num>
              <content>
                <p>	(c)	a claim for compensation (the <b><i>MRCA claim</i></b>) in respect of the partner is made under section 319 of the MRCA; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-d">
              <num>d</num>
              <content>
                <p>the Commonwealth becomes liable to pay compensation under <ref href="#sec-233">section 233</ref> of the MRCA in respect of the partner.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-10__subclause-6A">
              <num>6A</num>
              <content>
                <p>If this subsection applies:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-10__para-a">
              <num>a</num>
              <content>
                <p>from the time the Commission or the Board makes a decision to grant the MRCA claim, pension is no longer payable to the partner under <ref href="#sec-13A">section 13A</ref> of the VEA in respect of the death; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-b">
              <num>b</num>
              <content>
                <p>despite paragraph 234(5)(b) of the MRCA, the weekly amount under paragraph 234(1)(b) of the MRCA is payable to the partner from the date of the decision to grant the MRCA claim until the partner’s death.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-11">
            <num>11</num>
            <heading>At the end of section 12</heading>
            <content>
              <p>Add:</p>
              <p>Nil or negative amount of compensation or pension</p>
              <p>Note:	The amount of compensation may be nil or a negative amount due to offsets under this Act, the VEA, the MRCA or another law.</p>

              <content>
                <p>	(10)	For the purposes of this section, a person is taken to receive<b><i> </i></b>compensation (including a pension) even if the amount of the compensation payable is nil or a negative amount.</p>
              </content>

          <hcontainer name="clause" eId="schedule-1__clause-12">
            <num>12</num>
            <heading>Section 266A</heading>
            <content>
              <p>Repeal the section.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-13">
            <num>13</num>
            <heading>At the end of section 267A</heading>
            <content>
              <p>Add:</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-13__subclause-3">
              <num>3</num>
              <content>
                <p>If the Commonwealth is liable to pay compensation in respect of a deceased member’s funeral under both sections 266 and 268AC, the amount of compensation under <ref href="#sec-266">section 266</ref> must be reduced by the amount of compensation paid under <ref href="#sec-268A">section 268A</ref>C in respect of the deceased member’s funeral.</p>
