            <p>		This Act is the <i>Translating and Interpreting Services Act 2026</i>.</p>

          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Objects</heading>
          <content>
            <p>The objects of this Act are:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>to continue and expand the translating and interpreting service that was established by the Commonwealth after the Second World War to support Australia’s immigration program; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>to provide for translating and interpreting services to support government functions; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>to provide for translating and interpreting services to support equitable access to key services for people with limited English language proficiency; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-d">
            <num>d</num>
            <content>
              <p>in coordination with the States and Territories, to provide services to address national translation and interpretation needs that would not otherwise be met.</p>

          <num>4</num>
          <heading>Simplified outline of this Act</heading>
          <content>
            <p><role refersTo="#secretary">The Secretary</role> has functions in relation to provision of translating and interpreting services for certain purposes.</p>
            <p><role refersTo="#secretary">The Secretary</role> may charge fees for services provided under this Act.</p>

        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-rules">rules</term> means <def>the rules made under <ref href="#sec-13">section 13</ref>.</def></p>
            <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>

          <num>6</num>
          <heading>Extension to external Territories</heading>
          <content>
            <p>This Act extends to the external Territories.</p>
          </content>
        </section>
        <section eId="part-1__sec-7">
          <num>7</num>
          <heading>Extra-territorial application</heading>
          <content>
            <p>This Act extends to acts, omissions, matters and things outside Australia.</p>

        <heading>Functions</heading>

          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> has the following functions:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>to provide, or arrange for the provision of, translating and interpreting services to the Commonwealth or an agency, authority, body, organisation or office holder of the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to provide, or arrange for the provision of, translating and interpreting services to facilitate communication by a person with the Commonwealth or an agency, authority, body, organisation or office holder of the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>to provide, or arrange for the provision of, translating and interpreting services to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>a State or a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>an agency, authority, body, organisation or office holder of a State or a Territory;</p>
              </content>
              <content>
                <p>under an arrangement with the State or Territory;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>to provide, or arrange for the provision of, translating and interpreting services to facilitate communication by a person with:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>a State or a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>an agency, authority, body, organisation or office holder of a State or a Territory;</p>
              </content>
              <content>
                <p>under an arrangement with the State or Territory;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>to provide, or arrange for the provision of, translating and interpreting services by means of a telegraphic, telephonic or other like service (within the meaning of paragraph 51(v) of the Constitution);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>to provide, or arrange for the provision of, translating and interpreting services for the primary purpose of assisting the following persons:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>aliens;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>persons who have migrated to Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-g">
              <num>g</num>
              <content>
                <p>under arrangements with States and Territories, to provide, or arrange for the provision of, translating and interpreting services to address a national need that would not otherwise be met;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-h">
              <num>h</num>
              <content>
                <p>to develop, train and support translators and interpreters to provide services for the purposes of the above functions;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>any other functions relating to translation and interpretation specified in the rules;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-j">
              <num>j</num>
              <content>
                <p>to do anything else that is incidental or conducive to the performance of any of the above functions.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>Paragraphs (1)(a) to (j) do not limit each other.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-3">
            <num>3</num>
            <content>
              <p>Rules made for the purposes of paragraph (1)(i) must specify the legislative power or powers of the Parliament in respect of which the rules are made.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-4">
            <num>4</num>
            <content>
              <p>The functions of <role refersTo="#secretary">the Secretary</role> under this Act may be performed within or outside Australia.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-5">
            <num>5</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> has power to do all things necessary or convenient to be done for or in connection with the performance of <role refersTo="#secretary">the Secretary</role>’s functions under this Act.</p>

          </subsection>
          <subsection eId="part-2__sec-8__subsec-6">
            <num>6</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role>’s powers include, but are not limited to, the following powers:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>the power to make, enter into, vary and administer arrangements, contracts, agreements and deeds;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>the power to engage contractors and consultants.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-9">
          <num>9</num>
          <heading>Fees</heading>
          <subsection eId="part-2__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, on behalf of the Commonwealth, charge fees for services provided by <role refersTo="#secretary">the Secretary</role> in performing <role refersTo="#secretary">the Secretary</role>’s functions under this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p>A fee must not be such as to amount to taxation.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-3">
            <num>3</num>
            <content>
              <p>A fee charged under subsection (1):</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>is a debt due to the Commonwealth; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>is recoverable by the Commonwealth in a court of competent jurisdiction.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-10">
          <num>10</num>
          <heading>Executive power of the Commonwealth</heading>
          <content>
            <p>This Part does not limit the executive power of the Commonwealth.</p>

        <heading>Miscellaneous</heading>
        <section eId="part-3__sec-11">
          <num>11</num>
          <heading>Pre-existing arrangements</heading>
          <content>
            <p>Action before commencement of this section</p>
          </content>
          <subsection eId="part-3__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	This section applies if, at a time (the <b><i>relevant time</i></b>) before the commencement of this section:</p>
            </content>
            <paragraph eId="part-3__sec-11__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the Commonwealth purported to make, vary or administer an arrangement for the purposes of, or for purposes incidental to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>providing, or arranging for the provision of, a relevant service; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>developing, training or supporting translators or interpreters to provide a relevant service; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the Commonwealth did not (apart from this section) have the power to make, vary or administer that arrangement.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>The Commonwealth is taken to have had, at the relevant time, the power to make, vary or administer that arrangement.</p>
            </content>
            <content>
              <p>Action after the commencement of this section</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p>The powers conferred by subsection 8(5) include the power to vary or administer an arrangement made before the commencement of this section for the purposes of, or for purposes incidental to:</p>
            </content>
            <paragraph eId="part-3__sec-11__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>providing, or arranging for the provision of, a relevant service; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>developing, training or supporting translators or interpreters to provide a relevant service.</p>
              </content>
              <content>
                <p>Arrangements with States and Territories</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-4">
            <num>4</num>
            <content>
              <p>Paragraphs 8(1)(c), (d) and (g) apply in relation to an arrangement with a State or Territory made before, on or after the commencement of this section.</p>

            <num>5</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>arrangement</i></b> includes a contract, agreement or deed.</p>
              <p><b><i>make</i></b>, in relation to an arrangement, includes enter into.</p>
              <p><b><i>relevant service</i></b> means a service mentioned in any of paragraphs 8(1)(a) to (g).</p>

        </section>

          <num>12</num>
          <heading>Delegation by Secretary</heading>
          <subsection eId="part-3__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, in writing, delegate all or any of <role refersTo="#secretary">the Secretary</role>’s functions or powers under this Act to an SES employee, or an acting SES employee, in the Department.</p>

          </subsection>
          <subsection eId="part-3__sec-12__subsec-2">
            <num>2</num>
            <content>
              <p>A person performing functions or exercising powers under a delegation under subsection (1) must comply with any written directions of <role refersTo="#secretary">the Secretary</role> under subsection (3).</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, in writing, give directions for the purposes of subsection (2).</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-13">
          <num>13</num>
          <heading>Rules</heading>
          <subsection eId="part-3__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
            </content>
            <paragraph eId="part-3__sec-13__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p>To avoid doubt, the rules may not do the following:</p>
            </content>
            <paragraph eId="part-3__sec-13__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>entry, search or seizure;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>impose a tax;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;</p>
              </content>
            </paragraph>

              <num>e</num>
              <content>
                <p>directly amend the text of this Act.</p>
