              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Object of this Act</heading>
          <content>
            <p>The object of this Act is to establish a statutory scheme (the Public and Educational Lending Rights Scheme) for the purposes of:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>making payments to Australian creators of books, and to Australian publishers of books in Australia, in connection with the rights of copyright in those books, in recognition of income derived from those rights that is lost as a result of their books being made available by public lending libraries in Australia or educational lending libraries in Australia; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>the Commonwealth Government, as the national Government of Australia, supporting the enrichment of Australian culture by encouraging the growth and development of Australian writing and publishing by making such payments through a national scheme.</p>

        </section>

          <num>4</num>
          <heading>Simplified outline of this Act</heading>
          <content>
            <p><role refersTo="#minister">The Minister</role> must make a scheme (the Public and Educational Lending Rights Scheme) covering the making of payments to the following:</p>
          </content>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>Australian creators of books that are part of the collections of public lending libraries in Australia or educational lending libraries in Australia;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>Australian publishers of those books.</p>
            </content>
            <content>
              <p>The Public and Educational Lending Rights Committee is established. Its functions include those conferred on it by the scheme and advising <role refersTo="#secretary">the Secretary</role> and <role refersTo="#minister">the Minister</role> about matters relating to the operation of this Act or of that scheme.</p>
              <p>There are provisions providing for the reconsideration of decisions by <role refersTo="#secretary">the Secretary</role> and the review of decisions by the Administrative Review Tribunal.</p>

          </paragraph>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-appointed-member">appointed member</term> means <def>a member of the Committee covered by paragraph 13(a), (b), (c) or (d).</def></p>
            <p><b><i>Australia</i></b>,<b><i> </i></b>when used in a geographical sense, includes the external Territories.</p>
            <p><b><i>Australian creator </i></b>of a book means:</p>
          </content>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>an Australian person who is the author of the whole or a part of the book; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>an Australian person who:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-i">
            <num>i</num>
            <content>
              <p>has illustrated or translated the whole or a part of the book; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-ii">
            <num>ii</num>
            <content>
              <p>has otherwise contributed a significant proportion of original content to the whole or a part of the book.</p>
            </content>

            </authorialNote>
            <content>
              <p><b><i>Australian person</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>an individual who is an Australian citizen; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>an individual who is a permanent resident of Australia.</p>
            </content>
            <content>
              <p><b><i>Australian publisher</i></b><b><i> </i></b>means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>a body corporate that is incorporated in Australia and that carries on a business that consists of, or includes, the publishing of books in Australia; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>a registered charity that publishes books in Australia to advance the charity’s purposes and that satisfies the requirements (if any) prescribed by the rules for the purposes of this paragraph; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>an Australian creator of a book who also publishes the book in Australia; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-d">
            <num>d</num>
            <content>
              <p>a person or body that satisfies the requirements prescribed by the rules for the purposes of this paragraph.</p>
            </content>
            <content>
              <p><b><i>book</i></b>:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>	(a)	includes<b><i> </i></b>an ebook, an audiobook and any other thing prescribed by the rules for the purposes of this paragraph; but</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>does not include any thing prescribed by the rules for the purposes of this paragraph.</p>
            </content>
            <content>
              <p><term refersTo="#term-chair">Chair</term> means <def>the Chair of the Committee.</def></p>
              <p><term refersTo="#term-committee">Committee</term> means <def>the Public and Educational Lending Rights Committee established by <ref href="#sec-10">section 10</ref>.</def></p>
              <p><term refersTo="#term-deputy-chair">Deputy Chair</term> means <def>the Deputy Chair of the Committee.</def></p>
              <p><term refersTo="#term-member">member</term> means <def>a member of the Committee and includes the Chair and Deputy Chair.</def></p>
              <p><term refersTo="#term-paid-work">paid work</term> means <def>work for financial gain or reward (whether as an employee, a self-employed person or otherwise).</def></p>
              <p><term refersTo="#term-permanent-resident-of-australia">permanent resident of Australia</term> means <def>a person who is a permanent resident within the meaning of <ref href="">the Australian Citizenship Act 2007</ref>.</def></p>
              <p><term refersTo="#term-public-and-educational-lending-rights-scheme">Public and Educational Lending Rights Scheme</term> means <def>the scheme made under <ref href="#sec-8">section 8</ref>, as the scheme is in force from time to time.</def></p>
              <p><term refersTo="#term-registered-charity">registered charity</term> means <def>an entity that is registered under the Australian Charities and Not-for-profits Commission Act 2012 as the type of entity mentioned in column 1 of item 1 of the table in subsection 25-5(5) of that Act.</def></p>
              <p><term refersTo="#term-reviewable-decision">reviewable decision</term> means <def>a decision that is made under the Public and Educational Lending Rights Scheme and that is prescribed by the rules for the purposes of this definition.</def></p>
              <p><term refersTo="#term-rules">rules</term> means <def>the rules made by the Minister under <ref href="#sec-45">section 45</ref>.</def></p>
              <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>

        <heading>Public and Educational Lending Rights Scheme</heading>

          <num>7</num>
          <heading>Simplified outline of this Part</heading>
          <content>
            <p><role refersTo="#minister">The Minister</role> must make a scheme (the Public and Educational Lending Rights Scheme) covering the making of payments to the following:</p>
          </content>

            <num>a</num>
            <content>
              <p>Australian creators of books that are part of the collections of public lending libraries in Australia or educational lending libraries in Australia;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-b">
            <num>b</num>
            <content>
              <p>Australian publishers of those books.</p>
            </content>
            <content>
              <p>The scheme covers the making and deciding of claims for those payments and the determination of the amounts of those payments.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-8">
          <num>8</num>
          <heading>Minister to make Public and Educational Lending Rights Scheme</heading>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must, by legislative instrument, make a scheme for and in relation to the making of payments to the following:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>Australian creators of books that are part of the collections of public lending libraries in Australia or educational lending libraries in Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>Australian publishers of those books.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>The scheme may make provision for and in relation to one or more of the following:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the making of claims to <role refersTo="#secretary">the Secretary</role> by persons or bodies for approval of the making of payments to the persons or bodies;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> approving, by notifiable instrument, forms for making claims;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the withdrawal of claims;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>the eligibility criteria that a person or body must meet in order for <role refersTo="#secretary">the Secretary</role> to approve the making of payments to the person or body;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>the matters that <role refersTo="#secretary">the Secretary</role> must consider in deciding whether to approve the making of payments to a person or body;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-f">
              <num>f</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> requiring a person or body to provide further information or documents relating to a claim;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-g">
              <num>g</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> requiring a person to verify, by statutory declaration, any information or documents provided to <role refersTo="#secretary">the Secretary</role>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-h">
              <num>h</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> approving, or refusing to approve, the making of payments to a person or body;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>the amounts of payments, or a method for working out the amounts of payments, to be made to a person or body;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-j">
              <num>j</num>
              <content>
                <p>the making of payments to a person or body;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-k">
              <num>k</num>
              <content>
                <p>the duration of payments to be made to a person or body;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-l">
              <num>l</num>
              <content>
                <p>the variation or revocation of an approval of the making of payments to a person or body;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-m">
              <num>m</num>
              <content>
                <p>the giving of notice of decisions made by <role refersTo="#secretary">the Secretary</role>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-n">
              <num>n</num>
              <content>
                <p>the delegation by <role refersTo="#secretary">the Secretary</role> of <role refersTo="#secretary">the Secretary</role>’s functions or powers under the scheme.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-3">
            <num>3</num>
            <content>
              <p>The scheme may provide for the circumstances in which a person has, or has not, contributed a significant proportion of original content to the whole or a part of a book.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-4">
            <num>4</num>
            <content>
              <p>Subsections (2) and (3) do not limit subsection (1).</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-5">
            <num>5</num>
            <content>
              <p>	(5)	Despite subsection 14(2) of the <i>Legislation Act 2003</i>, the scheme may make provision in relation to a matter by applying, adopting or incorporating, with or without modification, any matter contained in an instrument or other writing as in force or existing from time to time.</p>

              <p>The Public and Educational Lending Rights Committee is established by this section.</p>
            </content>
          </section>
          <section eId="part-3__dvs-2__sec-11">
            <num>11</num>
            <heading>Committee’s functions</heading>
            <content>
              <p>The Committee has the following functions:</p>
            </content>
            <paragraph eId="part-3__dvs-2__sec-11__para-a">
              <num>a</num>
              <content>
                <p>any functions conferred on it by the Public and Educational Lending Rights Scheme;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-2__sec-11__para-b">
              <num>b</num>
              <content>
                <p>to provide advice to <role refersTo="#secretary">the Secretary</role>, upon request by <role refersTo="#secretary">the Secretary</role>, in respect of matters relating to the operation of this Act or that scheme;</p>
              </content>
            </paragraph>

              <num>c</num>
              <content>
                <p>to provide advice to <role refersTo="#minister">the Minister</role>, on its own initiative or upon request by <role refersTo="#minister">the Minister</role>, in respect of matters relating to the operation of this Act or that scheme;</p>

                <p>to make recommendations to <role refersTo="#minister">the Minister</role> about changes to that scheme.</p>

            <heading>Committee’s powers</heading>
            <content>
              <p>The Committee has power to do all things necessary or convenient to be done for, or in connection with, the performance of its functions.</p>
            </content>
          </section>

          <heading>Committee members</heading>
          <section eId="part-3__dvs-3__sec-13">
            <num>13</num>
            <heading>Number of Committee members</heading>
            <content>
              <p>The Committee consists of the following members:</p>
            </content>

              <num>a</num>
              <content>
                <p>a Chair;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-13__para-b">
              <num>b</num>
              <content>
                <p>2 members to represent Australian creators of books;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-13__para-c">
              <num>c</num>
              <content>
                <p>a member to represent Australian publishers of books;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-13__para-d">
              <num>d</num>
              <content>
                <p>a member to represent public lending libraries in Australia and educational lending libraries in Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-13__para-e">
              <num>e</num>
              <content>
                <p>	(e)	a member who is an APS employee in the Department administered by the Minister administering the <i>Copyright Act 1968</i> and is nominated by the Secretary of that Department;</p>
              </content>
            </paragraph>

              <num>f</num>
              <content>
                <p>a member who is an APS employee of the National Library of Australia and is nominated by the Director-General of that library.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-3__dvs-3__sec-14">
            <num>14</num>
            <heading>Appointments</heading>
            <subsection eId="part-3__dvs-3__sec-14__subsec-1">
              <num>1</num>
              <content>
                <p>A member of the Committee covered by paragraph 13(a), (b), (c) or (d) is to be appointed by <role refersTo="#minister">the Minister</role> by written instrument, on a part-time basis.</p>
              </content>

                <p><role refersTo="#minister">The Minister</role> must not appoint a person as a member unless <role refersTo="#minister">the Minister</role> is satisfied that the person has appropriate qualifications, knowledge, skills or experience.</p>

            </subsection>

              <num>3</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must appoint a member covered by paragraph 13(b), (c) or (d) to be the Deputy Chair.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-15">
            <num>15</num>
            <heading>Term of appointments</heading>
            <subsection eId="part-3__dvs-3__sec-15__subsec-1">
              <num>1</num>
              <content>
                <p>An appointed member holds office for the period specified in the instrument of appointment. The period must not exceed 3 years.</p>
              </content>

                <p>A person must not hold office as an appointed member for a total period of more than 9 years.</p>

            </subsection>
          </section>

            <num>16</num>
            <heading>Acting positions</heading>
            <content>
              <p>Acting by operation of law</p>
            </content>
            <subsection eId="part-3__dvs-3__sec-16__subsec-1">
              <num>1</num>
              <content>
                <p>The Deputy Chair is to act as the Chair:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-16__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>during a vacancy in the office of Chair (whether or not an appointment has previously been made to the office); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-16__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>during any period, or during all periods, when the Chair:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-16__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>is absent from duty; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-16__subsec-1__para-ii">

                  <p>is, for any reason, unable to perform the duties of the office.</p>
                </content>
                <content>
                  <p>Acting appointments</p>
                </content>
              </paragraph>
            </subsection>

              <content>
                <p><role refersTo="#minister">The Minister</role> may, by written instrument, appoint an appointed member to act as the Deputy Chair:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-16__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>during a vacancy in the office of Deputy Chair (whether or not an appointment has previously been made to the office); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-16__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>during any period, or during all periods, when the Deputy Chair:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-16__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>is acting as the Chair; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-16__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>is absent from duty; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-16__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>is, for any reason, unable to perform the duties of the office.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-16__subsec-3">
              <num>3</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by written instrument, appoint a person to act as an appointed member (other than the Chair or the Deputy Chair):</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-16__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>during a vacancy in the office of an appointed member (whether or not an appointment has previously been made to the office); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-16__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>during any period, or during all periods, when an appointed member:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-16__subsec-3__para-i">
                <num>i</num>
                <content>
                  <p>is acting as the Deputy Chair; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-16__subsec-3__para-ii">
                <num>ii</num>
                <content>
                  <p>is absent from duty; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-16__subsec-3__para-iii">
                <num>iii</num>
                <content>
                  <p>is, for any reason, unable to perform the duties of the office.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-16__subsec-4">
              <num>4</num>
              <content>
                <p>A person must not be appointed under subsection (3) to act as an appointed member unless <role refersTo="#minister">the Minister</role> is satisfied that the person has appropriate qualifications, knowledge, skills or experience.</p>
              </content>

          </section>

            <num>17</num>
            <heading>Remuneration</heading>
            <subsection eId="part-3__dvs-3__sec-17__subsec-1">
              <num>1</num>
              <content>
                <p>An appointed member is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, that member is to be paid the remuneration that is prescribed by the rules.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-17__subsec-2">
              <num>2</num>
              <content>
                <p>A member is to be paid the allowances (if any) that are prescribed by the rules.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-17__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-18">
            <num>18</num>
            <heading>Leave of absence</heading>
            <subsection eId="part-3__dvs-3__sec-18__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may grant the Chair leave of absence on the terms and conditions that <role refersTo="#minister">the Minister</role> determines.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-18__subsec-2">
              <num>2</num>
              <content>
                <p>The Chair may grant leave of absence to any other appointed member on the terms and conditions that the Chair determines.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-18__subsec-3">
              <num>3</num>
              <content>
                <p>The Chair must notify <role refersTo="#minister">the Minister</role> if the Chair grants an appointed member leave of absence for a period that exceeds 4 months.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-19">
            <num>19</num>
            <heading>Other paid work</heading>
            <content>
              <p>A member must not engage in any paid work that conflicts or could conflict with the proper performance of the member’s duties.</p>
            </content>
          </section>
          <section eId="part-3__dvs-3__sec-20">
            <num>20</num>
            <heading>Disclosure of interests to the Minister</heading>
            <content>
              <p>An appointed member must give written notice to <role refersTo="#minister">the Minister</role> of any direct or indirect pecuniary interest that the member has or acquires and that conflicts or could conflict with the proper performance of the member’s functions.</p>
            </content>
          </section>
          <section eId="part-3__dvs-3__sec-21">
            <num>21</num>
            <heading>Disclosure of interests to the Committee</heading>
            <subsection eId="part-3__dvs-3__sec-21__subsec-1">
              <num>1</num>
              <content>
                <p>A member who has a direct or indirect pecuniary interest in a matter being considered or about to be considered by the Committee must disclose the nature of the interest to a meeting of the Committee.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-21__subsec-2">
              <num>2</num>
              <content>
                <p>The disclosure must be made as soon as possible after the relevant facts have come to the member’s knowledge.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-21__subsec-3">
              <num>3</num>
              <content>
                <p>The disclosure must be recorded in the minutes of the meeting.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-21__subsec-4">
              <num>4</num>
              <content>
                <p>Unless <role refersTo="#minister">the Minister</role> or the Committee otherwise determines, the member:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-21__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>must not be present during any deliberation by the Committee on the matter; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-21__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	must not take part in any decision of the Committee<i> </i>with respect to the matter.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-21__subsec-5">
              <num>5</num>
              <content>
                <p>For the purposes of the Committee making a determination under subsection (4), the member:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-21__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	must not be present during any deliberation of the Committee<i> </i>for the purpose of making the determination; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-21__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>must not take part in making the determination.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-21__subsec-6">
              <num>6</num>
              <content>
                <p>A determination of the Committee under subsection (4) must be recorded in the minutes of the meeting of the Committee.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-22">
            <num>22</num>
            <heading>Resignation of appointment</heading>
            <subsection eId="part-3__dvs-3__sec-22__subsec-1">
              <num>1</num>
              <content>
                <p>An appointed member may resign the member’s appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-22__subsec-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by <role refersTo="#minister">the Minister</role> or, if a later day is specified in the resignation, on that later day.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-23">
            <num>23</num>
            <heading>Termination of appointment</heading>
            <subsection eId="part-3__dvs-3__sec-23__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of an appointed member:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>for misbehaviour; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if the member is unable to perform the duties of the member’s office because of physical or mental incapacity.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-23__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of an appointed member if:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the member:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>compounds with the member’s creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-2__para-iv">
                <num>iv</num>
                <content>
                  <p>makes an assignment of the member’s remuneration for the benefit of the member’s creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the member is absent, except on leave of absence, from 3 consecutive meetings of the Committee; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the member engages in paid work that conflicts or could conflict with the proper performance of the member’s duties (see <ref href="#sec-19">section 19</ref>); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>the member fails, without reasonable excuse, to comply with <role refersTo="#minister">the Minister</role>) or section 21 (disclosure of interests to the Committee).<ref href="#sec-20">section 20</ref> (disclosure of interests to </p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-24">
            <num>24</num>
            <heading>Other terms and conditions</heading>
            <content>
              <p>An appointed member holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </section>
        </division>

          <num>4</num>
          <heading>Meetings</heading>
          <section eId="part-3__dvs-4__sec-25">
            <num>25</num>
            <heading>Convening meetings</heading>
            <subsection eId="part-3__dvs-4__sec-25__subsec-1">
              <num>1</num>
              <content>
                <p>The Committee must hold such meetings as are necessary for the efficient performance of its functions.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-4__sec-25__subsec-2">
              <num>2</num>
              <content>
                <p>The Chair:</p>
              </content>
              <paragraph eId="part-3__dvs-4__sec-25__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>may convene a meeting at any time; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-25__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>must convene a meeting <quantity refersTo="#deadline">within 30 days</quantity> after receiving a written request to do so from:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-25__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>at least 3 other members of the Committee; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-25__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p><role refersTo="#minister">the Minister</role>.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-4__sec-26">
            <num>26</num>
            <heading>Quorum</heading>
            <subsection eId="part-3__dvs-4__sec-26__subsec-1">
              <num>1</num>
              <content>
                <p>At a meeting of the Committee, a quorum is constituted by a majority of members, which must include the Chair or the Deputy Chair.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-4__sec-26__subsec-2">
              <num>2</num>
              <content>
                <p>However, if:</p>
              </content>
              <paragraph eId="part-3__dvs-4__sec-26__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a member is required under <ref href="#sec-21">section 21</ref> not to be present during the deliberations, or to take part in any decision, of the Committee with respect to a particular matter; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-26__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>when the member leaves the meeting concerned there is no longer a quorum present;</p>
                </content>
                <content>
                  <p>the remaining members of the Committee at the meeting constitute a quorum for the purpose of any deliberation or decision at that meeting with respect to that matter.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-4__sec-27">
            <num>27</num>
            <heading>Presiding at meetings</heading>
            <subsection eId="part-3__dvs-4__sec-27__subsec-1">
              <num>1</num>
              <content>
                <p>The Chair must preside at all meetings of the Committee at which the Chair is present.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-4__sec-27__subsec-2">
              <num>2</num>
              <content>
                <p>The Deputy Chair must preside at a meeting of the Committee at which the Deputy Chair is present if the Chair is not present.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-4__sec-28">
            <num>28</num>
            <heading>Voting at meetings</heading>
            <subsection eId="part-3__dvs-4__sec-28__subsec-1">
              <num>1</num>
              <content>
                <p>A question arising at a meeting of the Committee is to be determined by a majority of the votes of the members of the Committee present and voting.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-4__sec-28__subsec-2">
              <num>2</num>
              <content>
                <p>The person presiding at a meeting of the Committee has a deliberative vote and, if the votes are equal, a casting vote.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-4__sec-29">
            <num>29</num>
            <heading>Minutes</heading>
            <content>
              <p>The Committee must keep minutes of its meetings.</p>
            </content>
          </section>
          <section eId="part-3__dvs-4__sec-30">
            <num>30</num>
            <heading>Conduct of meetings</heading>
            <content>
              <p>The Committee may, subject to this Division, regulate proceedings at its meetings as it considers appropriate.</p>
            </content>

            <heading>Decisions without meetings</heading>
            <subsection eId="part-3__dvs-4__sec-31__subsec-1">
              <num>1</num>
              <content>
                <p>The Committee is taken to have made a decision at a meeting if:</p>
              </content>
              <paragraph eId="part-3__dvs-4__sec-31__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>without meeting, a majority of the members of the Committee entitled to vote on the proposed decision indicate agreement with the decision; and</p>
                </content>
              </paragraph>

                <p>Subsection (1) applies only if the Committee:</p>

                  <p>has determined that it may make decisions of that kind without meeting; and</p>
                </content>
              </paragraph>

                  <p>has determined the method by which members of the Committee are to indicate agreement with proposed decisions.</p>

                <p>For the purposes of paragraph (1)(a), a member is not entitled to vote on a proposed decision if the member would not have been entitled to vote on that proposal if the matter had been considered at a meeting of the Committee.</p>

            <p><role refersTo="#secretary">The Secretary</role> is able to reconsider decisions made under the Public and Educational Lending Rights Scheme and prescribed by <role refersTo="#minister">the Minister</role>’s rules, where the decisions are made by a delegate of <role refersTo="#secretary">the Secretary</role>.</p>
            <p>The Administrative Review Tribunal is able to:</p>

          <heading>Secretary’s reconsideration of decisions</heading>

              <p>A person whose interests are affected by a reviewable decision made by a delegate of <role refersTo="#secretary">the Secretary</role> may request <role refersTo="#secretary">the Secretary</role> to reconsider the decision.</p>

          <heading>Administrative Review Tribunal review of decisions</heading>

              <p>An application may be made to the Administrative Review Tribunal for review of the following decisions:</p>

              <num>a</num>
              <content>
                <p>a reviewable decision that is made by <role refersTo="#secretary">the Secretary</role> personally;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-34__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a decision under subsection 33(4) that is made, or a decision under subsection 33(8) that is taken to have been made, by <role refersTo="#secretary">the Secretary</role>.</p>

              <p>	(1)	If a court convicts a person of an offence against <i>Criminal Code</i> that relates to this Act, the court may, in addition to imposing a penalty, order the person to pay to the Commonwealth an amount specified in the order.<ref href="#sec-136">section 136</ref>.1, 137.1 or 137.2 of the </p>

              <p>The court must not specify an amount that exceeds the total amount paid to the person under the Public and Educational Lending Rights Scheme because of the act, failure or omission in respect of which the person was convicted.</p>

              <p><role refersTo="#secretary">The Secretary</role> may certify in writing that a specified amount is the total amount paid to a specified person under the Public and Educational Lending Rights Scheme because of a specified act, failure or omission.</p>

          </subsection>

            <num>4</num>
            <content>
              <p>A certificate under subsection (3) is prima facie evidence of the matters stated in the certificate.</p>
            </content>
          </subsection>
        </section>

          <heading>Recovery of payments made because of false or misleading information or documents</heading>
          <subsection eId="part-5__sec-37__subsec-1">
            <num>1</num>
            <content>
              <p>The Commonwealth may recover from a person or body an amount equal to the amount paid to the person or body under the Public and Educational Lending Rights Scheme if the amount paid was because of the person or body providing information or a document to <role refersTo="#secretary">the Secretary</role> that was false or misleading in a material particular.</p>

          </subsection>

            <num>2</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, on behalf of the Commonwealth, recover the amount from the person or body as a debt due to the Commonwealth by action in a court of competent jurisdiction.</p>

              <p><role refersTo="#secretary">The Secretary</role> may, on behalf of the Commonwealth, set off the whole or a part of an overpayment of an amount paid to a person or body under the Public and Educational Lending Rights Scheme against another payment to the person or body under that scheme.</p>

          </subsection>
          <subsection eId="part-5__sec-38__subsec-2">
            <num>2</num>
            <content>
              <p>If <role refersTo="#secretary">the Secretary</role> is not able to do so, <role refersTo="#secretary">the Secretary</role> may give the person or body a written notice:</p>
            </content>
            <paragraph eId="part-5__sec-38__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>specifying the amount the Commonwealth is not able to set off; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-38__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>requiring the person or body to pay to the Commonwealth an amount equal to the amount specified under paragraph (a); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-38__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>specifying the period within which the person or body must make the payment, which must be a period of at least 28 days starting on the day on which the notice is given.</p>

                <p>is a debt due to the Commonwealth; and</p>

          <heading>Payments inalienable</heading>

              <p>A right (if any) to receive a payment under the Public and Educational Lending Rights Scheme is absolutely inalienable, whether by way of, or in consequence of, assignment, charge, execution, bankruptcy or otherwise.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-40__subsec-2">
            <num>2</num>
            <content>
              <p>This section is subject to <ref href="#sec-41">section 41</ref>.</p>

        </section>

          <heading>Payment to legal personal representative</heading>
          <content>
            <p><role refersTo="#secretary">The Secretary</role> must, on behalf of the Commonwealth, pay an amount under the Public and Educational Lending Rights Scheme to the legal personal representative of a person if:</p>
          </content>
          <paragraph eId="part-6__sec-41__para-a">
            <num>a</num>
            <content>
              <p>the amount is payable to that person under that scheme; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-6__sec-41__para-b">
            <num>b</num>
            <content>
              <p>the amount has not been paid to that person at the date of that person’s death.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-6__sec-42">
          <num>42</num>
          <heading>Staffing</heading>
          <content>
            <p>The staff necessary to assist the Committee are to be APS employees in the Department made available for the purpose by <role refersTo="#secretary">the Secretary</role>.</p>
          </content>
        </section>
        <section eId="part-6__sec-43">
          <num>43</num>
          <heading>Reports by the Secretary</heading>
          <content>
            <p>Annual report</p>
          </content>
          <subsection eId="part-6__sec-43__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> must, as soon as practicable after the end of each financial year, cause a report to be prepared and given to <role refersTo="#minister">the Minister</role> on the operation of this Act and the Public and Educational Lending Rights Scheme during that year.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-43__subsec-2">
            <num>2</num>
            <content>
              <p>The report may include:</p>
            </content>
            <paragraph eId="part-6__sec-43__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>information or comments concerning the effect of that scheme; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-43__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>recommendations relating to any matters concerning the operation of this Act or that scheme.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-43__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a copy of the report to be tabled in each House of the Parliament within 15 sitting days of that House after <role refersTo="#minister">the Minister</role> receives the report.</p>
            </content>
            <content>
              <p>Other reports</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-43__subsec-4">
            <num>4</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role>:</p>
            </content>

              <num>a</num>

                <p>must give <role refersTo="#minister">the Minister</role> such additional reports as <role refersTo="#minister">the Minister</role> requires; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-43__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>may give <role refersTo="#minister">the Minister</role> such other reports as <role refersTo="#secretary">the Secretary</role> thinks fit.</p>

        </section>

          <heading>Delegation by the Secretary</heading>
          <subsection eId="part-6__sec-44__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, in writing, delegate to an SES employee, or acting SES employee, in the Department one or more of <role refersTo="#secretary">the Secretary</role>’s powers or functions under section 36, 37, 38 or 41.</p>

              <p><role refersTo="#secretary">The Secretary</role> may, in writing, give directions for the purposes of subsection (2).</p>

          <heading>Rules</heading>
          <subsection eId="part-6__sec-45__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
            </content>
            <paragraph eId="part-6__sec-45__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-45__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-45__subsec-2">

              <p>To avoid doubt, the rules may not do the following:</p>
