            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

                <p>In this Division:</p>
              </content>
            </hcontainer>
            <content>
              <p><b><i>business day</i></b> means a day that is not a Saturday, a Sunday or a public holiday in the Australian Capital Territory.</p>
            </content>

                <p>A reference in this Division to an authorisation is a reference to an authorisation under this Division.</p>
              </content>

            <num>92B</num>
            <heading>Commission may grant authorisations in exceptional circumstances and emergencies</heading>
            <content>

              <p>Effect of an authorisation</p>

                <p>Subject to this Division, the Commission may, on an application by a person, grant an authorisation to a person to engage in conduct, specified in the authorisation, to which one or more provisions of <ref href="#dvs-1">Division 1</ref> or 2 of <ref href="#part-IV">Part IV</ref> specified in the authorisation would or might apply.</p>

              <num>2</num>
              <content>
                <p>While the authorisation remains in force, the provisions of <ref href="#dvs-1">Division 1</ref> or 2 of <ref href="#part-IV">Part IV</ref> specified in the authorisation do not apply in relation to the conduct to the extent that it is engaged in by:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-92B__para-a">
              <num>a</num>
              <content>
                <p>the applicant; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92B__para-b">
              <num>b</num>
              <content>
                <p>any other person named or referred to in the application as a person who is engaged in, or who is proposed to be engaged in, the conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92B__para-c">
              <num>c</num>
              <content>
                <p>any particular persons or classes of persons, as specified in the authorisation, who become engaged in the conduct.</p>
              </content>
            </paragraph>

              <num>3</num>
              <content>
                <p>The Commission may specify conditions in the authorisation. Subsection (2) does not apply if any of the conditions are not complied with.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-92B__subclause-4">
              <num>4</num>
              <content>
                <p>Without limiting subsection (3), a condition may include a requirement to obtain the approval of the Commission before engaging in certain conduct.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-92B__subclause-5">
              <num>5</num>
              <content>
                <p>The Commission may grant a single authorisation for all the conduct specified in an application for authorisation, or may grant separate authorisations for any of the conduct.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-92B__subclause-6">
              <num>6</num>
              <content>
                <p>The Commission may grant an authorisation for conduct engaged in before the Commission decided the application.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-92B__subclause-7">
              <num>7</num>
              <content>
                <p>An applicant for an authorisation may at any time, by writing to the Commission, withdraw the application.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-92C">
            <num>92C</num>
            <heading>Procedure for applications</heading>
            <content>
              <p>An application for an authorisation under this Division must:</p>
            </content>
            <paragraph eId="schedule-1__clause-92C__para-a">
              <num>a</num>
              <content>
                <p>be in a form approved by the Commission in writing and contain the information required by the form; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92C__para-b">
              <num>b</num>
              <content>
                <p>be accompanied by any other information or documents prescribed by the regulations; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92C__para-c">
              <num>c</num>
              <content>
                <p>specify that it is an application made under this Division.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-92D">
            <num>92D</num>
            <heading>Determination of applications</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-92D__subclause-1">
              <num>1</num>
              <content>
                <p>If a declaration mentioned in subsection (2) is in force, the Commission may, in respect of an application for an authorisation under this Division:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-92D__para-a">
              <num>a</num>
              <content>
                <p>make a determination in writing granting such authorisation as it considers appropriate; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92D__para-b">
              <num>b</num>
              <content>
                <p>make a determination in writing dismissing the application.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-92D__subclause-2">
              <num>2</num>
              <content>
                <p>The declarations are the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-92D__para-a">
              <num>a</num>
              <content>
                <p>a declaration under <ref href="#sec-95A">section 95A</ref>E;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92D__para-b">
              <num>b</num>
              <content>
                <p>	(b)	a national emergency declaration (within the meaning of the <i>National Emergency Declaration Act 2020</i>).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-92D__subclause-3">
              <num>3</num>
              <content>
                <p>The Commission must not make a determination under subsection (1) granting an authorisation in relation to conduct unless the Commission is satisfied that, in all the circumstances, the conduct would assist, or would be likely to assist, in the response to or recovery from the exceptional circumstances or emergency to which the declaration relates.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-92D__subclause-4">
              <num>4</num>
              <content>
                <p>In making a determination under subsection (1), the Commission:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-92D__para-a">
              <num>a</num>
              <content>
                <p>must have regard to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92D__para-i">
              <num>i</num>
              <content>
                <p>the likely benefit to the public resulting from the assistance, or likely assistance, in response to or recovery from the exceptional circumstances to which the declaration relates; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92D__para-ii">
              <num>ii</num>
              <content>
                <p>the detriment to the public that would result, or be likely to result, from the conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92D__para-b">
              <num>b</num>
              <content>
                <p>may have regard to any other public benefit that would result or likely result from the conduct.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-92D__subclause-5">
              <num>5</num>
              <content>
                <p>A determination under subsection (1) must specify the exceptional circumstances or emergency to which it relates.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-92D__subclause-6">
              <num>6</num>
              <content>
                <p>The Commission must state in writing its reasons for a determination under subsection (1).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-92D__subclause-7">
              <num>7</num>
              <content>
                <p>The Commission must give the person who made the application written notice of the determination.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-92D__subclause-8">
              <num>8</num>
              <content>
                <p>The Commission must not make a determination to grant a merger authorisation under this section.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-92E">
            <num>92E</num>
            <heading>Period for which authorisations remain in force</heading>
            <content>
              <p>An authorisation under this Division is in force for the period:</p>
            </content>
            <paragraph eId="schedule-1__clause-92E__para-a">
              <num>a</num>
              <content>
                <p>starting on the day specified in the determination (which may be before the commencement of this section, but must not be before <date date="2026-04-01">1 April 2026</date>); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92E__para-b">
              <num>b</num>
              <content>
                <p>ending at the earliest of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92E__para-i">
              <num>i</num>
              <content>
                <p>the start of the day specified in the determination;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92E__para-ii">
              <num>ii</num>
              <content>
                <p>if the determination is revoked—the end of the day the revocation takes effect;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92E__para-iii">
              <num>iii</num>
              <content>
                <p>the end of the last day on which a declaration mentioned in subsection 92D(2) to which the determination relates is in force.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-92F">
            <num>92F</num>
            <heading>Variation of authorisations</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-92F__subclause-1">
              <num>1</num>
              <content>
                <p>The Commission may, at any time, make a determination in writing to vary an authorisation under this Division if the Commission considers it appropriate to do so.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-92F__subclause-2">
              <num>2</num>
              <content>
                <p>The Commission must not make a determination under subsection (1) varying an authorisation unless the Commission is satisfied that, in all the circumstances, the conduct specified in the authorisation as varied would assist, or would be likely to assist, in the response to or recovery from the exceptional circumstances or emergency to which the declaration relates.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-92F__subclause-3">
              <num>3</num>
              <content>
                <p>In making a determination under subsection (1), the Commission:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-92F__para-a">
              <num>a</num>
              <content>
                <p>must have regard to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92F__para-i">
              <num>i</num>
              <content>
                <p>the likely benefit to the public resulting from the assistance, or likely assistance, in response to or recovery from the exceptional circumstances to which the declaration relates; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92F__para-ii">
              <num>ii</num>
              <content>
                <p>the detriment to the public that would result, or be likely to result, from the conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92F__para-b">
              <num>b</num>
              <content>
                <p>may have regard to any other public benefit that would result or likely result from the conduct.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-92F__subclause-4">
              <num>4</num>
              <content>
                <p>The Commission must give the person who applied for the authorisation written notice stating:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-92F__para-a">
              <num>a</num>
              <content>
                <p>that the authorisation is varied; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92F__para-b">
              <num>b</num>
              <content>
                <p>details of the variation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92F__para-c">
              <num>c</num>
              <content>
                <p>the date on which the variation takes effect.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-92F__subclause-5">
              <num>5</num>
              <content>
                <p>The variation takes effect on the business day after the day on which the notice is given.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-92G">
            <num>92G</num>
            <heading>Revocation of authorisations</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-92G__subclause-1">
              <num>1</num>
              <content>
                <p>The Commission may, at any time, revoke an authorisation under this Division if the Commission considers that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-92G__para-a">
              <num>a</num>
              <content>
                <p>the conduct would not assist, or would not be likely to assist, in the response to or recovery from the exceptional circumstances or emergency specified in the determination; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92G__para-b">
              <num>b</num>
              <content>
                <p>the conduct is not appropriate; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92G__para-c">
              <num>c</num>
              <content>
                <p>the authorisation was granted on the basis of evidence or information that was false or misleading in a material particular; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92G__para-d">
              <num>d</num>
              <content>
                <p>a condition to which the authorisation was expressed to be subject has not been complied with.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-92G__subclause-2">
              <num>2</num>
              <content>
                <p>The Commission must give the person who applied for the authorisation written notice stating:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-92G__para-a">
              <num>a</num>
              <content>
                <p>that the authorisation is revoked; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92G__para-b">
              <num>b</num>
              <content>
                <p>the date on which the revocation takes effect.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-92G__subclause-3">
              <num>3</num>
              <content>
                <p>The revocation takes effect on the business day after the day on which the notice is given.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-92H">
            <num>92H</num>
            <heading>Register of applications and proposals</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-92H__subclause-1">
              <num>1</num>
              <content>
                <p>The Commission must keep a register of the following things under this Division:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-92H__para-a">
              <num>a</num>
              <content>
                <p>determinations of applications for authorisations;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92H__para-b">
              <num>b</num>
              <content>
                <p>variations of authorisations;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92H__para-c">
              <num>c</num>
              <content>
                <p>revocation of authorisations.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-92H__subclause-2">
              <num>2</num>
              <content>
                <p>The register must include the statement of the reasons given by <role refersTo="#commissioner">the Commissioner</role> for a determination.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-92H__subclause-3">
              <num>3</num>
              <content>
                <p>The Commission is not required under subsection (2) to include the determination of an application on the register until the end of the period of 7 business days beginning on:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-92H__para-a">
              <num>a</num>
              <content>
                <p>if a declaration under <ref href="#sec-95A">section 95A</ref>E is in force—the day on which the declaration ceases to be in force; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92H__para-b">
              <num>b</num>
              <content>
                <p>	(b)	if a national emergency declaration (within the meaning of the <i>National Emergency Declaration Act 2020</i>) is in force—the day on which the declaration ceases to be in force; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-92H__para-c">
              <num>c</num>
              <content>
                <p>if both a declaration under <ref href="#sec-95A">section 95A</ref>E and a national emergency declaration are in force—the later of the days on which they cease to be in force.</p>
              </content>
            </paragraph>
          </hcontainer>

            <num>5</num>
            <heading>At the end of Division 3 of Part VII of Chapter 6</heading>
            <content>
              <p>Add:</p>

            <heading>Exceptional circumstances class exemptions</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-95AC__subclause-1">
              <num>1</num>

                <p>If a declaration mentioned in subsection (2) is in force, the Commission may, in writing, determine that one or more specified provisions of <ref href="#dvs-1">Division 1</ref> or 2 of <ref href="#part-IV">Part IV</ref> do not apply to a kind of conduct specified in the determination.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-95AC__subclause-2">
              <num>2</num>
              <content>
                <p>The declarations are the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-95AC__para-a">
              <num>a</num>
              <content>
                <p>a declaration under <ref href="#sec-95A">section 95A</ref>E;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AC__para-b">
              <num>b</num>
              <content>
                <p>	(b)	a national emergency declaration (within the meaning of the <i>National Emergency Declaration Act 2020</i>).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-95AC__subclause-3">
              <num>3</num>
              <content>
                <p>The Commission must not make a determination under subsection (1) unless the Commission is satisfied that, in all the circumstances, the conduct of that kind would assist, or would be likely to assist, in the response to or recovery from the exceptional circumstances or emergency to which the declaration relates.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-95AC__subclause-4">
              <num>4</num>
              <content>
                <p>In making a determination under subsection (1), the Commission:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-95AC__para-a">
              <num>a</num>
              <content>
                <p>must have regard to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AC__para-i">
              <num>i</num>
              <content>
                <p>the likely benefit to the public resulting from the assistance, or likely assistance, in response to or recovery from the exceptional circumstances to which the declaration relates; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AC__para-ii">
              <num>ii</num>
              <content>
                <p>the detriment to the public that would result, or be likely to result, from the conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AC__para-b">
              <num>b</num>
              <content>
                <p>may have regard to any other public benefit that would result or likely result from the conduct.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-95AC__subclause-5">
              <num>5</num>
              <content>
                <p>The Commission may specify in the determination any one or more of the following limitations:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-95AC__para-a">
              <num>a</num>
              <content>
                <p>a limitation to persons of a specified kind;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AC__para-b">
              <num>b</num>
              <content>
                <p>a limitation to circumstances of a specified kind;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AC__para-c">
              <num>c</num>
              <content>
                <p>a limitation to conduct that complies with specified conditions.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-95AC__subclause-6">
              <num>6</num>
              <content>
                <p>Without limiting paragraph (5)(c), a condition may include a requirement to obtain the approval of the Commission before engaging in certain conduct.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-95AC__subclause-7">
              <num>7</num>
              <content>
                <p>The determination is in force for the period:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-95AC__para-a">
              <num>a</num>
              <content>
                <p>starting on the day specified in the determination (which may be before the commencement of this section, but must not be before <date date="2026-04-01">1 April 2026</date>); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AC__para-b">
              <num>b</num>
              <content>
                <p>ending at the earliest of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AC__para-i">
              <num>i</num>
              <content>
                <p>the start of the day specified in the determination;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AC__para-ii">
              <num>ii</num>
              <content>
                <p>if the determination is revoked—the end of the day the revocation takes effect;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AC__para-iii">
              <num>iii</num>
              <content>
                <p>the end of the last day on which a declaration mentioned in subsection (2) to which the determination relates is in force.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-95AC__subclause-8">
              <num>8</num>
              <content>
                <p>While the determination remains in force, but subject to <ref href="#sec-95A">section 95A</ref>D and any limitations specified under subsection (5) of this section, the provisions of <ref href="#dvs-1">Division 1</ref> or 2 of <ref href="#part-IV">Part IV</ref> specified in the determination do not apply in relation to conduct of the kind specified in the determination.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-95AC__subclause-9">
              <num>9</num>
              <content>
                <p>The determination must specify the exceptional circumstances or emergency to which it relates.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-95AC__subclause-10">
              <num>10</num>
              <content>
                <p>	(10)	A determination made under subsection (1) is a legislative instrument and, despite anything in <i>Legislation Act 2003</i>, section 42 (disallowance) of that Act applies to the instrument.<ref href="#sec-44">section 44</ref> of the </p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	For variation and revocation, see subsection 33(3) of the <i>Acts Interpretation Act 1901</i>.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-95AD">
            <num>95AD</num>
            <heading>Commission may withdraw the benefit of exceptional circumstances class exemptions in particular case</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-95AD__subclause-1">
              <num>1</num>
              <content>
                <p>The Commission may give a person a written notice if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-95AD__para-a">
              <num>a</num>
              <content>
                <p>a determination in force under <ref href="#sec-95A">section 95A</ref>C specifies a kind of conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AD__para-b">
              <num>b</num>
              <content>
                <p>the Commission considers that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AD__para-i">
              <num>i</num>
              <content>
                <p>conduct of that kind would not assist, or would not be likely to assist, in the response to or recovery from the exceptional circumstances or emergency specified in the determination; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AD__para-ii">
              <num>ii</num>
              <content>
                <p>conduct of that kind is not appropriate.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-95AD__subclause-2">
              <num>2</num>
              <content>
                <p>The Commission must, in or with the notice under subsection (1), give the person a written statement of its reasons for giving the notice.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-95AD__subclause-3">
              <num>3</num>
              <content>
                <p>While a notice under subsection (1) is in force, the determination does not apply to the conduct specified in the notice engaged in by the person.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-95AD__subclause-4">
              <num>4</num>
              <content>
                <p>The notice under subsection (1):</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-95AD__para-a">
              <num>a</num>
              <content>
                <p>comes into force at the time the Commission gives the person the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AD__para-b">
              <num>b</num>
              <content>
                <p>ceases to be in force at the earlier of the following times:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AD__para-i">
              <num>i</num>
              <content>
                <p>if the Commission revokes the notice—the day after the day the Commission gives the person the written notice;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AD__para-ii">
              <num>ii</num>
              <content>
                <p>the time the determination under <ref href="#sec-95A">section 95A</ref>C ceases to be in force.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-6">
            <num>6</num>
            <heading>At the end of Part VII of Chapter 6</heading>

            <heading>Minister may declare exceptional circumstances</heading>

                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make a declaration under this section if <role refersTo="#minister">the Minister</role> is satisfied that:</p>

              <num>a</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AE__para-i">
              <num>i</num>

                <p>exceptional circumstances that are causing significant harm to the Australian economy or Australian consumers exist; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AE__para-ii">
              <num>ii</num>
              <content>
                <p>exceptional circumstances that would cause significant harm to the Australian economy or Australian consumers are likely to exist; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AE__para-b">
              <num>b</num>
              <content>
                <p>it is in the public interest to empower the Commission to make determinations under either or both of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AE__para-i">
              <num>i</num>
              <content>
                <p><ref href="#sec-92D">section 92D</ref>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AE__para-ii">

                <p><ref href="#sec-95A">section 95A</ref>C.</p>

                <p>A declaration under subsection (1) is in force for the period:</p>
              </content>

                <p>starting on the day specified in the declaration (which may be before the commencement of this section, but must not be before <date date="2026-04-01">1 April 2026</date>); and</p>

                <p>if the declaration is revoked—the end of the day the revocation takes effect.</p>

            </paragraph>

              <num>3</num>
              <content>
                <p>A day specified for the purposes of subparagraph (2)(b)(i) must ensure that the period the declaration is in force:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-95AE__para-a">
              <num>a</num>
              <content>
                <p>is no longer than the period that <role refersTo="#minister">the Minister</role> considers necessary for the purposes of emergency management; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-95AE__para-b">
              <num>b</num>
              <content>
                <p>is not longer than 6 months.</p>
              </content>
            </paragraph>
            <content>

                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, extend the operation of a declaration under section 95AE if <role refersTo="#minister">the Minister</role> is satisfied that the exceptional circumstances mentioned in subparagraph 95AE(1)(a)(i) are likely to continue to exist beyond the period in which the order will be in force.</p>
