                <p>ASIC may disqualify a person from managing corporations for up to 3 years if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-206FA__para-a">
              <num>a</num>
              <content>
                <p>within 7 years immediately before ASIC gives a notice under subparagraph (b)(i), ASIC reasonably believes that the person has contravened subsection 1272D(1); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-206FA__para-b">
              <num>b</num>
              <content>
                <p>ASIC has given the person:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-206FA__para-i">
              <num>i</num>
              <content>
                <p>a notice in the prescribed form requiring them to demonstrate why they should not be disqualified; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-206FA__para-ii">
              <num>ii</num>
              <content>
                <p>an opportunity to be heard on the question; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-206FA__para-c">
              <num>c</num>
              <content>
                <p>ASIC is satisfied that the disqualification is justified, after having had regard to the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-206FA__para-i">
              <num>i</num>
              <content>
                <p>the person’s conduct in dealing with <role refersTo="#registrar">the Registrar</role> under Part 9.1A (about director identification numbers);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-206FA__para-ii">
              <num>ii</num>
              <content>
                <p>whether the disqualification would be in the public interest;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-206FA__para-iii">
              <num>iii</num>
              <content>
                <p>any other matters that ASIC considers appropriate.</p>
              </content>
            </paragraph>

                <p>If ASIC disqualifies a person from managing corporations under this section, ASIC must serve a notice on the person advising them of the disqualification. The notice must be in the prescribed form.</p>
